MINUTES Mayor and Council Regular Meeting June 26, 2023 7:00 P.M. CALL TO ORDER – A Regular Meeting of the Mayor and Council of the Borough of River Edge was held virtually via Zoom. The meeting was called to order at 7:01 p.m. by Council President Kaufman. SILENT PRAYER – FLAG SALUTE Council President Kaufman asked for a moment of silence for those facing tornadoes in Indiana and extreme heat in Texas. She then led those present in a salute to the flag. STATEMENT OF COMPLIANCE - Council President Kaufman read the Statement of Compliance into the record as follows: Statement of Compliance with Open Public Meeting Act: This meeting complies with the Open Public Meeting Act by notification on January 9th of this location, date and time to the Town News and the Record and by posting of same on the municipal bulletin board and Borough website and filing a notice of the same with the Municipal Clerk. ROLL CALL PRESENT: Councilman Chinigo, Council President Kaufman, Councilwoman Kinsella, Councilwoman Malellari, and Councilman Benson ABSENT: Councilwoman Montisano-Koen and Mayor Papaleo ALSO PRESENT: Borough Administrator Lissette Aportela Borough Attorney John Shahdanian, Esq. APPROVAL OF MINUTES – On motion by Councilman Chingo, seconded by Councilman Benson, with Councilwoman Kinsella and Councilwoman Malellari abstaining and all other members present voting in favor, that the Minutes of the Mayor and Council Regular and Closed Session Meeting of June 12, 2023 are hereby approved. ******** PUBLIC COMMENTS ON ANY ITEM ON THIS AGENDA – On motion by Councilwoman Malellari, seconded by Councilwoman Kinsella, and all present voting in favor, to open for public comments on any item on the agenda. Frank Longo, 145 Webb Ave, advised that he and his wife moved to River Edge six months ago and commented that Bogert has no curbs. Council President Kaufman advised that public comment on non-agenda items can be made later in the meeting. On a motion by Councilman Benson, seconded by Councilwoman Malellari, and all present voting in favor, to close public comments on any item on the agenda. APPOINTMENTS & PERSONNEL CHANGES – On motion by Councilwoman Kinsella, seconded by Councilman Chinigo, and all members present voting in favor, to approve the following appointments and personnel changes: Approve the hire of Morgan Kiely as a Part-time Temporary Administrative Assistant in the Finance/Borough Clerk office at an hourly rate of $25.00 not to exceed 29 hours per week, effective June 26, 2023. Approve the revised list of Camp Staff on file with the Borough Clerk’s Office. On a roll call, the vote was recorded as follows: Councilman Chinigo: aye Councilwoman Kinsella: aye Council President Kaufman: aye Councilwoman Malellari aye Councilwoman Montisano-Koen: absent Councilman Benson: aye ******** #23-192 Appointment of Borough Representatives to the Open Space Trust Regional Committee WHEREAS, the Borough of River Edge has entered into a Cooperative Agreement with the County of Bergen as provided under the Interlocal Services Act NJSA 40A:8A-1 et seq. to participate in the Bergen County Open Space, Recreation, Farmland and Historic Preservation Trust Fund; and WHEREAS, said Agreement requires that one municipal representative be appointed by the governing body of the community to be part of the Open Space Trust Municipal Park Improvement Program Regional Committee for the term of one year coinciding with the fiscal year July 1, 2023 through June 30, 2024. NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough of River Edge herby appoint the Borough Administrator as the representative for the Borough of River Edge and the Director of Recreation & Cultural Affairs, as the alternate to participate on the Open Space Trust Municipal Program Regional Committee; and BE IT FURTHER RESOLVED, that the Borough Clerk forward a certified copy of this resolution to the Executive Director of the Bergen County Open Space Trust Fund, the Borough Administrator, and the Director of Recreation & Cultural Affairs. ******** #23-193 Authorize Issuance of Purchase Order – Security Cameras WHEREAS, Chief Michael Walker has received a proposal from the Borough Information Technology Consultant, Quikteks for the purchase and installation of a new cameras throughout the Borough, including the licensing of the software for a cost not to exceed $18,698; and WHEREAS, Chief Financial Officer Chris Battaglia has advised that funding is available. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Borough Council of the Borough of River Edge hereby confirms that Police Chief, Michael Walker is authorized to issue a purchase order purchase and installation of a new cameras throughout the Borough, including the licensing of the software for a cost not to exceed $18,698 to Borough Information Technology Consultant, Quikteks. ******** #23-194 Appoint Alternate Prosecutor WHEREAS, a conflict exists with a pending case in Municipal Court which requires the appointment of an alternate prosecutor. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Borough Council of the Borough of River Edge hereby appoint John Donahue as alternate prosecutor at the hourly rate of $85.00 per hour. ******** #23-195 Authorize Local Recreation Improvement 2023 Grant Application – Memorial Park Playground and Walking Path Project Phase I WHEREAS, the Borough of River Edge desires to apply for and obtain a grant from the New Jersey Department of Community Affairs for approximately $70,000 to carry out a project to make improvements to the playground and walking path in Memorial Park as phase I of a multi-year park improvement program. NOW, THEREFORE BE IT RESOLVED, that the Mayor and Council of the Borough of River Edge 1) do hereby authorize the application for such a grant; and, 2) recognize and accept that the Department may offer a lesser or greater amount and therefore, upon receipt of the grant agreement from the New Jersey Department of Community Affairs, does further authorize the execution of any such grant agreement; and also, upon receipt of the fully executed agreement from the Department, does further authorize the expenditure of funds pursuant to the terms of the agreement between the Borough of River Edge and the New Jersey Department of Community Affairs. Miami, FL 33183 ******** #23-197Amend 2023 Meeting Schedule July 2023 BE IT RESOLVED that the start time of the Monday, July 10th virtual meeting be changed from 7:00 p.m. to 6:30 pm. At 6:30 pm, the Oath of Office will be administered to the 3 newly hired police officers. The regular business will resume following the ceremony; and BE IT FURTHER RESOLVED that the 2023 Meeting Schedule adopted by Resolution #23-52 be amended to conduct a Special Meeting on Monday, July 17th at 7:00 p.m. virtually via Zoom. The purpose of the Special Meeting is to solely adopt the following resolutions: 1) award of contracts (contingent on the results of the July 12, 2023, bid openings), 2) adoption of a bill list, and 3) any other resolution as listed on the agenda, as needed; and BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to The Record and Town News, as well as be posted on the Municipal Bulletin Board and Borough Website. ******** #23-198 Approve the Appointment of a Volunteer Firefighter BE IT RESOLVED by the Governing Body of the Borough of River Edge that Roger Tarpey be and he is hereby appointed as a Firefighter in the River Edge Volunteer Fire Department effective June 26, 2023. ******** #23-199 Refund of Construction Bond for Shade Trees at 177 Mohawk Drive, River Edge, NJ WHEREAS, Quality Construction Services, LLC, deposited a cash construction bond for shade trees adjacent to the property located at 177 Mohawk Drive in the amount of $10,000.00 on November 11, 2013; and WHEREAS, the Shade Tree Commission has performed an inspection and has determined that the tree at this location was not affected by construction activity; and WHEREAS, the Shade Tree Commission recommends that the bond in the amount of $10,000.00 be released. NOW, THEREFORE, BE IT RESOLVED that the Accounts Supervisor is authorized to make the following refund of $10,000.00 from the Trust Other Account to: Quality Construction Services, LLC 537 Summit Street Englewood Cliffs, NJ 07632 ******** #23-200 Refund of Construction Bond for Shade Trees to Quality Construction Services, LLC for the Property Located at 364 Valley Road WHEREAS, Quality Construction LLC, deposited a cash construction bond for shade trees adjacent to the property located at 364 Valley Road in the amount of $5,000.00 on June 2, 2017; and WHEREAS, the Shade Tree Commission has performed an inspection and has determined that there was damage to the tree and ultimately the Borough had to remove the tree due to the construction activity; and WHEREAS, the Shade Tree Commission recommends that $1,000.00 of the original bond amount be used to repay a portion of the cost to remove the tree; and NOW, THEREFORE, BE IT RESOLVED that the Accounts Supervisor is authorized to make the following refund of $4,000.00 from the Trust Other Account to: Quality Construction Services LLC 537 Summit Street Englewood Cliffs, NJ 07632 BE IT FURTHER RESOLVED, that the Chief Financial Officer is authorized to transfer $1,000.00 from the Trust Other-Performance Bonds-Shade Tree Account to the Trust Other- Donations Shade Tree Commission Account. ******** #23-201 Refund of Construction Bond to Quality Construction Services, LLC for Shade Trees at 325 Lexington Drive, River Edge, NJ WHEREAS, Quality Construction Services, LLC, deposited a cash construction bond for shade trees adjacent to the property located at 325 Lexington Drive in the amount of $4,128.00 on October 5, 2018; and WHEREAS, the Shade Tree Commission has performed an inspection and has determined that the tree at this location was not affected by construction activity; and WHEREAS, the Shade Tree Commission recommends that the bond in the amount of $4,128.00 be released. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Borough Council of the Borough of River Edge hereby accepts the attached proposal, dated June 22, 2023 from Borough Engineer, Robert Costa of Costa Engineering Corporation for additional professional engineering services associated with surveying, design, bid services, project management and inspection services for the 2023 ADA Ramp Improvement and Sidewalk Replacement Project for a cost not to exceed $70,000.00. ******** #23-208 Approve Additional Engineering Services – Batting Cages & Hockey Rink at Memorial Park Project WHEREAS, the purchase and installation of batting cages as well as the purchase and installation of new hockey rink dasher boards at Memorial Park is a project in which the Borough will receive funding from the 2021 Municipal Park Improvement Program of the Bergen County Open Space, Recreation, Floodplain Protection, Farmland, and Historic Preservation Trust Fund; and WHEREAS, the Borough Engineer had submitted a proposal to perform additional professional engineering services associated with surveying, design, bid services, project management and inspection services for the Batting Cages & Hockey Rink at Memorial Park Project for a cost not to exceed $34,000.00; and WHEREAS, Chief Financial Officer Chris Battaglia has advised that funding is available. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Borough Council of the Borough of River Edge hereby accepts the attached proposal, dated June 22, 2023, from Borough Engineer, Robert Costa of Costa Engineering Corporation for additional professional engineering services associated with surveying, design, bid services, project management and inspection services for the Batting Cages & Hockey Rink at Memorial Park Project for a cost not to exceed $34,000.00. ******** #23-209 Approve Additional Engineering Services – Fenway Drainage Project WHEREAS, the Borough Engineer had submitted a proposal to perform additional professional engineering services associated with surveying, design, bid services, project management and inspection services for the Fenway Drainage Improvement Project for a cost not to exceed $57,000.00; and WHEREAS, Chief Financial Officer Chris Battaglia has advised that funding is available. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Borough Council of the Borough of River Edge hereby accepts the attached proposal, dated June 22, 2023 from Borough Engineer, Robert Costa of Costa Engineering Corporation for additional professional engineering services associated with surveying, design, bid services, project management and inspection services for the Fenway Drainage Improvement Project for a cost not to exceed $57,000.00. ******** #23-210 Authorize Receipt of Bids – The Fenway Drainage Improvements Project BE IT RESOLVED, by the Mayor and Council of the Borough of River Edge, that the Borough Clerk is hereby authorized to advertise for the receipt of bids for the Fenway Drainage Improvements Project; and BE IT FURTHER RESOLVED that said bids shall be received at 10:30 A.M. on Wednesday, July 12, 2023, at the lower level (Municipal Courtroom) of the Public Safety Building located at 705A Kinderkamack Road, River Edge, NJ 07661 at which time and place bids will be opened and read aloud; and BE IT FINALLY RESOLVED that said advertisement shall be published in the Friday, June 30, 2023, issue of the Record in accordance with the Local Public Contracts Law. ******** #23-211 Authorize Receipt of Bids – FY22 CDBG Sidewalk Replacement at Oxford Terrace and Rutgers Place BE IT RESOLVED, by the Mayor and Council of the Borough of River Edge, that the Borough Clerk is hereby authorized to advertise for the receipt of bids for the FY22 CDBG Sidewalk Replacement at Oxford Terrace and Rutgers Place Project; and BE IT FURTHER RESOLVED that said bids shall be received at 11:00 A.M. on Wednesday, July 12, 2023, at the lower level (Municipal Courtroom) of the Public Safety Building located at 705A Kinderkamack Road, River Edge, NJ 07661 at which time and place bids will be opened and read aloud; and BE IT FINALLY RESOLVED that said advertisement shall be published in the Friday, June 30, 2023, issue of the Record in accordance with the Local Public Contracts Law. ******** #23-212 Authorize Receipt of Bids – 2023 ADA Ramps Improvements and Sidewalk Replacement Project & Swim Club and KBG Field Parking Lot Improvements Project BE IT RESOLVED, by the Mayor and Council of the Borough of River Edge, that the Borough Clerk is hereby authorized to advertise for the receipt of bids for the 2023 ADA Ramps Improvements and Sidewalk Replacement Project & Swim Club and KBG Field Parking Lot Improvements Project; and BE IT FURTHER RESOLVED that said bids shall be received at 10:00 A.M. on Wednesday, July 12, 2023, at the lower level (Municipal Courtroom) of the Public Safety Building located at 705A Kinderkamack Road, River Edge, NJ 07661 at which time and place bids will be opened and read aloud; and BE IT FINALLY RESOLVED that said advertisement shall be published in the Friday, June 30, 2023, issue of the Record in accordance with the Local Public Contracts Law. ******** #23-213 Approval to Submit a Grant Application and Execute a Grant Agreement with the New Jersey Department of Transportation for the 2024 Municipal Aid Application - Bogert Road Improvement, Section 8 WHEREAS, the Borough of River Edge continues to develop projects that will improve access and maintenance on public roads; and WHEREAS, the Borough of River Edge’s Engineering Department has provided plans specifically designed to address and improve traffic flow/safety issues and maintenance on our roads; and WHEREAS, the Borough of River Edge has submitted plans to the State of New Jersey, Department of Transportation for Municipal Aid and will continue to do so in the future; and WHEREAS, the Borough of River Edge has identified Bogert Road, Section 8 in desperate need of repair. NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough of River Edge, in the County of Bergen, State of New Jersey formally approve the grant application for Bogert Road $ $1,661,197.80; and BE IT FUTHER RESOLVED that the Mayor and Clerk are hereby authorized to submit an electronic grant application identified as MA-2024-Bogert Road (Section 8)-00374, River Edge Borough, Bogert Road, Section 8, Application # MA-2024-00374 to the New Jersey Department of Transportation on behalf of the Borough of River Edge; and BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to sign the grant agreement on behalf of the Borough of River Edge and that their signature constitutes acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement; and BE IT FINALLY RESOLVED that the Borough Clerk’s signature and the Municipal seal serve to acknowledge this resolution and constitute acceptance of the terms and conditions of the grant agreement and approve the execution of the grant agreement as authorized by this resolution. ******** #23-214 Payment of Bills Council President Kaufman read resolution #23-214 into the record: #23-214 Payment of Bills At a Regular Meeting of the Mayor and Council of the Borough of River Edge, County of Bergen, State of New Jersey, held on June 26, 2023. BE IT RESOLVED, that the Mayor and Council of the Borough of River Edge approve the following expenditures. OLD BUSINESS – There was no Old Business. PUBLIC COMMENTS – Motion by Councilman Benson, second by Councilman Chinigo, and all members present voting in favor, to open public comments. Frank Longo, 145 Webb Ave, commented that he lives on the corner of Webb Avenue and Bogert Road and noted there are no curbs on Bogert. He inquired whether any work will take place to address this issue. Borough Administrator Aportela explained that, although a grant application was authorized on tonight’s agenda for sidewalks, curbs and paving on Bogert Road from Kensington to Continental, the actual length of Bogert that will be completed is dependent on the grant amount. As such, she advised that she is unable to give a timeframe for when the area that Mr. Longo specified would be reached. Mr. Longo advised that he has only seen the street sweeper sweep both sides of the street one time on Bogert when school was not in session. He inquired whether alternate side of the street parking can be implemented or parking restrictions put in place in the morning so that the streets can be cleaned more frequently. Borough Administrator Aportela is to speak with the DPW Superintendent regarding this issue tomorrow. Mr. Longo was asked to contact the Borough Administrator tomorrow for an update. Jane Lampmann, 353 Valley Road, advised that she was looking to attend the Board of Health meeting this evening. Ms. Lampmann was directed to the Borough website to find the meeting link. Motion by Councilwoman Malellari, second by Councilwoman Kinsella, and all members present voting in favor, to close public comments. COUNCIL COMMENTS – Councilman Benson thanked Council President Kaufman for stepping into Mayor Papaleo’s role this evening. Council President Kaufman thanked Mr. Shahdanian for attending tonight’s meeting in Borough Attorney Sarlo’s absence. She wished everyone a happy 4th of July. ADJOURNMENT – There being no further business to come before the Mayor and Council, on a motion by Councilman Chinigo, second by Councilman Benson, and unanimously carried, to adjourn this meeting.
