CALL TO ORDER
Mrs. Childress called the meeting to order and asked those who wished to speak to sign in.
MINUTES
Mrs. Childress called for approval of the minutes of the July 30, 2013 minutes. Mr. Gross
made a motion to approve the minutes as presented. Mr. Armstrong made the second. The
motion passed by a vote of four to zero.
SWEARING IN
Mrs. Childress swore in the audience and Staff.

Mr. Armstrong made a motion to waive the reading of the ‘Land Use and Zoning
Considerations’ and ‘Finding of Facts’ for the following case. Mr. Gwartney made the second. The
motion passed by a vote of four to zero.
CASE 13-017: Designate a Residential Zoning District for an Existing Planned Unit
Development (PUD)- Tierra Berrenda Development, Tract A and Open Space Zone of Tierra
Berrenda No. 11 Addition, located adjacent to the eastern side of the 3600-4300 blocks of North
Main Street, and Summary Replat Lot 1 and Lot 2 of Tierra Berrenda No. 8, known as 611 and
613 Tierra Berrenda Drive, Paul Shuster, Kenneth and Jeanine Sanders, Johnson Trust and City
of Roswell/Owners.
Paul Shuster, 613 Tierra Berrenda Drive, asked if the PUD would be zoned for residential
development only. Mr. Jaramillo stated an R-1 District would allow only single-family residential
homes and that no commercial or industrial development would be allowed. Mr. Shuster stated
he was in favor of the request. Mr. Jaramillo stated Mr. Vickers had spoken with Mr. Johnson,
owner of the largest tract in the request, and that Mr. Johnson supported the request. Mr.
Jaramillo stated the single-family designation is not as restrictive as the R-S Rural Suburban
District, which requires lots be a minimum of 2 1/2 acres. He stated a zone change would be
required before a multi-family development could be built and that owners within 100' would be
notified prior to a public hearing being held.
MOTION
Mr. Gwartney made a motion to approve Case 13-017 based on Findings of Facts. Mr.
Armstrong made the second. Mr. Jaramillo stated the Commission must designate a zoning
district. Mr. Gwartney amended his motion to include a recommendation of R-1 Residential
District. The motion passed by a vote of four to zero.

CASE 13-018: Abandonment of a Planned Unit Development (PUD)- Tierra Berrenda
Development, Tract A and Open Space Zone of Tierra Berrenda No. 11 Addition, located
adjacent to the eastern side of the 3600-4300 blocks of North Main Street, and Summary Replat
Lot 1 and Lot 2 of Tierra Berrenda No. 8, known as 611 and 613 Tierra Berrenda Drive, Paul
Shuster, Kenneth and Jeanine Sanders, Johnson Trust and City of Roswell/Owners.
Mr. Jaramillo stated a correction should be made to the description of the request to
change the word "abandonment" to "termination." He stated the PUD had been a nine phase
development, of which one phase had been completed over thirty years. He stated the PUD had
originally allowed for multi-family development but that the character of the neighborhood had
changed over time and that high-density development would now not blend in. He stated
termination of the PUD would protect surrounding property owners. Mr. Shuster asked how the
termination would affect his property. Mr. Jaramillo stated Mr. Shuster's property met setback
requirements for R-1District and that there would be no effect. Mr. Jaramillo stated Staff had
checked the existing structures and found that none would be in violation of setback requirements
for the R-1 District and that no structures had been built in the flood plain.
MOTION
Mr. Gwartney made a motion to recommend approval by City Council of Case 13-018
based on Findings of Facts. Mr. Armstrong made the second. The motion passed by a vote of
four to zero.
