CITY COUNCIL REGULAR MEETING
A Regular Meeting of the City Council was held remotely via zoom on Thursday,
September 9, 2021, at 7:00 P.M. for the purpose of transacting any and all business.
Notice of this meeting was posted on September 7, 2021, at 1:20 P.M. This meeting is
being taped and is live on S.A.T.V.
All Councillors were present.
Council President Madore presided.
Councillor Sargent moved to dispense with the reading of the record of the previous
meeting. It was so voted.
President Madore requested that everyone please rise to recite the Pledge of
Allegiance.
PUBLIC TESTIMONY

(#49) – VERIZON TO INSTALL TELECOMMUNCIATIONS ON BRIDGE STREET
Held from the last meeting of July 15, 2021, an order from Verizon Wireless to install
Telecommunications on Bridge Street. The hearing was kept open until the next
meeting on September 23, 2021.
#419 – APPOINTMENT OF MATTHEW MALONE TO THE CULTURAL COUNCIL
The Mayor’s appointment of Matthew Malone of 18 1/2 Pickman St. to the Salem
Cultural Council with a term to expire August 25, 2024 was received and filed.
#420 – APPOINTMENTS TO THE SCHOLARSHIP AND EDUCATION COMMITTEE
AND CONSERVATION COMMISSION
The Mayor’s appointment of the following with terms to expire on were held under the
rules until the next meeting on September 23, 2021.
Samuel Lim, Atlantic Hall, Salem State University to the Scholarship & Education
Committee for a term to expire April 25, 2022
Gabriel Yeager of 205 Highland Ave. to the Scholarship & Education Committee for a

(#370) – APPOINTMENT OF ZACHARY CAUNTER TO THE PLANNING BOARD
Held from the last meeting of July 15, 2021, the Appointment of Attorney Zachary
Caunter to the Planning Board with a term to expire March 10, 2026 was confirmed by a
unanimous roll call vote of 11 yeas, 0 nays and 0 absent.
Councillor McCarthy requested and received suspension of the rules to allow Mr.
Caunter to speak. Councillor McCarthy requested that a letter of thanks and City Seal
be sent to DJ Napolitano.
(#297) – CONSTABLE APPOINTMENT – CHRISTINA SORENSON
The Mayor’s reappointment of Christina Sorenson as a Constable with a term to expire
on March 8, 2022 (Housekeeping purposes only was adopted. During the June 10,
2021, Council Meeting term submitted as March 8, 2024.
#421 – APPROPRIATION OF $612,511.83 TO THE TRANSPORTATION ENHANCEMENT
FUND
The following order submitted by the Mayor was referred to the Committee on
Administration and Finance under the rules. Councillor Dibble objected to the suspension of
the rules.
ORDERED: That the sum of Six Hundred Twelve Thousand, Five Hundred Eleven Dollars
and Eighty-Three Cents ($612,511.83) is hereby transferred and appropriated from the
“Stabilization Fund” to the Transportation Enhancement Fund (25T9) to support city-wide
on-demand rideshare service and other priority transportation projects in accordance with
the recommendation of Her Honor the Mayor.
#422 – APPROPRIATION OF $501,295.63 FOR RETIREMENT BUYBACKS
The following order submitted by the Mayor was adopted under the suspension of the rules
by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent.
ORDERED: That the sum of Five Hundred One Thousand Two Hundred Ninety-Five
Dollars and Sixty-Three Cents ($501,295.63) be approved within the “Retirement
Stabilization Fund-Vacation/Sick Leave Buyback” account (83113-5146) to be expended for
the contractual buyback(s) listed below in accordance with the recommendation of Her

#423 – APPROPRIATION OF $114,732.58 FOR RETROACTIVE WAGES
The following order submitted by the Mayor was adopted under the suspension of the rules
by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent.
ORDERED: That the sum of One Hundred Fourteen Thousand, Seven Hundred Thirty-
Two Dollars and Fifty-Eight Cents ($114,732.58) is hereby appropriated from General
Stabilization to the "Human Resources Retro Wages Account” (11521-5161) for the
FY2021 and FY2022 retroactive wages for the pay increases for the contract
settlements reached with AFSCME Council 93, AFL-CIO, Local 818 in accordance with
the recommendation of Her Honor the Mayor.
#424 – APPROPRIATION OF $39,379.67 FOR FY20 & FY21 INVOICES FOR
SCHOOL DEPARTMENT
The following order submitted by the Mayor was adopted under the suspension of the rules
by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent.
ORDERED: Per MGL Chapter 44 Section 64 which allows for a municipality to pay for prior
fiscal year invoices using current fiscal year appropriations by two-thirds vote of the City
Council we request the sum of Thirty Nine Thousand, Three Hundred Seventy Nine Dollars
and Sixty-Seven Cents ($39,379.67) of outstanding Fiscal Year 2020 and Fiscal Year 2021
invoices is hereby allowed to be paid from the Fiscal Year 2022 School Department budget

CENTER AIR CONDITIONING AT POLICE DEPARTMENT
The following order submitted by the Mayor was adopted under the suspension of the rules
by a roll call vote of 10 yeas, 0 nays and 1 absent. Councillor Prosniewski recused himself
for this matter and was recorded as absent.
ORDERED: That the sum of Sixteen Thousand, One Hundred Eighty-One Dollars ($16,181.00) is
hereby appropriated within the “Capital Outlay” account (20002221-5846DD) to be expended for
emergency repair of the Dispatch Center air conditioning system by the Police Department in

#436 – ORDINANCE AMENDING TRAFFIC CH. 42 SECS. 51, 51B, & 75 – OCEAN AVE
The following Ordinance introduced by Councillor Turiel was adopted for first passage by a
unanimous roll call vote of 11 yeas, 0 nays and 0 absent.
An Ordinance Relative to Traffic, Ch. 42, Secs. 51, 51B, & 75
Be it ordained by the City Council of the City of Salem, as follows:
Section 1. Section 51 of Article V be amended by repealing the following:
Ocean Avenue - Parking Prohibited on Certain Streets - northeasterly side from a point opposite the
northwesterly line of Shore Avenue to the property line at the end of Ocean Avenue adjacent to the
southerly branch of Shore Avenue. (5/3/79 DPW 5-1604)
And replacing it with:
Shore Avenue - Parking Prohibited on Certain Streets - both sides from the end of Ocean Avenue to the
south easterly branch of Shore Avenue.
Section 2. Section 51B of Article V be amended by repealing the following:
Ocean Avenue - Parking Prohibited at Certain Times on Certain Streets - northeasterly side from a point
opposite the northwesterly line of Shore Avenue to the property line at the end of Ocean Avenue adjacent
to the southerly branch of Shore Avenue, Sundays and holidays, 9:00 A. M. to 4:00 P. M. June 1 to

Section 3. Section 75 of Article V-A be amended by repealing the following:
Ocean Avenue - Parking Prohibitions Towing Zone (Resident Sticker) - ZONE E-COLOR ORANGE-
both sides, in an easterly direction, from Lafayette Street to Summit Avenue (excluding Handicapped
Zone) twenty-four (24) hours a day seven (7) days a week. (7/10/91)
And replacing it with:
Ocean Avenue - Parking Prohibitions Towing Zone (Resident Sticker) - Zone E - Color Orange - both
sides in an easterly direction from Lafayette Street to Shore Avenue.
Section 4. This ordinance shall take effect as provided by City Charter.

#437 – TEMPORARY RESIDENT PARKING PERMITS FOR OCTOBER
The following Order introduced by Councillor Prosniewski was adopted as amended by a
unanimous roll call vote of 11 yeas, 0 nays and 0 absent.
Councillor Prosniewski requested and received suspension of the rules to allow David Kucharsky to
speak.
The amendments to delete Collins Street, add odd side and #14-18 even side only on Dalton
Parkway and amend East Collins Street to West Side only were adopted by a unanimous roll call
vote of 11 yeas, 0 nays and 0 absent.
Ordered: That residents of the following streets shall be granted eligibility for temporary resident
permit parking, and certain streets shall be designated as temporary resident permit parking
streets, from October 1 to November 1, 2021. Eligible residents will have a temporary resident
parking permit sent to them in the mail and must display the permit following the written
instructions included with said permit. One temporary guest pass shall be issued if requested in
accordance with Article VA Section 75A Subsection C. Temporary resident permit parking
signage will be installed on said streets. Temporary October Resident Permit Parking shall be in
effect from 5:00 P.M. to 7:00 A.M., Monday through Friday, and 12:00 P.M. to 7:00 A.M. Saturday
through Sunday, October 1 to November 1, 2021. Temporary October Resident Parking shall
occur on the street in existing parking areas and shall not supersede other parking restrictions,
including but not limited to, handicap/accessible parking spaces, parking within four (4) feet of a
driveway, parking within twenty (20) feet of an intersection, or parking restricted on a certain side

Temporary October Resident Permit Parking streets and all parking shall be prohibited during the

#438 – PARKING RATES FOR CANAL STREET DURING OCTOBER
The following order introduced by Councillor Turiel was adopted by a unanimous roll call vote
of 11 yeas, 0 nays and 0 absent. Councillor Turiel requested and received suspension of the rules
to allow David Kucharsky to speak.
Ordered: The parking rates for the location identified below shall be $1.00 per hour:
Canal Street – Temporary Parking Meter Zone Established – both sides, from the
intersection with Lyme Street to a point approximately two hundred fifty (250) feet south
of the intersection with Washington Street / Mill Street. October 1 to October 31, 2021.
Saturday through Sunday, 12:00pm to 6:00pm. Residents may park for free during
these times but must register with the Passport Parking App.
Councillor Dominguez asked if there was another way for people to pay if they cannot
download the app or understand technology.
Councillor Prosniewski asked if residents didn’t use the app and received a ticket would
your office waive the ticket.
Dave Kucharsky answered he would work with the Collector’s office since their office
receives these requests.
Councillor Dominguez asked what would be the indicator if this worked or doesn’t work.
Dave Kucharsky replied – utilization of this area and the compliance of or number of
citations.
Councillor Dominguez asked how this will be communicate to the residents that this will
be taking place.
Dave responded that the Mayor’s office will be putting out information and signage will
be put up by DPS.
Councillor Sargent asked if a person doesn’t have the app and the get a ticket can there
be an insert to say if you are a Salem resident send this ticket in with your car
registration and the ticket will be waived.
Dave Kucharsky responded he will have to check with the Collector’s office and look
into an insert.

#439 – ITALIAN FLAG BE DISPLAYED AT RILEY PLAZA
The following order introduced by Councillor Flynn was adopted as amended by a
unanimous roll call vote of 11 yeas, 0 nays and 0 absent.
The amendment was to change the dates from October 8 – 22 to October 15 – 26.
Ordered: That the Italian Flag be displayed at Riley Plaza from October 8 – 22 in honor of
the Italian-American Heritage and Cultural Month

Councillor Flynn was taken back by the comments made during public testimony.
Raising and Displaying this flag has nothing to do with Christopher Columbus.
Councillor Dominguez agreed with Councillor Flynn. WE need to be equal with
everyone. Don’t see any connection with Christopher Columbus. We are recognizing
our Italian Families in Salem.
Councillor Morsillo still questions how come one nationality for x amount of days and
others y amount of days. What about other nationalities. This is why there is an order
in Government Services to address this. This discussion needs to take place in
committee. This is turning into a conflict that shouldn’t be happening.
Councillor Sargent in response to Councillor Morsillo, we always accommodate those
that ask. Never flew Greek flag before until last year when someone approached him.
Only ask that American Flag flies higher than any other flag.
Councillor McCarthy asked if we could amend dates since Hispanic month ends on
October 15th. Then let Government services come up with a plan.
Councillor Dibble stated one flag can be lowered and the other one raised on the same
day to save on manpower hours.
Councillor Riccardi asked that Government Services take this up. Agrees with all the
comments said tonight.

#440 – NATIONAL GRID TO INSTALL EQUIPMENT ON HARBOR AND
WASHINGTON STREET
The following late file introduced by Councillor Turiel was adopted.
Ordered: That a public hearing for the petition submitted by National Grid to install a
SCADA (Supervisory Control and Data Acquisition) System in the public right of way be
held at our next regular Council meeting on September 23, 2021. This installation is
located at the intersection of Harbor and Washington Streets across from #3 Harbor
Street.
#441 – (#401 & #402) – GRANTING CERTAIN LICENSES
Councillor Morsillo offered the following report for the Committee on Ordinances,
Licenses and Legal Affairs. It was voted to accept the report and adopt the
recommendation.

Councillor Dominguez offered the following report for the Committee on
Community & Economic Development. It was voted to accept the report and
adopt the recommendation.
The Committee on Community & Economic Development to whom was referred
the matter of the former Ward 2 Club and related issues has considered said
matter and would recommend that the matter remain in Committee
Councillor Dibble stated he would like to see pressure put on the new owners to
get rid of the mosquitos.
Councillor Madore clarified that the mosquitos are not coming from the building.
It was a marsh area behind the building. The sidewalks have been repaired and
the foundation has now been filled.

The following zoning ordinance amendment was not adopted for first passage by
a roll call vote of 3 yeas, 7 nays, 0 absent and 1 Present. Councillors Sargent,
Flynn and Dominguez were recorded in the affirmative. Councillors Turiel,
Riccardi, Prosniewski, Morsillo, McCarthy, Hapworth, and Madore were recorded
in the negative and Councillor Dibble was recorded as present.
Clarification of vote prior to its taken a Yea vote is to adopt and nay vote is to Not

Ordered: That residents of the following streets shall be granted eligibility for temporary resident
permit parking, and certain streets shall be designated as temporary resident permit parking
streets, from October 1 to November 1, 2021. Eligible residents will have a temporary resident
parking permit sent to them in the mail and must display the permit following the written
instructions included with said permit. One temporary guest pass shall be issued if requested in
accordance with Article VA Section 75A Subsection C. Temporary resident permit parking
signage will be installed on said streets. Temporary October Resident Permit Parking shall be in
effect from 5:00 P.M. to 7:00 A.M., Monday through Friday, and 12:00 P.M. to 7:00 A.M. Saturday
through Sunday, October 1 to November 1, 2021. Temporary October Resident Parking shall
occur on the street in existing parking areas and shall not supersede other parking restrictions,
including but not limited to, handicap/accessible parking spaces, parking within four (4) feet of a
driveway, parking within twenty (20) feet of an intersection, or parking restricted on a certain side
of the street.
Temporary signage shall be installed before October 1 indicating streets designated as
Temporary October Resident Permit Parking streets and all parking shall be prohibited during the
hours indicated except by motor vehicles displaying a Temporary October Resident Parking
permit.
