(Heldenbrand/Yntema) BACKGROUND: Initiated by: Mayor, Mayor Pro Tem, and City Manager Effective July 1, the City raised water and wastewater rates to a tiered system. This resulted in substantial rate increases across the board for municipal water users. This amendment would scale back those increases after 3000 gallons the price of water $0.0035 per gallon ($3.50 per 1,000 gallons). Waste water rates will be $2.69 per 1,000 gallons. This amendment also included a decrease or increase for annual rates based upon CPI: Urban Consumer - Water and sewer and trash collection services. FINANCIAL CONSIDERATION While the final sum is uncertain, this proposal would decrease system revenue. WHEREAS, the City of Roswell Water and Wastewater Utility Rate Studies calls for rates to be fair and equitable across all user groups, and; WHEREAS, Chapter 26 of the Roswell City Code provides for the water utility and sewage facilities pursuant to NMSA 1978 Chapter 3, Articles 18, 23, 26 and 27; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL AS THE GOVERNING BODY OF THE CITY OF ROSWELL, NEW MEXICO, that: SECTION 1 Chapter 26 of the Roswell City Code is amended to read as follows: 26-180 – Rate Setting If in its annual review, the City Council fails to implement a rate increase or decrease, the rates found in Appendix A shall be increased or decreased in proportion to the increase or decrease found in the United States Consumer Price Index - CPI: Urban Consumer - water and sewer and trash collection services effective January 1 of each year beginning 2026. Appendix A [Attached] SECTION 2 All ordinances or parts of ordinances in conflict or inconsistent herewith are hereby repealed to the extent of such inconsistency. This repealer shall not be construed to revive any ordinance or part of any ordinance heretofore repealed. SECTION 3. If any section, paragraph, clause, or provision of this ordinance for any reason shall be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause, or provision shall not affect any other part of this ordinance. SECTION 4. This ordinance shall be effective five days following its publication as required by law.
