the entitlement time extension of a previously

existing use permit allowing an additional five

Consumption of Beer and Wine for a Restaurant located at 3443
El Camino Real
Recommendation: Determine the use Categorically Exempt pursuant to
CEQA guidelines 15301 (Class 1) Existing Facilities
and Adopt a resolution approving a Use Permit to
allow the on-site sale and consumption of beer and
wine (ABC License Type 41) for a 1,200 square foot
food-service establishment located at 3443 El
Camino Real, Santa Clara CA 95050, subject to the
findings and conditions of approval.

PUBLIC HEARING
Items listed above under Items for Council Action will be scheduled for Council review following the conclusion of
hearings and recommendations by the Planning Commission. Due to timing of notices for Council hearings and the
preparation of Council agenda reports, these items will not necessarily be heard on the date the minutes from this
meeting are forwarded to the Council. Please contact the Planning Division office for information on the schedule of
hearings for these items.
2. 23-499 Action on a Major Significant Property Alteration Permit and
Recommendation for Rezoning to Planned Development for
Property Located at 1365 Main Street and 1070 Lewis Street
Recommendation: 1) Adopt a resolution to approve the Major
Significant Property Alteration (SPA) Permit
based on the findings, the historical evaluation,
the treatment plan, and recommendation from
the HLC; and
2) Adopt a resolution to recommend the City
Council approve a rezone from R1-
6L-Single-Family Residential to PD-Planned
Development based on findings and conditions
of approval.

3. 23-678 Consideration of a Rezone to Planned Development for a First-
and Second-story Addition at 1485 Bellomy Street
Recommendation: Staff recommends that the Planning Commission:
1. Determine that the Project is categorically
exempt under Class 1 (Existing Facilities) of
the CEQA Guidelines;
2. Approve a resolution recommending that the
City Council approve the Rezone to Planned
Development to allow the first and second-story
addition for the existing single-family residence
at 1485 Bellomy Street, subject to conditions.
4. 23-927 Action on Use Permit to Allow an Outdoor Play Area for a New
Child Day Care Facility at 2280 El Camino Real (CEQA: Class 3
Categorical Exemption Section 15303). Continuance from June
14, 2023 Planning Commission Meeting.
Recommendation: Determine that the project is exempt from CEQA per
Class 3 (New Construction or Conversion of Small
Structures) and adopt a resolution approving the Use
Permit to allow an outdoor play area for a new child
day care facility at 2280 El Camino Real, subject to
findings and conditions of approval.
5. 23-928 Action on Appeal of Development Review Hearing Architectural
Approval for the Property at 74 Woodhams Road
Recommendation: Overrule the appeal and uphold the June 7, 2023
Development Review Hearing decision for
architectural review approval and determine the
project to be Categorically Exempt per CEQA
Guidelines section 15301 (e)(2) (Class 1 - Existing
Facilities) to allow construction of a 982 square-foot
second story addition, 238 square-foot first floor
addition, and 1,030 square feet remodel at 74
Woodhams, subject to findings and conditions of
approval.

The time limit within which to commence any lawsuit or legal challenge to any
quasi-adjudicative decision made by the City is governed by Section 1094.6 of the
Code of Civil Procedure, unless a shorter limitation period is specified by any other
provision. Under Section 1094.6, any lawsuit or legal challenge to any
quasi-adjudicative decision made by the City must be filed no later than the 90th day
following the date on which such decision becomes final. Any lawsuit or legal
challenge, which is not filed within that 90-day period, will be barred. If a person
wishes to challenge the nature of the above section in court, they may be limited to
raising only those issues they or someone else raised at the meeting described in
this notice, or in written correspondence delivered to the City of Santa Clara, at or
prior to the meeting. In addition, judicial challenge may be limited or barred where the
interested party has not sought and exhausted all available administrative remedies.
