NO SEPARATE DISCUSSION OR ACTION ON ANY OF THE ITEMS IS NECESSARY UNLESS DESIRED BY A COUNCIL MEMBER OR A CITIZEN, IN WHICH EVENT THE ITEM SHALL BE CONSIDERED IN ITS NORMAL SEQUENCE AFTER THE ITEMS NOT REQUIRING SEPARATE DISCUSSION HAVE BEEN ACTED UPON BY A SINGLE MOTION. 1. Consider approval of Ordinance 2024-53, on the second of two readings, creating a designated permit area under Section 82.189 of the San Marcos City Code authorizing parking by permit only from 8:00 A.M. to 5:00 P.M. during weekends and public holidays for the area consisting of the both sides of the 200 and 300 block of Riverside Drive from Riviera Drive to Cheatham Street; amending the traffic register to reflect such designated permit area; including procedural provisions; and declaring an effective date. 2. Consider approval of Resolution 2024-221R, approving a contract extension of up to five one-year periods with AVI-SPL, LLC., for vendor licensing and technical support for the City’s telephone system, through the Texas Department of Information Resources, in the amount of $78,918.94 each year; authorizing the City Manager, or her designee, to execute the contract extension; and declaring an effective date. Consider approval of Resolution 2024-222R, awarding an Indefinite Delivery Indefinite Quantity (IDIQ) Master Contract to Holbrook Asphalt Co., through an Interlocal Cooperative Purchasing Agreement with the City of Hurst, for the provision of high density mineral bond pavement seal for street maintenance in an annual amount not to exceed $ 400,000.00, with up to four one-year renewals; authorizing the City Manager, or her designee, to execute the contract and renewals on behalf of the city; and declaring an effective date. 4. Consider approval of Resolution 2024-223R, approving and authorizing the filing of an application with the Texas Water Development Board (TWDB) seeking financial assistance in an amount not to exceed $1,000,000.00 to provide for the costs of planning and design services related to the FM1978 Water Reclamation Facility project; designating an authorized representative of the City for purposes of furnishing information and executing required documents in connection with the preparation and filing of the application; designating firms and individuals authorized and directed to aid and assist the City in the preparation and submission of the application and appear on behalf of and represent the City before any hearing held by the Texas Water Development Board on the application; and declaring an effective date. 5. Consider approval of Resolution 2024-224R, approving a Joint Funding Agreement for the provision of youth services with Texas State University, San Marcos Consolidated Independent School District, and Hays County; providing for the joint funding of a Youth Services Director to administer youth services and programs, with a participation amount for the city not to exceed $71,500.00 annually; authorizing the City Manager, or her designee, to execute the agreement; and declaring an effective date. 6. Consider approval of Resolution 2024-225R, approving an agreement with Community Action, Inc. of Central Texas to provide personnel to serve as a Youth Services Director to administer youth services and programs for the benefit of the City, Texas State University, San Marcos Consolidated Independent School District, and Hays County in an amount not to exceed $143,000.00 annually, to be jointly funded by the City and such other entities, with a participation amount for the City not to exceed $71,500.00 annually; authorizing the City Manager, or her designee, to execute the agreement; and declaring an effective date. 7. Consider approval of Resolution 2024-226R, approving the reallocation of $218,571.65 in funds received by the City of San Marcos under the American Rescue Plan to support the recovery of the community from COVID-19; and declaring an effective date. 8. Consider approval of Resolution 2024-227R, approving a funding agreement with Pet Prevent a Litter of Central Texas allowing for American Rescue Plan Act (ARPA) funds to provide vaccinations and spay, neuter services for pets of residents of the City of San Marcos negatively affected by COVID-19 in the amount of $90,000.00 over a two-year term with an option to extend; authorizing the City Manager, or her designee, to execute the appropriate documents to implement the agreement on behalf of the city; and declaring an effective date. Hold a Public Hearing and consider a request by Jeffrey Colasurd, on behalf of Tantra, located at 217 West Hopkins Street, to appeal the decision of the Planning and Zoning Commission which approved a Conditional Use Permit in Case No. CUP-24-41 to allow on-premises consumption of mixed beverages, but limit noise levels. 10. Hold a Public Hearing and consider approval of Resolution 2024-231R, amending Resolution No. 2024-90R, a Resolution of No Objection to the submission of an application for Low-Income Housing Tax Credits to the Texas Department of Housing and Community Affairs for the proposed Blanco Basin multifamily development, generally located north of the intersection between East McCarty Lane and the Union Pacific Railroad, by allowing changes to the proposed amenities list and to the unit income mix, among other possible amendments; and declaring an effective date. NON-CONSENT AGENDA 11. Receive a staff presentation regarding and consider an initial authorization for Development Code text amendments to align terminology with the Vision SMTX Comprehensive Plan. 12. Consider approval of Ordinance 2024-55, on the first of two readings, amending Chapter 82, Article 4, of the San Marcos City Code by adding a new Division 4 to authorize the issuance of tickets by mail for non-payment of parking fees within the City of San Marcos parks paid parking lots, by updating the parking violation fee schedule to include a Level 1 Violation for non-payment of parking fees within the City of San Marcos parks paid parking lots, providing for a procedure to exempt residents from payment of the parking fees, and including a sunset provision for renewal of the ordinance; providing a savings clause; providing for the repeal of any conflicting provisions; and declaring an effective date. 13. Consider approval of Resolution 2024-228R, approving the purchase of a new fire engine from Metro Fire Apparatus Specialists, Inc., through the Sourcewell Purchasing Cooperative, for use by the Fire Department in the amount of $1,330,000.00 and up to an additional $220,000.00 for the cost of outfitting the truck from a variety of Sourcewell Purchasing Cooperative vendors; authorizing the City Manager, or her designee, to execute all appropriate documents to complete the purchase; and declaring an effective date. 14. Consider approval of Resolution 2024-229R, approving a Sales Contract with Hays County for the City’s purchase of the Five Mile Dam Park property in the vicinity of Old Stagecoach Road and Five Mile Park Road, at no cost to the City, except for half of the closing expenses; authorizing the City Manager, or her designee, to execute said contract and all closing documents related to such purchase on behalf of the city; and declaring an effective date. 15. Consider approval of Resolution 2024-230R, casting all of the City’s 395 votes in favor of City of San Marcos Page 3 Printed on 11/15/2024 City Council Regular Meeting Agenda - Final November 19, 2024 Jane Hughson to serve on the Hays Central Appraisal District Board of Directors for a one-year term commencing on January 1, 2025; and declaring and effective date. 16. Hold a discussion regarding creative designs to place on a new water tower in the Blanco Vista neighborhood; and provide direction to the City Manager on preferred design. 17. Hold a discussion regarding the Neighborhood Commission Recommendation Resolution 2024-03RR-NH, to study the effects of white-tailed deer on the community and to create a public awareness campaign on the dangers of feeding deer; and provide direction to the City Manager. 18. Discuss and consider appointments to fill vacancies on the following Boards and Commissions; and provide direction to Staff. A) Animal Shelter Advisory Committee B) Parks and Recreation Board EXECUTIVE SESSION NOTE: The City Council may adjourn into Executive Session to consider any item listed on this agenda if a matter is raised that is appropriate for Executive Session discussion. An announcement will be made of the basis for the Executive Session discussion. The City Council may also publicly discuss any item listed on the agenda for Executive Session. 19. The City Council will convene in executive session pursuant to Section 551.071 of the Texas Government Code to receive legal advice regarding contracts with the Guadalupe-Blanco River Authority concerning water treatment, management and distribution for the City. Consider action, by motion, or provide direction to staff regarding the City Council ’s deliberation under Section 551.071 of the Texas Government Code to receive legal advice regarding contracts with the Guadalupe-Blanco River Authority concerning water treatment, management and distribution for the City.
