MINUTES Mayor and Council Regular Meeting March 27, 2023 7:00 P.M. CALL TO ORDER – A Regular Meeting of the Mayor and Council of the Borough of River Edge was held virtually via Zoom. The meeting was called to order at 7:00 p.m. by Mayor Thomas Papaleo. SILENT PRAYER – FLAG SALUTE Mayor Papaleo asked for a moment of silence for schools throughout the United States especially in Nashville where three children and three teaching staff were killed in another mass shooting. He then led those present in a salute to the flag. STATEMENT OF COMPLIANCE - Mayor Papaleo read the Statement of Compliance into the record as follows: Statement of Compliance with Open Public Meeting Act: This meeting complies with the Open Public Meeting Act by notification on January 9th of this location, date and time to the Town News and the Record and by posting of same on the municipal bulletin board and Borough website and filing a notice of the same with the Municipal Clerk. Chief Financial Officer Christopher Battaglia APPROVAL OF MINUTES – On a motion by Council President Kaufman, seconded by Councilwoman Malellari, and all members present voting in favor, that the Minutes of the Mayor and Council Closed Session and Regular Meeting of March 13, 2023 are hereby approved. PUBLIC COMMENTS ON ANY ITEM ON THIS AGENDA – On motion by Council President Kaufman, seconded by Councilman Chinigo, and all present voting in favor, to open for public comments on any item on the agenda. No one came forward. On a motion by Councilwoman Montisano-Koen, seconded by Councilwoman Kinsella, and all present voting in favor, to close public comments on any item on the agenda. MONTHLY REPORTS – Mayor Papaleo advised that the following reports are on file in the Office of the Borough Clerk and available for review: Land Use Board - March 8, 2023 FIRST READING – ORDINANCES – Ordinance #23-7 Motion by Councilman Benson that the following ordinances be introduced and passed on first reading and setting April 10, 2023 at 7:00 p.m. or as soon thereafter as the as the matter can be heard as the date and time and Zoom as the virtual platform for a hearing on said ordinance. Second by Councilwoman Malellari. Mayor Papaleo read the titles of the ordinances into the record: Ordinance #23-7 An Ordinance Creating a New Chapter in the Revised General Ordinances of the Borough of River Edge, Entitled ‘Filming’ Ordinance #23-8 An Ordinance Creating a New Chapter in the Revised General Ordinances of the Borough of River Edge, Entitled ‘Liability Insurance and Annual Registration Requirements for Businesses and Owners of a Rental Unit or Units’ Ordinance #23-9 Calendar Year 2023 Ordinance to Exceed the Municipal budget Appropriation Limits and to Establish a Cap Bank (N.J.S.A. 40A:45-14) Borough Administrator Aportela advised that Ordinance #22-7 puts regulations in place for filming both on public and private property, noting that doing so is an opportunity to both generate interest in the Borough and revenue. She advised that, once adopted, the NJ Film Commission will be notified so that the Borough can be promoted to the various studios. With respect to Ordinance #23- 8, she explained that the purpose of this ordinance is to comply with a State mandate that information on liability insurance be collected from businesses and owners of rental units. She advised that the purpose of Ordinance #23-9 is to allow the Borough to increase the Cap Bank from 2.5% to 3.5%. She further advised that the additional 1% quantifies an amount that is set aside for use in next year’s budget or the following year, and if not used within this timeframe, it will expire. She advised that the adoption will be set for April 24th at which time a public hearing will be held. Motion by Council President Kaufman, second by Councilwoman Montisano-Koen, that Resolution #23-106 be approved. The Governing Body of the Borough of River Edge does hereby approve the following as the Budget for the year 2023: Revenues: Surplus Anticipated $1,552,500.00 Miscellaneous Revenues 2,389,323.26 Receipts from Delinquent Taxes 265,000.00 Local Tax for Municipal/Library Purposes 15,448,424.14 Total: $19,655,247.40 Appropriations: Appropriations within “CAPS” $ 14,126,915.00 Appropriations excluded from “CAPS” 4,958,332.40 Reserve for Uncollected Taxes 570,000.00 Total: $19,655,247.40 BE IT FURTHER RESOLVED that said Budget be published by summary in the Record on March 31, 2023, and in compliance with N.J.S.A. 40A: 4-8 (1a), a copy of the full approved budget will be made available for public inspection at the Office of the River Edge Borough Clerk located in the River Edge Municipal Building, 705 Kinderkamack Road and Borough website at www.riveredgenj.org Notice is hereby given that the budget and tax resolution was approved by the Governing Body of the Borough of River Edge, County of Bergen on March 27, 2023. A hearing on the Budget and Tax Resolution will be held virtually via Zoom, on April 24, 2023 at 7:00 o'clock P.M. at which time and place objections to the Budget and Tax Resolution for the year 2023 may be presented by taxpayers or other interested persons. Access information to participate in the meeting will be posted to the Borough website www.riveredgenj.org. ******** SECOND READING & HEARING ON ORDINANCES Ordinance #23-4 - #23-6 Mayor Papaleo read into the record: The following ordinances published herewith were first read by title only on March 13, 2023 and posted on the bulletin board of the municipal building. Borough Administrator Aportela explained that both Ordinance #23-4 and #23-5 establish the salaries within the Police Department in accordance with the Collective Bargaining Agreements that were ratified a few weeks ago. With respect to Ordinance #23-6, she advised that this ordinance amends the Table of Organization within the Police Department to allow for Class II and Class III Officers as well as to change the designation of Police Reserves to Class I Officers. Section 40A:11-5(1)(s) and N.J.S.A. 40A:11-36(6) permits the awarding of a contract without competitive bidding for the marketing of recyclables; and WHEREAS, the Borough Administrator and Superintendent of Public Works have prepared a contract containing the approved terms and conditions of the sale. WHEREAS, the River Edge Swim Club, Inc. entered into a Lease Agreement on or about December19, 1992 with the Borough of River Edge to lease certain estate owned by the Borough commonly known as Lots 1-B, 2-B and a portion of 3-B in Block 73 as shown on the tax assessment map of the Borough of River Edge; and WHEREAS, the parties subsequently entered into a First Amendment to the Lease Agreement amending Paragraph l5 of the lease; and WHEREAS, the lease includes certain residency restrictions with regard to the membership of the swim club and use of the premises; and WHEREAS, the Swim Club has requested and the Borough has agreed to make further Amendments to the Lease as outlined in the Second Amendment to the Lease Agreement attached hereto. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Borough Clerk are hereby authorized to execute the Second Amendment to the Lease Agreement; and BE IT FURTHER RESOLVED, that the parties agree that all other terms and conditions of the Original Lease Agreement shall remain in full force and effect during the remainder of the lease term that expires on December 31, 2025. #23-118 RESOLUTION AUTHORIZING SUPPLEMENTAL TEMPORARY APPROPRIATIONS FOR CY2023 WHEREAS, New Jersey Statute 40A:4-19 provides that where any contract, commitments, or payments are to be made prior to the final adoption of the 2023 Budget, temporary appropriations of certain line items totaling within twenty six and one quarter percent (26.25%) of the previous year's General Appropriations for the first three months and prorated for any month following the first three months should be made for the purposes and amounts required in the manner and time herein provided; and WHEREAS, temporary appropriations for Debt Service and Capital Improvement Fund are authorized without the 26.25% limitation; and WHEREAS, the governing body previously approved Temporary Appropriations; and WHEREAS, the 2023 Budget has not been adopted and is not anticipated to be adopted until later in the year; and WHEREAS, the governing body wishes to extend the temporary budget for an additional 2 months, totaling 43.75% of the previous year’s general appropriations; and NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of River Edge that this resolution adopted by not less than a majority vote of the full membership of the governing body authorizes supplemental temporary appropriations as set forth below and that a certified copy of this resolution be forwarded to the Borough’s Chief Financial Officer/Treasurer. It was decided that the Environmental Protection Commission is authorized to hold their May meeting in a hybrid format at the Library. Councilwoman Malellari is to relay this approval to the commission and ask them to coordinate with both the Library Director and Borough Clerk. Senior Prom Councilman Benson advised that he and Mayor Papaleo met with Gina Principato, Residence Manager of The Senior Residence at St. Peter the Apostle, to discuss ways that their residents can engage more with the community and SCORE. During this meeting, Ms. Principato advised that transportation of their residents to the Senior Prom at River Dell Regional High School was needed. He thanked the Borough Administrator, DPW Superintendent and the Senior Bus Coordinator for coordinating with Bergen County to provide transportation to and from this event for the residents at St. Peter as well as all seniors within the community who wish to attend. Budget Workshop Borough Administrator Aportela explained that, at the suggestion of Councilwoman Montisano- Koen, a meeting with the CFO will be coordinated with newer members of the governing body to learn more detail about the budget process. As Council President Kaufman indicated that the CFO does not have a curriculum to follow, it was suggested that newer governing body members follow the curriculum that is available through the New Jersey League of Municipalities to learn more about the budget process. Attendance at classes during the NJLM Annual Conference was also suggested. OLD BUSINESS – There was no Old Business. PUBLIC COMMENTS – Motion by Councilwoman Kinsella, second by Councilman Benson, and all members present voting in favor, to open public comments. No one came forward. COUNCIL COMMENTS – Council President Kaufman thanked the Citizens Budget Committee, Department Heads, Borough Administrator, CFO and members of the governing body for their work on the budget. She explained that the increases due to inflation have made this year tough, noting that many items were mandatory and outside of the Borough’s control. She expressed her opinion that the governing body did a good job of reducing the Capital Budget while still providing what the town needs. She reported that, in a recent ranking, River Edge was in the top 1% of all 17,916 neighborhoods throughout America. Councilwoman Kinsella announced that the Easter Egg Hunt and pictures with the Easter Bunny will take place at Memorial Park on April 1st from 11 a.m. to 1 p.m. with a rain date of April 2nd. Saturday, April 14th is the joint Opening Day for Little League and REGAL which will commence at 10:30 a.m. at Roosevelt and then proceed to Memorial Park. Mayor Papaleo echoed Council President Kaufman’s comments regarding the budget and thanked all involved in the process. He recognized the Finance Committee for their hard work. A new chapter entitled “Filming” is created with the following: § 1 Definitions. As used in this chapter, the following terms shall have the meanings indicated: FILMING - The taking of still, television or motion pictures either on film or videotape or similar recording medium, for commercial or educational purposes intended for viewing on television, in theaters, for institutional uses, or other non- private viewing. The provisions of this chapter shall not apply to News Productions: Current news productions, which includes reporters, photographers or cameramen in the employment of a newspaper, news service, broadcasting station or similar entity engaged in the broadcasting of news events within the Borough. MAJOR MOTION PICTURE - Any film which is financed and/or distributed by a major motion picture studio, including but not limited to the following: A. Universal Pictures. B. Warner Brothers, including New Line Cinema, Castle Rock Cinema, Village Road Show and Bel- Aire. C. Paramount, including MTV Films and Nickelodeon Movie. D. 20th Century Fox, including Fox Searchlight. E. Sony/Columbia. F. Disney/Miramax. G. MGM/United Artists. H. Dreamworks. I. Any major streaming service. J. Any film for which the budget is at least $5,000,000. K. Recurrent weekly television series programming. L. “Reality Film Productions”, which shall mean any unscripted activity filmed by a camera person, as an objective observer, whether for documentary, news or entertainment purposes, that follows a subject(s) in his/her/their normal day-to-day activities and uses no special sets or equipment in the production. MUNICIPAL LANDS - Any and every public street, highway, sidewalk, square, public park or playground or any other public place within the Borough which is within the jurisdiction and control of the Borough. § 2 Permit required. A. No person or organization shall film or permit filming on public or on private property where such filming involves the use of public property for the operation, placement or temporary storage of vehicles or equipment utilized in such filming, including, but not limited to, any temporary structure, barricade or device intended to restrict or block off pedestrian or vehicular traffic, without first having obtained a permit from the office of the Borough Clerk, which permit shall set forth the approved location of such filming and the approved duration of such filming by specific reference to day or dates. Said permit must be readily available for inspection by Borough officials at all times at the site of the filming. B. All permits shall be applied for and obtained from the office of the Borough Clerk during normal business hours. Applications for such permits shall be in a form approved by the Borough Clerk and be accompanied by a permit fee in the amount established by this chapter in § 10 herein. C. If a permit is issued and, due to inclement weather or other good cause, filming does not in fact take place on the dates specified, the Borough Clerk may, at the request of the applicant, issue a new permit for filming on other dates subject to full compliance with all other provisions of this chapter. No additional fee shall be paid for this permit. D. Filming activities are authorized between the hours of 8am to 11pm. § 3 Issuance of permits. A. No permits will be issued by the Borough Clerk unless applied for prior to three business days before the requested shooting date; provided, however, that the Borough Administrator may waive the three-day period if it is deemed that the applicant has obtained all related approvals and adjacent property owners or tenants do not need to be notified. B. No permit shall be issued for filming upon municipal lands unless the applicant shall provide the Borough with satisfactory proof of the following: (1) Proof of insurance coverage as follows: (a) Commercial general liability insurance coverage, written on an occurrence basis, and must not be altered by any endorsements limiting coverage. Limits of liability shall not be less than the following: • $2,000,000 General Aggregate per location/per job • $2,000,000 Products/Completed Operations • $1,000,000 Personal Injury and Advertising Injury Limit • $1,000,000 Each Occurrence Combined Single Limit Bodily Injury and Property Damage (b) Worker's Compensation insurance in accordance with the laws of the State of New Jersey and other states where work is being performed. The contractor shall also have and maintain Employers Liability Insurance as well as Longshore and Harbor Workers' Compensation Act (LHWCA) coverage where applicable. (c) Comprehensive Automobile Liability insurance covering the use of all owned, non-owned, hired or leased automobiles with limits of liability not less than one million ($1,000,000.00) dollars combined single limit for bodily injury and property damage. Coverage should include uninsured and underinsured motorist at limits no less than the minimum statutory limits. (d) The Borough is named as an additional insured. The insurance coverage required by this subsection shall at all times be maintained in the full amount. The policy of insurance required by this subsection, to be filed with the Borough Clerk shall contain a clause obligating the company issuing the same to give not less than thirty (30) days' written notice to the Borough Clerk before cancellation or amendments of any of the terms thereof. Notice of cancellation shall not relieve the company issuing such policy of liability for any injury or claim arising before the cancellation becomes effective. The cancellation of any such policy shall have the immediate effect of suspending the license of such person to film or tape covered thereby without further notice to the applicant until a new policy complying with the provisions of this subsection is filed with the Borough Clerk and a letter, in writing, confirming the new effective date of the license is issued by the Borough Clerk. The policy shall contain a provision for continuing liability thereunder to the full amount thereof notwithstanding any recovery thereon, that the liability of the insured shall not be affected by the insolvency or the bankruptcy of the insured and that until the policy is canceled the insurance company will not be relieved from liability on account of nonpayment of premium or of any act or omission by the named insured. Such policy of insurance shall be further conditioned for the payment of any and all judgments up to the limits of such policy. (2) An agreement, in writing, whereby the applicant agrees to indemnify and save harmless the Borough from any and all liability, expense, claim or damages resulting from the use of municipal lands. (3) The hiring of an off-duty police officer for the times indicated on the permit. C. The holder of the permit shall take all reasonable steps to minimize interference with the free passage of pedestrians and traffic over municipal lands and shall comply with all lawful directives issued by the Police Department with respect thereto. § 4 Interference with public activity; notice of filming. A. The holder of a permit shall conduct filming in such a manner as to minimize the inconvenience or discomfort to adjoining property owners attributable to such filming and shall, to the extent practicable, abate noise and park vehicles associated with such filming off the public streets. B. The holder shall avoid any interference with previously scheduled activities upon municipal lands and limit, to the extent possible, any interference with normal public activity on such municipal lands. Where the applicant's production activity, by reason of location or otherwise, will directly involve and/or affect any businesses, merchants or residents, these parties shall be given written notice of the filming at least three days prior to the requested shooting date and be informed that objections may be filed with the Borough Clerk, said objections to form a part of applicant's application and be considered in the review of the same. Proof of service of notification to adjacent owners shall be submitted to the Borough Clerk within two days of the requested shooting date. § 5 Refusal to issue permit; employment of patrolmen and electrician. A. The Borough Administrator may refuse to issue a permit whenever it has been determined on the basis of objective facts and after a review of the application and a report thereon by the Police Department and by other Borough agencies involved with the proposed filming site, that filming at the location and/or the time set forth in the application would violate any law or ordinance or would unreasonably interfere with the use and enjoyment of adjoining properties, unreasonably impede the free flow of vehicular or pedestrian traffic or otherwise endanger the public's health, safety or welfare. B. Further, the Borough reserves the right to require one or more on-site patrolmen in situations where the proposed production may impede the proper flow of traffic, the cost of said patrolman to be borne by the applicant as a cost of production. Where existing electrical power lines are to be utilized by the production, an on-site licensed electrician may be similarly required if the production company does not have a licensed electrician on staff. § 6 Appeals. A. Any person aggrieved by a decision of the Borough Administrator denying or revoking a permit or a person requesting relief may appeal to the Mayor and Council. A written notice of appeal setting forth the reasons for the appeal shall be filed with the Administrator within 10 days of the denial. § 7 Waiver of requirements. The Borough Administrator may authorize a waiver of any of the requirements, provisions or restrictions of this chapter, with the exception of the fee, if the Administrator determines that a waiver thereof may be granted without endangering the public health, safety and welfare. In determining whether to issue a waiver, the Administrator shall consider the following factors: (1) Potential traffic congestion at the location. (2) The applicant's ability to remove the applicant's vehicles and equipment from the public streets or other public property. (3) The extent to which the applicant is requesting restrictions on the use of public streets or public parking facilities during filming. (4) The nature of the filming, including whether filming will take place indoors or outdoors, and the proposed hours for filming. (5) The extent to which the filming may affect adjoining and nearby property owners and occupants. (6) The Borough 's prior experience with the applicant, if any. § 8 Copies of permit; inspections. Copies of the approved permit will be sent to the Police and Fire Departments before filming takes place and to the New Jersey Film Commission. The applicant shall permit the Fire Prevention Bureau or other Borough inspectors to inspect the site and the equipment to be used, if deemed necessary. The applicant shall comply with all safety instruction issued by the Fire Prevention Bureau or other Borough inspectors. § 9 Reimbursement of certain costs. In addition to any other fees or costs mentioned in this chapter, the applicant shall reimburse the Borough for any lost revenue, such as repairs to public property or other revenues that the Borough was prevented from earning because of filming. § 10 Fees. The schedule of fees for the issuance of permits authorized by this chapter are as follows: A. Basic filming permit: $500. Where an applicant requests a waiver of the provision of § 3A requiring expedited processing of a permit application within 24 hours of the filming date, the basic filming permit fee for processing the application on an expedited basis shall be $750. B. Daily filming fee payable in addition to the basic filming permit when filming either on public or private property: $250 per day. C. Daily filming fee payable for major motion picture when filming either on public or private property: $1,000 per day. D. Filming permit for nonprofit applicants filming for educational purposes (no daily rate required): $25. E. Student films for school purposes: No Fee § 11 Violations and penalties. Any person who violates any provision of this chapter shall, upon conviction thereof, be punished by a fine not exceeding $2,000, imprisonment in the county/municipal jail for a term not exceeding 90 days, or a period of community service not exceeding 90 days, or any combination thereof as determined by the Municipal Court Judge. Each day on which a violation of an ordinance exists shall be considered a separate and distinct violation and shall be subject to imposition of a separate penalty for each day of the violation as the Municipal Court Judge may determine. Section 2. Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms hereof are hereby repealed to such extent as they are so in conflict or inconsistent. Section 3. In case any article, section or provision of this ordinance shall be held invalid in any court of competent jurisdiction, the same shall not affect any other article, section or provision of this ordinance except insofar as the article, section or provision so declared invalid shall be inseparable from the remainder or any portion thereof. Section 4. This Ordinance shall take effect immediately upon final passage and publication as required by law. The owner of a multifamily home which is four or fewer units, one of which is owner occupied shall maintain liability insurance for negligent acts and/or omissions in an amount of no less than $300,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence. §2 Registration Required The owner of a business, owner of a rental unit or units and the owner of a multifamily home of four or fewer units, one which is owner occupied, shall annually register a certificate of insurance with the Borough Clerk, on or before February 1st of each year or within thirty (30) days of obtaining ownership of the property. §3 Fee There shall be an annual administrative fee in the amount of $100.00. §4 Penalty Failure to annually register a certificate of insurance on or before February 1st of each year shall result in a fine of $2000.00 which shall be collected through a summary proceeding pursuant to the “Penalty Enforcement Law of 1999”, P.L. 1999, c. 274 (C.2A- 58-10, et seq.) Section 2. Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms hereof are hereby repealed to such extent as they are so in conflict or inconsistent. Section 3. In case any article, section or provision of this ordinance shall be held invalid in any court of competent jurisdiction, the same shall not affect any other article, section or provision of this ordinance except insofar as the article, section or provision so declared invalid shall be inseparable from the remainder or any portion thereof. INTRODUCED: ADOPTED: ___________________________________ Thomas Papaleo, Mayor ATTEST: _________________________________ Anne Dodd, RMC, CMR Borough Clerk/Assistant Borough Administrator ORDINANCE 23-9 BOROUGH OF RIVER EDGE CALENDAR YEAR 2023 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A: 4-45.14) WHEREAS, the Local Government Cap Law, N.J.S. 40A: 4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget to 2.50% unless authorized by ordinance to increase it to 3.5% over the previous year=s final appropriations, subject to certain exceptions; and, WHEREAS, N.J.S.A. 40A: 4-45.16a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and, WHEREAS, the Borough Council of the Borough of River Edge in the County of Bergen finds it advisable and necessary to increase its CY 2023 budget by up to 3.5% over the previous year=s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and, WHEREAS, the Borough Council hereby determines that a 1.00% increase in the budget for said year, amounting to $134,281.37 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and, WHEREAS the Borough Council hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years.
