MINUTES Sand Springs City Council Regular Meeting September 10, 2012 – 7:00 p.m. Sand Springs Municipal Building 100 East Broadway – Room #211 Sand Springs, Oklahoma 74063 MEMBERS PRESENT: Mayor Mike Burdge (8-0) Vice Mayor Michael Phillips (8-0) Councilman Dean Nichols (8-0) Councilman Jesse Honn (8-0) Councilman Harold G. Neal (7-1) Councilman Brian M. Jackson (8-0) Councilman James D. Rankin (8-0) ALSO PRESENT: City Manager Rocky D. Rogers City Attorney David Weatherford City Clerk Janice L. Almy ABSENT: None The Sand Springs City Council met in regular session on September 10, 2012 in Room #211 of the Sand Springs Municipal Building pursuant to the agenda filed with the City Clerk’s office and posted at 10:00 a.m. on September 6, 2012, on the bulletin board located in the first floor lobby of the Sand Springs Municipal Building, 100 East Broadway, Sand Springs, Oklahoma 74063. 1. Call to Order Mayor Burdge called the meeting to order at the noted time of 7:01 p.m. 2. Roll Call Mayor Burdge called for an individual roll call with members replying in the following manner: Councilman Nichols, here; Councilman Honn, here; Councilman Jackson, here; Vice Mayor Phillips, here; Mayor Burdge, here; Councilman Neal, here; Councilman Rankin, here. CITY COUNCIL MINUTES SEPTEMBER 10, 2012 PAGE 2 3. Invocation Following Roll Call, Councilman Rankin delivered the invocation. 4. Pledge of Allegiance Following the invocation, Councilman Neal led the Pledge of Allegiance. 5. Presentations A. Mayor Burdge read aloud and presented a Citation from State of Oklahoma Representative Skye McNiel and Senator Brian Bingman to Fire Chief Mike Wood recognizing the Sand Springs Fire Department for their efforts is assisting Creek County during the recent wild land fires. Mike Wood, Fire Chief, expressed appreciation of Council and the City Manager in their support of the Sand Springs Fire Department, which allows them to participate and provide support to surrounding communities during their time of need. Susan Pitts, Interim Planner, introduced Planning Administrative Office Assistant Cynthia Webster. B. Mayor Burdge read aloud a letter from John T. Watson with the Pilots and Paws organization, expressing appreciation of the assistance he received from Grant Gerondale, Parks Director and Kendal Madison, Airport Supervisor, while experiencing a flat tire on his plane. Mayor Burdge presented Certificates of Commendation to Grant Gerondale, Parks Director, and Kendal Madison, Airport Supervisor, for their efforts. C. Robert Franklin and Joe Farney, Tulsa Technology Center (TTC), provided an update on the construction of the new TTC facility located on Charles Page in Sand Springs. It was noted that photos and conceptual drawing of TTC were displayed at the back of the Council Chamber. 6. Consent Agenda (A-E) Mayor Burdge informed Council that all matters listed under the Consent Agenda to be considered by Council are to be routine and will be enacted by one motion. Mayor Burdge noted that questions or clarification on any consent agenda items could be addressed prior to taking action. Mayor Burdge requested if Council had questions or needed clarification on any consent agenda item or whether any item needed to be considered separate. CITY COUNCIL MINUTES SEPTEMBER 10, 2012 PAGE 3 There being none, Mayor Burdge called for a motion regarding Consent Agenda Item No. 6A-E. A motion was made by Councilman Neal and seconded by Vice Mayor Phillips that the requested approval of Consent Agenda Item No. 6A-E, as follows: A. The minutes of the August 27, 2012 regular City Council meeting. B. The minutes of the August 30, 2012 special City Council meeting. C. The acceptance of the Sanitary Sewer Easement granted by Tulsa Technology Center. D. The purchase of a John Deere 35D Compact Excavator. E. A contract to Lamproe Construction, Inc. for the 2012 Street Overlays Pavement Rehabilitation project. Mayor Burdge called for the vote recorded as follows: Councilman Nichols, aye; Councilman Honn, aye; Councilman Jackson, aye; Vice Mayor Phillips, aye; Mayor Burdge, aye; Councilman Neal, aye; Councilman Rankin, aye. The motion carried 7-0-0. 7. Ordinance No. 1231 – Food Code for the City David Weatherford, City Attorney, requested Council’s adoption of Ordinance No. 1231, adopting State regulations for Food Service Establishments as the Food Code for the City. Debbie Watts, Tulsa Health Department, provided a brief overview of the Food Code. Mayor Burdge informed Council that a citizen signed in to address this item. Phyllis Cole, 711 Greenview Circle, Sand Springs, questioned whether or not the Tulsa County Health Department oversees food service establishments in Sand Springs and if so, was an inspector assigned to Sand Springs. Debbie Watts, Tulsa Health Department, stated Tulsa County Health Department does oversee food service establishments within Sand Springs and that one (1) inspector is assigned to the western division, which includes Sand Springs. CITY COUNCIL MINUTES SEPTEMBER 10, 2012 PAGE 4 A motion was made by Councilman Honn and seconded by Councilman Jackson that the requested adoption of Ordinance No. 1231, adopting state regulations for Food Service Establishments as the Food Code for the City, as presented, be approved. Mayor Burdge called for the vote recorded as follows: Councilman Rankin, aye; Councilman Neal, aye; Mayor Burdge, aye; Vice Mayor Phillips, aye; Councilman Jackson, aye; Councilman Honn, aye; Councilman Nichols, aye. The motion carried 7-0-0. 8. Correspondence The following correspondence was provided to Council for their review and information. A. Regular monthly bills. B. A letter, dated August 31, 2012, from Raymond Turner and Victoria Alexander Adunesi, expressing appreciation to the City of Sand Springs for giving them the opportunity to host an event to say a proper goodbye to the traditional home of the City’s African-American population. 9. City Manager’s and Council Member’s Reports Rocky D. Rogers, City Manager, reported on the following items: A. A phone conversation was held today with representatives from Gerdau regarding the steel mill site in Sand Springs. The conversation included marketing opportunities and environmental issues of the site. B. The new owners, Sand Springs Home, of the Covington Credit and former beauty college buildings have entered in to an agreement to have these buildings demolished within the next 15 or so days. C. The OML Annual Conference is scheduled for the week of September 26, 2012. D. City Manager Rocky Rogers will attend the ICMA Conference in Phoenix on October 5 through October 10, 2012. E. The 3rd Vision 2 Workshop is scheduled for Tuesday, September 18, 2012. CITY COUNCIL MINUTES SEPTEMBER 10, 2012 PAGE 5 F. Councilman Nichols informed Council of the upcoming Downhill Derby scheduled for September 22, 2012. G. Councilman Nichols informed Council of the upcoming Charles Page High School Homecoming Parade on September 27, 2012. H. Councilman Honn informed Council of the September 17, Street Talk, a two-mile walking event beginning at 7:30 p.m. at City Hall. 10. Executive Session A. Mayor Burdge informed Council of the consideration of retiring into Executive Session for the purpose of conferring on matters pertaining to acquisition of property, in accordance with O.S. Title 25, Section 307(B)(3). A motion was made by Vice Mayor Phillips and seconded by Councilman Neal to retire into Executive Session for the purpose of conferring on matters pertaining to acquisition of property, in accordance with O.S. Title 25, Section 307(B)(3). Mayor Burdge called for the vote recorded as follows: Councilman Nichols, aye; Councilman Honn, aye; Councilman Jackson, aye; Vice Mayor Phillips, aye; Mayor Burdge, aye; Councilman Neal, aye; Councilman Rankin, aye. The motion carried 7-0-0. Mayor Burdge, Vice Mayor Phillips, Councilman Nichols, Councilman Honn, Councilman Jackson, Councilman Neal, Councilman Rankin, City Manager Rocky D. Rogers, and City Attorney David Weatherford retired into Executive Session at the noted time of 7:24 p.m. Discussion was held in regards to the item as listed on the agenda. B. Following the Executive Session, a motion was made by Vice Mayor Phillips and seconded by Councilman Honn to return to the City Council meeting. Mayor Burdge called for the vote recorded as follows: Councilman Rankin, aye; Councilman Neal, aye; Mayor Burdge, aye; Vice Mayor Phillips, aye; Councilman Jackson, aye; Councilman Honn, aye; Councilman Nichols, aye. The motion carried 7-0-0. Council returned to the City Council meeting at the noted time of 7:52 p.m. CITY COUNCIL MINUTES SEPTEMBER 10, 2012 PAGE 6 C. Mayor Burdge stated there was no action deemed appropriate as a result of the Executive Session. 11.
