Commissioner Gilmore MOTIONED to approve the April 23, 2024 Planning
& Zoning Commission meeting minutes as presented. SECONDED by
Commissioner Holman.

F. PUBLIC HEARING ITEMS:
1. Chair Aguilar introduced CASE 24-010 SUP Request for Special Use Permit
to convert professional office into a hair salon in R-4 Residential Zoning
District at 1010 S Sunset Ave. Legal Description: WESTERN MEADOWS 1
Block: 2 Lot: 1 S 80' DOC# 202401838 WDJT. (Property Owner: Jaime Orosco
& Angie Orosco).
Ms. Hildreth: Planning & Zoning Commission Considerations from Staff
Review are as follows.
Intent of Petition:
The applicant for Zoning Case 24-010 SUP is requesting a Special Use Permit to
convert a professional office into a hair salon in the R-4 Residential Zoning District.
1. The corner lot property under consideration is located at 1010 S Sunset Ave
within the City of Roswell jurisdiction on the west side of Sunset Avenue
and the north side of Camino Real. Chaves County Assessor Information
shows a 2,350 square foot building constructed in 1969.
2. The property under consideration is in the R-4 Residential Zoning District
and was previously used as a professional medical office.
3. The corner lot property has access driveways on Camino Real (Local Road),
and Sunset Avenue (Minor Arterial).
4. The surrounding uses include single family residential to the west and Town
Plaza apartment complex is located on the east side of Sunset Avenue. The
abutting parcel to the north is currently vacant undeveloped. A residential
fourplex is located on the south side of Camino Real.
5. This slide shows Staff photos of the property that already has paved
parking areas.
Findings of Fact (Conclusions of Law) are as follows.

1. A notice of the time and place of the public hearing for this case was
published in the Roswell Daily Record at least fifteen (15) days prior to the
date of this hearing.
2. Notifications of the public hearing were mailed via certified mail with return
receipt requested to property owners of record, as shown by the Chaves
County Assessor Map, with lots or land within one-hundred (100) feet of
the area under consideration, excluding public rights-of-way.
3. This agenda, which includes this case, has been posted at City Hall and on
the City of Roswell’s website for over seventy-two (72) hours as required by
State of New Mexico law for a public hearing.
4. At the time of this writing, the Planning & Zoning Office has received zero
(0) written protests, zero (0) verbal protests, and zero (0) inquiries.
5. City of Roswell Zoning Ordinance Article 18: R-4 Residential District allows
barbershops and beauty shops in the R-4 Residential Zoning District with a
Special Use Permit; Article 18 B. Special Uses refers to Article 16: R-3
Residential District B. Special Uses are as follows 13: Barbershops and
beauty shops.
6. City of Roswell Zoning Ordinance Article 3 Section 8. Special Uses
Paragraph D allows the Planning and Zoning Commission to “decide
whether or not to approve a request for a special use. In its deliberations,
the Planning and Zoning Commission shall consider the impact of a special
use upon the public health, safety, and welfare of the community; the
existing and anticipated vehicular/pedestrian traffic flows; parking
conditions, setbacks, and height; landscaping and screening; open spaces;
signage; lighting; and other items. The Planning and Zoning Commission
shall not approve a special use unless it finds it conforms to the City’s Land
Use Plan, is in the public interest and is not solely in the interest of the
applicant.”
7. The property under consideration is currently within the jurisdiction of the
City of Roswell, New Mexico.
8. The 2016 Comprehensive Master Plan Preferred Land Use Scenario Map
indicates the property under consideration is located within an
Infill/Redevelopment Opportunities Area.
Staff stands for questions.
Commissioner Lessard:
Unless evidence to the contrary is introduced in the public hearing, based on
the Land Use and Zoning Considerations, Findings of Fact, Staff
Recommendations and materials provided, it is recommended that the

Planning and Zoning Commission introduce a motion and vote to approve
or deny Zoning Case 24-010 SUP.

G. OTHER BUSINESS
1. Ms. Hildreth provided a report on the Regional Economic Development and
Housing Summit held on May 22-23, 2024 by the SENMEDD (Southeast
New Mexico Economic Development District) attended by five counties
(Chaves, Eddy, Lea, Lincoln, Otero) and Mescalero Apache Tribe. Ms.
Vickers, Mr. Martinez, and I attended this event. Purdue University
presented data and we learned the region is several thousand housing units
short and experiencing a housing crisis as is the rest of the country. This
region has solutions. The modular home manufacturing plant opening in
Roswell is a solution to provide housing in Roswell, Chaves County, and a
10-hour regional radius. At the Summit, Ms. Hildreth presented information
on her Neighborhood Stabilization research as well as the recently
published Housing Supply Accelerator Playbook created in partnership
between the American Planning Association and National League of Cities.
The Southeast New Mexico region is already doing much the Playbook
suggests; the Playbook is a framework to support increasing local housing

supplies including affordable and attainable housing. New Mexico Mortgage
Finance Authority spoke at the summit about its many programs already
offered that the Playbook recommends. New Mexico’s programs are
assisting increases of all types of housing into the market. Commissioner
Gilmore reported attending a couple of sessions at the summit and
mentioned the ideas from the Neighborhood Stabilization presentation to
combine Keep Roswell Beautiful and Neighborhood Watch to get
neighborhoods back on track. Miguel Martinez said the Summit was very
informative, a lot to consider moving forward. Chair Aguilar mentioned the
press conference after the Summit announcing the Air Races are moving to
Roswell from Reno and talked about community involvement, the time
Commissioners provide to the city, and thanked staff for a great job and for
attending the Summit.
2. Mr. Martinez provided an overview of upcoming text amendments to the
Cannabis Ordinance, Subdivision Ordinance, Zoning Ordinance. A series of
workshops will be held. Planning & Zoning Commissioner discussion
ensued. Commissioners concluded they would hold one two-hour workshop
per month.

Parks & Recreation to I-1 Light Industrial for a 1.55-acre lot. Location: Northeast
corner of College Blvd and Grand Ave. Legal Description: 1.55 acres in the SE
Quarter of the SW Quarter of S: 28 T: 10S R: 24E of RR & E OF GRAND AVE
to be known as Subd: OVERLAND NORTH GRAND SUMMARY PLAT.
Ms. Merideth Hildreth: Chair Aguilar, Commissioners, we have one zoning
case Case 24-009, a request for a zone change from P&R Parks and
Recreation to I-1 Light Industrial for a 1.55-acre lot located at the northeast
corner of College Boulevard and Grand Avenue. If you will follow along in
your packet, it will be Staff Summary B starting on page 18 of 33. If you’ll look
at page 20 The Planning & Zoning Considerations from Staff Review, Item
number four.
1. The property under consideration is currently owned by the City of Roswell
and zoned P&R Parks & Recreation.
2. The property under consideration is a corner lot. On the 2016 Functional
Street Classification Plan, East College Boulevard is classified as a Minor
Arterial and intersects with North Grand Avenue classified as a Local
Street.
3. BNSF Railroad runs parallel with the east property line.
4. The Zoning Map on the slide shows the property under consideration is
located in the East College Boulevard Commercial and Light Industrial
Corridor. Within this context and adjacent location to the railroad, I-I Light
Industrial designation is a compatible zoning designation.
Commissioner Aguilar: Merideth, do you need to read Findings of Fact?
Ms. Hildreth:
5. A summary plat has been generated to create a 1.55-acre lot from the
parent tract.
6. The 1.55-acre tract is under contract for purchase by The Overland Group,
LLC for development of a Dollar General. Per Section 7 Paragraph B.
Mutual Cooperation of the PURCHASE AND SALE CONTRACT, the
“Property shall be properly zoned for commercial real estate” by the
Closing Date.
Mutual Cooperation. Buyer and Seller agree to cooperate with one
another in all reasonable respects in connection with any approvals,
zoning changes or variances, or similar actions or consents which may be
necessary or appropriate in connection with use of the Property and to
otherwise cooperate in all reasonable respects in connection with the
development of the Property. As of the Closing Date the Property shall be
properly zoned for commercial real estate with all necessary zoning
variances, if any are required, approved for Buyer’s intended
development. Buyer shall pay all costs incurred by either party in
connection with satisfying this condition.

7. The 2016 Comprehensive Master Plan shows the tract is located in an
area with Light Industrial as the preferred land use and within a
commercial and industrial corridor.
8. City Engineering has reviewed this zone change request, and does not
oppose it; the usual comprehensive plan set including civil site plan,
drainage and grading plan, drainage report, utility plan, truck access and
onsite circulation movements, landscaping / irrigation plan, and outdoor
lighting plan will be required for the development review process.
9. In the packet, I’ve included excerpts from the OVERLAND NORTH
GRAND SUMMARY PLAT by Souder, Miller & Associates, an excerpt from
a Preliminary Site Plan by Overland Engineering, LLC. See Appendix F, a
Google Earth Street View photo from June 2021 showing the property.
10. On February 8, 2024, City Council approved Ordinance 2024-13 an Ordinance
for the Purchase and Sale of Property by the Seller, City of Roswell, and Buyer,
The Overland Group.
Ms. Hildreth: I will now read the Findings of Fact/Conclusions of Law.

III. Intent of Petition:
The applicant for Zoning Case 24-010 SUP is requesting a Special Use Permit to
convert a professional office into a hair salon in the R-4 Residential Zoning District.
IV. Planning & Zoning Commission Considerations from Staff Review:
1. The corner lot property under consideration is located at 1010 S Sunset Ave
within the City of Roswell jurisdiction on the west side of Sunset Avenue
and the north side of Camino Real. Chaves County Assessor Information
shows a 2,350 square foot building constructed in 1969.
2. The property under consideration is in the R-4 Residential Zoning District
and was previously used as a professional medical office.
3. The corner lot property has access driveways on Camino Real (Local Road),
and Sunset Avenue (Minor Arterial).
4. The surrounding uses include single family residential to the west and
Town Plaza apartment complex is located on the east side of Sunset
Avenue. The abutting parcel to the north is currently vacant undeveloped. A
residential fourplex is located on the south side of Camino Real.

V. Findings of Fact (Conclusions of Law):
1. A notice of the time and place of the public hearing for this case was published in
the Roswell Daily Record at least fifteen (15) days prior to the date of this hearing.
2. Notifications of the public hearing were mailed via certified mail with return
receipt requested to property owners of record, as shown by the Chaves County
Assessor Map, with lots or land within one-hundred (100) feet of the area under
consideration, excluding public rights-of-way.
3. This agenda, which includes this case, has been posted at City Hall and on the City
of Roswell’s website for over seventy-two (72) hours as required by State of New
Mexico law for a public hearing.
4. At the time of this writing, the Planning & Zoning Office has received zero (0)
written protests, zero (0) verbal protests, and zero (0) inquiries.
5. City of Roswell Zoning Ordinance Article 18: R-4 Residential District allows
barbershops and beauty shops in the R-4 Residential Zoning District with a Special
Use Permit; Article 18 B. Special Uses refers to Article 16: R-3 Residential District
B. Special Uses are as follows 13: Barbershops and beauty shops.
6. City of Roswell Zoning Ordinance Article 3 Section 8. Special Uses Paragraph D
allows the Planning and Zoning Commission to “decide whether or not to approve
a request for a special use. In its deliberations, the Planning and Zoning
Commission shall consider the impact of a special use upon the public health,
safety, and welfare of the community; the existing and anticipated
vehicular/pedestrian traffic flows; parking conditions, setbacks, and height;
landscaping and screening; open spaces; signage; lighting; and other items. The
Planning and Zoning Commission shall not approve a special use unless it finds it
conforms to the City’s Land Use Plan, is in the public interest and is not solely in
the interest of the applicant.”
7. The property under consideration is currently within the jurisdiction of the City of
Roswell, New Mexico.
8. The 2016 Comprehensive Master Plan Preferred Land Use Scenario Map indicates
the property under consideration is located within an Infill/Redevelopment
Opportunities Area.

Unless evidence to the contrary is introduced in the public hearing, based on the Land
Use and Zoning Considerations, Findings of Fact, Staff Recommendations and

introduce a motion and vote to approve or deny Zoning Case 24-010 SUP.
