MINUTES Mayor and Council Special Meeting Monday, July 17, 2023 7:00 P.M. CALL TO ORDER – A Special Meeting of the Mayor and Council of the Borough of River Edge was held virtually via Zoom. The meeting was called to order at 7:00 p.m. by Mayor Thomas Papaleo. SILENT PRAYER – FLAG SALUTE Mayor Papaleo asked for a moment of silence for those who have died or have been displaced due to natural occurrences such as floods, fires, hurricanes, lightning, and tornadoes. He then led those present in a salute to the flag. STATEMENT – Mayor Papaleo read the Statement of Compliance into the record as follows: Statement of Compliance with Open Public Meeting Act: This meeting complies with the Open Public Meeting Act by notification on June 27, 2023 via Resolution #23-197 of this location, date and time to the Town News and the Record and by posting of same on the municipal bulletin board and Borough Web Site and filing a notice of the same with the Municipal Clerk. ROLL CALL PRESENT: Councilman Chinigo, Council President Kaufman, Councilwoman Montisano-Koen, Councilwoman Kinsella, Councilwoman Malellari, Councilman Benson and Mayor Papaleo. ABSENT: None ALSO PRESENT: Lissette Aportela, Borough Administrator Thomas Sarlo, Esq., Borough Attorney PUBLIC COMMENT Motion by Council President Kaufman, second Councilman Chinigo, and all members present voting in favor, to open the floor to the public. No one came forward. There being no public comments, on a motion by Councilwoman Malellari, second by Councilwoman Montisano-Koen, to close to the public. RESOLUTIONS - By Consent a. #23-222 Award Contract – FY22 CDBG Sidewalk Replacement at Oxford Terrace and Rutgers Place b. #23-223 Award Contract – The Fenway Drainage Improvement Project c. #23-224 Award Contract - 2023 ADA Ramps and KBG Parking Lot Improvement d. #23-225 Resolution Permitting the Possession and Consumption of Alcoholic Beverages at a Block Party on Berkeley Road e. #23-226 Authorize Purchase of Turnout Gear for the Fire Department Under State Contract f. #23-227 Confirmation of Commodity Resale System Registration Renewal g. #23-228 Approve Memorandum of Understanding – International Brotherhood of Teamsters, Local 125 Motion by Councilwoman Kinsella, second by Councilman Benson, that the Consent Agenda be approved. The vote was recorded as follows: Councilman Chinigo: aye Councilwoman Kinsella: aye Council President Kaufman: aye Councilwoman Malellari aye Councilwoman Montisano-Koen: aye Councilman Benson: aye ******* #23-222 Award Contract – FY22 CDBG Sidewalk Replacement at Oxford Terrace and Rutgers Place WHEREAS, on Wednesday, July 12, 2023, at 11:00 a.m., four bids were submitted at the date and time specified for the FY22 CDBG Sidewalk Replacement at Oxford Terrace and Rutgers Place and the Borough Administrator did open and read each bid aloud; and WHEREAS, the Borough Engineer has reviewed the bid as submitted by D&L Paving Contractors in the amount of $164,703.00 and has recommended the bid be awarded to D&L Paving Contractors; and WHEREAS, Chief Financial Officer Chris Battaglia has certified funds are available for this project. NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of River Edge that a contract for the FY22 CDBG Sidewalk Replacement at Oxford Terrace and Rutgers Place shall be awarded to D&L Contractors, having its principal office at 681 Franklin Avenue, Nutley, NJ 07110 in the amount of $164,703.00 based on the bid, submitted on July 12, 2023; and BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby authorized to sign said contract on behalf of the Borough of River Edge. ******* #23-223 Award Contract – Fenway Drainage Improvements Project WHEREAS, on Wednesday, July 12, 2023, at 10:30 a.m., three bids were submitted at the date and time specified for the Fenway Drainage Improvements Project and the Borough Administrator did open and read each bid aloud; and WHEREAS, the Borough Engineer has reviewed the bid as submitted by Matina & Son, Inc. in the amount of $200,000.00 and has recommended the bid be awarded to Matina & Son, Inc.; and WHEREAS, Chief Financial Officer Chris Battaglia has certified funds are available for this project. NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of River Edge that a contract for the Fenway Drainage Improvements Project shall be awarded to Matina & Son, Inc., having its principal office at 146 English Street, Hackensack, NJ 07601 in the amount of $200,000.00 based on the bid, submitted on July 12, 2023; and BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby authorized to sign said contract on behalf of the Borough of River Edge. ******* #23-224 Award Contract – 2023 ADA Ramps Improvements and Sidewalk Replacement Project & Swim Club and KBG Field Parking Lot Improvements Project WHEREAS, on Wednesday, July 12, 2023, at 10:00 a.m., six bids were submitted at the date and time specified for the 2023 ADA Ramps Improvements and Sidewalk Replacement Project & Swim Club and KBG Field Parking Lot Improvements Project and the Borough Administrator did open and read each bid aloud; and WHEREAS, the Borough Engineer has reviewed the base bids A and B, as well as alternate bids B1 and B2 as submitted by D&L Paving Contractors in the amount of $622,737.27 and has recommended the base bids and alternates be awarded to D&L Paving Contractors; and WHEREAS, Chief Financial Officer Chris Battaglia has certified funds are available for this project. NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of River Edge that a contract for the 2023 ADA Ramps Improvements and Sidewalk Replacement Project & Swim Club and KBG Field Parking Lot Improvements Project shall be awarded to D&L Contractors, having its principal office at 681 Franklin Avenue, Nutley, NJ 07110 in the amount of $622,737.27 based on the bid, submitted on July 12, 2023; and BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby authorized to sign said contract on behalf of the Borough of River Edge. ******* #23-225 Resolution Permitting the Possession and Consumption of Alcoholic Beverages at a Block Party on Berkeley Road WHEREAS, on or about July 17, 2023, the Borough of River Edge granted permission to Patricia Rodio, 217 Berkeley Road, River Edge, New Jersey, to hold a block party on Berkeley Road between Elm and Fifth Avenue on Saturday, September 9th from 12:00 to 10:00 p.m. (rain date Sunday, September 10th) in accordance with Borough Ordinance #1678; and WHEREAS, Patricia Rodio has requested that the possession and consumption of alcoholic beverages be permitted in connection with said block party; and WHEREAS, Borough Code Section 114-15 allows the Governing Body to permit the possession and consumption of alcoholic beverages in or on a public street or sidewalk in connection with an authorized block party. NOW THEREFORE BE IT RESOLVED, by the Mayor and Council of the Borough of River Edge that persons age 21 and over be and hereby are permitted to possess and consume alcoholic beverages at the block party described above, on the date and time specified herein. ******* #23-226 Authorize Purchase of Turnout Gear for the Fire Department Under State Contract WHEREAS, the purchase of turnout gear for the River Edge Fire Department was authorized in the 2023 capital budget; and WHEREAS, the Fire Chief, Gregg Carridi investigated the options to purchase turnout gear under a New Jersey State Bid contract; and WHEREAS, after evaluating the options for the purchase of the turnout gear, the Fire Chief has recommended purchasing a complete set of Fire Dex Gear; and WHEREAS, the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-12, permits municipalities to purchase goods and services without advertising for bids, from companies under any contract or contracts for such goods or services entered into on behalf of the State by the Division of Purchase and Property in the Department of the Treasury, commonly referred to as “State Contracts”; and WHEREAS, the purchase of the Fire Dex Gear qualifies to be purchased using State Contract #17-FLEET-00811, from New Jersey Fire Equipment Company of 119-131 Route 22 East in Green Brook, NJ 08812, at a total cost of $31,823.00; and WHEREAS, Borough Administrator/Qualified Purchasing Agent, Lissette Aportela has verified that State Contract #17-FLEET-00811, was awarded to Fire-Dex LLC on June 15, 2019 through June 14, 2024; and WHEREAS, Borough Administrator/Qualified Purchasing Agent, Lissette Aportela has verified that New Jersey Fire Equipment Company with Vendor ID V00000570 is an authorized vendor under aforesaid State Contract; and WHEREAS, Chief Financial Officer Chris Battaglia has advised that funding is available for this purchase from the 2023 capital budget. NOW THEREFORE BE IT RESOLVED, by the Mayor and Council of the Borough of River Edge that Fire Chief Gregg Carridi is hereby authorized to purchase Fire Dex Gear under State Contract #17-FLEET-00811 at a total cost of $31,823.00 from New Jersey Fire Equipment Company. #23-227 Confirmation of commodity resale system registration renewal WHEREAS, the Borough of River Edge operates a commodity resale system, ID# - 99041-RECRS, pursuant to 5:34-7.1, et. seq.; and WHEREAS, the Borough resells gasoline and/or diesel fuel to the following entities: River Edge Board of Education River Dell Board of Education WHEREAS, the commodity resale registration must be renewed every five years. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Borough Council of the Borough of River Edge hereby confirm that the Borough Administrator/Qualified Purchasing Agent is authorized to submit a renewal application for the Borough’s commodity resale system, ID# - 99041-RECRS to the Division of Local Government Services. ******* #23-228 Approve Memorandum of Understanding –International Brotherhood of Teamsters, Local 125 WHEREAS, the Collective Bargaining Agreement between the Borough of River Edge and the International Brotherhood of Teamsters, Local 125 was approved via Resolution #22-158 on September 12, 2022; and WHEREAS, a Memorandum of Understanding is required to clarify language concerning reimbursement for employees of the Department of Public Works who obtain their CDL-A licenses. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Borough Council of the Borough of River Edge hereby approve the attached Memorandum of Understanding between the Borough of River Edge and the International Brotherhood of Teamsters, Local 125. ******* #23-229 Payment of Bills Councilwoman Kaufman read resolution #23-229 into the record: #23-229 Payment of Bills At a Regular Meeting of the Mayor and Council of the Borough of River Edge, County of Bergen, State of New Jersey, held on July 17, 2023. BE IT RESOLVED, that the Mayor and Council of the Borough of River Edge approve the following expenditures. CURRENT FUND $524,505.17 CAPITAL FUND $ 13,479.00 TRUST OTHER FUND $ 506.09 RECREATION TRUST FUND $ 1,849.72 Motion by Council President Kaufman, second by Councilman Chinigo, that Resolution #23-229 be approved. The vote was recorded as follows: Councilman Chinigo: aye Councilwoman Kinsella: aye Council President Kaufman: aye Councilwoman Malellari aye Councilwoman Montisano-Koen: aye Councilman Benson: aye PUBLIC COMMENT Motion by Councilwoman Montisano-Koen, second Councilman Benson, and all members present voting in favor, to open the floor to the public. Carmen Philbin, 219 Dorchester Road, asked for confirmation that the governing body members received her email sent earlier today and questioned whether there was any feedback. Mayor Papaleo confirmed receipt of this email. There being no public comments, on a motion by Councilman Chinigo, second by km, to close to the public. Borough Attorney Sarlo explained that Ms. Philbin’s email referenced a case in which a governing body was able to place a non-binding referendum question regarding a school matter onto the ballot. He further explained that the governing body had jurisdiction to do so in that case as it involved a Type I School District. He noted that River Edge is a Type II School District in which the governing body does not appoint Board of Education members or have a say in the Board of Education budget. As such, the governing body in this municipality does not have jurisdiction to place a referendum question regarding a school matter. COUNCIL COMMENTS – There were no council comments. ADJOURNMENT – There being no further business to come before the Mayor and Council, on a motion by Councilman Chinigo, second by Councilwoman Kinsella, and unanimously carried, to adjourn this meeting.
