(CEQA: Class 1 Categorical Exemption 15301(e)(1), Existing Facilities) Recommendation: Approve the Architectural Review and a Class 1 CEQA Categorical Exemption for the demolition of the existing two-story residence to construct a one-story 2,204 square-foot residence at 970 White Drive, subject to conditions. 1.C 23-317 Action on the demolition of an existing two-family residence and construction of a new single-family residence with an attached Accessory Dwelling Unit (ADU) at 2467 Park Avenue. (CEQA: Exempt, Section 15301 (e)(2) Replacement or Reconstruction) Recommendation: Use of a Categorical Exemption per CEQA 15301 (e) (2) Replacement or Reconstruction and Approve the demolition of a two-family residence and new construction of a single-family residential home, subject to conditions. GENERAL BUSINESS The following items from this Development Review Hearing agenda will be scheduled for further review following the conclusion of hearings and recommendations by the Development Review Hearing. City of Santa Clara Page 3 of 5 Printed on 3/9/2023 Development Review Hearing Meeting Agenda March 15, 2023 2. 23-183 Action on the Architectural Review for a 307-unit mixed-use building at 3000 Patrick Henry Drive Continued from the February 22, 2023 Hearing (CEQA: Reuse of the Patrick Henry Drive Specific Plan EIR) Recommendation: Use the Patrick Henry Drive Specific Plan Environmental Impact Report and Approve the Architectural Review of a seven-story 307-unit mixed-use building containing a 5,000 square-foot Community Arts Center condominium space, an approximately 9,250 square-foot dedicated Art Park, and 4,000 square feet of retail space, subject to conditions. Under Section 1094.6, any lawsuit or legal challenge to any quasi-adjudicative decision made by the City must be filed no later than the 90th day following the date on which such decision becomes final. Any lawsuit or legal challenge, which is not filed within that 90-day period, will be barred. If a person wishes to challenge the nature of the above section in court, they may be limited to raising only those issues they or someone else raised at the meeting described in this notice, or in written correspondence delivered to the City of Santa Clara, at or prior to the meeting. In addition, judicial challenge may be limited or barred where the interested party has not sought and exhausted all available administrative remedies. If a member of the public submits a speaker card for any agenda items, their name will appear in the Minutes. If no speaker card is submitted, the Minutes will reflect "Public Speaker."
