Adopt a Resolution to adopt the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program for the Muslim Community Association School Expansion; and 2. Adopt a Resolution approving the Use Permit to allow an expansion of the Muslim Community Association School at 3003 Scott Boulevard and 3080 Alfred Street, subject to conditions. 24-1470 PUBLIC HEARING: Action on Mitigated Negative Declaration, General Plan Amendment, and Rezoning to Allow the Demolition of Four Existing Two-Story Buildings, and Construction of Two New 12-Story Office Buildings, a New Two-Story Amenity Building, and a New Seven-Story Parking Structure at 2901 Tasman Drive Recommendation: 1. Adopt a Resolution in the form presented recommending the City Council adopt the Mitigated Negative Declaration and the Mitigation Monitoring and Reporting Program prepared for the project, subject to findings; 2. Adopt a Resolution in the form presented recommending the City Council approve the General Plan Amendment from Low Intensity Office / Research and Development to High Intensity Office / Research and Development, and a text amendment to add a policy to allow up to 5 .0 Floor Area Ratio for HI O/R&D sites located North of Tasman Drive and South of Bunker Hill Lane; and 3. Adopt a Resolution in the form presented approving the Rezoning from Light Industrial to Planned Development to allow the demolition of four existing two-story buildings, and construction of two new 12-story office buildings, a new two-story amenity building, and a new seven-story parking structure at 2901 Tasman Drive, subject to findings and conditions of approval. Adopt a resolution to recommend the City Council adopt the Final EIR prepared for the Mission Point Project (SCH # 2018072068), including a Mitigation Monitoring and Reporting Program, CEQA Findings, and a Statement of Overriding Considerations. 2. Adopt a resolution to recommend the City Council approve a General Plan amendment to add a new land use designation Urban Center Mixed-Use. 3. Adopt a resolution to recommend the City Council approve the Planned Development Rezoning from ML - Light Industrial to PD - Planned Development. 4. Adopt a resolution to recommend the City Council approve a Vesting Tentative Subdivision Map. 5. Adopt a resolution to recommend the City Council approve the Development Agreement. 24-182 Recommendations on General Plan Text Amendment to Revise the Very Low Density General Plan land use designation; General Plan Amendments to Change the Residential Land Use Designations on Identified Properties to Preserve Residential Capacity, per State Law; the Zoning Code Cleanup Ordinance; and Zoning Code Map consistent with the City’s General Plan Land Use Diagram Recommendation: 1. Adopt a Resolution recommending that the City Council adopt General Plan Text Amendments related to the change to maximum densities to the Very Low Density Residential General Plan designation to recognize the additional density created by SB 9. 2. Adopt a Resolution recommending that the City Council adopt General Plan Amendments to maintain residential densities consistent with state law. 3. Adopt a Resolution recommending that the City Council adopt the Zoning Code cleanup ordinance, including changes to single-family setbacks to be consistent with the City’s adopted Residential Design Guidelines 4. Adopt a Resolution recommending that the City Council adopt the Zoning Code Map consistent with the City’s General Plan land use diagram. Under Section 1094.6, any lawsuit or legal challenge to any quasi-adjudicative decision made by the City must be filed no later than the 90th day following the date on which such decision becomes final. Any lawsuit or legal challenge, which is not filed within that 90-day period, will be barred. If a person wishes to challenge the nature of the above section in court, they may be limited to raising only those issues they or someone else raised at the meeting described in this notice, or in written correspondence delivered to the City of Santa Clara, at or prior to the meeting. In addition, judicial challenge may be limited or barred where the interested party has not sought and exhausted all available administrative remedies.
