Minutes Board of Adjustments April 15, 2021 Conducted via Zoom and in Sam King Room 2:30 pm MEMBERS PRESENT: Terry Williamson, Von Lambert, Phil Burkhalter, Will Byington, Cameron Abney, Jarod Johnson MEMBERS ABSENT: None (one vacant position) STAFF PRESENT: Artagus Newell, Brice Wood, Brittany Griffin, James Martin, Mary Catherine Chewning, Frank Beacham, Virginia Harman PUBLIC PRESENT: Olivia Morley, Marvin & Beth White, Dustin & Michelle Henderson Bone, Daniel Gober, Tony Carroway, Billy Floyd, Ricky F. WELCOME: Chair Williamson called the meeting to order and welcomed everyone at approximately 2:30 PM DETERMINATION OF QUORUM: A quorum was determined via roll call. REVIEW OF THE MINUTES: Von Lambert made a motion to approve the March 2021 Minutes, which was seconded by Phil Burkhalter. The motion passed unanimously (6-0). APPROVAL OF AGENDA: Lambert made a motion to approve the agenda, which was seconded by Burkhalter. The motion passed unanimously (6-0). BOA21-04-01, requests variances to reduce the lot width to 60 feet and the eastern side setback variances from 20 feet to 6 feet and the rear setbacks from 30 feet to 6 feet for the proposed expansion of the property located at 0 Alabama Hwy, Rome, GA 30165 as shown on the provided plat, Floyd County Tax Parcel A14002. Applicant/Owner: Darren Nicholson. Brice Wood presented the application, staff report and staff recommendation of approval with conditions. Billy Floyd was present to speak on behalf of the application. There was no one else present to speak in favor or opposition to the application. Phil Burkhalter made a motion to approve the application with the staff recommended conditions. Von Lambert seconded the motion. The motion passed 6-0. BOA21-04-02, requests a variance to increase the allowable fence height from 6 feet to 9 feet for the property located at 1304 Kingston Road, Rome, GA 30161, Floyd County Tax Parcel K13Y409. Applicant/Owner: Daniel Gober. Brice Wood presented the application, staff report and staff recommendation of approval. Daniel Gober was present to speak on behalf of the application. Neighbor Marvin White asked a question about how high the fence would be in relation to his property. Gober explained that the fence would be six feet in height near White’s property. Burkhalter made a motion to deny, which was seconded by Byington. The motion to deny passed 6-0. BOA21-04-03, requests a variance to reduce the southern side setback from 7 feet to 2 feet 6 inches for the property located at 670 Elliott Drive, Rome, GA 30165, Floyd County Tax Parcel G12Z368. Applicant/Owner: Dustin Bone/Michelle Henderson Bone. Brice Wood presented the application, staff report and staff recommendation of denial. Michelle Henderson Bone was present to speak on behalf of the application. Chief Building Official James Martin was present to answer questions about the International Residential Code (IRC). Burkhalter made a motion to deny, which was seconded by Byington. The motion passed 6-0. Adjournment There being no further business to bring before this body, the meeting of the Board of Adjustments was adjourned at 3:05 PM by a common consent, after a motion by from Von Lambert and a second by Phil Burkhalter.
