CITY OF SALEM OCTOBER 10, 2024 REGULAR MEETING A Regular Meeting of the City Council was held in-person on Thursday, October 10, 2024, at 7:00 P.M. for the purpose of transacting any and all business. Notice of this meeting was posted on October 8, 2024, at 12:56 P.M. This meeting is being recorded and is live on S.A.T.V. and Zoom unless technological issues interrupt the transmission. Councillors absent were Councillor Harvey, Councillor Varela and Councillor Watson-Felt Council President Hapworth presided. Councillor Prosniewski moved to dispense with the reading of the record of the previous meeting. It was so voted. President Hapworth requested that everyone please rise to recite the Pledge of Allegiance. Salem City Council Land Acknowledgment The Salem City Council honors that this land is Naumkeag, or fishing place, where generations of Naumkeag people from the Pawtucket band of the Massachusett Tribe lived and passed through for centuries. We acknowledge that this is unceded Indigenous land and also acknowledge the Massachusett Tribe, who continue to honor and hold this land into the present. Salem’s City Council is committed to having ongoing meaningful dialogue with the indigenous peoples who have presence in Salem in order to dismantle the legacies of oppression and inequities that persist today Councillor Merkl requested and received suspension of the rules to allow Elizabeth Solemn to speak to welcome back the Indian Deed. There was no public testimony. (#455) – NATIONAL GRID TO INSTALL 1 JO POLE ON MARGIN STREET Held from the last meeting a hearing on the request from National Grid to install 1 Jointly Owned Pole on Margin St. at the intersection of Summer St. and Margin Street. National Grid withdrew the petition. No one appeared in favor or opposed Councillor Morsillo moved to close the Public Hearing. It was so voted. 2 CITY OF SALEM OCTOBER 10, 2024 REGULAR MEETING (#456) - APPOINTMENTS TO THE FOOD POLICY COUNCIL Held from the last meeting, the Mayor’s Appointments of the following to the Food Policy Council, with a terms to expire on September 23, 2027 were confirmed by a roll call vote of 8 yeas, 0 nays and 3 absent. Councillors Harvey, Varela and Watson-Felt were recorded as absent. Shelmy Mendez 34 Willson St. Celia Grant 8 Alvah Kittredge Pk, Roxbury Councillor Prosniewski requested and received suspension of the rules to allow Shelmy Mendez to address the Council. (Celia Grant was not present. Council informed of conflict) (#457) – APPOINTMENT OF THOMAS PINEROS SHIELD TO THE AFFORDABLE TRUST FUND BOARD Held from the last meeting, the Mayor’s Appointment of Thomas Pineros Shields 7 Bristol St to the Affordable Housing Trust Fund Board with a term to expire January 14, 2026 was confirmed by a roll call vote of 8 yeas, 0 nays and 3 absent. Councillors Harvey, Varela and Watson-Felt were recorded as absent. Councillor Cohen requested and received suspension of the rules to allow Thomas Pineros Shields to address the Council. (#458) – REAPPOINTMENT OF JIM BOSTICK TO THE PUBLIC ART COMMISSION Held from the last meeting, the Mayor’s Re-appointment of Jim Bostick to the Public Art Commission September 24, 2026 was confirmed by a roll call vote of 8 yeas, 0 nays and 3 absent. Councillors Harvey, Varela and Watson-Felt were recorded as absent. ORDERED: To accept the donation from the Salem Police Superior Officers Association (SPSOA) and Salem Police Patrol Officers Association (SPPOA) of a 2024 model, 7’ x 14’ EZ Hauler Enclosed Cargo Trailer valued at $9,483.90 in accordance with the recommendation of His Honor the Mayor. 4 CITY OF SALEM OCTOBER 10, 2024 REGULAR MEETING #481 – RESOLUTION REGOGNIZING THE SERVICE OF JOHN BORIS The following resolution submitted by the Mayor was adopted by a roll call vote of 8 yeas, 0 nays and 3 absent. Councillors Harvey, Varela and Watson-Felt were recorded as absent. Resolution: Recognizing the Service of John Boris WHEREAS: On October 10, 2024, we pay tribute to John Boris, as he steps down from official service to the City of Salem after a lifetime of dedication to the community. WHEREAS: John Boris moved to Salem more than 65 years ago and committed his life to supporting the community, both with formal and informal efforts. He often refers to his approach to service as “grassroots” oriented. He is dedicated to helping in whatever ways he can, and he is particularly focused on Salem’s needs around affordable housing, homelessness, food insecurity, disability rights and autism. WHEREAS: John survived a challenging start to life that ultimately influenced his compassionate outlook and approach to serving the community. When he was still a teenager, he quit high school and went into the military, where he served in France for two years. He eventually returned to Massachusetts where he worked hard to finish high school in his twenties. Next, he attended Bentley College, where he earned a Bachelor of Science in Accounting. WHEREAS: John’s official community service has included time as a member of the Salem Housing Authority Board (including many years as Chair), the Affordable Housing Trust Fund Board, and the Community Preservation Committee. WHEREAS: John has been a compassionate resource for people seeking housing, has personally paid for hundreds of people and families in crisis to stay in hotels temporarily, and worked to find longer term housing for them as well. WHEREAS: John has served on the board of Northeast Arc and has remained a very committed volunteer through that organization, assisting community members who have disabilities throughout the area. He and his wife, Anne, have donated hundreds of weighted blankets to community members with autism throughout the Northshore. WHEREAS: In 2019, John was honored with the American Red Cross Enduring Hero Award for his invaluable support to the Salem Police Department for their annual ‘National Night Out’ event. WHEREAS: John is well-known around the community as a resource to turn to and a solver of monumental problems, as well as a deeply generous person. 5 CITY OF SALEM OCTOBER 10, 2024 REGULAR MEETING NOW THEREFORE BE IT RESOLVED: That the Mayor of the City of Salem and the Salem City Council express our sincere appreciation and gratitude to John Boris for the dedication, kindness and generosity he has shared throughout his lifetime as a community member of Salem. AND BE IT FURTHER RESOLVED: That this Resolution be made a matter of record of these proceedings, and that a suitable copy be presented to John Boris along with a copy of the City Seal on behalf of the Mayor, the City Council, and the residents of Salem. #482 – NAMING OF A VETERANS SQUARE – SOBOCZINSKI SQUARE The following order introduced by Councillor Jerzylo was adopted. ORDERED: That the Salem City Council officially designate the corner of Daniels Street and Daniels Street Court as Soboczinski Square in honor of Private First Class William “Willie” Peter Soboczinski who was killed in action on November 9, 1944 during the battle for Metz, France. And Be It Further Ordered: That the Veteran’s Agent working in conjunction with the Police Traffic Division erect a suitable sign at this location. #483 – TO DISCUSS ADOPTING THE HERO ACT – MGL CH. 59, CLAUSE 22I AND 22J The following order introduced by Councillor Prosniewski was adopted. ORDERED: That the Committee on Government Services co-posted with the Committee of the Whole meet to review the letter submitted by the Salem Veterans Council to discuss adopting the Mass General Law relative to the HERO Act – MGL Chapter 59, Section 5, Clause 22I and 22J #484 – (#461) - RESOLUTION AND TAX INCREMENT EXEMPTION AGREEMENT FOR 38 NORMAN QOZB, LLC Councillor Merkl offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation. The Committee on Administration and Finance co-posted with the Committee of the Whole to whom it was referred the matter of Resolution and Tax Increment Exemption Agreement for 38 Norman QOZB, LLC, has considered said matter and would recommend adoption by roll call vote. 6 CITY OF SALEM OCTOBER 10, 2024 REGULAR MEETING The Resolution and Tax Increment Exemption Agreement for 38 Norman QOZB, LLC was adopted by a roll call vote of 8 yeas, 0 nays and 3 absent. Councillors Harvey, Varela and Watson-Felt were recorded as absent. Councillor Merkl stated this was a 10% exemption for 5 years. It is a mixed use building with commercial on the first floor and 21 units above. Two units are deemed affordable. At first they were going to be rental units, but it did not work out financially to be rentals so they moved to be home ownership. Perspective owners will benefit from the exemption. But the developers will be able to get HDIP incentives. This passed in committee 5 in favor none opposed. Councillor Cohen stated it is unfortunate that there the Home Rule Petition for condo conversion did not get adopted at the State level. It is harder for middle class and below to purchase a home. #485 – (#467) – GRANTING CERTAIN LICENSES Councillor Morsillo offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and adopt the recommendation. SUMMARY This proposed law would eliminate the requirement that a student pass the Massachusetts Comprehensive Assessment System (MCAS) tests (or other statewide or district-wide assessments) in mathematics, science and technology, and English in order to receive a high school diploma. Instead, in order for a student to receive a high school diploma, the proposed law would require the student to complete coursework certified by the student’s district as demonstrating mastery of the competencies contained in the state academic standards in mathematics, science and technology, and English, as well as any additional areas determined by the Board of Elementary and Secondary Education. A YES VOTE would eliminate the requirement that students pass the Massachusetts Comprehensive Assessment System (MCAS) in order to graduate high school but still require students to complete coursework that meets state standards. A NO VOTE would make no change in the law relative to the requirement that a student pass the MCAS in order to graduate high school. SUMMARY The proposed law would provide Transportation Network Drivers (“Drivers”) with the right to form unions (“Driver Organizations”) to collectively bargain with Transportation Network Companies (“Companies”)-which are companies that use a digital network to connect riders to drivers for pre-arranged transportation-to create negotiated recommendations concerning wages, benefits and terms and conditions of work. Drivers would not be required to engage in any union activities. Companies would be allowed to form multi-Company associations to represent them when negotiating with Driver Organizations. The state would supervise the labor activities permitted by the proposed law and would have responsibility for approving or disapproving the negotiated recommendations. The proposed law would define certain activities by a Company or a Driver Organization to be unfair work practices. The proposed law would establish a hearing process for the state Employment Relations Board (“Board”) to follow when a Company or Driver Organization is charged with an unfair work practice. The proposed law would permit the Board to take action, including awarding compensation to adversely affected Drivers, if it found that an unfair work practice had been committed. The proposed law would provide for an appeal of a Board decision to the state Appeals Court. This proposed law also would establish a procedure for determining which Drivers are Active Drivers, meaning that they completed more than the median number of rides in the previous six months. The proposed law would establish procedures for the Board to determine that a Driver Organization has signed authorizations from at least five percent of Active Drivers, entitling the Driver Organization to a list of Active Drivers; to designate a Driver Organization as the exclusive bargaining representative for all Drivers based on signed authorizations from at least twenty-five percent of Active Drivers; to resolve disputes over exclusive bargaining status, including through elections; and to decertify a Driver Organization from exclusive bargaining status. A Driver Organization that has been designated the exclusive bargaining representative would have the exclusive right to represent the Drivers and to receive voluntary membership dues deductions. Once the Board determined that a Driver Organization was the exclusive bargaining representative for all Drivers, the Companies would be required to bargain with that Driver Organization concerning wages, benefits and terms and conditions of work. Once the Driver Organization and Companies reached agreement on wages, benefits, and the terms and conditions of work, that agreement would be voted upon by all Drivers who has completed at least 100 trips the previous quarter. If approved by a majority of votes cast, the recommendations would be submitted to the state Secretary of Labor for approval and if approved, would be effective for three years. The proposed law would establish procedures for the mediation and arbitration if the Driver Organization and Companies failed to reach agreement within a certain period of time. An arbitrator would consider factors set forth in the proposed law, including whether the wages of Drivers would be enough so that Drivers would not need to rely upon any public benefits. The proposed law also sets out procedures for the Secretary of Labor’s review and approval of recommendations negotiated by a Driver Organization and the 10 CITY OF SALEM OCTOBER 10, 2024 REGULAR MEETING Companies and for judicial review of the Secretary’s decision. The proposed law states that neither its provisions, an agreement nor a determination by the Secretary would be able to lessen labor standards established by other laws. If there were any conflict between the proposed law and existing Massachusetts labor relations law, the proposed law would prevail. The Board would make rules and regulations as appropriate to effectuate the proposed law. The proposed law states that, if any of its parts were declared invalid, the other parts would stay in effect. A YES VOTE would provide transportation network drivers the option to form unions to collectively bargain with transportation network companies regarding wages, benefits, and terms and conditions of work A NO VOTE would make no change in the law relative to the ability of transportation network drivers to form unions. QUESTION 4: LAW PROPOSED BY INITIATIVE PETITION Do you approve of a law summarized below, on which no vote was taken by the Senate or the House of Representatives before May 1, 2024? 12 CITY OF SALEM OCTOBER 10, 2024 REGULAR MEETING SUMMARY This proposed law would allow persons aged 21 and older to grow, possess, and use certain natural psychedelic substances in certain circumstances. The psychedelic substances allowed would be two substances found in mushrooms (psilocybin and psilocyn) and three substances found in plants (dimethyltryptamine, mescaline, and ibogaine). These substances could be purchased at an approved location for use under the supervision of a licensed facilitator. This proposed law would otherwise prohibit any retail sale of natural psychedelic substances. This proposed law would also provide for the regulation and taxation of these psychedelic substances. This proposed law would license and regulate facilities offering supervised use of these psychedelic substances and provide for the taxation of proceeds from those facilities’ sales of psychedelic substances. It would also allow persons aged 21 and older to grow these psychedelic substances in a 12-foot by 12-foot area at their home and use these psychedelic substances at their home. This proposed law would authorize persons aged 21 or older to possess up to one gram of psilocybin, one gram of psilocyn, one gram of dimethyltryptamine, 18 grams of mescaline, and 30 grams of ibogaine (“personal use amount”), in addition to whatever they might grow at their home, and to give away up to the personal use amount to a person aged 21 or over. This proposed law would create a Natural Psychedelic Substances Commission of five members appointed by the Governor, Attorney General, and Treasurer which would administer the law governing the use and distribution of these psychedelic substances. The Commission would adopt regulations governing licensing qualifications, security, recordkeeping, education and training, health and safety requirements, testing, and age verification. This proposed law would also create a Natural Psychedelic Substances Advisory Board of 20 members appointed by the Governor, Attorney General, and Treasurer which would study and make recommendations to the Commission on the regulation and taxation of these psychedelic substances. This proposed law would allow cities and towns to reasonably restrict the time, place, and manner of the operation of licensed facilities offering psychedelic substances, but cities and towns could not ban those facilities or their provision of these substances. The proceeds of sales of psychedelic substances at licensed facilities would be subject to the state sales tax and an additional excise tax of 15 percent. In addition, a city or town could impose a separate tax of up to two percent. Revenue received from the additional state excise tax, license application fees, and civil penalties for violations of this proposed law would be deposited in a Natural Psychedelic Substances Regulation Fund and would be used, subject to appropriation, for administration of this proposed law. Using the psychedelic substances as permitted by this proposed law could not be a basis to deny a person medical care or public assistance, impose discipline by a professional licensing board, or enter adverse orders in child custody cases absent clear and convincing evidence that the activities created an unreasonable danger to the safety of a minor child. This proposed law would not affect existing laws regarding the operation of motor vehicles while under the influence, or the ability of employers to enforce workplace policies restricting the consumption of these psychedelic substances by employees. This proposed law would allow property owners to prohibit the use, display, growing, processing, or sale of these psychedelic substances on their premises. State and local governments could continue to restrict the possession and use of these psychedelic substances in public buildings or at schools. This proposed law would take effect on December 15, 2024. 13 CITY OF SALEM OCTOBER 10, 2024 REGULAR MEETING A YES VOTE would allow persons over age 21 to use certain natural psychedelic substances under licensed supervision and to grow and possess limited quantities of those substances in their home and would create a commission to regulate those substances. A NO VOTE would make no change in the law regarding natural psychedelic substances. The proposed law would also permit employers to calculate this difference over the entire weekly or bi-weekly payroll period. The requirement to pay this difference would cease when the required hourly wage for tipped workers would become 100% of the state minimum wage on January 1, 2029. Under the proposed law, if an employer pays its workers an hourly wage that is at least the state minimum wage, the employer would be permitted to administer a “tip pool” that combines all the tips given by customers to tipped workers and distributes them among all the workers, including non-tipped workers. A YES VOTE would increase the minimum hourly wage an employer must pay a tipped worker to the full state minimum wage implemented over five years, at which point employers could pool all tips and distribute them to all non-management workers. A NO VOTE would make no change in the law governing tip pooling or the minimum wage for tipped workers. WHEREAS: John Boris moved to Salem more than 65 years ago and committed his life to supporting the community, both with formal and informal efforts. He often refers to his approach to service as “grassroots” oriented. He is dedicated to helping in whatever ways he can, and he is particularly focused on Salem’s needs around affordable housing, homelessness, food insecurity, disability rights and autism. WHEREAS: John survived a challenging start to life that ultimately influenced his compassionate outlook and approach to serving the community. When he was still a teenager, he quit high school and went into the military, where he served in France for two years. He eventually returned to Massachusetts where he worked hard to finish high school in his twenties. Next, he attended Bentley College, where he earned a Bachelor of Science in Accounting. WHEREAS: John’s official community service has included time as a member of the Salem Housing Authority Board (including many years as Chair), the Affordable Housing Trust Fund Board, and the Community Preservation Committee. WHEREAS: John has been a compassionate resource for people seeking housing, has personally paid for hundreds of people and families in crisis to stay in hotels temporarily, and worked to find longer term housing for them as well. WHEREAS: John has served on the board of Northeast Arc and has remained a very committed volunteer through that organization, assisting community members who have disabilities throughout the area. He and his wife, Anne, have donated hundreds of weighted blankets to community members with autism throughout the Northshore. SUMMARY The proposed law would provide Transportation Network Drivers (“Drivers”) with the right to form unions (“Driver Organizations”) to collectively bargain with Transportation Network Companies (“Companies”)-which are companies that use a digital network to connect riders to drivers for pre-arranged transportation-to create negotiated recommendations concerning wages, benefits and terms and conditions of work. Drivers would not be required to engage in any union activities. Companies would be allowed to form multi-Company associations to represent them when negotiating with Driver Organizations. The state would supervise the labor activities permitted by the proposed law and would have responsibility for approving or disapproving the negotiated recommendations. The proposed law would define certain activities by a Company or a Driver Organization to be unfair work practices. The proposed law would establish a hearing process for the state Employment Relations Board (“Board”) to follow when a Company or Driver Organization is charged with an unfair work practice. The 16 CITY OF SALEM OCTOBER 10, 2024 REGULAR MEETING COMMUNICATIONS FROM CITY OFFICIALS proposed law would permit the Board to take action, including awarding compensation to adversely affected Drivers, if it found that an unfair work practice had been committed. The proposed law would provide for an appeal of a Board decision to the state Appeals Court. This proposed law also would establish a procedure for determining which Drivers are Active Drivers, meaning that they completed more than the median number of rides in the previous six months. The proposed law would establish procedures for the Board to determine that a Driver Organization has signed authorizations from at least five percent of Active Drivers, entitling the Driver Organization to a list of Active Drivers; to designate a Driver Organization as the exclusive bargaining representative for all Drivers based on signed authorizations from at least twenty-five percent of Active Drivers; to resolve disputes over exclusive bargaining status, including through elections; and to decertify a Driver Organization from exclusive bargaining status. A Driver Organization that has been designated the exclusive bargaining representative would have the exclusive right to represent the Drivers and to receive voluntary membership dues deductions. Once the Board determined that a Driver Organization was the exclusive bargaining representative for all Drivers, the Companies would be required to bargain with that Driver Organization concerning wages, benefits and terms and conditions of work. Once the Driver Organization and Companies reached agreement on wages, benefits, and the terms and conditions of work, that agreement would be voted upon by all Drivers who has completed at least 100 trips the previous quarter. If approved by a majority of votes cast, the recommendations would be submitted to the state Secretary of Labor for approval and if approved, would be effective for three years. The proposed law would establish procedures for the mediation and arbitration if the Driver Organization and Companies failed to reach agreement within a certain period of time. An arbitrator would consider factors set forth in the proposed law, including whether the wages of Drivers would be enough so that Drivers would not need to rely upon any public benefits. The proposed law also sets out procedures for the Secretary of Labor’s review and approval of recommendations negotiated by a Driver Organization and the Companies and for judicial review of the Secretary’s decision. The proposed law states that neither its provisions, an agreement nor a determination by the Secretary would be able to lessen labor standards established by other laws. If there were any conflict between the proposed law and existing Massachusetts labor relations law, the proposed law would prevail. The Board would make rules and regulations as appropriate to effectuate the proposed law. The proposed law states that, if any of its parts were declared invalid, the other parts would stay in effect. SUMMARY This proposed law would allow persons aged 21 and older to grow, possess, and use certain natural psychedelic substances in certain circumstances. The psychedelic substances allowed would be two substances found in mushrooms (psilocybin and psilocyn) and three substances found in plants (dimethyltryptamine, mescaline, and ibogaine). These substances could be purchased at an approved location for use under the supervision of a licensed facilitator. This proposed law would otherwise prohibit any retail sale of natural psychedelic substances. This proposed law would also provide for the regulation and taxation of these psychedelic substances. This proposed law would license and regulate facilities offering supervised use of these psychedelic substances and provide for the taxation of proceeds from those facilities’ sales of psychedelic substances. It would also allow persons aged 21 and older to grow these psychedelic substances in a 12-foot by 12-foot area at their home 19 CITY OF SALEM OCTOBER 10, 2024 REGULAR MEETING COMMUNICATIONS FROM CITY OFFICIALS and use these psychedelic substances at their home. This proposed law would authorize persons aged 21 or older to possess up to one gram of psilocybin, one gram of psilocyn, one gram of dimethyltryptamine, 18 grams of mescaline, and 30 grams of ibogaine (“personal use amount”), in addition to whatever they might grow at their home, and to give away up to the personal use amount to a person aged 21 or over. This proposed law would create a Natural Psychedelic Substances Commission of five members appointed by the Governor, Attorney General, and Treasurer which would administer the law governing the use and distribution of these psychedelic substances. The Commission would adopt regulations governing licensing qualifications, security, recordkeeping, education and training, health and safety requirements, testing, and age verification. This proposed law would also create a Natural Psychedelic Substances Advisory Board of 20 members appointed by the Governor, Attorney General, and Treasurer which would study and make recommendations to the Commission on the regulation and taxation of these psychedelic substances. This proposed law would allow cities and towns to reasonably restrict the time, place, and manner of the operation of licensed facilities offering psychedelic substances, but cities and towns could not ban those facilities or their provision of these substances. The proceeds of sales of psychedelic substances at licensed facilities would be subject to the state sales tax and an additional excise tax of 15 percent. In addition, a city or town could impose a separate tax of up to two percent. Revenue received from the additional state excise tax, license application fees, and civil penalties for violations of this proposed law would be deposited in a Natural Psychedelic Substances Regulation Fund and would be used, subject to appropriation, for administration of this proposed law. Using the psychedelic substances as permitted by this proposed law could not be a basis to deny a person medical care or public assistance, impose discipline by a professional licensing board, or enter adverse orders in child custody cases absent clear and convincing evidence that the activities created an unreasonable danger to the safety of a minor child. This proposed law would not affect existing laws regarding the operation of motor vehicles while under the influence, or the ability of employers to enforce workplace policies restricting the consumption of these psychedelic substances by employees. This proposed law would allow property owners to prohibit the use, display, growing, processing, or sale of these psychedelic substances on their premises. State and local governments could continue to restrict the possession and use of these psychedelic substances in public buildings or at schools. This proposed law would take effect on December 15, 2024. A YES VOTE would allow persons over age 21 to use certain natural psychedelic substances under licensed supervision and to grow and possess limited quantities of those substances in their home and would create a commission to regulate those substances. A NO VOTE would make no change in the law regarding natural psychedelic substances. QUESTION 5: LAW PROPOSED BY INITIATIVE PETITION Do you approve of a law summarized below, on which no vote was taken by the Senate or the House of Representatives before May 1, 2024? SUMMARY The proposed law would gradually increase the minimum hourly wage an employer must pay a tipped worker, over the course of five years, on the following schedule: • To 64% of the state minimum wage on January 1, 2025; • To 73% of the state minimum wage on January 1, 2026; • To 82% of the state minimum wage on January 1, 2027; • To 91% of the state minimum wage on January 1, 2028; and • To 100% of the state minimum wage on January 1, 2029 The proposed law would require employers to continue to pay tipped workers the difference between the state minimum wage and the total amount a tipped worker receives in hourly wages plus tips through the end of 2028. The proposed law would also permit employers to calculate this difference over the entire weekly or bi-weekly payroll period. The requirement to pay this difference would cease when the required hourly wage for tipped workers would become 100% of the state minimum wage on January 1, 2029. 22 CITY OF SALEM OCTOBER 10, 2024 REGULAR MEETING COMMUNICATIONS FROM CITY OFFICIALS Under the proposed law, if an employer pays its workers an hourly wage that is at least the state minimum wage, the employer would be permitted to administer a “tip pool” that combines all the tips given by customers to tipped workers and distributes them among all the workers, including non-tipped workers. A YES VOTE would increase the minimum hourly wage an employer must pay a tipped worker to the full state minimum wage implemented over five years, at which point employers could pool all tips and distribute them to all non-management workers. A NO VOTE would make no change in the law governing tip pooling or the minimum wage for tipped workers.
