MINUTES Mayor and Council Regular Meeting November 13, 2023 7:00 P.M. CALL TO ORDER – A Regular Meeting of the Mayor and Council of the Borough of River Edge was held virtually via Zoom. The meeting was called to order at 7:01 p.m. by Mayor Thomas Papaleo. SILENT PRAYER – FLAG SALUTE Mayor Papaleo asked for a moment of silence for those who are dying and suffering in the Middle East, especially for those who are trying to find a resolution. He then led those present in a salute to the flag. STATEMENT OF COMPLIANCE - Mayor Papaleo read the Statement of Compliance into the record as follows: Statement of Compliance with Open Public Meeting Act: This meeting complies with the Open Public Meeting Act by notification on January 9th of this location, date and time to the Town News and the Record and by posting of same on the municipal bulletin board and Borough website and filing a notice of the same with the Municipal Clerk. ROLL CALL PRESENT: Councilman Chinigo, Council President Kaufman, Councilwoman Montisano-Koen, Councilwoman Kinsella, Councilwoman Malellari, Councilman Benson and Mayor Papaleo. ABSENT: None. ALSO PRESENT: Borough Administrator Lissette Aportela Borough Attorney Thomas Sarlo, Esq. Council-Elect Glass PRESENTATIONS – Historic Commission – QR codes on street signs Eric Model, 178 Bogert Road, and Jim Hoogstrate, 402 Windsor Road, were present on behalf of the Historic Preservation Commission (HPC.) Mr. Hoogstrate presented a revised decal which included the wording “River Edge Historical Commission” as well as the Borough seal and name of the street. He advised that they kept it as a square decal as this shape would most likely be easier to secure than a more elongated decal. Some members of the governing body expressed their opinion that having a more rectangular shaped decal would be preferable to avoid the decal wrapping around the pole. It was requested that the cost for a rectangular decal be obtained to determine the cost difference between the two shapes. Chief Walker requested that the decals be periodically checked to ensure that another decal with inappropriate content has not been placed over this decal. He advised that, should it be observed that children are congregating around the signs and spilling over into the roadway, this issue may need to be revisited. He further advised that the decal may not be placed onto the sign itself. It was the consensus of the governing body to authorize the HPC to proceed with this project. The resolution that was prepared for this purpose will be added to the Consent Agenda as Resolution #23-310 and the resolution to authorize the bill list will become #23-311. It was questioned whether the DPW has been informed of this matter. Borough Administrator Aportela confirmed that the DPW Superintendent is aware conceptually and she will relay to him that this sticker has been approved. It was requested that HPC consult with the Board of Education to ensure that this project is one that they feel is safe for the students and could be included as part of their educational program. FOR DISCUSSION – SCORE Update Councilman Benson reported that, as SCORE is utilizing less space and days than are included in the lease with Temple Avodat Shalom, Borough Administrator Aportela will be looking to renegotiate the terms to better fit SCORE’s needs. He further reported that Henry and Carol Mah will be retiring at the end of the year, and as a result, there is a need for someone to take over the SCORE program. He noted that a part-time position within Recreation had been included in this year’s budget and expressed his opinion that this position should be filled as soon as possible. Borough Administrator Aportela advised that they were unsuccessful in finding a volunteer to consistently oversee the program. She further advised that, although this position was initially included in the budget, it was removed due to the Recreation Department being in flux. Should they start soliciting for this position now, she commented that it is not likely that someone will be in place before January. Should the decision be to proceed, she will notify the CFO that this position will need to be funded as of January. Questions arose as to whether additional responsibilities outside of SCORE would be assigned. The budget impact of adding this position was also questioned. Although SCORE would be the main responsibility, Borough Administrator Aportela noted that the employee would also assist with Cultural Affairs, planning and setting up events, and expanding programs. With respect to budget impact, she advised that this position would be 29 hours per week at a salary of $40,000 per year. She further advised that she will request an updated revenue and expenditure report from the CFO for distribution to the governing body. She confirmed that revenues are in good shape and stated that there have been no transfers to date which means the budget is consistent with estimates. It was the consensus of the governing body to move forward with soliciting for this position. Borough Administrator Aportela is to begin working with the Recreation Director on developing the job advertisement. Proposed Amendments to Chapter 400 of the Borough Code Chief Walker advised that he is recommending to move forward with no U-turns on Summit from Continental to Lincoln at all times. He confirmed that signage indicating the end of the prohibited U-turns can be placed on the northbound side of Lincoln to allow U-turns from that point to the Oradell border. With respect to the request for prohibited parking on Summit Avenue, he explained that this request is being made due to the change in drop off as cars are now doubling up and preventing emergency vehicles from gaining access to the street. He advised that they are looking to implement prohibited parking on the east side of Summit from 7 am to 9 am. With regard to the stop sign on Center Avenue, he confirmed that this road is a municipal road which gives the Borough the authority to place a stop sign at this location, noting that either the Borough Engineer or Traffic Engineer would simply need to sign off on it. Concerns were raised regarding Summit Avenue residents and the impact that this change may have on them. Chief Walker noted that this change is being implemented due to a public safety concern and noted that the residents do have long driveways which should be able to accommodate their vehicles. Notification to the impacted residents will be made by going door to door and warnings will be given before any summonses are issued. Chief Walker also provided a few updates regarding the Police Department. He noted that requests came from a resident on Center Avenue for a handicapped parking space in front of their property and line of sight improvements. While the line of sight issue was addressed, it was found that placing a handicapped space in front of their residence is not warranted. The governing body agreed not to proceed with placing a handicapped parking space in front of this property. Chief Walker advised that, with respect to accreditation, the building has been evaluated and Standard Operating Procedures have been updated. He acknowledged the efforts of Sgt. Zemaites in this regard. He detailed the process going forward which includes an interview in the spring and scheduling a formal presentation at which point the department is considered accredited. Mayor Papaleo commended Chief Walker for doing a great job together with Sgt. Zemaites. He also congratulated Chief Walker on the Safety Hero Award which will be presented at the AAA Community Traffic Safety Award Program Luncheon on November 30th. Chief Walker acknowledged Sgt. Diamond for making this award possible, detailing a few of the initiatives that have been undertaken. He also thanked the governing body for their support. He spoke to letters of commendation for Officer Piterski for his efforts regarding shoplifting at CVS and Officer Colucci for his compassion during a call as well as a thank you letter from Superintendent Danahy for the department’s role in obtaining the COPS grant. Mayor Papaleo congratulated all the officers involved and thanked the entire department for their commitment to the public. Request from Girl Scout Troop 97900 – Ornament Sale at Tree Lighting Ceremony Borough Administrator Aportela advised that the Girl Scouts are looking for permission to sell ornaments at the Tree Lighting Ceremony. As holding a sale at this event is not permitted, confirmation from the governing body is necessary for the organization to conduct this sale. She noted that the Girl Scouts are assisting the Recreation Department with this event. Concerns were raised as to whether granting this permission would set a precedent. Borough Attorney Sarlo opined that requests can be evaluated on a case-by-case basis and granting permission would not set a precedent. Councilwoman Kinsella added that the Recreation Commission discussed this request at their meeting and the members were in full support. It was the consensus of the governing body to grant this request. Miscellaneous Items Borough Administrator announced that the DPW Superintendent secured a $25,000 grant through the DEP to assist the Borough in meeting stormwater requirements. Mayor Papaleo noted that Council-Elect Glass is present this evening, and although the results have not been certified, he congratulated Council-Elect Glass on being elected to serve on the governing body. He explained that it is tradition to allow Council-Elect to be part of the dais and ask questions or make comments. Council-Elect Glass expressed that it is great to be on board and commented that he looks forward to working with everyone. PUBLIC COMMENTS ON ANY ITEM ON THIS AGENDA – On motion by Council President Kaufman, seconded by Councilman Chinigo, and all present voting in favor, to open for public comments on any item on the agenda. APPOINTMENTS & PERSONNEL CHANGES – On motion by Councilwoman Malellari, seconded by Councilman Benson, and all members present voting in favor, to approve the following appointments and personnel changes: Approve the salary increase of Matthew Farley, Department of Public Works from a Laborer, Step 1 salary of $46,350.00 to Laborer, Step 2 - $49,153.00 due to satisfactory completion of CDL licensing requirement, retroactive to October 2, 2023. Approve the retirement of Judy O’Connell, Deputy Borough Clerk, effective December 31, 2023. Approve the appointment of Aditi Puri to the Environmental Protection Commission as Alternate #2 through 12/31/24, effective November 13, 2023. Approve the salary increase of Anne Dodd, Borough Clerk/Assistant Administrator from an annual salary of $93,000 plus $7,500 stipend to $96,000.00 plus $7,500 stipend per the employment contract and resolution #22-359, effective November 29, 2023. Mayor Papaleo acknowledged Matthew Farley for completing the CDL licensing requirement, noting that it is not an easy task. Members of the governing body as well as the Borough Administrator and Borough Clerk recognized Judy O’Connell, Deputy Clerk, who is retiring at the end of this year. They commented on her incredible commitment to the Borough and expressed sincere gratitude for her many years of service, wishing her well on her retirement. MONTHLY REPORTS – Mayor Papaleo advised that the following reports are on file in the Office of the Borough Clerk and available for review: Fire Prevention - July – September 2023 Land Use Board - September 27, 2023 Historic Commission - October 2023 Tax Collector - October 2023 Library Board of Trustees - November 2023 #23-296 CAPITAL BUDGET AMENDMENT – Borough Administrator Aportela explained that this resolution is necessary due to the acceptance of the 2023 CDBG grant agreement. As the deadline for completion has been moved to June instead of December, she noted that waiting to include this amount in next year’s budget is not possible. She advised that 100% of the construction costs will be reimbursed through this grant with the Borough only being responsible for soft costs. She explained that the purpose of Ordinance #23-22 is to finance the CDBG project referenced earlier in the amount of $185,000. She noted that approximately $125,000 of this amount will be reimbursed through the CDBG grant. With respect to Ordinance #23-22, she advised that this ordinance amends the fee schedule to add a fee for the Running Club. OLD BUSINESS – Update on Construction Projects Borough Administrator Aportela reported on the following projects: Voorhis Drainage Improvements Project The contractor is finishing all the concrete work and restoration this week. The piping and chambers are in the ground and operational. The Borough Engineer will conduct a final inspection within 2 weeks. KBG/Swim Club Parking Lot The contractor started paving this morning and will continue tomorrow. Striping is expected to be completed by Wednesday. The Borough Engineer will conduct a final inspection within 2 weeks. Train Station Parking Lot The parking lot was paved this morning and is expected to be restriped tomorrow. This work is being completed at no cost to the Borough and is necessary due to the asphalt not binding. Borough Administrator Aportela noted that the extra level of asphalt will make for a stronger parking lot. The meeting was adjourned at 8:10 p.m. Respectfully submitted, Anne Dodd, RMC Borough Clerk  BOROUGH OF RIVER EDGE ORDINANCE #23-22 BOND ORDINANCE TO AUTHORIZE THE REPLACEMENT OF SIDEWALKS (INCLUDING CONSTRUCTION OF ADA RAMPS) AT RUTGERS PLACE (PHASE 2) IN, BY AND FOR THE BOROUGH OF RIVER EDGE, IN THE COUNTY OF BERGEN, STATE OF NEW JERSEY, TO APPROPRIATE THE SUM OF $185,000 TO PAY THE COST THEREOF, TO MAKE A DOWN PAYMENT, TO APPROPRIATE A FEDERAL GRANT, TO AUTHORIZE THE ISSUANCE OF BONDS TO FINANCE SUCH APPROPRIATION AND TO PROVIDE FOR THE ISSUANCE OF BOND ANTICIPATION NOTES IN ANTICIPATION OF THE ISSUANCE OF SUCH BONDS. BE IT ORDAINED by the Borough Council of the Borough of River Edge, in the County of Bergen, New Jersey, as follows: Section 1. The Borough of River Edge, in the County of Bergen, New Jersey (the "Borough") is hereby authorized to undertake the replacement of sidewalks (including construction of ADA ramps) at Rutgers Place (Phase 2) in, by and for said Borough. Said improvements shall include all work, materials and appurtenances necessary and suitable therefor. Section 2. The sum of $185,000 is hereby appropriated to the payment of the cost of making the improvements described in Section 1 of this ordinance (hereinafter referred to as "purpose"). Said appropriation shall be met from the proceeds of the sale of the bonds authorized, and the down payment and the Federal grant appropriated, by this ordinance. Said improvements shall be made as general improvements and no part of the cost thereof shall be assessed against property specially benefited. Section 3. It is hereby determined and stated that (1) the making of such improvements is not a current expense of said Borough, and (2) it is necessary to finance said purpose by the issuance of obligations of said Borough pursuant to the Local Bond Law (Chapter 2 of Title 40A of the New Jersey Statutes Annotated, as amended; the "Local Bond Law"), and (3) the estimated cost of said purpose is $185,000, and (4) $123,747 of said sum is to be provided by a Federal grant hereinafter appropriated, and (5) $2,923 of said sum is to be provided by the down payment hereinafter appropriated to finance said purpose, and (6) the estimated maximum amount of bonds or notes necessary to be issued for said purpose is $58,330, and (7) the cost of such purpose, as hereinbefore stated, includes the aggregate amount of $60,000 which is estimated to be necessary to finance the cost of such purpose, including architect's fees, accounting, engineering and inspection costs, legal expenses and other expenses, including interest on such obligations to the extent permitted by Section 20 of the Local Bond Law. Section 4. It is hereby determined and stated that the sum of $123,747 received or to be received as a grant from the Bergen County Community Development program, pursuant to the Federal Housing and Community Development Act, is hereby appropriated to the payment of the cost of such purpose. Section 5. It is hereby determined and stated that moneys exceeding $2,923, appropriated for down payments on capital improvements or for the capital improvement fund in budgets heretofore adopted for said Borough, are now available to finance said purpose. The sum of $2,923 is hereby appropriated from such moneys to the payment of the cost of said purpose. Section 6. To finance said purpose, bonds of said Borough of an aggregate principal amount not exceeding $58,330 are hereby authorized to be issued pursuant to the Local Bond Law. Said bonds shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law. All matters with respect to said bonds not determined by this ordinance shall be determined by resolutions to be hereafter adopted.  Section 7. To finance said purpose, bond anticipation notes of said Borough of an aggregate principal amount not exceeding $58,330 are hereby authorized to be issued pursuant to the Local Bond Law in anticipation of the issuance of said bonds. In the event that bonds are issued pursuant to this ordinance, the aggregate amount of notes hereby authorized to be issued shall be reduced by an amount equal to the principal amount of the bonds so issued. If the aggregate amount of outstanding bonds and notes issued pursuant to this ordinance shall at any time exceed the sum first mentioned in this section, the moneys raised by the issuance of said bonds shall, to not less than the amount of such excess, be applied to the payment of such notes then outstanding. Section 8. Each bond anticipation note issued pursuant to this ordinance shall be dated on or about the date of its issuance and shall be payable not more than one year from its date, shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law and may be renewed from time to time pursuant to and within limitations prescribed by the Local Bond Law. Each of said notes shall be signed by the Mayor and by a financial officer and shall be under the seal of said Borough and attested by the Borough Clerk or Deputy Borough Clerk. Said officers are hereby authorized to execute said notes and to issue said notes in such form as they may adopt in conformity with law. The power to determine any matters with respect to said notes not determined by this ordinance and also the power to sell said notes, is hereby delegated to the Chief Financial Officer who is hereby authorized to sell said notes either at one time or from time to time in the manner provided by law. Section 9. It is hereby determined and declared that the period of usefulness of said purpose, according to its reasonable life, is a period of ten years computed from the date of said bonds. Section 10. It is hereby determined and stated that the Supplemental Debt Statement required by the Local Bond Law has been duly made and filed in the office of the Borough Clerk of said Borough, and that such statement so filed shows that the gross debt of said Borough, as defined in Section 43 of the Local Bond Law, is increased by this ordinance by $58,330 and that the issuance of the bonds and notes authorized by this ordinance will be within all debt limitations prescribed by said Local Bond Law. Section 11. Any funds received from the County of Bergen, the State of New Jersey or any of their agencies or any funds received from the United States of America or any of its agencies in aid of such purpose (other than the Federal grant hereinbefore appropriated which shall be applied to the cost of such purpose, but shall not be applied to the payment of outstanding bond anticipation notes and the reduction of the amount of bonds authorized), shall be applied to the payment of the cost of such purpose, or, if bond anticipation notes have been issued, to the payment of the bond anticipation notes, and the amount of bonds authorized for such purpose shall be reduced accordingly. Section 12. The capital budget is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency therewith and the resolutions promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director, Division of Local Government Services, is on file with the Borough Clerk and is available for public inspection. Section 13. The Borough intends to issue the bonds or notes to finance the cost of the improvements described in Section 1 of this bond ordinance. If the Borough incurs such costs prior to the issuance of the bonds or notes, the Borough hereby states its reasonable expectation to reimburse itself for such expenditures with the proceeds of such bonds or notes in the maximum principal amount of bonds or notes authorized by this bond ordinance.  Section 14. The full faith and credit of the Borough are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this ordinance. Said obligations shall be direct, unlimited and general obligations of the Borough, and the Borough shall levy ad valorem taxes upon all the taxable real property within the Borough for the payment of the principal of and interest on such bonds and notes, without limitation as to rate or amount. Section 15. This ordinance shall take effect twenty days after the first publication thereof after final passage.
