BOARD OF ADJUSTMENT MINUTES September 25, 2017 The Board of Adjustment will hold its regular monthly meeting on Monday, September 25, 2017 at 5:00 p.m. in the Council Chambers at City Hall. Members Present Chairman Lannis Nicholson Vice-Chair Wendell Miller Karen Yarbrough Members Absent Secretary Peggy Stratton Rob Caldwell Visitors Present: Mayor Horton, City Planner James Walden, City Engineer Kurt Jones, Fire Marshall Setian, City Attorney Trey Smith, and Planning Assistant Lequitta Jones. Welcome Visitors The First Order of Business was a request to review and approve the minutes of the August 28, 2017 meeting. Commissioner Miller made the motion to approve the minutes as written. The motion was seconded by Member Yarbrough and passed unanimously. The Second Order of Business was a public hearing requesting approval to expand/remodel a non- conforming structure at 1309 South El Paso to allow a 14-foot front yard setback from the 25 feet required. Submitted by James Dunbar. (BOA.17.09.3632) Member Miller made the motion to approve the minutes as written. Planner Walden said this request is to remodel an existing nonconforming structure and allow a 320 square foot addition to the north side of the structure. The Comments: 1. The R-2 zoning building setback requirements is 25 feet, which this house does not meet, (presently 14) feet. 2. The setback of the property across the street is also not 25 feet. These conditions most likely came about as the neighbor developed and the street was improved. 3. The segment of El Paso is not a high-traffic street in the city. 4. The addition will meet all setback and area requirements and will not increase the structure’s nonconformity. The Recommendation for Action is approval. Approval will allow reinvestment in the property and neighborhood, a goal of the city. Despite the existing nonconformity, allowing the remodel and addition meets the spirit and intent of the zoning code. There were no outstanding issues noted by the members.
