251 September 11, 2023 The City Council of the City of Rocky Mount met this day in a regular session scheduled for 7:00 p.m. in the George W. Dudley City Council Chamber of the Frederick E. Turnage Municipal Building with Mayor C. Saunders “Sandy” Roberson, Jr. presiding. Councilmembers present: André D. Knight, Richard Joyner, T.J. Walker, Jr., Lige Daughtridge, Tom Harris and Jabaris Walker. Members absent: Reuben C. Blackwell, IV. The Mayor called the meeting to order at 7:00 p.m. and requested all in attendance to stand for a moment of silence remembering Captain Kimberly Witting from our Rocky Mount Fire Department who recently passed away. APPROVAL OF MINUTES Motion was made by Councilmember Harris, seconded by Councilmember Daughtridge, and unanimously carried that the minutes of the Regular Scheduled City Council meeting held May 8, 2023 be approved as submitted to the City Council prior to the meeting. APPROVAL OF ADDITIONS/DELETIONS TO AGENDA Mayor Roberson stated there were requests made to add the following items to the agenda: • Consideration of a 6% COLA (Cost of Living Adjustment) for City of Rocky Mount employees who did not receive at least a 5% increase after the pay study implementation and a 15% pay increase for the employees in Public Works and Parks and Recreation • Proclamation proclaiming the month of September 2023 as Sickle Cell Awareness Month Motion was made by Councilmember Joyner, seconded by Councilmember Knight, motion carried by a vote of 4-2 (Councilmembers 252 Knight, Joyner, T.J. Walker, Jabaris Walker ayes; Councilmembers Daughtridge and Harris nayes) that the agenda be amended, as requested. COMMUNITY UPDATE BY CITY MANAGER City Manager Keith Rogers Jr. provided the following community update. The City Manager reported that: • Stated a new exhibit titled Extreme Deep: Mission to the Abyss opens Saturday at the Children’s Museum at the Imperial Centre • Stated this exhibit enables visitors to explore mysteries of the sea and discover creatures that some of us never new existed • Stated this upcoming Saturday the Fairy Tale Network is being staged in the theater at the Imperial Centre • Stated this is a comedy performed by the Directions which is a new youth ensemble that focuses on joy and the structure of acting, show time begins at 7:30 PM and tickets are $5 • Stated the City of Rocky Mount has gotten positive state-wide publicity in Our State Magazine (copies on the dais for City Council) • Stated there have been full page ads that have highlighted the Denton Street Pool project, the Sunset Park Amusement Center, the Dog Park, and the Imperial Centre • Stated the City will continue to promote activities through this great publication RESOLUTION RECOGNIZING AND CONGRATULATING ROCKY MOUNT PARKS AND RECREATION DEPARTMENT’S YOUTH STEP TEAMS “P.U.P.S AND S.W.A.T.” FOR WINNING THE 2023 NATIONAL GRAND CHAMPIONSHIPS The Mayor welcomed and congratulated the Rocky Mount Parks and Recreation Department’s Youth Step Teams “P.U.P.S. and S.W.A.T. for winning the 2023 National Grand Championships. Motion was made by Councilmember Joyner, seconded by Councilmembers Joyner and Knight and unanimously carried that the following Resolution R-2023-54 entitled RESOLUTION RECOGNIZING AND CONGRATULATING ROCKY MOUNT PARKS AND RECREATION DEPARTMENT’S YOUTH STEP TEAMS “P.U.P.S AND S.W.A.T.” FOR WINNING THE 2023 NATIONAL GRAND CHAMPIONSHIPS be adopted: RESOLUTION RECOGNIZING AND CONGRATULATING ROCKY MOUNT PARKS AND RECREATION DEPARTMENT’S YOUTH STEP TEAMS “P.U.P.S AND S.W.A.T.” FOR WINNING THE 2023 NATIONAL GRAND CHAMPIONSHIPS WHEREAS, the House Party National Step Show was hosted by X Factor Step Team at the Johnson C. Smith University on April 29, 2023 in Charlotte, North Carolina and brought teams in from across the states; and WHEREAS, all steppers are selected and placed on teams by team coaches; these steppers are intended to be the best representatives of the community, not only in competition, but also character; and citizens in school; and WHEREAS, on April 29, 2023, the Rocky Mount Parks and Recreation Department's P.U.P.S. (Perfectly Unique Precise Steppers) and S.W.A.T. (Steppers With Amazing Talent) performed flawlessly to win the 2023 National Grand Championship for the elementary and middle school divisions; and P.U.P.S. (Perfectly Unique Precise Steppers) are the reigning 2x State Champions in the elementary division; and WHEREAS, this championship win marks the first time a Rocky Mount Parks and Recreation Step team has won the 2023 National Grand Championship; and The State Championship; and  253 WHEREAS, while there were outstanding individual steppers in the competition, winning the championship was a total team effort from the following team members: PUPS: Imani Combs, Heaven Powell, Amilliana Thomas, Tamron Thorne, Gabrielle Harris, Caliyah Moore, Ja’Naysha Vick; and S.W.A.T.: Shakira Jones, Amani Davis, J’Kiyah Davis, Arianna Whitted, Makayla Hunter, Nevaeh Daniels, Shetira Thorne, and De’Erek Morris; and WHEREAS, also contributing to the team's success were their coaches: Felicia Meeks (Founder), Shaneeka Bell, LaQuwna Daniels, and Treana Higgs. NOW, THEREFORE, BE IT RESOLVED that Mayor C. Saunders Roberson, Jr. and the Rocky Mount City Council hereby congratulate Rocky Mount Parks and Recreation Department and PUPS and S.W.A.T. Step Teams on this great accomplishment and honor of winning the 2023 National Championships; and 2X State Champions Elementary Division; and BE IT FURTHER RESOLVED that the Mayor and City Council, individually and collectively thank the members of the team, the coaches, staff and support personnel for the honor the championship has brought to the team and to the City of Rocky Mount; and BE IT FURTHER RESOLVED that this resolution shall be spread upon the pages of the minutes of this proceeding and a copy shall be presented to each team member and the coaches who were instrumental in winning this phenomenal championship. RESOLUTION RECOGNIZING AND CONGRATULATING ROCKY MOUNT PARKS AND RECREATION DEPARTMENT’S 12U ALL STAR BASEBALL TEAM FOR WINNING THE SWAC 12U BASEBALL STATE CHAMPIONSHIP The Mayor welcomed and congratulated the Rocky Mount Parks and Recreation Department’s 12U All Star Baseball Team for winning the SWAC 12U Baseball State Championship. Motion was made by Councilmember Daughtridge, seconded by Councilmember Joyner and unanimously carried that the following Resolution R-2023-55 entitled RESOLUTION RECOGNIZING AND CONGRATULATING ROCKY MOUNT PARKS AND RECREATION DEPARTMENT’S 12U ALL STAR BASEBALL TEAM FOR WINNING THE SWAC 12U BASEBALL STATE CHAMPIONSHIP be adopted: RESOLUTION RECOGNIZING AND CONGRATULATING ROCKY MOUNT PARKS AND RECREATION DEPARTMENT’S 12U ALL STAR BASEBALL TEAM FOR WINNING THE SWAC 12U BASEBALL STATE CHAMPIONSHIP WHEREAS, the Statewide Athletics Committee (SWAC) 2023 State Baseball Tournament was hosted by Tarboro Parks and Recreation at the Indian Lakes Sports Complex on July 28-30 in Tarboro, North Carolina and brought teams in from across the state; and WHEREAS, All-Star Team players are nominated by their coach and placed on a ballot to be selected by league coaches; these players are intended to be the best representatives of the league, not only in competition, but also character; and WHEREAS, on July 30, 2023, the Rocky Mount Parks and Recreation Department's 12-U All-Star Baseball Team rallied to win the 2023 SWAC State Baseball Tournament for their age bracket; and WHEREAS, this win proved the Rocky Mount Parks and Recreation Department's 12-U All-Star Baseball Team to be the best of the best 254 in their age group, achieving a record of 4-1 and outscoring opponents 37-27 during the weekend long double elimination tournament format; and WHEREAS, this championship win marks the 9th time a Rocky Mount Parks and while there were outstanding individual players in the tournament, winning the championship was a total team effort from the following team members: Avery Bass, Aaron Flood, Ethan Jones, Mathew Hayes Hall, Caleb Hinnant, Chase Lancaster, Andrew McKellar, Amari Richardson, Dalton Robbins, and Gage Ward; and WHEREAS, also contributing to the team's success were their coaches: Nate Cooper, Lee Flood, and Jarvis Cooper and the team parents who provided unwavering support. NOW, THEREFORE, BE IT RESOLVED that Mayor C. STORMWATER AWARENESS WEEK The Mayor read a Proclamation proclaiming the week of September 24 through 30, 2023 as Stormwater Awareness Week. The Mayor presented the Proclamation to Public Works Director Brad Kerr who joined the Mayor for a photograph. SICKLE CELL AWARENESS MONTH (added in open meeting) The Mayor read a Proclamation proclaiming the month of September 2023 as Sickle Cell Awareness Month in the City of Rocky Mount. PETITIONS FROM THE PUBLIC The Mayor opened the meeting for petitions from the public and outlined guidelines for public petitions. He called on the following individuals for public comment and a brief summary of comments is outlined below: Cindy Worthy • Thanked the City on behalf of UCM for the approval of $200,000 last month to help with the expenses for the remaining of the fiscal year which ends June 30, 2024 • Stated for FY 23-24 there is a projected annual expense of $587,000; she is hoping the remaining $287,000 will be obtained through grants, church donations, fundraising events, and appeals to the citizens of Rocky Mount • Stated she is here to ask the City Council to consider making an annual donation of $300,000 to assist UCM with keeping the doors open as they operate 24 hours a day/7 days a week  255 • Stated this also includes the community soup kitchen which offers a hot meal to not only the shelter residents but any individual in need; they serve about 15,000 hot meals annually Winslow Hagans • Stated he is the president of the Berkshire Community Acres Association • Thanked Council on behalf of the Berkshire Community Acres Association for the help they have given to the community in restoring and rebuilding two properties which have now been sold • Stated they are ready to move forward with another project with the help of the City Mumtaz Shaik • Stated she feels that denying the lowest paid, most overworked City employees a much- deserved living wage is effectively and cruelly weaponizing Council’s vote • Stated a living wage is a human right which should be extended to every City employee • Opposition regarding a 15 percent increase was swift this afternoon when some members would not support raising taxes if needed but she feels raising taxes would have been forced had the $20 million dollar judicial center been built without public input Adrienne Copland • Stated that wages are a reflection of the value to an organization for the skills, education and training needed to perform that job and the willingness to do that job, not a person’s value as a human being • Stated she feels by saying all departments should receive the same types of increases, regardless of the job, would result in nobody wanting to do the jobs that are more dangerous or require more training • Stated she feels by giving everyone the same increase, it does not motivate everyone continue to improve • Stated the police and fire departments risk their lives every single day so to say that all departments deserve exactly the same raise devalues the job that public safety performs Antionette Cutler • Stated that the Hillsdale organization would like to thank the Communications Department for putting out public communications in the bus terminal on Barnes Street • Thanked the Police and Fire departments for all of the dangerous work they do and for protecting the citizens of Rocky Mount • Stated she stands with the sanitation workers because COVID is on the rise and the sanitation workers come in contact with materials every day that carry different bacteria, viruses and disease • Stated if the 15 percent increase were to be approved, she does not think that anyone in the meeting today would disagree Arnie Jones • Stated he is speaking on behalf of Environmental Services and he has been speaking for quite some time • Stated they are not asking for the world, they just want something that is fair across the board as 90 days is up • Stated there would be more of his coworkers with him tonight but are worried about being retaliated against • Stated they have been through COVID and lost co-workers from it • Stated they sometimes lack the equipment and manpower to do the job and that is something that needs to be addressed as well 256 Crystal Wimes-Anderson • Stated she wanted to give a public apology to the City of Rocky Mount and the citizens because she scheduled a forum to be held on September 6th and it did not happen • Stated she had some issues come up so the forum was not held • Stated she wanted to let Council and the citizens know that there was a group of small business owners that put together about 40 questions that they would like answers to and if anyone is interested in those questions she will provide them • Thanked Chief Hassell and his department for supporting her husband while she was going through her situation Nehemiah Smith • Stated he is an advocate for the City workers • Stated the pay ranges in Rocky Mount for sanitation are some of the highest in the state • Stated the conversation has been focused on percentages and not the hard numbers, and when you deal with the hard numbers you see something else • Stated his understanding is that as workers complete training, they will move up in their job and receive a raise as well • Stated there will be merit increases from 2 to 4 percent by March 31, 2024, as well as a potential cost of living raise • Stated he is still an advocate for the sanitation workers, but he is looking at the hard numbers CONSENT AGENDA Motion was made by Councilmember Joyner, seconded by Councilmember Harris, and unanimously carried that the Consent Agenda [Items 9(A) through 9(D)], be approved as follows and more specifically: A. RATIFICATION OF RESOLUTION REMEMBERING AND HONORING CAPTAIN KIMBERLY WITTIG The City Council considered ratification of the resolution which was previously informally approved. Resolution No. R-2023-56 entitled RESOLUTION REMEMBERING AND HONORING CAPTAIN KIMBERLY WITTIG was ratified. B. TEMPORARY STREET CLOSINGS (recommended for approval): That that following temporary street/road closure was approved: • Request from Kimberly Hickerson to close Hammond Street from Church Street to SW Main Street, SW Main Street from Hammond Street to a point 230 feet north (Station Square entrance) and entirety of Coastline Street for “On the Lawn Celebration MED Week” on Saturday October 7, 2023, from 12 p.m. to 4 p.m. C. FY 2024 METROPOLITAN PLANNING PROGRAM GRANT/TRANSIT The City Council was advised that the City has been approved by the North Carolina Department of Transportation for the FY 2024 Section 5303 Metropolitan Planning Grant from the Public Transportation Division in the amount of $60,078. City Council was advised that the funding shares are as follows: Federal $48,062; State $6,007; and City $6,009. It was noted that the grant will assist in funding salary expenses for the Metropolitan Planning Officer (MPO) and fund various long- and short-range Transit panning activities including Transit Data Collection, Transportation Improvement Program (TIP) reporting, and planning of various Public Involvement activities.  257 The grant agreement with the North Carolina Department of Transportation was approved and the Mayor and City Clerk were authorized to execute the grant agreement and any required documentation/ certifications on behalf of the City. D. SOLE SOURCE SCREW PUMP GEARBOX PURCHASE FOR WASTEWATER TREATMENT PLANT (WWTP) The City Council received a request for approval for a sole source waiver of competition to purchase a Screw Pump Gearbox for the WWTP. The Purchasing Division recommends the waiver of competition in accordance with the “sole-source” purchase pursuant to G.S. 143- 129(e)(6) based on standardization or compatibility. The information furnished by the Purchasing Division supporting the recommendation will be placed on file in the office of the City Clerk as BD-2023-18. The “sole-source” purchase for the Screw Pump Gearbox for the WWTP from Timken Gears & Services, Inc. @ total cost of $241,803.00 (includes the goods and services, a 5-year warranty on new enclosed drives, 3-year warranty on overhauled drives and OEM parts, 1 year onsite technical services) was approved and the Purchasing Division was authorized to issue a purchase order in accordance with the Council’s award. PLANNING BOARD RECOMMENDATIONS The City Council received the minutes and recommendations from a Planning Board meeting held July 11, 2023. Motion was made by Councilmember T.J. Walker, seconded by Councilmember Joyner and unanimously carried to acknowledge receipt of the Planning Board Minutes. The minutes are on file in the office of the City Clerk. The following action was taken upon the recommendations of the Planning Board: A. PUBLIC HEARING/REZONING REQUEST The Mayor opened a public hearing relative to the following rezoning request recommended for approval and found in compliance with the Comprehensive Plan by the Planning Board: • Request by Lemanuel Williams (Building Shalom, Inc.) to rezone ± 0.58-acre parcel located at 2175 W. Raleigh Boulevard from R- 6MFA to B-2 Emile Pinkston, Director of Development Services, gave an overview of the request. No one from the public appeared and the Mayor declared the public hearing closed. Motion was made by Councilmember Joyner, seconded by Councilmember T.J. Walker, and unanimously carried that Ordinance No. O-2023-105 entitled ORDINANCE AMENDING THE LAND DEVELOPMENT CODE AND MAP OF THE CITY OF ROCKY MOUNT was adopted. 258 PLANNING BOARD RECOMMENDATIONS The City Council received the minutes and recommendations from a Planning Board meeting held August 8, 2023. Motion was made by Councilmember Joyner, seconded by Councilmember Harris and unanimously carried to acknowledge receipt of the Planning Board Minutes. The minutes are on file in the office of the City Clerk. The following action was taken upon the recommendations of the Planning Board: A. PUBLIC HEARING/REZONING REQUEST The Mayor opened a public hearing relative to the following rezoning request recommended for approval and found in compliance with the Comprehensive Plan by the Planning Board: • Request by Robert J. Walker to rezone ± 4.19-acre site located at 1837 S. Wesleyan Boulevard and an unaddressed parcel immediately south (PIN 374816749682) from B-2 to B-5 Emile Pinkston, Director of Development Services, gave an overview of the request. No one from the public appeared and the Mayor declared the public hearing closed. Motion was made by Councilmember Harris, seconded by Councilmember Joyner, and unanimously carried that Ordinance No. O-2023-106 entitled ORDINANCE AMENDING THE LAND DEVELOPMENT CODE AND MAP OF THE CITY OF ROCKY MOUNT was adopted. COST OF LIVING ADJUSTMENT (COLA) AND PAY INCREASE (added in open meeting) Consideration was given to a COLA (Cost of Living Adjustment) of 6 percent for City of Rocky Mount employees who did not receive an increase after the pay study implementation and a 15 percent pay increase for the employees in Public Works and Parks and Recreation. Council Comments Councilmember Knight – • Stated the reason he asked for this to be put on the agenda is because he has heard overwhelmingly from numerous City employees that had seen no impact from the pay study • Stated that only 437 received an increase due to the comp and pay study which means 500 plus employees did not receive anything • Stated he think it is right to value all of the City employees • Stated if they did not receive anything in this comp study then they should get a COLA increase • Stated he is in favor of what was done for the police department and the fire department • Stated they have this kind of discussion only when it concerns certain people in certain departments and he has been here long enough to have witnessed that Councilmember T.J. Walker – • Stated it was kind of shocking to him when the information presented in the Committee of the Whole meeting, showed that 44 out of 45 of the sanitation workers, had received a raise  259 from 5 to 24 percent and the only one that did not receive a raise was the superintendent • Stated he still stands with the sanitation workers but there needs to be honesty about those details and those facts and make sure that is clear • Stated the City of Rocky Mount is amongst the highest in the state for sanitation workers pay • Sated this whole situation has become so political • Stated if this has been the struggle, if sanitation workers have been overlooked, oppressed for years why is this just now a conversation amongst Council • Stated the truth of the matter is that if this has been an issue for years, it should have been dealt with years ago and that is the reason he is unable to support it at this time • Stated this has turned into a matter of trying to minimize the new City Manager and overlook the good work that has been done Joyner – • Stated this has been a struggle and they wanted to handle this at a management level • Stated he seconded the motion so they could have a discussion and get to a vote and trust in the management and leadership • Stated they need to do right by all of the workforce and not just some • Stated he is glad to hear about the study that has been done but he is concerned about the employees that did not get anything and the sanitation department • Stated he is willing to trust leadership from the City Manager to do justice and bring back to Council what can be done to help meet the needs of all of the City workers Knight – • Stated when you look back on 20 years, there is not enough time to even discuss all the accomplishments • Stated he does not think employees would intentionally lie, some of the sanitation workers received 80 cents and those who do not have a CDL received 2 dollars • Stated that you cannot operate a truck without a CDL so the ones who have been out here working hard to keep the trash picked up did not get anything and without them the trash could not be picked up • Stated this is nothing political as Council did not open that door with the 36 percent increase, which he is fine with, but he would like to know why it is scrutinized when it comes to sanitation, public works, and parks and recreation • Stated that it is nothing political, it is the right thing to do and whatever is done today, history will record Harris – • Stated he greatly appreciates the information that was shared tonight, but Mr. Smith only presented one of the three levels of operators that we have here at the City • Stated one of the good things about this comp plan is to give people incentive with the City’s involvement in providing additional training so they can make career advancements • Stated the salaries are slightly below Durham and Raleigh but it is substantially cheaper to live here in Rocky Mount • Stated when he ran for Ward 6 he made a promise to do his best to be a good steward of the City’s funds and feels something cannot be voted on without knowing the impact on the budget • Stated the City only has a certain amount of money and most of it comes from the taxpayers in Rocky Mount so without knowing 260 the direct impact and what budget revisions would have to be made, that he cannot support the motion • Stated he values and he believes everyone values all City employees • Stated he believes a 2 to 4 percent merit increase is given to employees on their anniversary dates • Stated he believes there was a slide that showed next year it was stated the City Manager would be looking at a cost-of- living adjustment in the budget in addition to merit increases • Stated he believes that is the time to look at the numbers to ensure the budget that is approved is something we can all live with here in the City of Rocky Mount Daughtridge – • Stated that he agrees with Councilmembers T.J. Walker and Harris • Stated he believes everyone on the City Council and at a management level supports all City staff; he agrees that departments being weaponized against each other for political gain and it is unfortunate • Stated that he trusts in the City Manager; he feels he is very talented and he feels Council should put trust in the City Manager’s vision on how to not only move the City forward, but staff as well • Stated there are advancement opportunities within these departments and compression is being worked on as well • Stated he agrees with Councilmember Harris about the budget and what the impact would be; he would be concerned about potential cuts and tax increases on the citizens in Rocky Mount who are barely getting by • Stated it is very dangerous to try to do this at this time; he feels it would be better to address through the budget and that is why he cannot vote in favor of this Councilmember Daughtridge called for the question; Councilmember Harris seconded the motion, with no opposition, debate was ended. Councilmember Knight made a motion to give a COLA (Cost of Living Adjustment) of 6% for City of Rocky Mount employees who did not receive an increase after the pay study implementation and a 15% pay increase for the employees in Public Works and Parks and Recreation. The motion failed by a vote of 1-5 (Councilmember Knight aye; Councilmembers T.J. Walker, Daughtridge, Harris, Joyner, and Jabaris Walker nayes). APPOINTMENTS (added in open meeting) Councilmember Jabaris Walker nominated Gerell Brown for the Member-at-Large vacancy on the Central City Revitalization Panel. Motion was made by Councilmember Jabaris Walker, seconded by Councilmember Joyner, and unanimously carried that Gerell Brown be appointed to the Member-at-Large vacancy on the Central City Revitalization Panel. This unexpired term will expire June 30, 2025. Councilmember Jabaris Walker nominated Tilda Whitaker-Bailey for the Ward 7 vacancy on the Board of Adjustment. Motion was made by Councilmember Jabaris Walker, seconded by Councilmember Joyner, and  261 unanimously carried that Tilda Whitaker-Bailey be appointed to the Ward 7 vacancy on the Board of Adjustment.
