For those individuals that do not have the above access, the City Cafeteria has been set up to accommodate up to 10 people at a time and public comment will be given from that location. The meeting set-up is in line with the recommendations of the COVID-19 White House Task Force, which notes no more than 10 people gatherings. The Mayor will be present for the meeting with Councilmembers and department heads participating remotely. A limited number of staff will also be present. Authorize the City Manager to negotiate and execute Master Agreements with the following vendors with a term ending on or about July 31, 2025: CherryRoad Technologies, Ciber Global Tech, Deloitte Consulting, Graviton Consulting Services, Highstreet, Kastech Software Solutions Group, PRJ Consulting, Smart ERP Solutions, SpearMC Management Consulting; 2. Authorize the City Manager to execute task orders not to exceed $250,000 per task order without further Council action and subject to the appropriation of funds; and 3. Authorize the City Manager to amend the Agreements to extend the term in the event that task orders are issued during the five-year term of the Master Agreement with a completion timeline that extends beyond the five-year term. Authorize the City Manager to execute Amendment No. 1 to the Agreement for the Performance of Services with Soudi Consultants, Inc.; 2. Authorize the City Manager to make minor modifications to the agreement, if necessary; and 3. Authorize the City Manager to add or delete electric protection engineering services consistent with the scope of the agreement and extend the agreement for projects initiated before the expiration date of the agreement subject to the appropriation of funds. Approve the Electric Utility transfer of funds to the City General Fund for the City Property at 2975 Lafayette Street; 2. Approve the transfer of $580,000 to the City’s General Fund from Electric CIP project Distributed Antenna System Development (No. 2413) for the land at the appraised value; and 3. Approve the FY 2020/21 budget amendment in the Electric Utility Capital Fund to increase the Beginning Fund Balance and the Construction - Distributed Antenna System Development project by $580,000 to reflect the carryover of unspent funds from FY 2019/20 and the subsequent reduction of the Construction - Distributed Antenna System Development project to fund the transfer to the General Fund in the amount of $580,000; in the General Fund, recognize the transfer from the Electric Utility Capital Fund of $580,000 and allocate the funding to Land Sale Reserve. Authorize the City Manager to execute Amendment No. 1 to the Agreement for the Performance of Services with Power Systems Professionals, Inc. dba Power Pros to extend the term of the Agreement for two additional years through August 2022; 2. Authorize the City Manager to make minor modifications to Amendment No 1, if necessary; and 3. Authorize the City Manager to add or delete services consistent with the scope of the agreements, and allow future rate adjustments subject to request and justification by contractor or consultant and approval by the City, subject to the appropriation of funds. 3.H 20-639 Action on the Award of the Public Works Contract for the Fairview Substation Expansion Project [Council Pillar: Deliver and Enhance High Quality Efficient Services and Infrastructure] Recommendation: 1. Award the Public Works Contract for the Fairview Substation Expansion Project (Contract No. 2403H) to the lowest responsive and responsible bidder, Tri Technic, Inc. in the amount of $454,950 and authorize the City Manager to execute any and all documents necessary for the award, completion and acceptance of the Project; and 2. Authorize the City Manager to execute change orders up to 10% of the original contract amount, or $45,495, for a total not-to-exceed amount of $500,445 for Contract No. 2403H. Approve and authorize the City Manager to continue negotiating the terms and conditions of the agreements and execute final agreements with JPMorgan Chase Bank, N.A. for General Banking, Merchant Card Processing, and Commercial Card Services for an initial five-year term starting on or about August 1, 2020 and ending on or about July 31, 2025, subject to the appropriation of funds; 2. Approve and authorize the City Manager to continue negotiating the terms and conditions and execute a final agreement with Wells Fargo Bank for Custody Services for an initial five-year term starting on or about August 1, 2020 and ending on or about July 31, 2025, subject to the appropriation of funds; and 3. MEETING DISCLOSURES The time limit within which to commence any lawsuit or legal challenge to any quasi-adjudicative decision made by the City is governed by Section 1094.6 of the Code of Civil Procedure, unless a shorter limitation period is specified by any other provision. Under Section 1094.6, any lawsuit or legal challenge to any quasi-adjudicative decision made by the City must be filed no later than the 90th day following the date on which such decision becomes final. Any lawsuit or legal challenge, which is not filed within that 90-day period, will be barred. If a person wishes to challenge the nature of the above section in court, they may be limited to raising only those issues they or someone else raised at the meeting described in this notice, or in written correspondence delivered to the City of Santa Clara, at or prior to the meeting. In addition, judicial challenge may be limited or barred where the interested party has not sought and exhausted all available administrative remedies.
