MINUTES Mayor and Council Regular Meeting September 14, 2023 7:00 P.M. CALL TO ORDER – A Regular Meeting of the Mayor and Council of the Borough of River Edge was held virtually via Zoom. The meeting was called to order at 7:00 p.m. by Mayor Thomas Papaleo. SILENT PRAYER – FLAG SALUTE Mayor Papaleo asked for a moment of silence for those who are suffering or have passed away due to cancer and their families as well as those who are suffering from or lost someone due to the flood in Libya and earthquake in Morrocco. Mayor Papaleo led those present in a salute to the flag. STATEMENT OF COMPLIANCE - Mayor Papaleo read the Statement of Compliance into the record as follows: Statement of Compliance with Open Public Meeting Act: This meeting complies with the Open Public Meeting Act by notification on January 9th of this location, date and time to the Town News and the Record and by posting of same on the municipal bulletin board and Borough website and filing a notice of the same with the Municipal Clerk. DPW Superintendent Jason Milito CFO Chris Battaglia APPROVAL OF MINUTES – On a motion by Council President Kaufman, seconded by Councilwoman Montisano-Koen, with Councilwoman Montisano-Koen abstaining from the Minutes of August 14, 2023 and all other members present voting in favor, that the Minutes of the Mayor and Council Regular and Closed Session Meeting of August 14, 2023 and Mayor and Council Special and Closed Session Meeting of September 5, 2023 are hereby approved PROCLAMATIONS & AWARDS Proclamation JS Taekwondo Center’s National Championships Master Yun thanked the governing body for showcasing the JS Taekwondo Center’s students and their achievements today. He commented that this facility has been in River Edge for 9 years now and they are in the process of taking on 464 Kinderkamack Roa d which is a much larger facility. Proclamation Declaring September 15 – October 15, 2023 as Hispanic Heritage Month Mayor Papaleo read the following proclamation into the record: PROCLAMATION WHEREAS, more than fifty years after the United States first observed what was then National Hispanic Heritage Week, Hispanics represent a vibrant and thriving part of our diverse nation; their histories and cultures stretch across centuries, and the contributions of those who come to our shores today in search of their dreams continue to add new chapters in our national story; and WHEREAS, America has always drawn its strength from the contributions of a diverse people and throughout our nation, Hispanics are advancing our economy, improving our communities and bettering our country; and WHEREAS, during National Hispanic Heritage Month, we renewed our commitment to ensuring ours remains a society where the talents and potential of all its members can be fully realized; and WHEREAS, Hispanic Heritage Month is a time to honor the rich heritage of the Hispanic community and celebrate its countless achievements as we celebrate the rich and vibrant traditions of Faith, Family, Hard Work and Patriotism within their communities. NOW, THEREFORE, I, Thomas Papaleo, Mayor of the Borough of River Edge do hereby proclaim:  September 15 – October 15, 2023 as Hispanic Heritage Month As we honor the contributions of the Hispanic Community to our Borough. Proclamation Declaring the Month of September 2023 as Prostate Cancer Awareness Month Mayor Papaleo read the following proclamation into the record: PROCLAMATION Whereas, this year, approximately 288,300 men will be diagnosed with prostate cancer in the United States alone – one man every 2 minutes, and roughly 34,700 will die this year from the disease, about 3,500 more than 2020 – which is one man every 15 minutes; and Whereas, in New Jersey, an estimated 9,460 new cases of prostate cancer will be diagnosed and an estimated 730 deaths will occur in 2023; and Whereas, men with relatives – father, brother, son – with a history of prostate cancer are twice as likely to develop the disease; and Whereas, prostate cancer is the most commonly diagnosed cancer in American Men and the third leading cause of cancer death behind lung and colon cancer; and Whereas, 1 in 8 men are diagnosed with prostate cancer in their lifetime and 1 in 6 African American men will develop prostate cancer in their lifetime. Overall, African American men are 1.7 times more likely to be diagnosed with - and 2.1 times more likely to die from - prostate cancer than white men; and Whereas, veterans who were exposed to herbicides like Agent Orange are at increased risk for developing prostate cancer, and are more likely to have an aggressive form of the disease; and Whereas, education regarding prostate cancer and early detection strategies is critical to saving lives, preserving, and protecting our families. As well as the economic and social burden of prostate cancer is huge on families; and Whereas, if caught early prostate cancer has a five-year survival rate of nearly 100%. However, for late stage prostate cancer the five-year survival rate is 31%; and Whereas, many more men will be diagnosed in 2023 at a later stage because of delayed screenings and treatment due to Covid-19 and Whereas, all men are at risk for prostate cancer and we encourage the citizens of River Edge to increase the importance of prostate awareness and screenings. Now, Therefore, Be It Resolved, I, Thomas Papaleo, Mayor of the Borough of River Edge do hereby proclaim: September 2023 as Prostate Cancer Awareness Month Proclamation Declaring the Month of September 2023 as Childhood Cancer Awareness Month Mayor Papaleo read the following proclamation into the record: PROCLAMATION WHEREAS, September is designated as Childhood Cancer Awareness Month, a time to honor and remember children and families affected by these rare diseases, and help rally support to give kids with cancer better outcomes; and; WHEREAS, 15,780 children under the age of 21 are diagnosed with cancer every year and approximately ¼ of them will not survive the disease; and WHEREAS, a cancer diagnosis turns the lives of the entire family upside down and the objective of Childhood Cancer Awareness Month is to put a spotlight on the types of cancer that largely affect children and survivorship issues; and WHEREAS, during the month of September, 25,000 families around the world will get the horrible news that their child or teen has cancer and 6,667 families will experience the loss of a child; and WHEREAS, childhood cancer is not just one disease but is made up of a dozen types and countless subtypes of cancer that spares not socioeconomic, ethnic, racial or geographic class; and WHEREAS, cancer kills more children than AIDS, asthma, cystic fibrosis, diabetes and muscular dystrophy combined and despite the major advances in treatment, research is vastly and consistently underfunded. NOW, THEREFORE, BE IT RESOLVED, that I, Thomas Papaleo, Mayor of the Borough of River Edge and on behalf of the Council do proclaim: September 2023 as Childhood Cancer Awareness Month Mayor Papaleo stated that the governing body’s hearts go out to all the families who have to watch their child or sibling suffer, recognizing that their suffering is not only sympathetic but empathetic as well. He expressed his hope that, through raised public awareness, Congress and other organizations will direct additional funding to childhood cancer needs. PUBLIC COMMENTS ON ANY ITEM ON THIS AGENDA – On motion by Councilman Benson, seconded by Council President Kaufman, and all present voting in favor, to open for public comments on any item on the agenda. Toni Pasqualicchio, 92 Surrey Lane, thanked the governing body for setting up the pickleball court. She expressed her belief that the court is being vandalized. Mayor Papaleo explained that the tape came up due to the weather and it will be repaired by tomorrow. Ms. Pasqualicchio requested that the rules be updated to make it clear that vandalism will not be tolerated. She also requested that the hours be made the same as those for tennis. Mayor Papaleo advised that the Police Department will keep an eye on this situation. He requested that the pickleball hours be listed for reconsideration under Old Business on the September 28th agenda. On a motion by Councilwoman Montisano-Koen, seconded by Councilman Benson, and all present voting in favor, to close public comments on any item on the agenda. APPOINTMENTS & PERSONNEL CHANGES – On motion by Council President Kaufman, seconded by Councilwoman Montisano-Koen, and all members present voting in favor, to approve the following appointments and personnel changes: Approve the resignation of Milo Fondanarosa, Summer Help in the Department of Public Works effective August 24, 2023. Approve the resignation of Gail Menkes, Police Crossing Guard effective August 17, 2023. Approve the resignation of Paul Hemmendinger, Probationary Laborer in the Department of Public Works effective August 25, 2023. Approve the extension of the probationary period for Matthew Farley, Laborer in the Department of Public Works to November 12, 2023. Approve the re-hire of Hayden Hernandez as temporary intern to sort files stored offsite for the Borough Clerk’s Office, at an hourly rate of $15.00, up to 10 hours per week effective September 15th through November 15, 2023. MONTHLY REPORTS – Mayor Papaleo advised that the following reports are on file in the Office of the Borough Clerk and available for review: Library Board - September 2023 Tax Collector - August 2023 FIRST READING – ORDINANCES – Ordinance #23-16 - #23-17 Motion by Councilwoman Montisano-Koen that the following ordinances be introduced and passed on first reading and setting September 28, 2023 at 7:00 p.m. or as soon thereafter as the as the matter can be heard as the date and time and Zoom as the virtual platform for a hearing on said ordinance. Second by Councilman Benson. Mayor Papaleo read the titles of the ordinances into the record: Ordinance #23-16 – An Ordinance Amending and Supplementing the Revised General Ordinances of the Borough of River Edge, Chapter 400, “Vehicles and Traffic” Ordinance #23-17 – An Ordinance Amending Chapter 308 in the Revised General Ordinances of the Borough of River Edge, Entitled ‘Parks and Public Lands’ Borough Clerk Dodd explained that Ordinance #23-16 updates the prohibited parking during certain hours restriction on Bogert Road to account for the double sidewalk area that was extended from the DOT funded sidewalk improvements in this area. This amendment will allow additional vehicles to pull up along the curb line to drop off and pick up students. With respect to Ordinance #23-17, Borough Clerk Dodd advised that this ordinance codifies the start time for use of the tennis courts and updates the park permit process, noting that this portion of the Borough Code has not been updated since 1985. Ordinance #23-12 – An Ordinance Amending the New Chapter in the Revised General Ordinances of the Borough of River Edge Entitled ‘Filming’ Ordinance #23-13 – An Ordinance to Amend Chapter 206 of the Revised General Ordinances of the Borough of River Edge Entitled ‘Fees’ Ordinance #23-14 – An Ordinance Creating a New Chapter in the Revised General Ordinances of the Borough of River Edge Entitled ‘Prohibition of Domestic Fowl & Roosters’ Ordinance #23-15 – An Ordinance Amending Chapter 65 in the Revised General Ordinances of the Borough of River Edge, Entitled ‘Officers and Employees Public Comments on Ordinances 23-12 through 23-15 Motion by Councilman Benson, second by Council President Kaufman, and all members voting in favor, to open the floor to the public on Ordinance #23-12 through 23-15. Borough Clerk Dodd explained that Ordinance #23-12 is being adopted at the request of the NJ Filming Commission. As studios already pay for location fees, concerns were raised that the daily filming fee to film on private property was too high and would deter studios from filming in the Borough. After consideration by the Legal Review & Ordinance Committee, it was decided to reduce these fees by fifty percent. She advised that the purpose of Ordinance #23-13 is to update the fees for all Recreation programs and activities. She explained that this increase is required due to the rising costs of running the programs such as increased maintenance costs for Borough facilities and the increased cost for the required liability insurance. She noted that a thorough evaluation of the trust funds found that some programs were running in the negative and these increased fees will allow programs to be self-sustaining. She noted that organizations which have opened their fall registrations already will not be charged the new fees until 2024. Borough Clerk Dodd explained that Ordinance #23-14 was recommended by the Board of Health and the purpose is to prohibit domestic fowl and roosters as a matter of public health and safety. The purpose of Ordinance #23-15 is to update the purchasing responsibilities of the Borough Administrator to comply with recently updated legislation. No one came forward. Motion by Council President Kaufman, second by Councilwoman Montisano-Koen, to close the floor to the public on Ordinance #23-12 through #23-15. Councilwoman Montisano-Koen noted that it has been more than a decade and a half since the Recreation fees had been updated. Motion by Council President Kaufman, second by Councilman Benson, that Ordinance #23-12 through #23-15 be passed on second and final reading and are hereby adopted and notice of same shall be published according to law. BE IT FURTHER RESOLVED, that the appointment date is predicated on passing a physical examination. ******** #23-260 Resolution of Certification of the Annual Audit WHEREAS, N.J.S.A. 40A:5-4 requires the Governing Body of every local unit to have made an annual audit of its books, accounts and financial transactions; and WHEREAS, the Annual Report of Audit for the year 2022 has been filed by the Registered Municipal Accountant with the Municipal Clerk pursuant to N.J.S.A. 40A:5-6, and a copy has been received by each member of the Governing Body; and WHEREAS, R.S. 52-27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs; and WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6-5, a regulation requiring that the governing body of each municipality shall, by resolution, certify to the Local Finance Board of the State of New Jersey that all members of the Governing Body has reviewed, as a minimum, the sections of the annual audit entitled “Comments and Recommendations”, and WHEREAS, the members of the governing body have personally reviewed, as a minimum, the Annual report of Audit, and specifically the sections of the Annual Audit entitled “Comments and Recommendations”, as evidenced by the group affidavit form of the Governing Body attached hereto; and WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the annual audit, pursuant to N.J.A.C.5:30-6-5; and WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board; and WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New Jersey may subject the members of the local Governing Body to the penalty provisions of R.S. 52:27BB-52, to wit:  R.S. 52:27BB-52: A local officer or members of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fined not more than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office. Status/Date Completed: Completed – August 2023 ******** #23-262 Approval to Waive a Portion of the Police Outside Duty Rate for Bergen County Historical Society WHEREAS, the Bergen County Historical Society will host an event celebrating Major General Baron Von Steuben (Baronfest) at Historic New Bridge Landing on Saturday, September 30, 2023; and WHEREAS, the Bergen County Historical Society has requested one (1) uniformed officer for the duration of the event; and WHEREAS, the Bergen County Historical Society has made an appeal to the Mayor and Council to waive the administrative fee portion of the $135.00 per hour rate and be billed for the officer’s overtime rate; and WHEREAS, the Mayor and Council have discussed this matter at their meeting of August 14, 2023 and have indicated that the outside duty rate of $135.00 be waived and that the actual overtime rate of the police officer assigned to that duty be charged. NOW, THEREFORE, BE IT RESOLVED that the Police Department and the Chief Financial Officer are instructed to adjust their billing accordingly and to notify the Bergen County Historical Society of the fee to be paid for the services provided. #23-263 Authorize Tax Collector to Refund 3rd Quarter 2023 Tax Overpayments WHEREAS, the tax office has received duplicate and/or tax overpayments for the 3rd Quarter 2023 taxes on the following properties; and WHEREAS, a written request was received from their mortgage company to refund the overpaid amount directly to the mortgage company. Food insecurity can affect anyone, whether they are recently unemployed, underemployed, or supporting a large family; and WHEREAS, food insecurity is a symptom of broader challenges, such as unemployment, disability, retirement or unforeseen financial hardships; and  WHEREAS, those who do not have their basic needs met are further hampered in their path toward self-sufficiency; and WHEREAS, ongoing economic instability has increased food insecurity amongst individuals and families throughout Bergen County and across the country; and WHEREAS, food pantries in Bergen County have experienced an approximately 22% increase in need for food assistance compared to last year, and a 40% increase in need from the unprecedented levels seen in 2020 due to the COVID-19 pandemic; and WHEREAS, there are residents in every municipality in Bergen County who receive SNAP benefits, illustrating that this is an issue impacting residents all across Bergen County; and WHEREAS, the economic coattails of the pandemic are long, and despite the end of Federal and state emergency declarations, tremendous need still exists within our community; and WHEREAS, the Bergen County Food Security Task Force was established to support food pantries in Bergen County by increasing the supply of healthy food options, connecting those in need to vital services, and investing in long term infrastructure to build a more resilient pantry network to ensure no one in Bergen County goes hungry; and WHEREAS, the Bergen County Food Security Task Force has been incorporated into the Department of Human Services as the new Office of Food Security to reaffirm that the county’s commitment to fighting hunger continues past the pandemic; and WHEREAS, the energy, philanthropy, and hands-on efforts of a multitude of volunteers throughout the county make a tremendous impact in combatting hunger in our community, and are vital in meeting the struggles of our neighbors with compassion; and WHEREAS, the Borough of River Edge is fortunate to host the St. Peter’s Food Pantry within our municipality; and NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council hereby recognizes the month of September 2023 as “Hunger Action Month” in the Borough of River Edge, and encourages all Bergen County residents to support their local food pantries. BE IT FURTHER RESOLVED that this Mayor and Council is committed to ending hunger in Bergen County and will spread awareness and increase engagement in our community to solve this problem. ******** #23-265 Award Contract – River Edge Police Department – HVAC Replacement WHEREAS, on Wednesday, August 9, 2023, at 11:00 a.m., six bids were submitted at the date and time specified for the River Edge Police Department – HVAC Replacement and the Borough Administrator did open and read each bid aloud; and WHEREAS, the Borough Architect has reviewed the base bid as submitted by McCloskey Mechanical in the amount of $254,017 and has recommended the bid and be awarded to McCloskey Mechanical; and WHEREAS, Chief Financial Officer Chris Battaglia has certified funds are available for this project.  NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of River Edge that a contract for the River Edge Police Department – HVAC Replacement shall be awarded to McCloskey Mechanical, having its principal office at 445 Lower Landing Road in Blackwood, NJ 08012 in the amount of $254,017 based on the bid submitted on August 9, 2023; and BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby authorized to sign said contract on behalf of the Borough of River Edge. ******** #23-266 Approve the Appointment of Crossing Guard BE IT RESOLVED by the Governing Body of the Borough of River Edge that William Levine be and he is hereby appointed as a part-time School Crossing Guard at an hourly probationary rate of $18.00 with a six-month probationary period. BE IT FURTHER RESOLVED, that the appointment date is predicated on passing a physical examination. ******** #23-267 Authorize Tax Collector to Adjust 2023 Final Tax Bills Due to County Board Judgments WHEREAS, County Board Judgments were entered on 4/5/23 and 8/2/23 and received by the tax office on 7/7/23 and 8/15/23 for the year 2023 reducing the Assessed Value on the following properties; and WHEREAS, the reductions were not reflected in the 2023 Extended Tax Duplicate. NOW, THEREFORE, BE IT RESOLVED the Tax Collector apply the tax credits to the 4th Quarter 2023 and the Preliminary 2024 taxes and adjust her records accordingly. OLD BUSINESS – Environmental Protection Commission/Green Team request to meet in person Council President Kaufman reported that she met with David Kraft, Co-Chair of the Environmental Protection Commission (EPC), and conducted a practice Zoom meeting. She advised that he will take over the responsibility of running Zoom, and such, the request from EPC to meet in person has been withdrawn. PUBLIC COMMENTS – Motion by Councilwoman Montisano-Koen, second by Councilman Benson, and all members present voting in favor, to open public comments. No one came forward. Motion by Council President Kaufman, second by Councilman Benson, and all members present voting in favor, to close public comment. Mayor Papaleo requested that Jason Milito, DPW Superintendent, provide an update on construction projects. Superintendent Milito advised that Bogert Road 5 & 6, a DOT funded project, is in the process of being closed out. He reported that this weekend the contractor will be completing the topsoil and hydroseed. Due to both the road and the trenching by PSE&G needing to settle, he noted that this road will be paved next year. The 2022 CDBG Sidewalk Replacement at Oxford Terrace commenced last week and will be completed by the end of September. Superintendent Milito noted that the project is progressing well. The Voorhis Drainage Improvements project is approximately halfway complete. He explained that the structures being delivered from the plant are coming in slowly which has slowed down the project. He commented that the system was flowing beautifully with the storm last week, explaining that it is connected to the overflow pipe. He advised that they are awaiting the 200,000 gallons of storage to be installed which he commented, once completed, will also alleviate problems around Memorial Park. He reported that the Elm ditch is also being addressed in-house by the DPW as part of this project, explaining that it is being stoned and opened up to ensure that water flows to the new structures. As the Voorhis Drainage Improvements project has slowed down, the contractor has begun the Fenway Drainage Improvements project which is anticipated to be completed by the end of September. The 2023 ADA Ramps and Sidewalk Replacement & Swim Club and KBG Parking Lot Improvements project is currently underway. The ADA ramps and sidewalk replacement portion of the project is anticipated to be completed by the beginning of October and the portion involving KBG is anticipated to be completed by the beginning of November. With respect to Voorhis, Superintendent Milito reported that the sidewalks will be addressed next spring as there will be settling over the winter. In regard to the pickleball courts, he explained why the tape is coming up and advised that the DPW will continue to make repairs as needed until the nets are taken down in November. DPW Superintendent Milito finished by commending PSE&G for accommodating the Borough’s needs with respect to the various projects that are underway. COUNCIL COMMENTS – Councilwoman Montisano-Koen announced that the Library will be closed on September 26th due to the installation of a natural gas generator. The meeting was adjourned at 7:48 p.m. Respectfully submitted, Anne Dodd, RMC Borough Clerk  BOROUGH OF RIVER EDGE ORDINANCE NO. 23-17 AN ORDINANCE AMENDING CHAPTER 308 IN THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF RIVER EDGE, ENTITLED ‘PARKS AND PUBLIC LANDS’ BE IT ORDAINED by the Mayor and Council of the Borough of River Edge, County of Bergen, State of New Jersey, as follows: Section 1. Section 308-2 entitled “Hours of use” is amended by the following: Remove: No person on or within public land owned by the Borough of River Edge shall consume, possess, sell, serve, deliver, distribute, expose for sale or give away any alcoholic beverage without permission of the Borough of River Edge. Add: A. No person on or within public land owned by the Borough of River Edge shall consume, possess, sell, serve, deliver, distribute, expose for sale or give away any alcoholic beverage without permission of the Borough of River Edge. B. The use of the Tennis Courts is permitted no earlier than 8:00am and the use is subject to the rules and regulations established by the Department of Recreation and Cultural Affairs. Use of the courts before 8:00am and/or any violation of the established rules and regulations will result in the loss of the membership of using the Tennis Courts as well as the penalties stipulated in Section 308-13. Section 2. Section 308-2 entitled “Permits” is amended by the following: Remove: A. A person or group seeking issuance of a permit hereunder shall file an application in triplicate with the Borough Clerk. The application shall state: (1) The name and address of the applicant. (2) The name and address of the person(s) sponsoring the activity, if any. (3) The days and hours for which the permit is desired. (4) The area or public land, or portion thereof, for which such permit is desired. (5) An estimation of the anticipated attendance.  (6) Any other information which the Borough Clerk shall find reasonably necessary to a fair determination as to whether a permit shall be issued. Upon approval of application, which shall be signed by the Borough Clerk or the Deputy Borough Clerk, one copy shall be filed with the Police Department, one copy shall be forwarded to the applicant and one copy shall remain on file in the office of the Borough Clerk in the Borough of River Edge. Nothing herein shall be read to require the application for a permit for organized, officially sanctioned Borough activities. (7) A permit to do any act shall authorize the same only insofar as it may be performed in strict accordance with the terms and conditions thereof. Any violation of the permit holder or his agents or employees of any term or condition thereof shall constitute grounds for its revocation by the Borough of River Edge or by its authorized representative, whose action therein shall be final. In the case of any revocation of any permit or moneys paid for or account thereof shall, at the option of the Borough Clerk, be forfeited. Forfeit and retention of such moneys shall not in any manner relieve such persons from personal liability or punishment for any violation of any municipal ordinance, rule or regulation or any violation of the laws of the State of New Jersey. Add: A person or group seeking issuance of a permit hereunder shall file an application with the Director of Recreation and Cultural Affairs online via Community Pass. All applicants must complete a hold harmless agreement and provide proof of insurance at the time of application. Residents seeking a permit must provide a copy of their homeowner’s or renter’s insurance policy declaration page. Organizations must provide a certificate of liability insurance naming the Borough of River Edge as an additional insured with limits carried of at least $1,000,000. Fees will be assessed in accordance with the “Recreation Department fees” enumerated in Section 206-2(JJ) and must be paid at the time of application. Section 3. Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms hereof are hereby repealed to such extent as they are so in conflict or inconsistent. Section 4. In case any article, section or provision of this ordinance shall be held invalid in any court of competent jurisdiction, the same shall not affect any other article, section or provision of this ordinance except insofar as the article, section or provision so declared invalid shall be inseparable from the remainder or any portion thereof. Section 5.
