Items listed on the Consent Calendar with associated file numbers constitute Public Hearing items. 1.A 23-1439 Planning Commission Special Meeting Minutes of November 15, 2023 Recommendation: Approve the Planning Commission Special Meeting Minutes of the November 15, 2023 Meeting 1.B 23-1331 Action on a Vesting Tentative Map for 5185 Lafayette Street for the Proposed Development of a 198-Unit Housing Development with Four Commercial Condominiums (CEQA: Addendum to the Tasman East Specific Plan EIR) Recommendation: Adopt a resolution to recommend the City Council approve the Vesting Tentative Map to subdivide the existing lot with 198 residential condominium units, four commercial condominium units, one residential parking condominium unit, and one commercial parking condominium unit at 5185 Lafayette Street, subject to findings and conditions of approval. Adopt a Resolution to adopt the Addendum to the 2018 Initial Study/Mitigated Negative Declaration for the McLaren Data Center; and 2. Adopt a Resolution to approve a Use Permit to install four additional emergency generators at the McLaren Data Center at 737 Mathew Street, subject to findings and conditions of approval 3. 23-1363 Action on a Conditional Use Permit and Architectural Review for a New Lincoln Dealership at 3155 Stevens Creek Boulevard (CEQA: Mitigated Negative Declaration) Recommendation: 1. Adopt a resolution adopting the Mitigated Negative Declaration (MND) and the Mitigation Monitoring and Reporting Program (MMRP) prepared for this project; 2. Adopt a resolution approving the Use Permit for the renovation and addition for a new Lincoln dealership with outdoor storage of vehicles for sale, subject to conditions; and 3. Under Section 1094.6, any lawsuit or legal challenge to any quasi-adjudicative decision made by the City must be filed no later than the 90th day following the date on which such decision becomes final. Any lawsuit or legal challenge, which is not filed within that 90-day period, will be barred. If a person wishes to challenge the nature of the above section in court, they may be limited to raising only those issues they or someone else raised at the meeting described in this notice, or in written correspondence delivered to the City of Santa Clara, at or prior to the meeting. In addition, judicial challenge may be limited or barred where the interested party has not sought and exhausted all available administrative remedies.
