Recommendation: Adopt a Class 1 Categorical Exemption Under CEQA Guidelines Section 15303 and approve the Architectural Review for the 1,077 square-foot first floor additions to an existing two-story single-family residence, resulting in a five bedroom and five and one-half bath home at 3049 Barkley Avenue, subject to conditions. 1.B 23-379 Action on the Architectural Review of the demolition of an existing one-story residence and the construction of a new two-story residence at 2888 Fresno Street. (CEQA: Class 1 Categorical Exemption 15301(e)(1), Existing Facilities) Recommendation: Approve the Architectural Review and a Class 1 CEQA Categorical Exemption for the demolition of the existing one-story residence and the construction of a two-story residence at 2888 Fresno Street, subject to conditions. 1.C 23-394 Action on an entitlement extension of a previously approved project (File No. PLN2019-14040) for an 89-dwelling unit, multi-family building with 75 stalls of parking in automated parking stackers. Recommendation: Approve the entitlement extension of a previously approved project (PLN2019-14040) for a new 89 - unit development as part of the Tasman East Specific Plan (TESP). GENERAL BUSINESS The following items from this Development Review Hearing agenda will be scheduled for further review following the conclusion of hearings and recommendations by the Development Review Hearing. (CEQA: Exempt, Section 15301 (e)(3) New Construction or Conversion of small structures) Recommendation: Redesign the second story of the proposed addition consistent with the Single-Family Design Guidelines. (CEQA: Exempt, Section 15301 (e)(2) Replacement or Reconstruction) (Continued from the March 15, 2023 Development Review Hearing) Recommendation: Use of a Categorical Exemption per CEQA 15301 (e) (2) Replacement or Reconstruction and Approve the demolition of a two-family residence and new construction of a single-family residential home, subject to conditions. Under Section 1094.6, any lawsuit or legal challenge to any quasi-adjudicative decision made by the City must be filed no later than the 90th day following the date on which such decision becomes final. Any lawsuit or legal challenge, which is not filed within that 90-day period, will be barred. If a person wishes to challenge the nature of the above section in court, they may be limited to raising only those issues they or someone else raised at the meeting described in this notice, or in written correspondence delivered to the City of Santa Clara, at or prior to the meeting. In addition, judicial challenge may be limited or barred where the interested party has not sought and exhausted all available administrative remedies. If a member of the public submits a speaker card for any agenda items, their name will appear in the Minutes. If no speaker card is submitted, the Minutes will reflect "Public Speaker."
