MINUTES Mayor and Council Regular Meeting Monday, June 28, 2021 6:30 p.m. *Meeting held via Zoom CALL TO ORDER – Mayor Papaleo called the meeting to order at 6:30 p.m. in the courtyard outside of Borough Hall. SILENT PRAYER – FLAG SALUTE Mayor Papaleo called for a moment of silent prayer and led the salute to the flag. ROLL CALL – Councilwoman Busteed, Councilman Chinigo, Councilman Gautier, Councilwoman Kaufman, Councilwoman Kinsella, Councilwoman Montisano-Koen and Mayor Papaleo were present. On motion by Councilman Chinigo, seconded by Councilwoman Busteed, resolution #21- 199, #21-200 and #21-206 were approved unanimously. #21-199 Appoint Patrol Officer Domenic A. Pizzanelli WHEREAS, vacancies exist in the rank of Patrol Officer in the River Edge Police Department; and WHEREAS, the River Edge Police Department received 23 applications and conducted 12 screening interviews; and WHEREAS, the Mayor and Council interviewed 5 candidates on June 22, 2021; and WHEREAS, an eligibility list has been established ranking 4 of the aforementioned candidates. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of River Edge in the County of Bergen, New Jersey, that Domenic A. Pizzanelli is hereby appointed as Patrol Officer for the River Edge Police Department effective July 1, 2021 at an annual salary of $42,653 with a one year probationary period. June 28, 2021 ******** #21-200 Appoint Patrol Officer Maclane Doran WHEREAS, vacancies exist in the rank of Patrol Officer in the River Edge Police Department; and WHEREAS, the River Edge Police Department received 23 applications and conducted 12 screening interviews; and WHEREAS, the Mayor and Council interviewed 5 candidates on June 22, 2021; and WHEREAS, an eligibility list has been established ranking 4 of the aforementioned candidates. June 28, 2021 ******** #21-206 Establish Eligibility List – Police Department WHEREAS, vacancies exist in the rank of Patrol Officer in the River Edge Police Department; and WHEREAS, the River Edge Police Department received 23 applications and conducted 12 screening interviews; and WHEREAS, the Mayor and Council interviewed 5 candidates on June 22, 2021. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of River Edge in the County of Bergen, New Jersey, that an eligibility list is hereby established consisting of the following candidates: Maclane Doran -#2021-03245 Domenic A. Pizzanelli - #2021-03243 Ryan P. Reilly - #2021-03246 Jason S. Hall - #2021-03244 BE IT FURTHER RESOLVED, that the eligibility list is valid for up to 18 months, with an expiration date of December 28, 2022 or when the candidates are no longer available for consideration, whichever comes first; and BE IT FURTHER RESOLVED that the Mayor and Council reserve the right to extend the eligibility list for an additional 12 months. June 28, 2021 ******** Mayor Papaleo administered the Oath of Office to Domenic Pizzanelli and Maclane Doran. PROCLAMATIONS & AWARDS – Mayor Papaleo read the Proclamation Honoring Reverend Dennis TeBeest into the record as follows: PROCLAMATION WHEREAS, Reverend Dennis TeBeest has served as Pastor to the First Congregational Church and has been the congregation’s spiritual and moral leader since 2015; and WHEREAS, as spiritual leader of the First Congregational Church of River Edge, Reverend TeBeest has crafted and created meaningful worship services bringing his thoughtful and unique perspective to everything he does. During his tenure at FCC River Edge, he has fostered an emphasis on outreach to the community through such programs as Second Sunday, Loaves of Love, Habitat for Humanity, Family Promise, Local Food Pantry, Center for Food Action and Pumpkin Patch; and WHEREAS, Reverend TeBeest has brought new life and spirit to a growing Church School Program through his mentoring and encouragement of a new Minister of Faith Formation. With his expertise and experience in religious studies, he has enriched and enhanced Adult Bible Study opportunities, and the Confirmation Education Program. He has provided countless hours of counsel, ministry, and spiritual guidance to individuals and families facing challenges, as well as providing comfort and care through his visitation to ill and homebound members and friends; and WHEREAS, Reverend TeBeest took on the gargantuan task of motivating and overseeing a major capital campaign and facilities renovation with the focus on making our building barrier free and accessible to all. He initiated a kitchen renovation to create opportunities for future mission projects and ministry within the community; and WHEREAS, Reverend TeBeest continually fulfilled the needs of the Congregation and the Community in so many ways with his dynamic ability to engage and connect to all, for infusing new energy and excitement into this body of faith and for creating a new vision and setting us on a solid path to a bright future; and WHEREAS, the Borough wishes to express their thanks and gratitude to Reverend TeBeest who served River Edge through his participation in the River Dell Clergy Association and The River Edge Local Emergency Management Council and for his continuous support for our local civic and service organizations. ROLL CALL – Councilwoman Busteed, Councilman Chinigo, Councilman Gautier, Councilwoman Kaufman, Councilwoman Kinsella, Councilwoman Montisano-Koen and Mayor Papaleo were present. STATEMENT OF COMPLIANCE – Mayor Papaleo read the Statement of Compliance into the record as follows: Statement of Compliance with Open Public Meeting Act: This meeting complies with the Open Public Meeting Act by notification on January 8th of this location, date and time to the Ridgewood News and the Record and by posting of same on the municipal bulletin board and Borough Web Site and filing a notice of the same with the Municipal Clerk. APPROVAL OF MINUTES - On motion by Councilman Chinigo, seconded by Councilwoman Kaufman, the minutes of the Mayor and Council Regular Meeting of June 14, 2021 were approved unanimously. There was no motion on the minutes of the Mayor and Council Closed Session of June 14, 2021. The Closed Session minutes were moved to the next meeting. PROCLAMATIONS & AWARDS – Mayor Papaleo read the Proclamation Declaring the Month of June as National Gun Violence Awareness Month into the record as follows: PROCLAMATION WHEREAS, every day, 100 Americans are killed by gun violence and on average there are nearly 13,000 gun homicides every year; and WHEREAS, Americans are 25 times more likely to be murdered with guns than people in other developed countries; and WHEREAS, protecting public safety in the communities they serve is a Mayors’ highest responsibility; and WHEREAS, support for the Second Amendment rights of law-abiding citizens goes hand- in-hand with keeping guns away from dangerous people; and WHEREAS, we renew our commitment to reduce gun violence and pledge to do all we can to keep firearms out of the wrong hands and encourage responsible gun ownership to help keep our children safe. NOW, THEREFORE, I, Thomas Papaleo, Mayor of the Borough of River Edge, do hereby proclaim: The Month June, 2021 as National Gun Violence Awareness Month in the Borough of River Edge, and I encourage all citizens to support their local communities efforts to prevent the tragic effects of gun violence and to honor and value human lives. FURTHER, we honor and remember all victims and survivors of gun violence and declare that we as a country must do more to reduce gun violence. _________________________ Thomas Papaleo, Mayor Dated: June 28, 2021 Councilwoman Busteed-accepted the proclamation on behalf of the Borough. She said that this is the third or fourth year that the Borough has recognized National Gun Violence Awareness Month and thanked them for continuing to do so. PUBLIC COMMENTS ON ANY ITEM ON THIS AGENDA – On motion by Councilman Gautier, seconded by Councilwoman Kaufman to open for public comments on any item on the agenda was unanimously approved. There being no comments by the public, the motion by Councilwoman Montisano-Koen, seconded by Councilwoman Kinsella, to close public comments was unanimously approved. PUBLIC HEARING - Cherry Blossom Park Urban Parks Grant Application Lissette Aportela-explained that this is a 100% funded grant if awarded. The purpose of this grant is to improve the drainage issues at Cherry Blossom Park because we can’t move forward with any project until the drainage problem is corrected. On motion by Councilwoman Montisano-Koen, seconded by Councilman Gautier to open the public hearing on Cherry Blossom Park Urban Parks Grant Application was unanimously approved. There being no comments by the public, the motion by Councilwoman Kinsella, seconded by Councilwoman Kaufman was unanimously approved. Councilwoman Busteed-asked that Ms. Aportela reiterate that this application is for drainage and does not bind us to any other piece of it at this point. She said that the Green Team and Environmental Commission would like to have input during the planning stages. Lissette Aportela-explained that the main intent is to correct infrastructure issues and once they’re corrected whether borough is awarded the grant, the governing body has to consider whether to fund it through a capital budget. We first need to correct the drainage issues, then groups such as the Environmental Commission, Shade Tree, Recreation, Green Team will be invited to provide their wish lists and input and we can then evaluate what’s feasible. On motion by Councilwoman Busteed, seconded by Councilman Chinigo resolution #21- 192 was unanimously approved. #21-192 Urban Parks Initiative Enabling Resolution STATE OF NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION URBAN PARKS INITIATIVE ENABLING RESOLUTION WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (“State”), is providing grants through the Urban Parks initiative; and WHEREAS, the Borough of River Edge desires to further the public interest by obtaining grant funding in the amount of $485,000 from the State to fund the following project: CHERRY BLOSSOM PARK at a cost of $485,000. NOW, THEREFORE, the governing body resolves that Thomas Papaleo or the successor to the office of Mayor is hereby authorized to: (a) make application for such a grant, (b) provide additional application information and furnish such documents as may be required, and (c) act as the authorized correspondent of the above-named applicant; and WHEREAS, the State shall determine if the application is complete and in conformance with the scope and intent of the Urban Parks initiative, and notify the applicant of the amount of the funding award; and WHEREAS, the applicant is willing to use the State’s funds in accordance with applicable policies and laws, and is willing to enter into an agreement with the State for the above-named project; NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE Mayor and Council of the Borough of River Edge: 1. That Mayor Thomas Papaleo is hereby authorized to execute an agreement and any amendment thereto with the State known CHERRY BLOSSOM PARK; 2. That, in the event the State’s funds are less than the total project cost specified above, the applicant has the balance of funding necessary to complete the project; 3. That the applicant agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project; and 4. That this resolution shall take effect immediately. June 28, 2021 APPOINTMENTS & PERSONNEL CHANGES – On motion by Councilwoman Montisano-Koen, seconded by Councilwoman Busteed the Appointments & Personnel changes were unanimously approved as follows: The salary change of Judy O’Connell, Deputy Borough Clerk from $61,768.23 to $62,248.23 due to an increase in longevity from $1,440.00 to $1,920.00 effective July 6, 2021; The salary change of Patrick Diamond, Police Officer from an annual salary of $106,635.00 to Patrol Officer 11th Grade - $115,775.00 effective July 23, 2021; The hire of Camp Staff from June 28, 2021 through July 30, 2021 as per the list on file with the Borough Clerk’s office; The resignation of Ron Starace as Emergency Management Coordinator, effective June 6, 2021. MAYOR’S APPOINTMENT – The Mayor appoints Stuart Heinzinger as Emergency Management Coordinator at an annual salary of $10,000 effective June 28, 2021. ORDINANCES – 1ST READING – Mayor Papaleo read the title of Ordinance #21-22 into the record. Ordinance #21-22 AN ORDINANCE AMENDING AND SUPPLEMENTING THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF RIVER EDGE, CHAPTER 192, “DRUG- FREE ZONES” Lissette Aportela – explained that Ordinance #21-20 is an amendment to designate a crosswalk at the intersection of Howland and Kinderkamack so the Police Department can put a crossing guard there. On motion by Councilman Chinigo, seconded by Councilwoman Kinsella, the first reading of Ordinance #21-22 was unanimously approved as follows: BOROUGH OF RIVER EDGE ORDINANCE #21-22 AN ORDINANCE AMENDING AND SUPPLEMENTING THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF RIVER EDGE, CHAPTER 192, “DRUG-FREE ZONES” BE IT ORDAINED by the Mayor and Council of the Borough of River Edge, County of Bergen, State of New Jersey, as follows: Section 1. RESOLUTIONS – By Consent On motion by Councilwoman Montisano-Koen, seconded by Councilwoman Kinsella resolution #21-193 through #21-195, #21-197, #21-198, #21-201 through #21-205 were unanimously approved. #21-193 Resolution Permitting the Possession and Consumption of Alcoholic Beverages at a Block Party on Manchester Road WHEREAS, on or about June 14, 2021, the Borough of River Edge granted permission to Laura White, 180 Manchester Road, River Edge, New Jersey, to hold a block party on Manchester Road between Fifth Avenue and Elm Avenue on Saturday, July 17th from 1:00 p.m. to 10:00 p.m. (rain date Saturday, July 24th) in accordance with Borough Ordinance #1678; and  WHEREAS, Laura White has requested that the possession and consumption of alcoholic beverages be permitted in connection with said block party; and WHEREAS, Borough Code Section 114-15 allows the Governing Body to permit the possession and consumption of alcoholic beverages in or on a public street or sidewalk in connection with an authorized block party. NOW THEREFORE BE IT RESOLVED, by the Mayor and Council of the Borough of River Edge that persons age 21 and over be and hereby are permitted to possess and consume alcoholic beverages at the block party described above, on the date and time specified herein. June 28, 2021 ******** #21-194 Authorize Purchase of Radios for the River Edge Fire Department Under State Contract WHEREAS, the radios for the River Edge Fire Department was authorized in the 2021 capital budget; and WHEREAS, the Fire Chief, William Sanders investigated the options to purchase radios under a New Jersey State Bid contract; and WHEREAS, after evaluating the options for the purchase of the radios, the Fire Chief has recommended purchasing Motorola APX8000XE all band portable and APX 8500 tri band mobile radios and related accessories; and WHEREAS, the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-12, permits municipalities to purchase goods and services without advertising for bids, from companies under any contract or contracts for such goods or services entered into on behalf of the State by the Division of Purchase and Property in the Department of the Treasury, commonly referred to as “State Contracts”; and WHEREAS, the purchase of Motorola APX8000XE all band portable and APX 8500 tri band mobile radios, related accessories and installation, qualifies to be purchased using State Contract #83909, from Regional Communications of 64 East Midland Avenue in Paramus, NJ 07653, at a total cost of $98,318.10; and WHEREAS, Borough Administrator/Qualified Purchasing Agent, Lissette Aportela has verified that State Contract #83909, was awarded to Motorola Solutions on May 1, 2013 through April 30, 2022; and WHEREAS, Borough Administrator/Qualified Purchasing Agent, Lissette Aportela has verified that Regional Communications with Vendor ID V00001603 is an authorized vendor under aforesaid State Contract; and WHEREAS, Chief Financial Officer Chris Battaglia has advised that funding is available for this purchase from the 2021 capital budget. NOW THEREFORE BE IT RESOLVED, by the Mayor and Council of the Borough of River Edge that Fire Chief William Sanders is hereby authorized to purchase Motorola APX8000XE all band portable and APX 8500 tri band mobile radios, related accessories and installation under State Contract #83909 at a total cost of $98,318.10 from Regional Communications. June 28, 2021 ******** #21-195 Appoint Qualified Purchasing Agent WHEREAS, July 1, 2020, commenced the revision to the Local Public Contracts Law which created a bid threshold of $17,500 for municipalities without a Qualified Purchasing Agent or $44,000 for municipalities with a Qualified Purchasing Agent, and WHEREAS, the Borough of River Edge can save significant funds in its budget by having a Qualified Purchasing Agent, and  WHEREAS, via Resolution #R20-298, adopted on January 4, 2021, Borough Administrator, Lissette Aportela was appointed as the Borough’s “Temporary Purchasing Agent” for one year or until such QPA certification is obtained pursuant to N.J.S.A. 40A:11-9 (G); and WHEREAS, Ms. Aportela has obtained the Qualified Purchasing Agent Certification with Certification Number Q-2213, effective February 17, 2021. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of River Edge that Borough Administrator, Lissette Aportela, is hereby appointed as the Qualified Purchasing Agent for the Borough of River Edge. TABLED TABLED TABLED #21-196 Approve River Edge Fire Department Alcohol Policy BE IT RESOLVED by the Mayor and Council of the Borough of River Edge that the attached revised policy of the River Edge Fire Department concerning the consumption of alcoholic beverages is hereby approved. June 28, 2021 RIVER EDGE FIRE DEPARTMENT ALCOHOL POLICY ARTICLE I Purpose To establish a policy that regulated the consumption of alcoholic beverages by members of the River Edge Fire Department on within the buildings of River Edge Company One and River Edge Company Two. Establish procedures to follow when planning social events at either of the River Edge Fire Department buildings when alcohol will be served. Establish maximum parameters of alcohol consumption after department sanctioned Firematic events such as training exercises, company and department business meetings. Establish maximum parameters of alcohol consumption for social events that occur throughout the year. Establish recommended departmental disciplinary consequences for violations of the accepted alcohol policy. Establish Refreshment Committees for each fire company. ARTICLE II General Prohibitions 1. Any and all real property and Improvements occupied by or operated by the River Edge Fire Department is deemed to be a public and/or quasi public place in or upon which the storage, consumption, drinking, or offering to another for consumption or drinking any alcoholic beverage is prohibited. 2. Exceptions: The River Edge Fire Department commencing upon the adoption of a resolution by the Mayor and Council pursuant to Ordinance shall be permitted' to serve its members and invited guests at least twenty-one (21) years of age shall be permitted to consume alcoholic beverages In or upon the real property and Improvements occupied or operated by the River Edge Fire Department, but nevertheless only upon the following conditions: ARTICLE III Special/Social Events The Department shall seek permission from the Mayor and Council at the beginning of every calendar year to have social events where alcohol will be served. Examples of this will be annual events such as Old Timers Night, holiday parties, St Patrick’s Day. If a company decides to have a special event such as a retirement dinner, awards celebration etc. and plan to serve alcoholic beverages the following procedures are to be followed. 1. The alcohol will not be brought into the respective firehouse until the day of the event and will be removed from the respective firehouse within 24 hours after the start of the event. 2. The company hosting the event will be out of service one hour before the start of the event and will remain out of service until 6:00am the following morning. If the department is attending the event, the same off duty hours will be followed. 3. No such event shall be proposed or conducted except between the hours of 7:00 p.m. and 12:·00 midnight on a weekday or between 12:00 noon and 12:00 midnight on a Saturday, Sunday or legal or religious holiday but nevertheless for no longer than five (5) hours of alcoholic refreshment service per event. ARTICLE IV Special Circumstances, Unexpected Events If, during the course of the year there is an unscheduled or unexpected event, such as a funeral call of a company member, working fire, mutual aid officer meeting etc., the following shall apply: It will be the discretion of the senior civic or fire officer of the company to allow the refreshment committee member to open the beer and wine. The following parameters will be followed: 1. Only Beer, Wine and other non-alcoholic beverages (herein after “Refreshments”) may be served for up to 1 hour after the conclusion of the event. 2. The authority to allow Refreshments is delegated to the senior fire officer or the senior civic officer. 3. Refreshments will only be served by members of the refreshment committee of the respective company. At no time shall a non-refreshment committee member be behind the bar to serve said refreshments. 4. If no refreshment committee member is available for service of refreshments, the service of alcoholic refreshments will be prohibited. 5. Bringing your own beer, wine, or alcohol into either firehouse will be strictly prohibited. ARTICLE V Disciplinary Action Members of the department, regardless of rank who willfully violate the parameters of the REFD Alcohol policy will be immediately suspended from all Firematic and civic functions. The length of the suspension will be determined BY THE REFD alcohol policy committee within 72 hours of notification of violation. All disciplinary action will be in addition to penalties that may be imposed by statute, regulation and/or ordinance. ARTICLE VI  Responsibility Every member of the River Edge Fire Department is expected to take responsibility for their own personal behavior with regards to consuming alcohol in the firehouse. It is expected that members use proper judgment when answering alarms, riding or operating apparatus and equipment. It is also expected that every member be aware of the condition of our brother and sister firefighters, regardless of rank to ensure all members answering alarms or operating apparatus and equipment are capable of performing their tasks. It is expected that every member, when asked to surrender car keys, or not to ride the apparatus, do so without hesitation or argument. Every member of the department is to understand that our mission is not only to protect the life and property of the people of River Edge, but to ensure that our members stay safe and everybody goes home. ARTICLE VII In the event any section, part or provision of this policy is held unconstitutional or inconsistent with Borough Ordinance or otherwise invalid by the Mayor and Council or Court of competent jurisdiction, such determination shall not affect the validity of the remaining provisions which shall remain in full force and effect. ******** #21-197 Request Approval of Items of Revenue and Appropriation NJS 40A:4-87 WHEREAS, NJS 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount was not determined at the time of the adoption of the budget; and WHEREAS, the Director may also approve the insertion of an item of appropriation for equal amount, NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of River Edge in the County of Bergen, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2021 in the sum of $20,870.63, which is now available from “Clean Communities - 2021” in the amount of $20,870.63. She said that after the July 4th holiday, the Finance Committee will meet to discuss the applicable program that we can implement using this funding which involves a sewer replacement. She said that we’ll receive the same amount in 12 months. OLD BUSINESS – Cannabis Committee-No report PUBLIC COMMENTS – On motion by Councilwoman Kinsella, seconded by Councilman Gautier to open for public comments was unanimously approved. Michele Cariddi – 193 Wayne Avenue – asked if she could be included in the conversations that pertain to Cherry Blossom Park. She said that it would be wonderful if we received the grant and feels that since she’s been part of the park from the very beginning, she would like to continue to be a part of it. Mayor Papaleo-said that this park is a product of devotion by Michele Cariddi and the Beautification Committee. He continued to say that the park looks as nice as it does because of Michele. The Mayor thanked Michele for all her hard work. On motion by Councilwoman Busteed, seconded by Councilwoman Montisano-Koen to close public comments was unanimously approved. COUNCIL COMMENTS - Council President Chinigo-congratulated all of the Eagle Scouts from Troops 184 and 295 for attaining this momentous achievement. He said that these young men are committed to doing good deeds for the community and work towards the betterment of our society. He also congratulated the River Dell Class of 2021. He thanked Ron Starace for his service to the town an wished him luck in the future. He thanked Stu Heinzinger for stepping up and feels that he will be a terrific addition to that role. Council President Chinigo congratulated the two new police officers, Mr. Doran and Mr. Pizzanelli as they join our Police force and is sure they will be great assets to the department. Councilwoman Montisano-Koen-said that she’s worked very closely with Ron Starace over the past year and his devotion to River Edge will not be forgotten and he will be sorely missed. She also congratulated the Class of 2021 as well as the two new police officers who were sworn in this evening. Mayor Papaleo-concurs with the words of Council President Chinigo and Councilwoman Montisano- Koen. The Mayor offered a special word of thanks to Ron Starace former Chief of Police and Emergency Management Coordinator who has done a wonderful job and will be sorely missed. The Mayor thanked Stuart Heinzinger who is stepping up from the Deputy to the position of Coordinator. He said that Ron left Stuart in a good place to begin his term of service. The Mayor thanked both men for all that they’ve done.
