City Planning Commission action on all items may be appealed to the City Council within
ten calendar days for zoning and map cases. Contact the Planning Division for further

PLANNING/ZONING MATTERS FROM THE AUDIENCE
This is the portion of the meeting specifically set aside to invite your comments on matters
of interest to the Commission, including items on the Consent Calendar.
This portion of the agenda will be limited to a cumulative total of 15 minutes, with
individual speakers limited to a maximum time limit of 3 minutes. Further discussion of any
matter beyond 15 minutes will be continued to following the public hearing calendar or
scheduled for a later agenda. If there is no one from the audience wishing to speak, the
Commission will move to the Consent Calendar.
Materials related to an item on this Agenda submitted to the City Planning Commission
after distribution of the agenda packet are available for public inspection in the Planning
Division office during normal business hours.
9 A.M.--PUBLIC HEARINGS
This portion of the Planning Commission Agenda is for all matters where staff and public

1 PLANNING CASE P13-0448 (Continued from July 17, 2014): Proposal by Jeff
McConnell of Smartlink, LLC, on behalf of AT&T, to consider a Conditional Use
Permit to construct a 75-foot high wireless telecommunications facility
camouflaged as a palm tree, on an approximately 0.1 acre site developed with an
approximately 8,550 square-foot office/research building and two 60-foot high
telecommunications facilities camouflaged as palm trees, located at 3155 Date
Street, situated on the northwesterly corner of Date and Vine Streets, in the I –
General Industrial Zone, in Ward 2. It is recommended that the Planning
Commission recommend to the City Council adoption of a Negative Declaration in

2 PLANNING CASE P13-0714: Proposal by Smartlink, LLC, on behalf of Verizon
Wireless, to consider a Conditional Use Permit to construct three wireless
telecommunications facilities ranging in height from 50 to 60 feet and camouflaged
as flag poles, on an approximately 1.1 acre site developed with an approximately
12,000 square-foot building and surface parking (“Veterans Of Foreign Wars Post
92”), located at 10303 Arlington Avenue, situated on the northwesterly corner of
Arlington Avenue and Tyler Street, in the CG – Commercial General Zone in Ward
7. It is recommended that the Planning Commission recommend to the City
Council adoption of a Negative Declaration in conjunction with this case. Contact

3 PLANNING CASE P14-0359 (Continued from July 17, 2014): Proposal by the City
of Riverside to amend the Zoning Code (Title 19 of the Municipal Code) with
regard to businesses that sell alcohol. Amendments include: 1) Chapter 19.450 -
Alcohol Sales, to reorganize and clarify existing text; require a CUP or Minor CUP
for all off-sale activities; add conditions of operation to prohibit off-site sales of
single unit, cold ready to drink alcoholic beverages, to establish "last call" times for
on-site alcohol sales, and to codify occupancy restrictions based on Fire Marshal
determination; include Deemed Approved Use requirements and standards for
existing non-conforming alcohol related businesses; and rename the "Other
Applicable Regulations" section to "Public Convenience or Necessity", and add
applicable Public Convenience and Necessity findings and criteria; allow the
reduction of separation requirements from existing potentially sensitive uses by
conditional use permit, and remove section 19.450.050, Variances; 2) Chapter
19.150 - Base Zones Permitted Land Uses, amending tables and clarifying zones
in which alcohol is currently allowed as a primary or incidental use; 3) Chapter
19.910 – Definitions, to add a "Deemed Approved Use" definition; 4) Chapter
19.080 - Nonconformities, to be consistent with the new Chapter 19.450 Deemed
Approved Uses requirements, standards and procedures; and 5) other minor Title
19 edits for consistency of the Riverside Municipal Code. This case is applicable

4 PLANNING CASE P14-0449 (Continued from July 17, 2014): Proposal by the City
of Riverside to amend the Zoning Code (Title 19 of the Municipal Code) with
regard to drive-thru businesses, specifically Chapter 19.150 – Base Zones and
Permitted Land Uses, to establish separate permit requirements for drive-thru
lanes incidental to 1) Banks & Financial Institutions/Services and 2) Drug Stores
and Pharmacies; specifically to distinguish these uses from drive-thru operations
incidental to restaurants and other uses. This case is applicable to all Wards. The
Planning Division of the Community Development Department is recommending
that the Planning Commission determine that this proposal is categorically exempt
from further California Environmental Quality Act (CEQA) review pursuant to
Section 15061(b)(3) as it can be seen with certainty that there is no possibility that
this proposed amendment to the Zoning Code will have a significant effect on the
