Mayor Coursey called the closed session to order at 2:01 p.m.

PUBLIC COMMENT
Duane DeWitt spoke in support of the Roseland community
providing assistance to the Council towards the Kawana Springs
Community Park.
Mayor Coursey recessed the meeting to closed session at
2:04 p.m. to discuss Items 2.1 and 2.2 as listed on the agenda:
2.1 CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Initiation of litigation and significant exposure to litigation pursuant to

BACKGROUND: At the January 9, 2018, City Council meeting, Vice
Mayor Rogers requested a future agenda item to discuss
development within the areas that were affected by the fires. Mayor
Coursey concurred.
PUBLIC COMMENT
Duane DeWitt spoke in support of the item and had concerns to
rebuild with safety measures.
Peter Tscherneff spoke in support of item and rebuilding with
drought resistance plants.
Teri Shore spoke in support of the item.

A motion was made by Vice Mayor Rogers, seconded by Mayor
Coursey, to discuss the current fire codes at a future meeting as a staff
briefing. The motion carried by the following vote:

AS ASSESSOR’S PARCEL NOS. 173-260-007 AND 173-260-008,
RESPECTIVELY, TO THE R-1-6 (SINGLE-FAMILY RESIDENTIAL)
ZONING DISTRICT; FILE NO. ANX17-004
RECOMMENDATION: This ordinance, introduced at the January 9,
2018, Regular Meeting by a 5-0-2 vote (Council Members Combs and
Tibbetts absent), prezones the KNIBB Properties located at 3747 and
3753 Chanate Road, also identified as Assessor’s Parcel Nos.
173-260-007 and 173-260-008, respectively, to the R-1-6 (Single-family
Residential) zoning district; File No. ANX17-004.

Ricardo Olvera spoke regarding the parking violation situation.
Danielle Cagan, representing AAA Insurance Group, spoke
regarding the status of the clients that filed a claim.
Elizabeth Neylon spoke regarding various topics.
Steve Birdlebough spoke regarding the homeless in regards to
temporary housing.
Bob Hansen spoke regarding the importance of public control and
the concerns of the installations of cell towers.

14.1 REPORT - DISTRICT BASED CITY COUNCIL ELECTIONS:
COMPOSITION OF DISTRICTS -- RESCHEDULING OF PUBLIC
HEARINGS (CALIFORNIA VOTING RIGHTS ACT)
BACKGROUND: On August 29, 2017, the City Council adopted a
resolution declaring its intent to initiate proceedings to transition the City
from at-large to district-based Council member elections pursuant to
Elections Code Section 10010 and Government Code Section 34886
(RES-2017-13).

The Council’s resolution set forth a schedule of public hearings in
connection with the drawing of the electoral districts. The first of those
public hearings took place on October 3, 2017. The remaining public
hearings were postponed due to the impacts of the wildfires that swept
into the City beginning on October 8, 2017.
The City is now ready to resume proceedings to transition the City to
district-based Council member elections. Pursuant to Elections Code
Section 10010, the City Council is required to hold at least five public
hearings in connection with the establishment of electoral districts,
before the Council considers an ordinance to transition the City to
district-based elections. Two of the public hearings must be held before
any map or maps of the boundaries of the proposed voting districts are
drawn. These two initial public hearings provide the public an
opportunity to provide input regarding the criteria for the proposed
districts. Two additional public hearings must be held after the
proposed maps are drawn, to allow for public comment on the draft
maps. A final public hearing must be held prior to the Council’s
adoption of an ordinance establishing district-based elections.
RECOMMENDATION: It is recommended by the City Attorney that the
City Council establish a new schedule of public hearings regarding the
composition of new voting districts and the establishment of
district-based Council member elections.
