minutes. Commissioner Henderson MOTIONED to approve the minutes from the
October 26, 2021 Planning & Zoning Commission meeting as presented. Seconded by

Chair Storey introduced Case 21-016 ZOC.
Mr. Kevin Maevers: Presented Case 21-016 ZOC. The proposed zone change from R-4 to
C-2 for the 4.5-acre lot is consistent with C-2 zoning of adjacent properties and is a
reasonable request. Avemere has sold its properties across the nation. Due to market
conditions, lack of skilled facility staff, and decreased number of residents in facilities in
a post-COVID world, the cost of operating senior living facilities has increased
dramatically. Rezoning to commercial could help facilitate adaptive reuse of the
property and provide additional revenue streams. A C-2 zoning district provides more
opportunities for use of the building. Buildings that remain vacant for long periods have
negative impacts on surrounding communities and can contribute to potential security
issues. Four letters objecting to the zone change were submitted to the Planning &
Zoning Office. The primary objections are about an increase in vehicular traffic and
noise, security issues with an increase in activity and foot traffic, and property values.
Since the facility is currently closed, there will be an increase in traffic. Pennsylvania
Avenue has adequate width for increase traffic. The building is 30 years old and in
reasonably good condition. A zone change will not in and of itself cause property values
to decrease. R-4 is an extremely limited zone. If the property owner is unsuccessful in
utilizing the property, then surrounding property values will decrease.
Chair Storey: Is there anyone wishing to speak in favor of Case 21-016 ZOC?
In Favor: Narendra Mistry
Mr. Narendra Mistry: Stated he has lived in and invested in Roswell for 20 years.
Avemere is a Hong Kong based company that owned the senior care facility. Mr. Mistry
stated that he has owned and operated long term and short term stay hospitality
businesses which is similar to senior living facilities. Mr. Mistry contacted five senior
living facilities and medical facilities to see if they would be interested in leasing the
property, but there has been no interest so far. If Mr. Mistry cannot attract a senior
living facility to this property, he wants to use the building for a short/long term stay
hotel, which in his opinion, is a similar situation to an assisted living facility.
Commissioner Henderson: Expressed his disappointment that Avemere did not remain
as senior housing and the way they treated the residents was disgraceful, that there is
not enough housing for seniors, and that he has sympathy for the residents living in the
condominiums who bought properties next to what they thought was going to be senior
living. Commissioner Henderson asked Mr. Mistry about his plans for the property and
whether he tried to talk to Quail Village and North Springs.
Mr. Narendra Mistry: The main protest seems to be on-street parking. Hotel guests will
be required to park on the property and will not be allowed to park on the street. His
plan is to install kitchenettes in the long-term stay units for tenants, such as travelling
nurses. Since the housing market is tight, there is a need for long-term stay facilities.
The property will be managed 24/7 and will have security cameras. Mr. Mistry stated he
cares about the neighbors and the town.
Commissioner Richard Gutierrez: Asked whether Mr. Mistry has a current business plan
for the property.
Mr. Narendra Mistry: Because the property was well maintained, Mr. Mistry is speaking
with three different franchises for short and long term stay accommodations. The
business model includes three inspections each year plus customer ratings. Mr. Mistry
has been in the hotel industry since 1999 in Roswell and the occupancy rate typically
runs 50 to 60 percent occupancy except, when there are special events such as Hike-It-
and-Spike-It.
Mr. Kevin Maevers: The current facility located at 2725 N Pennsylvania Avenue was
built to 1995 development standards. A change in the intensity of use will trigger a
traffic impact study. The City can implement “No Parking Zones” on the street. The
Community Development Department reviews redevelopments to ensure compliance
with current development standards. Intensity of use is addressed through the staff
review process. Mr. Mistry has been forthright and communicative with staff. R-4
property is not currently in high demand. Commercially zoned property has a higher
loan to value ratio over property zoned R-4.
Chair Storey: Is there anyone wishing to speak against Case 21-016 ZOC?
Against:
Ms. Patsy Felber: As president of the Quail Village Association, Ms. Felber represents 53
homes and over 100 homeowners and stated that this zone change will directly impact
Quail Village. C-2 has 29 possible uses plus additional special uses. Any increase in traffic
and security issues will have a direct impact on the Quail Village community. Until Mr.
Mistry has a proposed use and presents a business plan, the residents of Quail Village
oppose this zone change and encourage the Commission to deny this proposed zone
change until the property owner presents a specific plan detailing how the lot will be
used.
Mr. Thomas Woolworth: As president of the Homeowners’ Association at North
Springs, Mr. Woolworth represents 54 homes and 102 homeowners, many of whom are
retired and want to live in a quiet community. North Springs agrees with Ms. Patsy
Felber in wanting to see a business plan before the Commission approves a zone
change.
Commissioner Lessard: Suggested that if the property were developed into apartments,
it would also increase traffic.
Mr. Kevin Maevers: If redevelopment occurred on the 4.5-acre property to turn it into
an apartment complex, the Zoning Ordinance would allow 40 units per net acre. This
means the property has the potential to accommodate 180 apartment units. The
development code standards will apply to properties that go through a zone change.
Mr. Greg Smith: As vice-president of the Homeowners’ Association at North Springs, Mr.
Smith stated there is a big difference between apartment owners/renters who care
about the property and hotel guests who have no ties to the community.
Ms. Marion Hobbs: Property values in Quail Village have increased substantially and Ms.
Hobbs stated that she is against the proposed zone change from R-4 to C-2 as it could
lower the value of adjacent homes.
Commissioner McDaniel: Stated the property values have increased due to the current
market and he receives 10 to 20 calls a day from people living in their cars who are
looking for a place to live. He said he hopes that Mr. Mistry can keep the property for
long-term stays. C-2 has limitations as well.
Mr. Gary Shubert: My wife and I own a professional office in Oak Plaza to the south of
the property. I was under the impression the R-4 lot was there as a buffer between low
density residential and the C-2 commercial zone.
Ms. Laura Shubert: Stated she spent two years trying to get a zone change from R-4 to
C-1 in the professional building across the street on Wilshire Boulevard, was
unsuccessful, and was told the property was zoned R-4 as a buffer between the
commercial and residential zoning districts.
Chair Storey: I am disappointed we cannot table the vote until we know what the
specific plan is. I would like to ask Mr. Mistry to keep the adjacent property owners in
the loop about the business plan.
Mr. Louis Najar: Stated he sees a lot of potential in the property and reminded the
Commission that the code does not require Mr. Mistry to provide a business plan.
Mr. Narendra Mistry: Stated he will communicate with the presidents and vice-
presidents of Quail Village and North Springs Homeowners’ Associations.

2. At the Planning and Zoning Commission meeting next month, staff will provide a new
community and economic development monthly report format.
3. The November Planning and Zoning Commission meeting is scheduled for November 16,
2021.

III. Intent of Petition:
The property owner of 2725 N Pennsylvania is requesting a change in zoning from R-4
Residential to C-2 Community Commercial to allow greater flexibility of adaptive reuse for
the property that the previous owner vacated and sold.
IV. Land Use and Zoning Considerations:
1. The property under consideration was formerly a Senior Living Facility owned and operated
by Avemere of Roswell that closed in 2021.
2. The 36,072 square foot structure was constructed in 1995.
3. According to the Chaves County Assessor Map information, the lot is approximately 4.5
acres.
4. This corner property is located on local streets North Pennsylvania Avenue and Wilshire
Boulevard.
5. This property has a paved alley.
6. In December 1994, the Planning & Zoning Commission granted the owner of the property
a Special Use Permit per Zoning Case 94-036 for the development of a 92-unit group care
home with 64 parking stalls, a paved alley, a drainage plan (the grassy area on the south
side of the property is the detention area), and completion of paving Wilshire Boulevard.
7. The following zoning and land uses adjacent to and across streets from the property under
consideration are:
North: A Shopping Center zoned C-2 Community Commercial that features Farmers
Country Market, Ace Hardware, restaurants, and a gift store
East: A childcare center, carwash, and other retail, service, and office businesses zoned
C-2 are located between the alley and Main Street;
South: Oak Plaza Condominium is a professional office development located at 200 E
Wilshire Boulevard on the south side of Wilshire Boulevard;
West: Homes in Quail Village Association zoned R-4 PUD are located on the west side
of Pennsylvania Avenue with garages and walls facing the street;
Southwest: Homes in North Springs Association zoned R-4 are located on the west side
of Pennsylvania Avenue and south of Wilshire Boulevard.
8. The C-2 Community Commercial District allows a variety of uses including retail, medical
facilities, professional offices, hospitality establishments, etc., (see Article 30: C-2 Community
Commercial District and Article 28: C-1 Neighborhood Commercial District).

9. Assisted living homes, group care homes, convalescent homes, and retirement centers, etc.,
are allowed uses in the C-2 District.
10. The Preferred Land Use Scenario Map in the 2016 City of Roswell Comprehensive Plan indicates
residential for this lot with abutting commercial to the north and east, residential south of
Wilshire Boulevard, and high density residential west of Pennsylvania Avenue.

V. Findings of Fact (Conclusions of Law):
1. A notice of the time and place of the public hearing for this case was published in the
Roswell Daily Record at least fifteen (15) days prior to the date of this hearing.
2. Notification of the public hearing was mailed via certified mail with return receipt
requested to property owners of record, as shown by the Chaves County Assessor, with
lots or land within one-hundred (100) feet of the area under consideration, excluding
public rights-of-way.
3. This agenda which includes this case has been posted at City Hall and on the City of
Roswell’s website for over seventy-two (72) hours as required by State of New Mexico law
for a public hearing.
4. As of the time of this writing, the Planning & Zoning Office has received zero (0) written
protests and zero (0) verbal protests, and one (1) in person inquiry.
5. City of Roswell Zoning Ordinance Article 3: Procedures, Amendments, and Changes
Section 9. Zone Changes regulates zone changes.
VI. Staff Recommendation:
Based on the land use and zoning considerations, findings of fact, surrounding land uses, and
the regulations established in the Zoning Ordinance, Staff recommends approval of Zoning
Case 21-016 ZOC to allow a change in zoning from R-4 Residential to C-2 Community
Commercial as C-2 provides greater flexibility for adaptive reuse of the property which abuts
C-2 properties located to the north and east.
VII. Action by the Planning & Zoning Commission:
The Planning and Zoning Commission may make a motion to approve or deny this application
