State law restricts the Cultural Heritage Board from taking action on an item unless it has been included on an agenda and posted at least 72 hours in advance of a meeting, or unless the matter falls within one of the narrow exceptions. Consequently, any item not listed on this agenda will normally have to be delayed until the item can be made part of a posted agenda. Additionally, significant changes to a project made subsequent to posting of the agenda and not addressed in the Cultural Heritage Board staff report will result in continuance of that item in order to allow for adequate review by the Commission. Karber on behalf of Galleria Centers, Inc., for restoration of a 2116 SF historic former tire store, demolition of a 1265 SF building and a 554 SF addition to a 2640 SF building for a net decrease in square footage, with driveway modifications for a retail/restaurant project at 4135 Market Street, located at the northwest corner of Market and Eleventh Streets in the Downtown Specific Plan, Justice Center district in Ward #1. It is recommended that the Cultural Heritage Board determine the project is exempt from the California Environmental Quality Act (CEQA) per Section 15331 of the CEQA Guidelines. Related cases to this proposal include a General Plan Amendment (P13-0198), Amendment to the Zoning Code (P13-0199), and a Plot Plan Review (P13-0201) to facilitate development of this proposal.
