It is recommended that the City Planning Commission recommend to the City Council adoption of a Negative Declaration in conjunction with this case. It is recommended that the Planning Commission recommend to the City Council adoption of a Negative Declaration in conjunction with these cases. The proposal specifically involves occupancy of an existing approximately 4,400 square foot two-story building at 4035 Trail Creek Road for ancillary Sunday school classrooms and offices. The Sunday school will be affiliated with an existing church in a 3,256 square foot building at 4027 Trail Creek Road. Both buildings are situated westerly of the intersection of Trail Creek and Warm Springs Roads, in the BMP-SP - Business and Manufacturing Park and Specific Plan (La Sierra University) Overlay Zones and in Ward 7. It has been determined that this proposal is exempt from California Environmental Quality Act (CEQA) review pursuant to Section 15301 as the project constitutes occupancy of an existing building. It has been determined that this proposal is exempt from California Environmental Quality Act (CEQA) review pursuant to Section 15332 as the project constitutes an infill development. It is recommended that the City Planning Commission recommend to the City Council adoption of a Mitigated Negative Declaration in conjunction with these cases. Amendments include: 1) Chapter 19.450 - Alcohol Sales, to reorganize and clarify existing text; require a CUP or Minor CUP for all off-sale activities; add conditions of operation to prohibit off-site sales of single unit, cold ready to drink alcoholic beverages, to establish "last call" times for on-site alcohol sales, and to codify occupancy restrictions based on Fire Marshal determination; include Deemed Approved Use requirements and standards for existing non-conforming alcohol related businesses; and rename the "Other Applicable Regulations" section to "Public Convenience or Necessity", and add applicable Public Convenience and Necessity findings and criteria; allow the reduction of separation requirements from existing potentially sensitive uses by conditional use permit, and remove section 19.450.050, Variances; 2) Chapter 19.150 - Base Zones Permitted Land Uses, amending tables and clarifying zones in which alcohol is currently allowed as a primary or incidental use; 3) Chapter 19.910 – Definitions, to add a "Deemed Approved Use" definition; 4) Chapter 19.080 - Nonconformities, to be consistent with the new Chapter 19.450 Deemed Approved Uses requirements, standards and procedures; and 5) other minor Title 19 edits for consistency of the Riverside Municipal Code. This case is applicable to all Wards.
