Council Chamber City of Santa Rosa 100 Santa Rosa Avenue Board of Public Utilities Regular Meeting Minutes - Final Thursday, January 18, 2024 1:30 PM 1. CALL TO ORDER AND ROLL CALL Chair Galvin called the meeting to order at 1:30 p.m. Present 4 - Chair Daniel Galvin III, Vice Chair William Arnone Jr., Board Member Robin Bartholow, and Board Member Glen Wright Absent 2 - Board Member Lisa Badenfort, and Board Member Christopher Grabill 2. PROCLAMATION 2.1 PROCLAMATION - MARK WALSH 2.2 PROCLAMATION - EMPLOYEE SERVICE RECOGNITION Chair Galvin read aloud the proclamation for retired Santa Rosa Water employee Sean Murphy. Vice Chair Arnone shared a story and Director Burke spoke about Sean Murphy. Sean Murphy spoke on his time with the City of Santa Rosa. Chair Galvin read aloud the proclamation for former Board Member Mark Walsh. Chair Galvin read aloud the proclamation for retired Santa Rosa Water employee Denise Cordova. Duane Dewitt shared his excellent experience with former Board Member Mark Walsh. 3. STATEMENTS OF ABSTENTION BY BOARD MEMBERS None. 4. MINUTES APPROVAL 5.1 December 7, 2023 - Regular Meeting Minutes - DRAFT The minutes for the December 7, 2023 Board of Public Utilities meeting were approved as submitted. 6. STAFF BRIEFINGS 6.1 WATER AND RECYCLED WATER SUPPLY UPDATE Staff will update the Board on water and recycled water supply issues. The Board may discuss this item and give direction to staff. Sean McNeil, Deputy Director of Environmental Services and Mike Prinz, Deputy Director - Regional Water Reuse Operations, presented. Duane Dewitt spoke about a project that utilizes recycled water and asked if there would be a way to get income from recycled water use. 7. CONSENT ITEMS None. 8. REPORT ITEMS None. 9. PUBLIC COMMENTS ON NON-AGENDA MATTERS Duane Dewitt spoke about leaking underground storage tanks in regards to those who are on wells in the Roseland area. 10. REFERRALS None. 11. DIRECTORS REPORTS Director Burke reported: There is one vacancy on the Board of Public Utilities (BPU). The purpose of BPU is to provide general policy direction over the management and operation of the City’s water and sewer utilities.The board reviews and approves policies and procedures for the department; establishes and recommends the approval of rates, fees and the annual operating and maintenance budgets; awards utility and capital improvement projects; awards contracts for maintenance, services, supplies and professional services; and negotiates property acquisitions, rents and leases utility property needed for City utility operations all in accordance with City Council policy and procedures. With the retirement of Kimberly Harryman, Deputy Director of Administration, an acting assignment was made available and Nick Harvey, Budget and Financial Analyst Manager, was selected for the acting role. 15. ANNOUNCEMENT OF CLOSED SESSION ITEM(S) 15.1 CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Initiation of litigation pursuant to paragraph (2) of subdivision (d) of Government Code Section 54956.9: one case. Potential litigation by Meadowgreen #2 Homeowners Association related to creek bank erosion on the Association’s parcel adjacent to 6512 Meadowgreen Place. Assistant City Attorney Biggerstaff announced the Closed Session City of Santa Rosa Regular Meeting Minutes Page 4 of 5 Board of Public Utilities Regular Meeting Minutes - Final January 18, 2024 item. Duane Dewitt shared his curiosity in how a home owner's association can come to the City about a dispute and questioned if the City is responsible for all creeks within city limits even if it is not the City's property. Assistant City Attorney Biggerstaff responded that the City is responsible for property that it holds interest in. RECESS CLOSED SESSION AND RECONVENE TO OPEN SESSION IN THE COUNCIL CHAMBER. Chair Galvin recessed the meeting to Closed Session at 2:01 p.m. Chair Galvin reconvened the meeting from Closed Session at 2:29 p.m. 16. REPORT ON CLOSED SESSION Assistant City Attorney Biggerstaff reported that the Board gave direction to legal counsel. 18. ADJOURNMENT OF MEETING Chair Galvin adjourned the meeting at 2:31 p.m. in honor of former Board Member Mark Walsh and the two retired Santa Rosa proclamation recipients. The next Board of Public Utilities meeting is scheduled for February 1, 2024.
