BOARD OF ADJUSTMENT MINUTES October 19, 2023 @ 5:00 p.m. The Board of Adjustment held a special called meeting on Thursday October 19, 2023 at 5:00 p.m. Members Present Wendell Miller, Chairman Don Jacimore, Vice Chairman Wayne Cummings Josh Stroud Members Absent Justin Cothren, Secretary Visitors Present: City Planner Sara Jondahl, Planner I Victoria Marchant, and Mayor Fred Teague. Welcome Visitors The First Order of Business is a Variance from Article 7.8 (8) (B) to allow a pylon sign taller and larger than that allowed by code located at 105 E Harrell Drive. Submitted by D & P Investments Inc. (VARI-0923-000433) Planner I Marchant stated that the existing conditions are that located at 105 E Harrell Drive within the Highway 7 Interchange District, this was the previous location of Dixie Cafe and the new location of Old South Restaurant. She stated that it is a C-2 (Highway Commercial) zoned property surrounded by other C-2 zoned properties including such uses as numerous hotels, restaurants, and a small strip mall. Planner I Marchant stated that the application is to allow a 256 square foot sign despite the 150 square foot limit to allow a total sign height of 63’ despite the 35’ allotment. She stated that although the applicant has not demonstrated special conditions exist the applicant has provided reasons to justify the variance being granted. She stated that the granting of the variance is the minimum variance allowing reasonable use of land. She stated that the applicant has demonstrated that they are coming closer into compliance with the sign regulations. She stated that while the dimensions of the sign are remaining the same, the applicant is reducing the total height of the sign by approximately 9.5’ therefore they are coming closer into compliance with the sign regulations, providing a reasonable basis to approve the Variance. She stated that the applicant has met all other variance requirements. It is staff’s recommendation that the Board of Adjustment approve this variance request based on the findings below: 1. The applicant has provided a reasonable basis to justify the Variance. Member Jacimore made a motion to approve the variance. The motion was seconded by Member Cummings and passed unanimously.
