STUDY SESSION 3.1 2021 WATER AND WASTEWATER DEMAND FEE UPDATE STUDY SESSION Water and wastewater demand fees, one-time fees charged for new development, are updated periodically to adjust the fees based on current system valuation and customer usage. On August 26, 2014 the 2014 Water and Wastewater Demand Fee Study and the current demand fee schedule were adopted by Council. Santa Rosa Water’s consultant, The Reed Group, Inc., performed a detailed analysis to develop a new fee schedule and update the Water and Wastewater Demand Fee. The proposed 2021 demand fee update will increase the demand fee per one thousand gallons of water and wastewater. However residential categories, based on Santa Rosa customer usage, have reduced resulting in the combined 2021 water and wastewater fees being less than the current combined demand fees. This item was received and filed. 3.2 COUNCIL DISTRICT REDISTRICTING PROCESS AND TIMELINE Council District boundaries must be reviewed every ten years upon receipt of Federal Census data to ensure continuing compliance with the U.S. Constitution and federal and state law. The ten-year review also gives the City the opportunity to adjust the boundaries of the Council Districts if desired. The U.S. Census Bureau has announced that the Census data needed for local redistricting efforts will be released by September 30, 2021. The redistricting must be completed by mid-April 2022 to be operative in the November 2022 election. State Elections Code sets forth procedural requirements for local redistricting. The Study Session will outline those procedural steps and will inform the Council and the public of required timelines. The Council may receive information, ask questions, discuss and provide direction to staff regarding the redistricting process. This item was received and filed. 3.3 CHARTER REVIEW The City of Santa Rosa is a Charter City formed pursuant to the provisions of the California Constitution and governed by the City Charter as ratified by the City’s voters. Section 12 of the Charter allows for review and revision of the Charter no more frequently than every 10 years. The last Charter revision began in 2011 and resulted in proposed revisions placed on the November 2012 ballot. Under the terms of Section 12, the City is now eligible, though it is not required, to begin a new Charter review. Charter review may result in proposed revisions, additions or deletions to existing Charter provisions. Any proposed changes to the Charter are subject to voter approval. It is recommended that Council hold a study session to hear and discuss the procedures, timing and options for Charter review. The Council may receive information, ask questions, and provide direction to staff. No formal action will be taken. PUBLIC HEARINGS 15.1 PUBLIC HEARING - 2020 URBAN WATER MANAGEMENT PLAN AND 2020 WATER SHORTAGE CONTINGENCY PLAN BACKGROUND: The Urban Water Management Planning Act (Act) requires every urban water supplier that provides water for municipal purposes to more than 3,000 connections or supplying more than 3,000 acre-feet per year (AFY) of water to adopt and submit an Urban Water Management Plan (UWMP) to the California Department of Water Resources (DWR) every five years. The Act requires very specific information to be included in the UWMP and requires the urban water supplier to hold a public hearing to review and adopt the UWMP. The City of Santa Rosa Regular Meeting Minutes Page 9 of 25 City Council Regular Meeting Minutes - Final June 8, 2021 deadline for water suppliers to submit their 2020 UWMP to DWR is July 1, 2021. The City is an urban supplier of water for approximately 54,000 connections supplying approximately 19,000 AFY of water and is therefore required to comply with the Act. The City’s previous UWMP was the 2015 UWMP, which was adopted by the City Council in June 2016. The Act includes a requirement to prepare a Water Shortage Contingency Plan (Shortage Plan), which details how a water supplier plans to respond to water shortages ranging from up to 10 percent to over 50 percent. The City's Shortage Plan was initially adopted in 1992 and was most recently updated and adopted by City Council as part of the 2015 UWMP in June 2016. For 2020, the UWMP Act requires that the Shortage Plan be prepared as a stand-alone document. The Act also requires the urban water supplier to hold a public hearing to review and adopt the Shortage Plan. The deadline for water suppliers to submit their 2020 Shortage Plan to DWR is July 1, 2021. The Water Conservation Subcommittee of the Board of Public Utilities met three times from January through April 2021 to participate in the development of the 2020 UWMP and the 2020 Shortage Plan. The Board of Public Utilities reviewed the 2020 UWMP and the 2020 Shortage Plan in a Study Session on April 15, 2021. The Board of Public Utilities reviewed and recommended updates to the 2020 UWMP and the 2020 Shortage Plan at their meeting on May 20, 2021. The Council reviewed the 2020 UWMP and the 2020 Shortage Plan in a Study Session on April 27, 2021. Many have faced substantial loss of income or significant out-of-pocket medical expenses. Among those hardest hit are residential tenants unable to meet their rent obligations due to COVID-related financial loss. On March 24, 2020, the Board of Supervisors adopted the County of Sonoma Eviction Defense Ordinance (Ordinance 6301), prohibiting residential evictions for failure to pay rent, if that failure was due to COVID-related financial loss. The Ordinance was expressly intended to apply, and has applied, throughout the County, including in both incorporated and unincorporated areas. On February 9, 2021, the Board of Supervisors amended the County’s Eviction Defense Ordinance to prohibit all evictions except (a) when necessary due to violence or threats to the health or safety of another, (b) when sought for the purpose of immediately removing the unit from the rental market, or (c) when based on non-payment of rent unrelated to financial hardships resulting from COVID-19. The amendments are intended to apply throughout the County, absent alternative action by a city. On April 6, 2021, the Council conducted a study session on residential eviction protections, including the County’s February 2021 amendment to its Eviction Defense Ordinance. The Council gave direction to staff to return to the Council with a proposed City ordinance that would City of Santa Rosa Regular Meeting Minutes Page 13 of 25 City Council Regular Meeting Minutes - Final June 8, 2021 continue tenant protections in alignment with the County’s original Ordinance without inclusion of the recent amendments. RECOMMENDATION: It is recommended that the Council consider adoption of an urgency ordinance to prohibit residential evictions for failure to pay rent due to specified COVID-related financial loss, in alignment with County of Sonoma Ordinance No. 6301 as originally adopted on March 24, 2020. PUBLIC COMMENT Keith spoke on being a housing provider and tenants being $100,000 in arrears, not evicting tenants, being unable to evict bad tenants due to the County's ordinance, and encouraged the City to go back to the state ordinance. Alexis spoke on receiving a notice for past due rent and the vote on this item affecting thousands of people in Sonoma County. Kimi spoke on industries that are understaffed and how the action being taken by Council will affect the community. Shaela spoke on being a business owner and her concern on the action being taken by Council that will affect thousands of residents. Michael spoke on the problem of homelessness, encouraged Council to protect the people, not property, and the need for just cause evictions. Asya Sorokurs spoke on her concerns that Santa Rosa is withdrawing from the County ordinance, protecting tenants addresses equity, and asked the Council not to reject the County ordinance. Sarah spoke on landlords illegally evicting people and the sacrifice people made by losing their jobs to not spread COVID. Noa, member of the Tenants Union and the North Bay Organizing Project, spoke on discussions of housing and displacement happening on stolen southern Pomo and coast Miwok land, and the imbalance of power between landlords and tenants. Dave spoke on landlords who take advantage of tenants, and the County needing to expand their ordinance. Isabel spoke on being a renter and serving on the board of Sonoma County Renters Union and asked the Mayor to vote no on the ordinance to keep current protections in place. Allegra spoke on people not being able to live here due to the high rent and for Council not to fix the situation on the backs of renters. John, Fair Housing Advocates, spoke on their experiences during the pandemic, families who have come looking for help with rental assistance, and stated he stands in solidarity with Tenants Union. Suzie Dershowitz, Legal Aide, asked Council to vote no to opt out of County's ordinance and preserve temporary eviction protections. Melissa spoke urging Council to think about their decision and the impact it will have on people, to vote for the strongest protections for tenants. Raquel spoke advocating for all tenants who couldn't attend the meeting and urged the Council to vote no on the ordinance. Tami spoke on being a landlord and her experience with a tenant that resulted in her selling her property and taking it out of the rental market. Lee spoke on leaders who lead with greed instead of compassion. Resident 9137 spoke urging Council to vote no on the ordinance and on the need to provide protections to the most vulnerable populations. Natalie spoke on being disappointed with the Council for taking action to opt out of the County's ordinance. Eduardo, Tenants Together, spoke asking Council to vote no to opt out of the County's just cause for eviction ordinance. Elizabeth Finn, Member of Immigrant Defense Task Force, urged the Council to vote no to opt out of the County's just cause for eviction ordinance. RECOMMENDATION: It is recommended by the Transportation and Public Works Department that the Council, by resolution, 1) establish the CityBus Unlimited Pass Program allowing the Transit Division to seek additional community partnerships to provide fare-free transit access, 2) adopt a methodology for calculating Unlimited Pass Program costs for participating entities, 3) delegate authority for executing Unlimited Pass Program partnership agreements up to $100,000 to the City Manager or designee, and 4) authorize the Transit Division to initiate an 18 month grant-funded unlimited pass pilot program for TK-12th grade youth.
