AGENDA FOR REGULAR MEETING OF THE COMMON COUNCIL DECEMBER 11, 2024 7:00 PM COURT ROOM OF THE MUNICIPAL BUILDING At approximately 6:30 PM, the Mayor and Council will hold a work session in the Conference Room for the purpose of reviewing agenda items and signing bills. No official action will be taken during this time. Pledge of allegiance and moment of silence. 1. Call to order at 7:00 PM. 2. Public Hearing on the proposed Local Law for 2024 to increase the salary of certain elected officials of the City of Salamanca. Note: This is the public hearing before the Mayor that is required before the final adoption of any Local Law 3. A resolution approving and dispensing with the reading of the minutes of the last regular meeting of November 23, 2024 and special meeting of November 25, 2024. OLD BUSINESS: NEW BUSINESS: 4. A resolution confirming an amended contract between the City of Salamanca and the County of Cattaraugus for distribution of State Finance Law Section 99-h funds to be extended until New York State and the Seneca Nation of Indians enter into a new tribal compact and further authorizing the Mayor to sign such agreement. A resolution approving the tentative agreement with the Salamanca Professional Firefighters Local 2501 for a successor collective bargaining agreement, for a term of April 1, 2024 through March 31, 2027. Sponsor: Council Member Johnson 6. A resolution authorizing the City to apply for Ralph Wilson Jr. Legacy grant fund to be used toward the wages of Art’s Alive summer theater program staff. Sponsor: Mayor Magiera and Council Member Reed 7. A resolution supporting and authorizing an application for Empire State Development Corporation (ESDC) Restore NY grant funding for the rehabilitation of seven vacant City owned properties, with the City matching funds up to $100,000.00 and further authorizing the Mayor to sign any required documents and schedule a public hearing for 4:00 PM on Wednesday, December 18, 2024. A resolution rejecting the three low bids of Dynasty Construction, Cory, PA for the City Hall Records Storage Room and further accepting the bid of Kinley Construction, Allegany, NY for General Construction in the amount of $76,215 and BECC Electric for Electrical in the amount of $13,250. NO ACTION TAKEN - A resolution authorizing the City Comptroller to deposit funds received by the City from the sale of real property into an interest-bearing account and that the interest from such funds are to be used exclusively to offset the cost of emergency repairs to City-owned properties. A resolution approving the Mutual Aid agreement between Cattaraugus County Emergency Services and the City for Emergency Medical Services and further authorizing the Mayor to sign such agreement. Sponsor: Council Member Johnson 11. A resolution authorizing the creating of three Firefighters positions, as recommended by the Fire Commission. Sponsor: Council Member Johnson 12. A resolution authorizing the execution of all necessary documents to contract with Empower Life & Annuity Insurance Company of NY in conjunction with Empower Trust Company, LLC as Trustee for the administrative, financial and trustee services for the City of Salamanca/City of Salamanca BPU employees Deferred Compensation Plan (Model 457 Plan) for a five-year period, contingent on approval of the City Attorney. A resolution accepting the quote of Ricoh USA, Inc., Atlanta, GA for the buyout of the Ricoh IMC4500 copy machine in the amount of $1,779.63. Sponsor: Mayor Magiera 15. A resolution supporting the NYCOM campaign to request NYS to increase Municipality Arterial Maintenance Reimbursement rates and further authorize the Mayor to sign such support letter. Sponsor: Mayor Magiera 16. Certain appointments by the Mayor and Common Council 17. A resolution to waive the agenda rule to consider other items(s), if necessary. a. A resolution to appoint Logan Grinols, Salamanca, NY, as Provisional Part-time Dispatcher, effective December 22, 2024, contingent on being reachable on a Civil Service list, according to the current union contract 18. Communications from the Mayor and Council. 19. Reminder of other meetings – December 17th BPU at 6:00, January 7th Fire at 6:30, January 8th IDA at 4:00, January 8th DPW at 6:00 and the next Regular Council will be January 8th at 7:00 PM. 20. A resolution authorizing payment of the bills as warranted and recommended by the appropriate Commissions and/or Department Heads, the City Comptroller and City Clerk and accept reports.
