Pursuant to the City Council Rules of Procedure and Order of Business Resolution, the
Members of the City Council and the public are reminded that they must preserve order
and decorum throughout the meeting. In that regard, Members of the City Council and
the public are advised that any delay or disruption in the proceedings or a refusal to obey
the orders of the City Council or the presiding officer constitutes a violation of these
rules.

5 Adopt a Resolution declaring that the Public Interest and Necessity require the
acquisition of a Permanent Street and Highway Easement and Temporary
Construction Easement over a portion of certain real property for the construction of
the Brockton Avenue to Palm Avenue Railroad Quiet Zone Project, and authorizing
the filing of Eminent Domain proceedings - Waive further reading - Find and
determine, based on substantial evidence in the staff report and administrative

record: (a) the public interest and necessity require the Project; (b) the Project is
planned/located for greatest public good and least private injury; (c) the described
property interests are necessary for the Project; and (d) the statutory offer under

prepare, file, and prosecute the eminent domain complaint in Riverside Superior
Court and seek prejudgment possession under CCP §1255.410 et seq - Five
