A motion was made by Jamie Tsandes, seconded by Jeff Lovell that the Planning Commission determine preliminary subdivision review is complete for the Sandy Rehabilitation two-lot commercial subdivision based on the two findings and subject to the four conditions listed in the staff report. NH Rather asked Claire what the original intent was vs what is being asked now. Claire Hague explained the difference between the home occupation applications. Dave Bromley asked if applicant needs to live in the home. Claire Hague explained that the applicant must reside in this home as their primary residence. Cameron Duncan asked if the home ever functioned as the assisted living with four residents. Claire Hague explained that it did not. Cyndie Albert, the applicant, further presented to the Planning Commission. Jamie Tsandes asked how the applicant would run drop up and pick up of clients. NH Rather asked the applicant if she lived in the home. Cyndie Albert said that she lived there with her daughter. Britney Ward, City Traffic Engineer clarified the traffic concerns and impacts. Jeff Lovell clarified that Glendover Way usually has about 500 trips a day. NH Rather asked if there are different requirements for kid’s vs adults. Claire Hague explained that there are no differences. Michael Christopherson opened this item to public comment. Steve Van Maren has concerns about the clumping for 12 cars and suggested a 30 min staggering for drop off/pick up. Lisa Neiderhauser is concerned about traffic and cars that are already parked on the side of the street and elementary schoolers walking home. Lisa Stearns has concerns about traffic and the safety/quality of life in the neighborhood. Patrick Phinkle has concerns about deliveries and visitors going over the limit and how that will be enforced, the overuse of facilities, neighborhood disruptions, and does not think the applicant lives at the residence. Kathy Jensen is concerned about coming from the east - pass the house and flip a U-turn and would worry they would park at her house - a lot of people outside in the mornings Sandy City, Utah Page 4 Printed on 7/21/2020 Planning Commission Meeting Minutes June 18, 2020 and people’s safety. Debbie Strong concerned about the traffic and people pulling into the driveway. She also wanted to know how many employees will be there and where will they park. Brad Jensen is concerned about traffic and property value. Michael Christopherson closed this item to public comment. Britney Ward explained that the proposed item is in a small accident area, neighborhoods should be using the sidewalk to walk; and if there are parking issues that would be enforced through the police department. There will be some car queuing; but it wouldn’t be anything different from regular neighborhoods, and further explained what 24 stops vs 48 trips means. (1 stop means 2 trips) Michael Christopherson asked if that’s residential or commercial parking laws. Britney Ward explained that it is the law for both. Mike Wilcox clarified that this item is just about the business impact on the neighborhood. Jeff Lovell asked if the number of allowed stops/trips included employees and deliveries to the home. Mike Wilcox said yes and further explained code. Michael Christopherson asked who enforces the code and the limit to trips/stops. Claire Hague explained that residences must report any violations to code enforcement. Dave Bromley asked if they applicant had any traffic plans in mind or that there should be a condition to turn in a traffic plan with staff. Cyndie Albert further explained her plans for the drop off/pick up to have clients pull into driveway and that her and the employees will park in the garage and right now she has 8-10 adults. Dave Bromley asked if the increase in traffic in the neighborhood has been addressed by staff. Claire Hague explained that staff had no concerns with the traffic increase because it is like daycare use but Planning Commission could limit number of people in the home. Mike Wilcox clarified that if the Planning Commission does limit the amount of people allowed in the home, they would need to have a finding as to why the number is limited. Jeff Lovell asked about safety and if the Planning Commission could only deny the request if they could not find solutions for the safety risks. James Sorensen clarified that the Planning Commission can only deny if they find the applicant can’t mitigate the impact. Darien Alcorn said that it can’t be a suspected impact and only one that is already Sandy City, Utah Page 5 Printed on 7/21/2020 Planning Commission Meeting Minutes June 18, 2020 happening and not potentially happening. NH Rather asked about impact on the utilities. Mike Wilcox clarified the code is talking about a huge high demand in utilities (example of high use: water for pooling process) that goes beyond residential purposes. Ron Mortimer likes the idea of adding a condition to have staff approve a traffic plan. NH Rather is concerned that the applicant’s residence is not in the home full time. Claire Hague suggested what they do for short term rental as proof of residency. Dave Bromley thinks that if a neighbor had that same concern down the road it could be taken to the city and would have to be investigated/enforced. Mike Wilcox further explained code requirement with home occupations. A motion was made by Jeff Lovell, seconded by Dave Bromley that the Planning Commission approve a Conditional Use Permit to allow for Willow Canyon Living to operate a Category II home occupation that allows up to a maximum of 12 business related customers (including employees) for an adult day care at 9853 S. Glendover Way based on the two findings and six conditions listed in the staff report, with an added seventh condition as follows: 7. That the applicant will work with city staff to develop a traffic plan that will address traffic impact to the neighborhood. A spokesperson who has been asked by a group to summarize their concerns will be allowed 5 minutes to speak. Comments which cannot be made within these time limits should be submitted in writing to the Community Development Department prior to noon the day before the scheduled meeting. Planning Commission applications may be tabled if: 1) Additional information is needed in order to take action on the item; OR 2) The Planning Commission feels there are unresolved issues that may need further attention before the Commission is ready to make a motion. No agenda item will begin after 11 pm without a unanimous vote of the Commission. The Commission may carry over agenda items, scheduled late in the evening and not heard, to the next regular scheduled meeting.
