SUGGESTED MOTION No motion necessary. EXECUTIVE SUMMARY This study session will inform the Commission and Council of the changes Staff proposes in response to the feedback received at the February 27, 2023 study session. The amendment serves to streamline the residential zones and to implement specific action items from the housing strategy. STRATEGIC PLAN ☐ Economic Expansion & Placemaking ☐ Outreach & Communication ☐ Infrastructure ☐ Highly Performing Organization ☐ Community Well-being ☐ Other GOALS/OTHER: FINANCIAL / BUDGET SUMMARY DISCUSSION BACKGROUND: On February 27, 2023, the Town Council and Planning & Zoning Commission held a joint Study Session, and staff presented the draft amendment and the results of the public outreach process. In addition, the Town Council and Planning and Zoning Commission provided Staff with feedback on the draft and direction to return for another study session. PROPOSED CHANGES: Based on the Commission and Council feedback, Staff has made some proposed changes to the draft amendment and has detailed those changes below. Town Council Agenda Communication Tiny Homes: • Only allow tiny homes on wheels in the RH, GR-1, and SR Zones when attached to a foundation and either ground set or skirted. In the Manufactured Home zone, they would be permitted without being ground set or skirted. This will provide consistency with where RVs are permitted and eliminate a concern that Town residents commonly expressed during our public outreach. February 27th Study Session Version: W. Tiny Homes: 1. Stick-built tiny homes are permitted in any residential zone. 2. Tiny homes built on chassis with wheels, where the wheels are removed and the tiny home is attached to a foundation, are permitted as the main house in RH, GR-1, and SR. The foundation must use skirting to appear ground-set. 3. Tiny homes on wheels are permitted in RH, GR-1, and SR with a minimum 100’ setback from any property line and must use skirting to appear ground-set. 4. Tiny homes on wheels that are licensed as a vehicle are not considered tiny homes and shall follow the regulations for recreational vehicles. Proposed: 1. Site-built tiny homes are permitted in any residential zone. 2. Tiny homes built on trailers with wheels are permitted as the main home in the RH, GR-1, and SR zones when attached to a foundation and either ground set or skirted. 3. Tiny homes on wheels are permitted in the MH Zone. Accessory Dwelling Units: Minimum lot size: Feb 27th Study Session Version: Minimum lot size 8,000 square feet. Proposed: Minimum lot size 11,000 square feet. Members of the Commission and Council expressed concern with ADUs being placed in very tight backyard spaces. Increasing the minimum lot size for an ADU addresses this concern. Setbacks: Feb 27th Study session Version: R-4 and R-5 rear yard setbacks are 5 feet, consistent with setbacks for other types of accessory structures (sheds, ramadas, etc.). Proposed: Increase the R-4 and R-5 setbacks for Accessory Dwelling Units from 5 feet to 10 feet. At the study session on February 27th, the Council and Commission expressed a desire for consistency with setbacks for other structures and a concern over the proximity of ADUs to adjacent properties. Therefore, in the R-4 and R-5 zones, where the proposal had 5-foot setbacks for detached ADUs in keeping with the 5-foot setback that applies to other accessory structures, we propose increasing that setback to 10 feet for ADUs. Town Council Agenda Communication Maximum Height: Feb 27th Study Session Version: Detached ADUs are limited to 16 feet in height regardless of where they are located on the property, while attached ADUs have the same maximum height requirement as the main house. Proposed: Change the maximum height requirements to allow ADUs, whether attached or detached, that meet the main house setbacks to have the same maximum height as the main house and those that extend past the main house setbacks but meet the ADU setbacks to be limited to 16 feet. At the last study session, there was discussion regarding consistency with the setbacks for the house and detached ADUs. However, detached ADUs and accessory structures generally have a lower maximum height than the main house. Staff finds that a 29-foot tall ADU, as opposed to a 16-foot tall ADU at the same setback, has a greater impact on the adjacent property owner. This proposal allows for consistency with setbacks for other structures but attempts to lessen the impact on adjacent property owners though the height step-down requirement. Parking: February 27th Study Session: Staff sought comments from the Council and Commission regarding parking for Accessory Dwelling Units. In response, Staff was directed to provide information on what is currently required for on-site parking for a house. Proposed: The Town code currently requires two parking spaces for a single-family home plus one guest parking space for every four homes. This requirement can be met with the garage or the driveway if the driveway is long enough. Guest parking may be provided on-street or in common areas. We do not have standards for driveway width or paving. Town Council Agenda Communication Staff recommends requiring one parking space for an ADU but allowing that parking space to be provided on-site or on-street where there is adequate legal parking along the property’s frontage. The one additional parking space should be easily met on-site in most cases. However, if there is a case where a parking space is not available on-site or on the street, the applicant would be required to create an additional space on-site. Interior ADU At the February study session, staff was asked to clarify interior ADUs like the NextGen product offered by Lennar. To ensure that an interior ADU would be allowed, Staff has added the following definition for an interior ADU: A delineated living area located within a dwelling unit that has interior pedestrian access to the common area of a dwelling unit, such as a foyer, living room, laundry room, basement, etc., shares a primary entrance and exit, contains permanent facilities for living, sleeping, eating cooking and sanitation, and may have a separate secondary entrance/exit. Design: The February 27th study session draft did not include any standards related to the design of the accessory dwelling unit. Staff is also proposing adding language that the ADU must be architecturally compatible with the existing home: The ADU’s architectural character (colors, details, materials, roofs, etc.) shall be compatible with the primary dwelling unit. Single-Family for Rent Subdivision Staff was asked to clarify how a single-family-for-rent subdivision differs from townhomes or condos. The single-family for-rent subdivision is not subdivided -- townhomes and condos are. The single-family for-rent subdivision would include several single-family homes on one lot under one property owner, such as how apartment complexes are operated. To allow this in our code, we had to allow for more than one single-family home on a lot in the R-4 and R-5 zones. Applicability: The Council requested that Staff clarify what areas of Town the amendment would apply to. Attachment 1 is a map showing where the residential zones amendment would apply. Note that areas with HOAs could restrict provisions of this amendment, such as allowing ADUs, through their CC&Rs. Study Session: Residential Zones Code Text Amendment April 10, 2023 Study Session Purpose • Present the proposed changes to the February 27th study session version of the draft. • The Commission and Council had requested that Staff make changes and provide additional information on specific elements of the draft. • Collect feedback from the Commission and Council on those changes and get direction on next steps. Tiny Homes • Allowing tiny homes on wheels in the RH, GR-1, and SR Zones, where the tiny home is attached to a foundation and is skirted or ground set • Allow tiny homes on wheels in the MH Zone. • Members of the Council and Commission had raised some questions regarding the difference between a tiny home on wheels and RVs. • This provides consistency with where RVs are permitted as well as eliminates a concern expressed by the public. Accessory Dwelling Units Minimum lot size • Increasing the minimum lot size required to allow an ADU from 8,000 square feet to 11,000 square feet. • Members of the Council and Commission expressed concern with ADUs in very tight yards. Accessory Dwelling Units Setbacks • Increase the minimum setback from 5 feet to 10 feet in the R-4 and R-5 zones. • The Council and Commission expressed a desire for consistency but also a concern with the proximity to the rear property lines. Accessory Dwelling Units Maximum Height • ADUs that meet the main house setbacks have the same max height requirement as the main house. • An ADU or portion of an ADU that extends past the main house setback but is within the ADU setback would have a maximum height of 16 feet. • Accessory structures have lower maximum heights than main buildings making this more consistent with those requirements. Accessory Dwelling Units Interior ADUs • Adding a definition to the amendment that clarifies that interior ADUs are permitted and what constitutes an interior ADU. Single Family for rent vs. Condos/Townhomes • Single Family for rent – is not subdivided, townhomes and condos are subdivided. • All homes are rented to tenants and owned by a common owner-- condos and Townhomes are generally under separate owners. • Operated the same as an apartment complex Where does the amendment apply?
