MINUTES Mayor and Council Regular Meeting March 13, 2023 6:30 P.M. CALL TO ORDER – A Regular Meeting of the Mayor and Council of the Borough of River Edge was held virtually via Zoom. The meeting was called to order at 6:31 p.m. by Mayor Thomas Papaleo. SILENT PRAYER – FLAG SALUTE Mayor Papaleo asked for a moment of silence for America as a whole as well as for countries that are struggling with different questions especially those questions relating to banking regulations and what seems to be fair for country. Mayor Papaleo led those present in a salute to the flag. STATEMENT OF COMPLIANCE - Mayor Papaleo read the Statement of Compliance into the record as follows: Statement of Compliance with Open Public Meeting Act: This meeting complies with the Open Public Meeting Act by notification on January 9th and March 2nd this location, date and time to the Town News and the Record and by posting of same on the municipal bulletin board and Borough website and filing a notice of the same with the Municipal Clerk. ROLL CALL PRESENT: Councilman Chinigo, Council President Kaufman, Councilwoman Montisano-Koen, Councilwoman Kinsella (arrived at 6:43 p.m.), Councilwoman Malellari, Councilman Benson and Mayor Papaleo. CLOSED SESSION – On a motion from Council President Kaufman, seconded by Councilman Benson, and all present voting in favor, the meeting was adjourned to the Closed Executive Session via Resolution #23-96 at 6:33 p.m. #23-96 Resolution to Go Into Closed Session and Exclude Public WHEREAS, the Open Public Meetings Act, NJSA 10:4-12 permits the exclusion of the public from a meeting in certain circumstances; and WHEREAS, this public body is of the opinion that such circumstances presently exist. NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of River Edge, County of Bergen, State of New Jersey, as follows: 1. Mayor Papaleo announced that Assemblywoman Lisa Swain, representative for District 38, is present this evening. PROCLAMATIONS & AWARDS Proclamation Declaring the Month of March as Women’s History Month Mayor Papaleo read the following proclamation into the record: PR O C L A M A T I O N Whereas, American women of every race, class, and ethnic background have made historic contributions to the growth and strength of our Nation in countless recorded and unrecorded ways; and Whereas, American women have played and continue to play a critical economic, cultural, and social role in every sphere of the life of the Nation by constituting a significant portion of the labor force working inside and outside of the home; and Whereas, American women have played a unique role throughout the history of the Nation by providing the majority of the volunteer labor force of the Nation; and Whereas, American women were particularly important in the establishment of early charitable, philanthropic, and cultural institutions in our Nation; and Whereas, American women of every race, class, and ethnic background served as early leaders in the forefront of every major progressive social change movement; and Whereas, American women have been leaders, not only in securing their own rights of suffrage and equal opportunity, but also in the abolitionist movement, the emancipation movement, the industrial labor movement, the civil rights movement, and other movements, especially the peace movement, which create a more fair and just society for all; and Whereas, despite these contributions, the role of American women in history has been consistently overlooked and undervalued, in the literature, teaching and study of American history. Now, Therefore, Be It Resolved that I, Thomas Papaleo, Mayor of the Borough of River Edge, in recognition thereof, do hereby proclaim the month of March 2023 as: “Women’s History Month” Mayor Papaleo announced that Mary Donahue, an outstanding exemplar of commitment to volunteerism, service, and intelligent debate, was supposed to be present this evening to accept this proclamation. He noted that she previously served as a Commissioner and Councilwoman and has done so much for the residents of River Edge and Bergen County. He commented that, in her absence, the governing body honors her as well as all women and wish all women the recognition and deserved credit that is so long earned. Assemblywoman Swain commented on how nice it is to see the Girl Scouts present this evening as they are the future leaders. She advised that she also has a proclamation in honor of Mary Donahue. She provided a history of Ms. Donahue’s life and highlighted Ms. Donahue’s accomplishments and contributions to the community. Proclamation Declaring the Week of March 12-18th as Girl Scout Week Mayor Papaleo read the following proclamation into the record: PROCLAMATION WHEREAS, throughout the long history of Girl Scouts, certain traditions remain meaningful and important and are still practiced today; and WHEREAS, every year the week containing Girl Scout Birthday (March 12th) is bookended by celebrating the connection between Girl Scouts and their faith; and WHEREAS, Girl Scout Week begins the Sunday before March 12th (a day known as “Girl Scout Sunday”) and extends through the Saturday following March 12th (a day known as “Girl Scout Sabbath”) ; and WHEREAS, the Girl Scout Birthday on March 12th commemorates the day in 1912 when Juliette Gordon Low officially registered the organization’s first 18 girl members in Savannah, Georgia and this year represents the 111th birthday; and WHEREAS, since its founding in 1912, Girl Scouts has enjoyed the support of religious organizations and together they have enriched the spiritual lives of Girl Scout members, each of whom strives from the perspective of their own personal belief to live up to the Girl Scout Promise and Law. NOW, THEREFORE, BE IT RESOLVED that I, Thomas Papaleo, Mayor of the Borough of River Edge, in recognition thereof, do hereby proclaim: March 12 - 18, 2023 as: Girl Scout Week Vanessa Estevez, Troop Leader, commented on how hard the Girl Scouts work to make a difference in the community. She thanked the Mayor and Council for honoring them this evening and expressed how glad she is that they are being honored on the same night that the proclamation in honor of Women’s History Month was read. Proclamation Honoring Steven Baxter Mayor Papaleo reviewed Mr. Baxter’s contributions to the community which included being a Boy Scout leader as well as a Recreation Commission member. He advised that Mr. Baxter served as the Grand Marshal of the Bergen County St. Patrick’s Day Parade this year and stated that he, Council President Kaufman and Councilwoman Kinsella marched in the parade along with the River Edge Fire Department. He then read the following proclamation into the record: PROCLAMATION WHEREAS, the Council of Irish Associations of Greater Bergen County has announced that River Edge resident, Steven Baxter of the Ancient Order of Hibernians, Father Solanus Casey Division #32 will be the Grand Marshal of the annual Saint Patrick’s Day Parade in Bergenfield; and WHEREAS, in addition to spreading the cause for Fr. Solanus Casey’s Sainthood, Steven currently serves as the President of the Ancient Order of Hibernians, Division#32, he is a member of the Council of Irish Associations of Greater Bergen County, the Bergen Irish Association and the County Leitrim Society of New York; and WHEREAS, Steven is also an active member of Msgr. Burke 5051 Knights of Columbus and th a 4 Degree Knight of Msgr. Charles G. McCorristin Assembly 1289; and WHEREAS, Steven has dedicated his time as Assistant Cub Master and Pack Committee Chair of Cub Scout Pack 95 in River Edge and is currently an Assistant Scout Master in charge of lower rank advancement and first aid, emergency preparedness, public health, scholarship and a geneaology merit badge counselor for 3 Rivers District and River Edge Troop 184 where his sons are scouts; and WHEREAS, Steven is currently a member of the River Edge Recreation Commission and has been a valued asset to our community. We acknowledge his many accomplishments and recognize his contributions to society. NOW, THEREFORE, I, Mayor Thomas Papaleo, and on behalf of the Borough Council of River Edge do Honor, Thank, Commend and Congratulate Steven Baxter for his years of dedicated service. Mr. Baxter thanked the Mayor and Council for marching in the parade and commented that it was a nice tribute to River Edge. He provided a brief history on the Ancient Order of Hibernians. Mayor Papaleo thanked Mr. Baxter for his commitment to River Edge and the Irish cause in Bergen County. APPROVAL OF MINUTES – On a motion by Councilwoman Malellari, seconded by Councilman Benson, and all members present voting in favor, that the Minutes of the Mayor and Council Regular and Closed Session Meeting of February 27, 2023 are hereby approved APPOINTMENTS & PERSONNEL CHANGES – On motion by Councilwoman Malellari, seconded by Councilwoman Kinsella, and all members present voting in favor, to approve the following appointments and personnel changes: Approve the salary change of Gabriel Colucci, Patrol Officer from an annual salary of $72,526.00 to Patrolman 15th grade - $81,988.00 effective April 8, 2023. MONTHLY REPORTS – Mayor Papaleo advised that the following reports are on file in the Office of the Borough Clerk and available for review: Tax Collector - February 2023 Historic Commission - February 2023 Land Use Board - February 8, Library Board - January 2023 FIRST READING – ORDINANCES – Ordinances #23-4 – #23-6 Motion by Councilman Benson that the following ordinances be introduced and passed on first reading and setting March 27, 2023 at 7:00 p.m. or as soon thereafter as the as the matter can be heard as the date and time and Zoom as the virtual platform for a hearing on said ordinances. Mayor Papaleo read the titles of the ordinances into the record: Ordinance #23-4 An Ordinance to Fix the Salary, Wage and Compensation of the Employees of the River Edge Police Department Represented by PBA Local 201, for the Years 2023 Through 2027 Ordinance #23-5 An Ordinance to Fix the Salary, Wage and Compensation of the Employees of the River Edge Superior Officers Association Represented by PBA Local 201, for the Years 2023 Through 2027 Ordinance #23-6 an Ordinance Amending an Ordinance Entitled ‘Police Department’ of the Revised General Ordinances of the Borough of River Edge, County of Bergen, State of New Jersey Borough Administrator Aportela advised that Ordinance #23-4 and #23-5 establish the salaries within the Police Department both for the Police Officers and Superior Officers according to the Collective Bargaining Agreements which she noted are listed for approval on the Consent Agenda this evening. She further advised that Ordinance #23-6 amends Police Department Table of Organization to reclassify the Police Reserves as Special Law Enforcement Officers Class I as well as to establish the positions of Special Law Enforcement Officers Class II and Class III. SECOND READING & HEARING ON ORDINANCES Ordinance #23-3 Mayor Papaleo read into the record: The following ordinance published herewith was first read by title only on February 16, 2023 and posted on the bulletin board of the municipal building. Ordinance #23-3 - An Ordinance Amending the Revised General Ordinances of the Borough of River Edge, Chapter 79, Entitled ‘Recreation and Cultural Affairs, Department of’. Public Comments on Ordinances 23-3 Motion by Councilman Chinigo, second by Councilwoman Kinsella, and all members voting in favor, to open the floor to the public on Ordinance #23-3. Borough Administrator Aportela advised that the purpose of this ordinance is to update the requirements for personnel within the Department of Recreation and Cultural Affairs and to consolidate the various sections pertaining to the Recreation Commission and the Cultural Affairs Advisory Committee into one detailed section for each. On a roll call, the vote was recorded as follows: Councilman Chinigo: aye Councilwoman Kinsella: aye Council President Kaufman: aye Councilwoman Malellari aye Councilwoman Montisano-Koen: aye Councilman Benson: aye ******** #23-97 Authorize Execution of Developer’s Agreement between 915 Kinderkamack Road LLC and the Borough of River Edge WHEREAS, 915 Kinderkamack Road LLC (the “Developer”) is the owner of property located at 915 Kinderkamack Road, Block 206, Lot 4 (the “Property”); and WHEREAS, the Developer received minor subdivision approval and preliminary and final site plan approval pursuant to a Resolution adopted by the Borough of River Edge Municipal Land Use Board (the “Board”) on October 12, 2022; and WHEREAS, the Developer is required to post Performance Guarantees pursuant to the terms of the Borough Code and Resolution as adopted by the Board; and WHEREAS, the Developer is desirous of entering into a Developer’s Agreement with the Borough of River Edge (the “Borough”) and the Board with respect to the development of the Property in view of the provisions of the Borough’s Ordinances which, among other things, require that prior to the granting of a building permit, the Developer shall have installed or shall have furnished performance guarantees for the ultimate installation of the several improvements therein mentioned, and that no final plat shall be approved by the Board until the completion of all such required improvements has been certified to the Board by the Borough Engineer, unless satisfactory performance guarantees to cover the cost of all such improvements or the incomplete portions thereof and deposits for Borough professional costs are filed by the Developer; and WHEREAS, a Developer’s Agreement has been drafted that is mutually acceptable to the Developer and the Borough. NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of River Edge as follows: 1. The Mayor and Borough Clerk are hereby authorized and directed to execute the Developer’s Agreement in the form annexed to this Resolution; and 2. The Developer’s Agreement is expressly conditioned upon acceptance by the Borough of the required performance guarantees and escrow deposits. 3. Certified copies of this Resolution shall be provided to the River Edge Municipal Land Use Board; the Building Department; Borough Engineer; and Attorney for the Developer, Joseph A. Paparo, Esq. 4. A copy of the Assignment of Developer’s Agreement shall remain on file in the Borough Clerk’s office and available for public inspection. 5. This Resolution shall take effect immediately. ******** #23-98 Approve the Collective Bargaining Agreement Between the Borough of River Edge and the River Edge PBA Local 201 BE IT RESOLVED by the Mayor and Council of the Borough of River Edge that the Collective Bargaining Agreement for the period beginning January 1, 2023, and ending December 31, 2027, between the River Edge PBA Local 201 and the Borough of River Edge is hereby approved; and BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby authorized to execute said Agreement on behalf of the Borough of River Edge. ******** #23-99 Approve the Collective Bargaining Agreement Between the Borough of River Edge and the River Edge Superior Officers Association BE IT RESOLVED by the Mayor and Council of the Borough of River Edge that the Collective Bargaining Agreement for the period beginning January 1, 2023, and ending December 31, 2027, between the River Edge Superior Officers Association and the Borough of River Edge is hereby approved; and BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby authorized to execute said Agreement on behalf of the Borough of River Edge. ******** #23-100 Approve the Appointment of a Volunteer Firefighter BE IT RESOLVED by the Governing Body of the Borough of River Edge that Kenneth Schwabik II be and he is hereby appointed as a Volunteer Firefighter in the River Edge Volunteer Fire Department effective March 13, 2023. ******** #23-101 Authorize Execution of Shared Services Agreement with the River Edge Board of Education – Roosevelt School Athletic Field Improvements WHEREAS, the Uniform Shared Services and consolidation Act (N.J.S.A. 40A:65-1 -1, et seq.) allows a municipality and school district to enter into a contract to provide any service which any of the parties on whose behalf such services are to be performed may legally perform for itself; and WHEREAS, the River Edge Board of Education and the Borough wish to enter into the a Shared Services Agreement regarding improvements to the Roosevelt School Athletic Field, which outlines that the Borough shall reimburse the Board for the purchase and installation of one scoreboard and four dugout covers in an amount not to exceed $100,000 upon certain terms and conditions as indicated in the aforementioned agreement. NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of River Edge, that it does hereby authorize the Mayor and Borough Clerk to execute the attached Shared Services Agreement with the River Edge Board of Education. ******** #23-102 Approve the Appointment of Crossing Guard BE IT RESOLVED by the Governing Body of the Borough of River Edge that Willie Thomas be and he is hereby appointed as a part-time School Crossing Guard at an hourly probationary rate of $18.00 with a six-month probationary period. BE IT FURTHER RESOLVED, that the appointment date is predicated on passing a physical examination. ******** #23-102 Approve the Appointment of Crossing Guard BE IT RESOLVED by the Governing Body of the Borough of River Edge that Willie Thomas be and he is hereby appointed as a part-time School Crossing Guard at an hourly probationary rate of $18.00 with a six-month probationary period. BE IT FURTHER RESOLVED, that the appointment date is predicated on passing a physical examination. ******** #23-103 Adopt Computer Security Incident Response & Business Continuity Plan WHEREAS, the New Jersey Municipal Excess Liability Joint Insurance Fund has the New Jersey Cyber Risk Management Fund (“Cyber JIF”); and WHEREAS, the Cyber JIF will deliver broad insurance coverage alongside a suite of security services, providing members with the type of complete risk management program; and WHEREAS, program establishes a minimum set of technology proficiency standards and provides reimbursement of a portion of a member’s deductible if they were in compliance with the minimum standards at the time of the claim; and WHEREAS, the Borough of River Edge is certified for Tier 3 and adopted a Computer Security Incident Response and Business Continuity Plan on November 8, 2021, via Resolution #21-304; and WHEREAS, an updated Computer Security Incident Response and Business Continuity Plan is required to be adopted. NOW, THEREFORE BE IT RESOLVED, by the Mayor and Council of the Borough of River Edge that the attached Computer Security Incident Response & Business Continuity Plan is hereby approved. ******** #23-104 Payment of Bills Council President Kaufman read resolution #23-74 into the record: At a Regular Meeting of the Mayor and Council of the Borough of River Edge, County of Bergen, State of New Jersey, held on March 13, 2023. BE IT RESOLVED, that the Mayor and Council of the Borough of River Edge approve the following expenditures. CURRENT FUND $107,883.83 CAPITAL FUND $ 51,460.17 GRANT FUND $ 848.68 ANIMAL CONTROL FUND $ 124.20 TRUST OTHER FUND $ 424.78 PAYROLL FUND $ 17,173.85 DEVELOPER’S ESCROW FUND $ 3,360.00 SELF INSURANCE TRUST FUND $ 54,377.67 RECREATION TRUST FUND $ 78.88 Motion by Council President Kaufman, second by Councilman Chinigo, that Resolution #23-104 be approved. The vote was recorded as follows: Councilman Chinigo: aye Councilwoman Kinsella: aye Council President Kaufman: aye Councilwoman Malellari aye Councilwoman Montisano-Koen: aye Councilman Benson: aye ******** NEW BUSINESS – Filming Ordinance Borough Administrator Aportela advised that, currently, a Special Event Permit together with a $15 fee is only required if filming takes place on public property and no other rules or regulations are in place to film within the Borough. She commented that the proposed ordinance is based on a model that was provided by the NJ Film Commission, and if adopted, they will promote the Borough to various studios which can help to generate revenue. She confirmed that the Risk Manager reviewed the portions relating to insurance coverages and the model ordinance was updated accordingly. The consensus of the governing body was to move forward with the Filming Ordinance. As Councilman Chinigo advised that he has notes and questions that he would like addressed, he suggested that this ordinance be vetted through the Legal Review & Ordinance Subcommittee prior to introduction. It was decided that a meeting of this subcommittee will be coordinated with the Borough Administrator to review this ordinance and introduction is anticipated to take place at the next meeting. Request from Library to host BYOB Trivia Night on May 19th Borough Administrator Aportela explained that the Library is seeking permission to hold a BYOB trivia night for its staff. It was the consensus of the governing body to grant this request. OLD BUSINESS – Tabled Resolution #23-88 – Approve Memorandum of Understanding Motion by Councilwoman Malellari, second by Council President Kaufman, to remove Resolution #23- 88 from the table. COUNCIL COMMENTS – Council President Kaufman commented that she is glad that Mary Donohue was honored this evening, noting that Ms. Donahue is a fantastic person. She thanked the DPW for painting the River Edge signs. Mayor Papaleo announced that the DPW Superintendent has indicated that the DPW is prepared for tomorrow’s predicted storm. Councilwoman Montisano-Koen reported that the Ribbon Cutting Ceremony at the Library was a tremendous success with more than 100 people in attendance. She remarked that it was good to see the community come together. Councilman Benson thanked the Borough Administrator for spreading the word that Brute Contracting will be replacing lead lines within the Borough at no cost to the homeowner. On behalf of the DPW Superintendent, Borough Administrator Aportela announced that cardboard recycling in districts 1 and 2 has been canceled for tomorrow and rescheduled to Friday. As of now, garbage collection has not been impacted. She noted that a Nixle alert including this information was sent today. Mayor Papaleo requested that residents remove their cars from the streets if possible. He asked the Council to join him in thanking Borough Administrator Aportela as well as the Labor Attorney, PBA and its attorney for doing a great job in negotiating the new collective bargaining agreements. He commented that the River Edge Police Department’s community policing is second to none. Motion by Council President Kaufman, second by Councilwoman Kinsella, to open the floor to the public. Dean Rayside, 224 Madison Avenue, thanked the governing body, on behalf of REGAL, for passing the resolution to work with the Board of Education to complete the Roosevelt Field project. Ryan Gibbons, 223 Madison Avenue, also thanked the governing body for doing what is right for the girls, noting that it was a long journey to get here. Motion by Council President Kaufman, second by Councilman Benson, to close the floor for public comment.
