MINUTES Mayor and Council Regular Meeting Monday, June 13, 2022 7:00 p.m. CALL TO ORDER – Mayor Papaleo called the meeting to order at 7:00 p.m. in the Council Chambers of the Borough Hall. SILENT PRAYER – FLAG SALUTE Mayor Papaleo called for a moment of silent reflection for those who we have lost and for those who’ve struggled with acceptance in our society. The Mayor asked Councilwoman Busteed to lead the salute to the flag. STATEMENT – Mayor Papaleo read the Statement of Compliance into the record as follows: Statement of Compliance with Open Public Meeting Act: This meeting complies with the Open Public Meeting Act by notification on January 7th of this location, date and time to the Town News and the Record and by posting of same on the municipal bulletin board and Borough Web Site and filing a notice of the same with the Municipal Clerk. APPROVAL OF MINUTES – On motion by Councilwoman Kinsella, seconded by Councilwoman Busteed, with Councilwoman Montisano-Koen abstaining and all other members present voting in favor, that the Minutes of the Mayor and Council Regular Meeting and Closed Session Meetings of May 23, 2022 are hereby approved. On motion by Councilwoman Kinsella, seconded by Councilwoman Busteed, and all members present voting in favor, that the Minutes of the Mayor and Council Special Meeting and Closed Session meeting of May 31, 2022 are hereby approved. PROCLAMATIONS & AWARDS – Mayor Papaleo read the Proclamation Declaring the Month of June as LGBTQ+ Pride Month into the record. PROCLAMATION WHEREAS, the struggle for dignity and equality for lesbian, gay, bisexual, transgender and questioning (LGBTQ+) people is reflected in the tireless dedication of advocates and allies who strive to forge a more inclusive society; and WHEREAS, President Bill Clinton, on June 2, 2000, declared June “Gay & Lesbian Pride Month” to commemorate the June 1969 Stonewall Uprising in Lower Manhattan and on June 1, 2009, President Barack Obama expanded the commemoration further by declaring June to be Lesbian, Gay, Bisexual and Transgender Pride Month; and WHEREAS, June 28, 2019 marked the 50th Anniversary of the Stonewall Uprising which broke out following a police raid on the Stonewall Inn, targeting LGBTQ+ patrons and other marginalized people, in violation of their civil rights, leading to the birth of the "Gay Rights Movement”; and  WHEREAS, LGBTQ+ Americans, including those who live in our local communities, face discrimination simply for being who they are and for who they love and there remains much work to do to extend the promise of our country to every person; and WHEREAS, the landmark Supreme Court decision of 2015 guaranteeing marriage equality in all 50 states was a historic victory for LGBTQ+ Americans and continues to affirm our belief that we are all more free when we are treated as equals. NOW, THEREFORE, BE IT RESOLVED that I, Thomas Papaleo, Mayor of the Borough of River Edge, in recognition thereof, do hereby proclaim: The Month of June 2022 as LGBTQ+ Pride Month and encourage all River Edge residents to eliminate prejudice wherever it exists and to celebrate our great diversity by taking part in community events throughout the month of June which focus on and celebrate our LGBTQ+ neighbors. Craig Cutler-owner of Equality Mental Health in River Edge accepted the proclamation. He explained that his practice is dedicated to the LGBTQ+ community as they offer different types of counseling and therapy. He feels very honored to accept this proclamation and thanked the Mayor and Council for recognizing Pride Month. FOR YOUR INFORMATION – Troop 5862 Silver Award Project – Claire Busteed, 597 Bogert Road & Kaitlyn Turschmann, 219 Concord Drive explained their Girl Scout Silver Award Project to the Mayor and Council. Their goal is to have many areas in town meet house number requirements that are lacking right now. Before starting their research, they met with Neal Carroll to review the house number requirements and compiled a list of streets that needed to be reviewed. Now that their research is complete, Neal will bring them to the Building Department at Borough Hall to ask for assistance in sending letters out. Claire and Kaitlyn feel that it’s very important to have correct and visible house numbers to assist first responders in case of an emergency. Mayor Papaleo-feels that this is a great project and understands the importance of identifying house numbers for our first responders. PRESENTATION – Anthony Iovino – Design Plans – Borough Hall Anthony Iovino-Arcari & Iovino, 1 Katherine Street, Little Ferry, New Jersey – said that the original charge was to renovate Wing A only. On the ground level, Finance would stay where it is, Health moves from the back to the front of Wing A, and Building, Land Use, and the Assessor move to the back. Right now, space in Finance and Building is very tight. Upstairs, the Council Chambers would remain the same and on the Tenney Avenue side, the Clerk and Deputy and the Administrator would be located with Recreation and a meeting room in between. Due to a shortage of space, he was asked to explore an addition and both options 1a and 1b utlize the same footprint with a reconfiguration of the different departments. He said that the last time he was here they talked about bumping out on the front of the building toward Kinderkamack Road. His plan is to bump out a little further than the portico to about 15 feet where he has a full meeting room and reconfiguring the Deputy, the Clerk and Administrator to the same side. On the first floor, that extension would be the Building Department. He explained that in 1b, the difference is the reconfiguration of the meeting room and offices. In option 2, the bulk addition of usable space would be out toward the Tenney Avenue side. He reconfigured the Building Department to the where Finance is now and Finance back to where the Health Department is now. With this version, he would extend the front entrance further out to resolve the barrier free entrance problem which is too steep now. In concepts 1 & 2, he has also proposed parking spaces on the Kinderkamack Road side to allow for employee parking. Mayor Papaleo-asked if the new stair addition is required? Anthony Iovino-replied yes, especially if we’re going to add on. He expressed uncertainty as to whether the gut renovation would trigger it but it would definitely be required in option 2. He explained that there is a fire escape outside the Administrator’s window that they can modify and make it a door but it’s not the ideal arrangement. Mayor Papaleo-asked how much of a savings would it be if we didn’t do the parking lot? Anthony Iovino-replied that he’s very hesitant to give estimates right now, it but would probably be about $200,000. Mayor Papaleo-stated that the staircase is not optional if we bump out but it may be optional if we don’t. Anthony Iovino-replied, yes. Councilwoman Busteed-noted that that there is an effort to digitize files in Borough Hall. She asked if that would help the Building Department and should they take that into consideration for the future size of office space? Lissette Aportela-explained that the Building Department needs plan desks and to digitize only helps to an extent for modernization and OPRA requests. The state requires the actual paper for Building Department files for the lifetime of the structure. Councilwoman Montisano-Koen-said that it’s her understanding that option 2 is an attempt to solve the issues we already have and also provide the space that we’ll need in the future for new staff and growth. She asked is that what addition means at this point in time? Lissette Aportela-replied that addition doesn’t just mean staff, but files, activity and unfortunately active shooter as there isn’t any place to run and hide. She said that option 2 addresses the grading issue, the steepness of the exit that is not ADA compliant and other multiple factors. Anthony Iovino-stated that the difference between option 1 and option 2 is expanding the room that we’re in and the rest of the staff spaces are added equally. Councilwoman Kinsella-asked if there was a reason why the Deputy Clerk, Borough Clerk and Administrator weren’t in the same area in the original plan? Anthony Iovino-he felt that the Deputy Clerk should be part of the lobby space but nothing is set in stone right now as the space can be reconfigured. Councilwoman Malellari-noticed that on option 1 it stated that roofing repairs were not included but in option 2 it doesn’t say anything. She asked if roofing was included in option 2? Anthony Iovino-replied no, he just forgot to say it. Mayor Papaleo-stated that the last time Mr. Iovino was here they discussed when construction would occur and that they wouldn’t really know the full extent until they got down to the joists and studs. It is his understanding that option 1 and 2 are based off of the renovation model. He assumes that we would be able to correct the torque that’s currently occurring with minor effort and wouldn’t have to completely gut and remove the 2nd floor. Anthony Iovino-we are stripping Wing A down to the framing. Mayor Papaleo-said that the joists and studs represent the second floor and asked if he is estimating that he’ll take out the second floor and put it back in? Anthony Iovino-replied no, we would expose it, see where the issues are, beef up framing that needs to be beefed up but wouldn’t take everything out and put everything back. Chris Battaglia-Chief Financial Officer-had provided the Mayor and Council a cost analysis for additional funding for both options. He felt that both options are affordable in the sense that we can absorb the costs in future budgets without excess increases to taxpayers. Neither of the scenarios is so large that we would want to change course and utilize the cash reserved from the Community Center Project. He suggested having a financial advisor run a projection with what they expect to be markets rates over the next 5 years. He said that both scenarios would require introducing a bond ordinance. He also discussed the Borough’s debt policy and the impact of both options. He said that Option 2 would require a modification to the debt policy in order to be in compliance. Councilwoman Busteed-has concerns about the impact of this project on the 5-year capital plan, DPW projects and other larger projects. She said that we’ve been pushing the DPW project off for many years and worries about the financial impact. Mayor Papaleo-asked CFO Battaglia if in his 5-year analysis did he anticipate the DPW projects? Chris Battaglia –said that he anticipated an additional $2 million dollars in 2023. He was also asked to explain how the $1.3 million reserved for the Community Center will be used. Councilman Chinigo-also has concerns about future DPW projects and doesn’t feel $2 million will be enough. He said that we live in an area with high taxes and need to be cognizant of the fact that we have a lot of expenses coming up and although there are things we wish for, we should be as fiscally conservative as possible. He doesn’t feel we need option 2 but is willing to consider option 1 a/b. He also urges the Council to keep in mind the expenses for the DPW over the next few years. Mayor Papaleo-asked the Council if there is any member who would argue for Option 2. Hearing none, Option 2 is off the table. The Mayor stated that he would like to take the parking lot off the table and the Council was in agreement. Councilman Chinigo-feels that it all comes down to additional space and whether they feel we need it or not. The majority of the Council said that they were leaning towards Option 1 a/b. Anthony Iovino-said that he would be remiss to not reiterate that there is an ongoing structural issue in Wing A that needs to be addressed sooner than later. Councilwoman Busteed-asked if anyone knows which way Council President Kaufman is leaning as she is head of the Finance Committee. Jason Milito-Department of Public Works-feels that the Council should concentrate on this building and doing things correctly before worrying about DPW projects. He said that he’s willing to keep maintaining the salt bin and continue to do small repairs at the DPW over the next few years if it means completing the Borough Hall project correctly. He continued to say that issues with the roof and air conditioning have arisen in Wing C. His recommendation is to conduct an assessment of the entire building to include Wing A, B, and C and address all issues before considering any other projects. Mayor Papaleo-asked Mr. Iovino if he would be able to get a general idea about roof repairs as an option on the bid? Anthony Iovino-replied, yes and suggested hiring a roofer and a mechanical contractor for the specialized issues. He said that he will consult with DPW Superintendent Milito and provide a ballpark figure for the Council. On motion by Councilwoman Busteed, seconded by Councilman Chinigo to move forward with Option 1 as presented this evening and separately get costs for roofing of A, B & C and the mechanical problems that have been identified in Wing C was unanimously approved. Lissette Aportela, Borough Administrator-said that she hasn’t signed the lease to relocate yet and in an effort to save money, asked if she has permission to look at a virtual option. She feels that it would be more cost effective to get employees laptops and VPN’s than pay over $80,000 in rent. Mayor Papaleo-asked if she would be comfortable with that for a 2-year period. Lissette Aportela-replied that if it’s going to give our employees a safe and functional working environment, then yes. Councilwoman Busteed-has concerns about the access to services for the public over a 2-year period. She wants to make sure that we don’t unintentionally fail the public. She said that she’s not opposed to the idea and suggested possibly a hybrid option. Lissette Aportela-said that in moving offsite, people would have to make appointments to enter a private building anyway which is what other municipalities have done in this type of situation. Being virtual doesn’t mean hands off and she’s trying to think of the most cost-effective way to get this project done because every penny counts. She also explained that the public will still come in for finance purposes. If there are special events during the year and we need to be on site, it might be easier to make space as needed, possibly at the Library, rather than pay for a rental. Mayor Papaleo-asked for a ballpark figure of what the savings would be. Lissette Aportela-replied that for 2 ½ years it would be approximately $100,000. The difference between rental space versus getting laptops and VPN’s would be about 10% or $90,000. Councilwoman Busteed-asked where the building was? Lissette Aportela-replied 70 Grand Avenue. Councilwoman Montisano-Koen-asked if the idea is to do a hybrid or virtual model to avoid paying the lease of that facility? Lissette Aportela – replied yes and explained that we would have to pay the lease, move telephone lines, install internet service and IT wiring of lines which could cost another $5,000. Councilwoman Montisano-Koen-asked for clarification on possibly utilizing space at the Library. Lissette Aportela-explained that it wouldn’t be on a permanent basis only at certain times of year when we know we’ll need to be accessible and we will work with the Library Director’s schedule. She said that the Library Director could not commit the Library for an extended amount of time and we don’t have a parking lot where we could put a modular building. Councilman Chinigo-asked about the Cultural Center building. Mayor Papaleo-said that the building really isn’t in good shape and the Cultural Center has a lease. Councilwoman Montisano-Koen-asked about the Shade Tree building since it’s been redone. Lissette Aportela -said that she will look into whether a few departments can be put there. Councilman Chinigo-has concerns about flooding in that area. On motion by Councilman Chinigo, seconded by Councilwoman to authorize the Borough Administrator to abandon the offsite option for a remote or hybrid option was unanimously approved. Memorial Park Subcommittee Recommendation – presentation was postponed until the June 27th meeting. PUBLIC COMMENTS ON ANY ITEM ON THIS AGENDA – (Public Comments will be limited to two (2) minutes per speaker) On motion by Councilwoman Busteed, seconded by Councilwoman Kinsella, and all members present voting in favor, to open public comments on any item on the agenda. Patrick Smith-173 Oxford Terrace-stated that he just received his rental renewal agreement with a 4% increase as well as a document stating that he must get rental insurance otherwise they wouldn’t renew his lease. He asked if they are allowed to do that? He feels like he’s being bullied. Tom Sarlo, Esq.-replied yes they can. He said that the Borough has no justification to step in because requiring an insurance policy doesn’t have anything to do with a rent increase. He said that it’s really in his best interest and is something that is very common. On motion by Councilwoman Busteed, seconded by Councilwoman Kinsella, and all members present voting in favor, to close public comments on any item on the agenda. APPOINTMENTS & PERSONNEL CHANGES – On motion by Councilwoman Montisano-Koen, seconded by Councilwoman Kinsella, the appointments and personnel changes were unanimously approved as follows: The increase in longevity of Jairo Duarte, Laborer I in the Department of Public Works from $1,440.00 to $1,920.00 effective February 27, 2022; The salary increase of Maclane Doran, Police Officer from an annual salary of $44,146 to Patrol Officer 18th Grade - $53,609.00 effective June 28, 2022; The salary increase of Domenic Pizzanelli, Police Officer from an annual salary of $44,146.00 to Patrol Officer 18th Grade - $53,609.00 effective June 29, 2022; The hire of Camp Staff from June 27, 2022 through July 29, 2022 as per the list on file with the Borough Clerk’s office. June 13, 2022 ******** #22-190 Support S790 Flood Control Measures WHEREAS, S790 requires the DEP and owners of certain reservoirs to implement certain flood control measures, and authorized the Office of Emergency Management to order lower of reservoir levels in response to severe weather events; and WHEREAS, the seasonal water level at the Oradell Reservoir and the operation of the dam, both before and during rain events, is a principal concern of River Edge residents who are impacted by flooding during these events; and WHEREAS, the properly-timed release of water in advance of a storm has historically helped abate the risk of flooding from a rain event, but State statute and DEP regulations have prevented the water company from consistently utilizing a water release as a flood mitigation aid; and WHEREAS, the adoption of the measures contained in S790 would provide a reduction to the severity of flooding in the Borough of River Edge; NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council hereby support S790 and urge the Legislature to fast track the adoption of this legislation in order to provide hope and flood relief to those New Jersey residents that are still wrestling with the aftermath of Hurricane Ida and who live in dread of future rain storm events; and BE IT FURTHER RESOLVED that the Clerk is hereby directed to forward a copy of this resolution to the bill sponsors; District 38 Legislators; Governor Murphy; the Bergen County Commissioners; and all municipalities in the County of Bergen. June 13, 2022 ******** #22-196 Retain Consulting Services – Police Accreditation WHEREAS, the Commission on the Accreditation of Law Enforcement Agencies (“CALEA”) and the State of New Jersey Associations of Chiefs of Police offer programs to obtain accreditation of police department management; and WHEREAS, Police Chief, Michael Walker has obtained a proposal from the Rodgers Group, LLC for professional consulting services to obtain accreditation for the River Edge Police Department; and  WHEREAS, the services provided by the Rodgers Group, LLC qualifies as a proprietary purchase because the consulting services associated with the process of a police department to become accredited is of a specialized nature and there is no other consulting firm in the State of New Jersey that provides this service and obtaining accreditation is necessary for the conduct of the River Edge Police Department’s affairs; and WHEREAS, the Rodgers Group, LLC has submitted a Business Entity Disclosure Certification on June 2, 2022, which certifies that the company has not made any contributions to any political or candidate committee in the Borough of River Edge in the previous one year that would render the firm ineligible to be awarded this contract, and that the proposed contract prohibits the Rodgers Group, LLC from making any such reportable contributions through the term of the contract; and WHEREAS, the Rodgers Group, LLC has submitted a Political Contribution Disclosure Form on June 2, 2022, required pursuant to NJSA 19:44A-20.26; and WHEREAS, Chief Financial Officer Chris Battaglia has advised that funding is available for this service. In order to make amendments to the ordinances, she must obtain permission from governing body. Councilman Chinigo-suggested that, in the future, ordinance revisions go through the Ordinance Committee. There was no objection by the Council to move forward with the ordinance amendment. NEW BUSINESS – None OLD BUSINESS – Update on Construction Projects Lissette Aportela-reported that there are several projects on close-out where the contractors are completing a punch list that our engineer’s office provided. The projects are: Continental Avenue, the Train Station Parking Lot, the 2021 ADA Ramps and the paving program which are all in the final stages. With regard to the bid opening for 2022 Ramps as well as the repaving of Fire Co #1 and Co #2 parking lot, she explained that prior to the contract being awarded, if the price difference is greater than 10%, the lowest bidder is required to certify in writing that they will pay prevailing wages. Since this document is still awaited, this award is anticipated to be authorized at the next meeting. With regard to the Reservoir Avenue Sidewalk Improvement, she’s waiting for approval from the County on the bid specs in order to go out to bid. Farmer’s Market Lissette Aportela-read an update from Council President Kaufman who has worked tirelessly to get the Farmer’s Market up and running. She announced that the market will reopen on Thursday, June 30th from 3 to 7 p.m. and continue through the end of September on Continental Avenue at Memorial Park. There are 10 vendors joining along with a farmer from Long Valley New Jersey who will provide a nice mix of items for our residents and other patrons. Councilwoman Montisano-Koen-thanked River Edge resident Theresa Esposito for being a key part of the discussions and guiding them through the process. Although Councilwoman Montisano-Koen commented that she initially brought the idea to Council, she thanked Council President Kaufman profusely because she really ran with it. She thanked the Risk Consultant, Ezio Altamura, and Borough Attorney, Tom Sarlo, for helping them finalize the agreements as well as Chief Walker and Sgt. Diamond for walking the area and making sure everyone knew where they had to go. PUBLIC COMMENTS -(Public Comments will be limited to two (2) minutes per speaker) On motion by Councilwoman Kinsella, seconded by Councilwoman Malellari, and all present voting in favor, to open for public comments. Neal Carroll – 321 Wales Avenue-asked where we are with the lightning detection system? Lissette Aportela-replied that it was completed and she just received the invoice in the mail. It was installed a few weeks ago and they were working out the kinks with the server but all the equipment is up. Neal Carroll –asked if it was set up at the ball fields and schools? Lissette Aportela-replied yes. She explained that we have a lightning detections system that sends out sound notifications so everyone leaves an open area for safety. Neal Carroll-asked what’s the status of the generator at the Library? Lissette Aportela-explained that the project is moving along with the grant. There was a delay with the HVAC equipment and supply chain issues and there was a lot of back and forth with PSE&G. Our engineer has kept meticulous notes on all emails and is holding them to task on what needs to be done in order to get this generator put in. On motion by Councilwoman Busteed, seconded by Councilwoman Montisano-Koen, and all present to close public comments was unanimously approved. COUNCIL COMMENTS Councilwoman Kinsella-wanted to bring everyone up to date on the July 4th festivities. She said that the July 4th Committee is comprised of dedicated volunteers who have been working tirelessly on getting these events scheduled. She announced that on July 1st there will be a movie in the park, July 3rd music in the park and July 4th the annual parade and family fair. She will provide additional details at the next meeting. Mayor Papaleo-also commended the committee for doing a wonderful job and is very grateful to have them. Councilwoman Busteed-stated that she had asked Borough Administrator Aportela to reach out to the County regarding a complaint that she received from a resident about the crosswalks not being visible at Midland and Kinderkamack. She asked whether there is an update as to when they will be painted? Lissette Aportela-said Mr. Connolly mentioned that he was sending people out to various crosswalks and would provide a report. She said she’ll follow-up. Mayor Papaleo-mentioned that the Recreation Commission is raising funds for the 4th of July celebration and expressed his understanding that it’s being spearheaded by Sgt. Joe Zemaites. He thanked the commission for their fundraising efforts.
