September 6, 2025 5. Discussion and Possible Action Items a. Case #2023-3. Complaint Brought Forward by Arcy Baca – In Accordance with Section 6-16.4 SFCC 1987 “Determination of Legal Sufficiency; Setting a Hearing.” Consideration of Whether the Complaint Sets Forth Legally Sufficient Facts which, if True Show Probable Cause to Believe there was a Violation. (The Board May Go Into Executive Session Under NMSA 1978, Section 10-15- 1(H)(3) to Deliberate in Connection with an Administrative Adjudicatory Proceeding.) 1. Discussion of Actions. 2. Action Regarding Whether the Complaint Sets Forth Legally Sufficient Facts, Which, if True, Show Probable Cause to Believe there was a Violation. 3. Call to Order The meeting of the Ethics and Campaign Review Board was called to order at 3:00 PM in the City Council Chambers Located at City Hall, 200 Lincoln Avenue, Santa Fe NM 87501. 2. Roll Call MEMBERS PRESENT Member James Sullivan Member Judith Amer Member Christina Brennan Vice Chair Justin Miller Chair Paul Biderman MEMBERS EXCUSED Member Andrew Black Member Jose Puentes OTHER PARTICIPANTS ATTENDING Marcos Martinez, Senior Assistant City Attorney Geralyn Cardenas, Deputy City Clerk Xavier Vigil, Assistant City Clerk 3. Approval of Agenda Staff requested to remove the September 6, 2024 Minutes from the agenda. A motion was made by Member Brennan, seconded by Member Miller, to Approve the Agenda as amended. The motion passed unanimously by voice vote. 4. Approval of Minutes a. September 6, 2025 5. Discussion and Possible Action Items a. Case #2023-3. Chair Biderman recused himself from Case #2023-3 Member Sullivan recused himself from Case #2023-3 A motion was made by Member Amer, seconded by Member Brennan, to dismiss the case for lack of evidence of a violation. The Motion passed on a roll call vote: Member Amer - Yes Member Brennan - Yes Member Miller - Yes 6. Executive Session a. Discussion of Complaint Brought Forward by Arcy Baca in Regard to Case #2023-3. 7. Discussion No Action Items a. Additional Ethics Rules for City of Santa Fe Governing Body and City of Santa Fe Employees. Chair Biderman suggested appointing a subcommittee to review and compare the Ethics Code for City Employees to make recommendations to the Governing Body. A motion was made by Member Brennan, seconded by Member Amer, to appoint a subcommittee to review the Code of Ethics. The motion passed unanimously on a roll call vote. Chair Biderman volunteered to Chair the subcommittee. Member Brennan volunteered to participate in the subcommittee. Member Amer volunteered to participate in the subcommittee. 8. Public Comment No public comment was made. 9. Matters from Staff There were no matters from staff to discuss. 10. Matters from the Committee There were no matters from the committee brought forward. 11. Matters from the Chair Chair Biderman asked Deputy Clerk Cardenas about a potential incoming complaint. Deputy Clerk Cardenas said that her office had received a call about a potential complaint, but no formal complaint had been received. 12. Adjourn Member Amer made a motion to adjourn, seconded by Member Brennan. The motion was approved unanimously by voice vote.
