CITY OF SALEM SEPTEMBER 23, 2021 CITY COUNCIL REGULAR MEETING A Regular Meeting of the City Council was held remotely via zoom on Thursday, September 23, 2021, at 7:00 P.M. for the purpose of transacting any and all business. Notice of this meeting was posted on September 21, 2021, at 10:00 A.M. This meeting is being taped and is live on S.A.T.V. Councillors absent: Council President Madore presided. Councillor McCarthy moved to dispense with the reading of the record of the previous meeting. It was so voted. President Madore requested that everyone please rise to recite the Pledge of Allegiance. Fawaz Abusharkh, 4 Harrison Rd., - Afghan Resolution (#49) – VERIZON WIRELESS TO INSTALL TELECOMMUNICATIONS ON BRIDGE STREET Held from the last meeting of September 9, 2021, the order from Verizon Wireless to install Telecommunications on Bridge Street was held open until the next meeting on October 14, 2021. #485 – (#447) – COMCAST TO INSTALL CONDUITS ON BRIDGE STREET A hearing was held on the order from Comcast to install Conduits at Bridge Street. Dave Flewelling appeared in favor to explain this is needed to provide service to 136- 146 Bridge Street. No one appeared opposed. The motion to close the hearing was granted by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent. The order was granted by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent.  2 CITY OF SALEM SEPTEMBER 23, 2021 CITY COUNCIL REGULAR MEETING #486 – (#448) – NATIONAL GRID TO INSTALL CONDUITS ON BRIDGE STREET A hearing was held on the order from National Grid to install Conduits at Bridge Street and Washington Street. Sibhita Mahabier-Sheehy appeared in favor. No one appeared opposed. The motion to close the hearing was granted by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent. The order was granted by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent. #487 – (#449) – NATIONAL GRID TO INSTALL CONDUITS ON LORING AVENUE A hearing was held on the order from National Grid to install Conduits at Loring Avenue. Sibhita Mahabier-Sheehy appeared in favor. This is needed to provide service to 602 Loring Avenue. No one appeared opposed. The order was granted by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent. #488 – (#440) - NATIONAL GRID TO INSTALL GAS PRESSURE REGULATOR STATION ON HARBOR STREET AT WASHINGTON STREET A hearing was held on the order from National Grid to Install Gas Pressure Regulator Station on Harbor Street at Washington Street. Appearing in favor was Chris Maher a National Grid Representative. Councillor Turiel asked what the comparative dimensions were. Mr. Maher responded that the new traffic cabinet installation will be adjacent, and it is 2 feet wide by 3 feet long and stands 4 feet high. Councillor Flynn asked with the gas pressure regulator will there be any odor in the area and also any danger of any leaks if this gets knocked over? Mr. Maher responded there would be no odor it is strictly to monitor pressure and there is the ability to adjust remotely. There are bollards on either side. If it still gets hit, there is no danger to the increase pressure in the vault. The traffic box has no effect on the pressure but there may be a small release of natural gas. Councillor Dibble asked that the following condition by set: Full concrete sidewalk panels be saw cut and replaced with ALTERNATING BROOM FINISH concrete panels to match the existing park perimeter sidewalk panels. It was so voted. No one appeared opposed. The motion to close the hearing was granted by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent. The order was granted with the condition by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent.  3 CITY OF SALEM SEPTEMBER 23, 2021 CITY COUNCIL REGULAR MEETING (#420) – APPOINTMENTS TO THE SCHOLARSHIP COMMITTEE AND CONSERVATION COMMISSION Held from the last meeting, the Mayor’s appointments of the following with their terms to expire: Samuel Lim, Atlantic Hall, Salem State University to the Scholarship & Education Committee for a term to expire April 25, 2022, Gabriel Yeager of 205 Highland Ave. to the Scholarship & Education Committee for a term to expire September 10, 2023, Judith Kohn of 145 Federal St. to the Conservation Commission for a term to expire November 15, 2021 were confirmed by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent. Rule 29A was suspended for Samuel Lim’s appointment. Suspension of the rules were requested and received to all Gabriel Yeager and Judith Kohn to speak. #489 – REAPPOINTMENT OF CAROLE HAMILTON TO THE PLANNING BOARD The Mayor’s Re-Appointment of Carole Hamilton of 4 Willow Ave. to the Planning Board With a term to expire September 23, 2026 was confirmed by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent. #490 – APPROPRIATION OF $54,755.17 FOR OFFICE RECONFIGURATION EXPENSES The following order submitted by the Mayor was adopted under suspension of the rules by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent. ORDERED: That the sum of Fifty-four Thousand Seven Hundred Fifty-Five Dollars and Seventeen Cents ($54,755.17) is hereby appropriated within the “Capital Outlay” account (20002202-5846DE) to be expended by the Building Department for various office reconfiguration expenses in accordance with the recommendation of Her Honor the Mayor. #491 – RESOLUTION SUPPORTING THE RESETTLEMENT OF AFGHAN REFUGEES IN THE UNITED STATES The following resolution was submitted by the Mayor. Resolution: Supporting the Resettlement of Afghan Refugees in the United States WHEREAS: Global conflicts and war have fueled the largest refugee crisis since World War II and, according to the United Nations Refugee Agency, more than 65.6 million people have been displaced worldwide, with 22.5 million living as refugees; and  4 CITY OF SALEM SEPTEMBER 23, 2021 CITY COUNCIL REGULAR MEETING WHEREAS: Afghan refugees are fleeing war, armed conflict, violence, religious persecution, and human rights abuses from the Taliban and other terrorist organizations in their country; and, WHEREAS: Afghan refugees are being persecuted by Taliban forces and other terrorist groups for aiding the United States, our allies, and other relief and assistance organizations for their work serving as interpreters, information sources, and cultural intermediaries during the war; and, WHEREAS: The lives and safety of American service men and women, as well as American diplomats, relief workers, and others who served in Afghanistan were protected thanks to the efforts, dedication, and sacrifices of these newly displaced Afghans; and, WHEREAS: These refugees include men, women, and children – whole families who cannot return home due to the danger to their lives and are being properly screened and reviewed by relevant federal government agencies prior to coming the United States; and WHEREAS: Salem supports and embraces America’s historic tradition of welcoming refugees as a central part of our values as a nation and our unwavering respect for human rights; and WHEREAS: Salem is a sanctuary for peace, welcoming all neighbors and those who wish to be our neighbors without discrimination because of their race, ethnicity, place of origin, religion, or language. NOW THEREFORE BE IT RESOLVED: That the Mayor and City Council affirms the City of Salem’s support for the resettlement of Afghan refugees through the U.S. State Department’s U.S. Refugees Admissions Program and pledge to continue to work with state and federal partners and local stakeholders to identify ways the City can help welcome these refugees to America and support their integration into our communities. Councillor Prosniewski stated it was important to bring this in at this time. It shows who we are and what we stand for. Councillor Dibble stated he would support this but had some concerns. He made a motion to replace the word sanctuary with city. Councillor Prosniewski stated sanctuary is just a word. He understands the division it caused at the time of the ordinance was brought in. This motion failed by a roll call vote of 4 yeas, 7 nays and 0 absent. Councillors Sargent, Flynn, Dominguez, and Dibble were recorded in the affirmative and Councillors Turiel, Riccardi, Prosniewski, Morsillo, McCarthy, Hapworth and Madore were recorded in the negative. The matter did not carry.  5 CITY OF SALEM SEPTEMBER 23, 2021 CITY COUNCIL REGULAR MEETING The Resolution was adopted by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent. #492 – COMMUNICATION FROM THE MAYOR AND POLICE CHIEF MILLER TO ADDRESS THE COUNCIL RELATIVE TO OCTOBER The letter submitted by the Mayor for her and Police Chief Lucas Miller to briefly address the Council in order to provide an update about plans for our October season and Haunted Happenings was received and filed. Mayor Driscoll stated it was that time of year again to come before Council to give an update on October and Covid protocols. Each year we learn and reflect on how to improve coordination among city departments and lessen the impact on residents. Mayor Driscoll reviewed the current conditions in Salem relative to Covid. 82% have received 1 dose of vaccine with only 50% of people in the age range of 16-29 years old receiving a vaccine shot. If you are under 12, you cannot be vaccinated. Seeing cases on the rise due to the delta variant. Hospitalization at Salem Hospital has increased. Currently there are 13 covid cases and 2 in the ICU. The average age of those hospitalized is 46 years old. There is an increase of break through cases. That is why the Board of Health has an indoor mask mandate. You must have a negative covid test within 72 hours of an indoor event of over 100 people. Destination Salem is informing tourists regarding Covid protocol on their media. Salem is setting up rapid testing in Salem along with our normal testing site that has moved to St. Peters Church. Mayor Driscoll turned the public safety planning portion over to Chief Miller. She stated we are fortunate to have a Police Chief who comes with a lot of expertise from his working in NY and Joint Terrorism Task Force. Chief Miller thanked the Councillors for the opportunity to speak tonight. It is particularly critical this year since Halloween falls on a Sunday and last year there was no Halloween in Salem. We are prepared for it to be busy from Friday afternoon and all weekend. We are considering the two weekends before Halloween to be busy. In terms of pre-operational planning we are doing a table top exercise for next week relative dealing with unrest and terrorist attack to test our abilities on the way we communicate with each other and outside law enforcement agencies. Can’t say much more on this. In terms of greater threats, we have been in touch with the FBI who is doing a threat assessment for us. At this time, no specific threats. We have been conducting regular planning meetings with NEMLEC being our main outside agency. We have been in touch with drinking establishments for contact information. One strike and you are out policy. If you are removed from one drinking establishment you cannot go to any others. We have been in touch with the Beverly Airport to let us know if there are any unmanned aircrafts in Salem. We have been gradually increasing police presence downtown starting with crossing pedestrians at the Square. We will make use of our Special Police Officers. The NEMLEC van will be stationed on Hawthorne Blvd and we have requested additional cellular coverage. Downtown is divided into 5 sectors each with a Lt. and Sgt in Charge and augmented by outside agencies. Rest assured  6 CITY OF SALEM SEPTEMBER 23, 2021 CITY COUNCIL REGULAR MEETING we will not compromise the rest of Salem for coverage those are different beats. MA State Police Mounted unit will be here on 10/23, 10/24, 10/30 and 10/31. We provide safety to the visitors but also to the residents of Salem. Councillor Dominguez thanked the Chief and the Mayor for the information. He asked what the plans are to alleviate Halloween night traffic and parking. Chief Miller responded that the parking department is in the process of extending the residential zones. Our police department and the State police will enforce. There will be street closures in the downtown area. There will be Salem Police Dept. presence to facilitate residents in getting to their home if there is a barricade to their street. They can’t be there all day but can be dispatched. Chief Miller also stated that there will be coordination with the Salem Fire Dept. and EMS for emergencies. There will be mobile teams with one small vehicle to transport medical supplies and remove a person if needed. Councillor McCarthy thanked the Chief for the update and it’s nice to see he is expanding upon the past and adding some of his own personal touches. I am a fan of trick and treating but has there been any talks of moving the date to Saturday. Just curious not asking you too. Mayor stated has looked into this in the past and sent out a survey a few years ago and most responded as purists Halloween is October 31st. No time to switch this year but can look into it again. Councillor Prosniewski said he would be remised if he didn’t speak to this since he has worked Halloween as a police officer since this became big back in the 80’s. Hats off to Chief Miller this will be baptism by fire. You only know what you heard but not seen. The Salem Police year after year meet to see what works and what doesn’t. One word of advice is understanding that things are fluid there must be communications between downtown businesses and the rest of Salem on street closures and other matters i.e. robo calls, emails, etc. The trolleys need to know if a street is being shut down. Good Luck. Councillor Madore encourages businesses and residents to download the Salem app in order to receive the push notifications. She creates an October Survival Guide for her residents. Councillor Dibble stated that the Chief is doing a good job. Would like him to speak about the recent shootings and stabbings and any gang related issues coming into Salem for Halloween. Chief Miller attributed the interruption to significant high level gang arrests made by the Salem Police and FBI. There has been several shots fired can’t attribute to gangs but still investigating and will update you when he can.  7 CITY OF SALEM SEPTEMBER 23, 2021 CITY COUNCIL REGULAR MEETING Councillor Sargent referred back to the Covid information and asked how do we explain the break through cases. The Mayor explained that the vaccine doesn’t prevent you from getting or transmitting the virus. Many of these cases may have underlying conditions. That is why there is an indoor mask mandate or a negative test needed at these events. Not just sitting at one table but interacting with the whole room and then they go home and may have children under 12. The Mayor thanked all of the Public Safety officials and Chief Miller stated Salem is now his home and honored to appear before you. #493 – TRAFFIC ORDINANCE AMENDING CH. 42 SEC. 49 – STOP SIGN -GABLES CIRCLE The following ordinance introduced by Councillor Flynn was adopted for first passage by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent. In the year two thousand and twenty-one An Ordinance to amend an Ordinance relative to Traffic, Stop Sign Be it ordained by the City Council of the City of Salem, as follows: Section 1. Chapter 42, Section 49, Obedience to Isolated Stop Signs, is hereby amended by adding the following: Gables Circle, northwesterly bound traffic on Gables Circle at Puritan Road Section 2. This Ordinance shall take effect as provided by City Charter. #494 – TRAFFIC ORDINANCE AMENDING CH. 42 SEC 51 – PARKING PROHIBITED – SUMMIT STREET The following ordinance introduced by Councillor Flynn was adopted for first passage by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent. In the year two thousand and twenty-one An Ordinance to amend an Ordinance relative to Traffic, Parking Prohibited on Certain Streets Be it ordained by the City Council of the City of Salem, as follows:  8 CITY OF SALEM SEPTEMBER 23, 2021 CITY COUNCIL REGULAR MEETING Section 1. Chapter 42, Section 51, is hereby amended by adding the following: Summit Street: westerly side beginning 190 feet southwest of Butler Street, running for 40 feet, No Parking Anytime. Councillor Morsillo offered the following report for the Committee Ordinances Licenses and Legal Affairs co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation. The Committee Ordinances Licenses and Legal Affairs co-posted with the Committee of the Whole to whom was referred the matter Home Rule Petition for additional all alcohol liquor license for Jaho located at 57 Loring Ave. has considered said matter and would recommend that the matter remain in committee. #499 – (#421) - $612,511.83 APPROPRIATION FROM THE STABILIZATION FUND TO THE TRANSPORTATION ENHANCEMENT FUND Councillor Turiel offered the following report for the Committee on Administration and Finance. It was voted to accept the report and adopt the recommendation. The Committee on Administration and Finance to whom was referred the matter of a $612,511.83 appropriation from the Stabilization fund to the Transportation Enhancement Fund (TEF)– City Wide on demand rideshare service, has considered said matter and would recommend adoption by roll call vote. Councillor Dominguez stated this service is in conflict with the taxi drivers and taxi cab owners. Their livelihood is at risk. He asked for the Council to meet with them and see how it impacts them. Councillor Dibble that the proceeds from the marijuana tax should be used to help offset the tax rate to home owners. This funding for this ride share is hurting other real taxi companies and perhaps put them out of business. This is a great service but it is on the backs of the tax payers and putting private companies out of business. Councillor Dibble made a motion for this matter to remain in Committee and co-post it with the Comm. of the Whole and have this discussion. Councillor Turiel stated that the marijuana revenues we are getting as a local excise tax is going into the general fund and does off set taxes. The Community Benefit agreement was to have separate funds go into the TEF. Councillor Morsillo stated that the City did have discussions with the taxi cab and livery owners. Councillor Dominguez stated that they did but that was before this expansion. We need to communicate now that this is happening. The owners are worried about this new expansion so only asking for a conversation to continue. I am not against the program.  10 CITY OF SALEM SEPTEMBER 23, 2021 CITY COUNCIL REGULAR MEETING Councillor Prosniewksi agreed that we did have a discussion about taxi cabs versus liveries and how it affected them but that was before the expansion. I think conversations should continue. But no need to stop this order from going forward. Councillor McCarthy stated this is serving our most vulnerable population and this is only local not regional. Cab companies have the ability to go outside of the city. Saving money in the point. Sympathetic to the taxi owners, but we gave them an opportunity to participate in this or own it and they didn’t. This happened when people started using Ubers and lyfts. The Skipper serves our residents that are most vulnerable. Councillor Dibble stated he is not looking to stop this program but $612K is a sizable amount of money for this service and it may put 3 companies out of business. Only asking for this owners to have an opportunity to speak. It’s worth have a single meeting to be heard. Councillor Dibble’s motion to refer it to Administration and Finance co-posted with the Committee of the Whole did not pass. Councillor Madore wanted to mention if the money for this program was not approved by September 30th the service will stop. The order of appropriating $612,511.83 from the Stabilization Fund to the Transportation Enhancement fund was adopted by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent. #500 (#643 of 2019) – PORTRAIT OF THE NAUMKEAG PEOPLE TO BE HUNG IN THE COUNCIL CHAMBERS AND THE PORTRAIT OF PRESIDENT JACKSON TO BE MOVED TO THE ANTEROOM Councillor Hapworth offered the following report for the Committee on Government Services co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation. The Committee on Government Services co-posted with the Committee of the Whole to whom was referred the matter of the Portrait of a Representative of the Naumkeag People be hung in the Council Chambers and that President Jackson be moved to the Anteroom has considered said matter and would recommend to allow the City Clerk to put the Naumkeag Portrait in a prominent location in the City Council Chambers. Council Hapworth stated it was not the will of the Council to move the Jackson Portrait into the Ante Room. But all agree would like to see the new portrait in a  11 CITY OF SALEM SEPTEMBER 23, 2021 CITY COUNCIL REGULAR MEETING prominent location. Hopefully to the left of the Ante Room. Chris Pappen is coming on Monday. Councillor Sargent spoke about Andrew Jackson and his 2 terms as President. It was under him that every man could vote not just rich men and he gave Salem the surplus to build City Hall – that’s why he’s hanging there. The Indian Removal Act was not a good thing, but is was passed by the House and the Senate and he signed it. It was the will of the people back then. He was a flawed man; we all are. Councillor Morsillo would like to see portraits of women and minorities in the Chambers. They haven’t been given there due. Hope to find more space on the Council wall. Councillor Morsillo made a motion to tell the story of why he is there and put it into context. Councillor Turiel would like to see descriptions of all the portraits. Councillor Morsillo said the City Clerk should not have to do this. Councillor McCarthy agrees with a place of prominence but we should hold off on the amendment because we need to think through the concept and ADA compliance. Councillor Riccardi stated this conversation should continue in committee. The City of Salem Zoning Code is hereby amended as follows: 1. In section 1.5 replace “his” with “the registered land surveyor's” in all one instance. 2. In the year Two Thousand and Twenty-one An Ordinance Relative to Traffic, Ch. 42, Secs. 51, 51B, & 75 Be it ordained by the City Council of the City of Salem, as follows: Section 1. Section 51 of Article V be amended by repealing the following: Ocean Avenue - Parking Prohibited on Certain Streets - northeasterly side from a point opposite the northwesterly line of Shore Avenue to the property line at the end of Ocean Avenue adjacent to the southerly branch of Shore Avenue.
