Electronic Meeting Planning Commission Chairman Statement In accordance with, Utah Code 52-4-207(4) Open and Public Meeting Act, I have determined that to protect the health and welfare of Sandy citizens, an in person Planning Commission meeting, including attendance by the public and the Planning Commission is not practical or prudent. Considering the continued rise of COVID-19 case counts in Utah, meeting in an anchor location presents substantial risk to the health and safety of those in attendance because physical distancing measures may be difficult to maintain in the Sandy City Council Chambers. The Center for Disease Control states that COVID-19 is easily spread from person to person between people who are in close contact with one another. The spread is through respiratory droplets when an infected person coughs, sneezes or talks and may be spread by people who are non-symptomatic. It is my intent to safeguard the lives of Sandy residents, business owners, employees and commission members by meeting remotely through electronic means without an anchor location. Community Development staff are hereby authorized and directed to include a copy of the above notice with each Planning Commission agenda. Monica Collard asked if the R-1-8 zone requires a minimum of eight thousand square feet. Jake Warner explained that it does. However, the average lot size can be reduced to 7,500 square feet if the Planning Commission approves a residential conservation overlay as part of a subdivision application. Monica asked if the city likes to have a buffer zone between commercial and residential zone. Jake Warner said typically yes, however the applicant has submitted two applications to try and get a transitional zone, but they were denied by the City Council. Dave Bromley asked what the minimum lot width is. Jake Warner said 70 feet. Cameron Duncan clarified that the Planning Commission is just looking at the rezoning and not the site plan. Ben Smith further presented to the Planning Commission. Cameron Duncan asked if the applicant has read and was comfortable with the staff report. Ben Smith said yes. Cameron Duncan opened this item to public comment. Tom Lewis is happy with the current plan for the rezone and thinks it will fit the neighborhood. Dennis and Heather Hiatt are in favor of this item and likes the new concept plan and are glad that homes will be built instead of townhomes. Cameron Duncan closed this item to public comment. A motion was made by Dave Bromley, seconded by Jeff Lovell that the Planning Commission forward a positive recommendation to the City Council to approve the zone change from the CN Zone to the R-1-8 Zone. Lyle Beecher further presented this item to the Planning Commission. Mark Dietlein the C.A.O of Hale Centre Theater further presented this item to the Planning Commission. Lyle Beecher explained that the current opened patio is not being used to its full potential and Hale Center Theater wants to be able to maximize the use. He also explained that they were originally going to use granite on the outside of the building but because of the building material shortage the granite would be too hard to get. They then decided to use brick for the outside of the building. Cameron Duncan opened this item to public comment. Steve Van Maren likes the final design but is concerned with the amount of glass, privacy and light hitting drivers. Cameron Duncan closed this item to public comment. Doug Wheelwright explained that light will be emanating out, but because it is on the second level, it should not affect drivers. Mark Dietlein explained that at night that different shades of lighting will be used in that room so that it does not affect the roads or anything else. A motion was made by Monica Collard, seconded by Daniel Schoenfeld that the Planning Commission find that the proposed building addition’s final architectural design, building materials and colors as proposed be approved for the Hale Centre Theatre, based upon the two findings and the three conditions detailed in the staff report. Monica Collard asked what the city plans to do if the drive-up window stacking becomes a problem. Doug Wheelwright showed the full site plan to explain the queuing plans. Brittney Ward explained the traffic study that was conducted for this project. She explained that on opening day and other high queuing times will go beyond the proposed queuing plan. For now, the cars will need to queue in the shoulder but once 9400 S is widened, they will no longer need to queue in the shoulder, but by then the initial opening will be over. Monica Collard asked if there is a plan for striping or signs to inform drivers where they can and cannot queue. Brittney Ward explained that the city does not have any regulations on directing queuing on a private lot. Monica Collard asked if there was adequate room for vehicles to back out. Brittney Ward explained that vehicles will not be able to back out onto 9400 South and will need to use other accesses. Natalie Nichols explained that the accommodations for the queuing on site and the peak hour volume. Currently there is no striping, and the employees will help direct cars to queue away from 9400 S. Brittney Ward clarified that the traffic study requires a traffic queuing management plan to be done by Dutch Bros and it has not been completed yet. Monica Collard asked if it would be possible to queue toward the east. Brittney Ward explained that the site plan is designed to keep all the queuing on their parcel and not spilling over into the parking lot. Hypothetically they could spill into the parking lot, but it would require cross access easements.
