STAFF BRIEFINGS No public comments were made. 7.1 COVID-19 RESPONSE UPDATE This will be a standing item on the agenda. No action will be taken except for possible direction to staff. Interim City Manager Jeff Kolin reported the Center for Disease Control (CDC) announced they have authorized Pfizer booster doses for individuals aged 65 and over, individuals 18-64 years of age that are high or severe risk of COVID-19, and individuals 18-64 years of age whose frequent institution or occupational exposure puts them at high risk for serious complications due to COVID-19. This item was received and filed. 7.2 DEBRIS RESPONSE TEAM UPDATE Staff will provide council with an update of the activities of the Debris Response Team during the first 8 months. No action will be taken except for possible direction to staff. Will Fetrow, Senior Maintenance Worker, and Jeremy Gundy, Deputy Director - Field Services, provided an update on the work of the Debris Response Team. This item was received and filed. 8. CITY MANAGER’S/CITY ATTORNEY’S REPORTS Interim City Manager Kolin reported he attended the CalCities Conference in Sacramento and attended several education workshops. City Attorney Gallagher reported AB 361 was signed by Governor Newsom allowing cities to continue hybrid meetings. No public comments were made. 9. STATEMENTS OF ABSTENTION BY COUNCIL MEMBERS Council Member Tibbetts announced he would abstain from City of Santa Rosa Special Meeting Minutes Page 4 of 18 City Council Special Meeting Minutes - Final September 28, 2021 approving the September 10 Special Meeting minutes due to being absent from the meeting. 10. MAYOR'S/COUNCIL MEMBERS’ REPORTS Council Member Schwedhelm reported he attended the CalCities Conference in Sacramento, attended the Coffey Park celebration, and a Coffey Strong Board meeting. Council Member Alvarez reported he attended the CalCities Conference in Sacramento for one day, attended the opening of the Mitote Food Park in Roseland, expressed interest in having a conversation on sideshows at the Council level, and announced his appointment of Mark Walsh to the Charter Review Committee. Vice Mayor Rogers reported she attended the opening of Mitote Food Park in Roseland, and announced her appointment of Ron Miller, Ernesto Olivares, and Kristine Byrne to the Charter Review Committee. Council Member Sawyer reported he attended the CalCities Conference, and announced his appointment of Jim Pedgrift to the General Plan Community Advisory Committee. Council Member Tibbetts announced his appointment of Brian Ling, Dan Condron, and Adriana Arrizon to the Charter Review Committee, and expressed interest in having a conversation on sideshows at the Council level. Mayor Rogers announced his appointment of Jocelyn Villalobos to the Charter Review Committee, he reported he attended the CalCities Conference noting that the resolution before the Legislative Committee regarding the distribution of sales tax on the sales tax hubs did not make it out of the Resolutions Committee and, therefore, was not considered, and the resolution regarding streamlining and working with the California Public Utilities Commission regarding railroad tracks did pass. PUBLIC HEARINGS City of Santa Rosa Special Meeting Minutes Page 10 of 18 City Council Special Meeting Minutes - Final September 28, 2021 15.1 PUBLIC HEARING - ADOPTION OF MITIGATED NEGATIVE DECLARATION AND MASTER PLAN FOR ROSELAND CREEK COMMUNITY PARK BACKGROUND: Roseland Creek Community Park is a nearly twenty-acre community park site located in the Southwest Quadrant of the City of Santa Rosa. A Master Plan is needed to show the community desired park amenities. An environmental declaration (Mitigated Negative Declaration) is required to construct amenities shown within the Master Plan. RECOMMENDATION: It is recommended by the Transportation and Public Works Department that the Council, by resolution: (1) adopt the Mitigated Negative Declaration, including the Mitigation Monitoring and Reporting Program, for the Roseland Creek Community Park Master Plan; and (2) adopt the Roseland Creek Community Park Master Plan, which includes, paved pedestrian and bicycle trails, community garden or outdoor classroom, nature center, and parking, picnic areas with single use barbeques, parking, children’s play areas for ages 2-5 and 5-12, restroom building, sport court, fitness stations, irrigated turf area, two pedestrian bridges, crosswalk, looped walking paths and interpretive signage. PUBLIC COMMENT City of Santa Rosa Special Meeting Minutes Page 11 of 18 City Council Special Meeting Minutes - Final September 28, 2021 Shawn Smallwood spoke on his experience detecting species of wildlife, suggested an Environmental Impact Report be prepared before Council took action. Ana Salgado spoke in support of the park, the park needing to be taken care of for the children to learn and enjoy natural spaces and she thanked the children for showing her the area. Jasmin spoke in support of the park, removing the lawn area in light of the drought, and her concern for the homeless being removed from the park. Rick spoke in support of a full Environmental Impact Report be conducted, his concern about the safety of the school children using the crosswalk if placed in the location of the plan, and the bicycle trail being an extension of Roseland Creek without a crosswalk. Richard Drury, Roseland Action, spoke asking the City to reject the Mitigated Negative Declaration and to prepare an Environmental Impact Report, and supports a series of neighborhood parks instead of a large park. Allegra Roseland Resident, spoke in support of the park, and asked Council to do a dual track process to address environmental issues so the project is not delayed. Amalia Bowley Fuentes, Roseland Action, spoke requesting the Council reject the Mitigated Negative Declaration and prepare an Environmental Impact Report to address environmental concerns before moving forward with the project, Susan Kirks, President of Madrone Audobon Society, spoke on the property providing environmental education and offerings to the community, and the need to conserve appropriately with passive recreation. Tatiana spoke in opposition to the park as currently planned with the City of Santa Rosa Special Meeting Minutes Page 12 of 18 City Council Special Meeting Minutes - Final September 28, 2021 parking lots and barbeque lots. Ana spoke on participating in the meetings for several years, in support of the park, the need to improve the quality of education and habitat in the park, in opposition to the barbeque lots, the sports parks, and her concern the community is still not being heard. Stephanie Manieri, Roseland Resident, spoke in support of the Roseland Creek Park, the importance of leadership to take care of the community, and thanked staff for their work over the years. Kimi, Roseland Resident, excited to be able to bring her future children to the park, the importance of making meetings accessible to Roseland residents, and having access to green space. Nohemi, President of Roseland CVI, spoke on wanting visible signage in both English and Spanish as well as signage stating there is No drinking, No smoking of marijuana, and in support of other amenities with some maintenance to keep things natural in the park. Nick Rineberg, Roseland Resident, spoke on his concerns with the Environmental Impact Report, and the need for more parks in Roseland. Erin Rineberg, spoke on her concerns that Roseland is overdeveloped and the environment being destroyed, supports the park to be an ecological preserve, and on her concern the Environmental Impact Report was inadequate. Magdalena McQuilla, Roseland Resident, spoke in support of the park as designed. Melissa spoke on taking her students to the area and connecting kids to nature, in support of the park to be built, the need for a crosswalk on the west side, and her concern and opposition about watering a lawn. City of Santa Rosa Special Meeting Minutes Page 13 of 18 City Council Special Meeting Minutes - Final September 28, 2021 WSH spoke on the need for an adequate Environmental Impact Report, in support of the park and keeping it natural with signage, and to not turn it into a hardscape. Maria Manieri spoke in support of the park and to preserve the nature in the area. Liz, Roseland Resident, spoke in opposition to the new development of the park, preserve the natural wildlife. Duane De Witt spoke in opposition to the Negative Declaration, asked for a comprehensive Environmental Impact Report, and on the efforts over the years to keep the area as a natural preserve. Ana Diaz spoke on the condition of Sheppard Elementary School fields being shared by multiple schools, and wanting to be included in District 7. Nancy Kusichs spoke on a park that is already in the area, and in support of preserving the nature of the property. April spoke in opposition of the park with a parking lot. Alicia submitted comment in support of a Roseland Creek Park. Maria submitted comment in support of the park. Star submitted comment in support of the community park. Brenda submitted comment in support of a crosswalk next to the school. Virginia Lasso submitted comment in keeping the park an ecological park to preserve nature. Anna Reyes, Roseland Resident, submitted comment in support of the park with amenities for children and to bring families together. Stan Gow submitted comment stating the park is being under-utilized by the youth, and in support of more active play area for children. Ethan submitted comment in support of the park as a public space. Jorge Innocencio spoke in support of the park, there is space for nature and for kids and to increase access to the area. REPORT ITEMS City of Santa Rosa Special Meeting Minutes Page 15 of 18 City Council Special Meeting Minutes - Final September 28, 2021 14.1 REPORT - ANNUAL REPORT OF THE COMMUNITY WILDFIRE PROTECTION PLAN, A WILDFIRE ANNEX TO THE LOCAL HAZARD MITIGATION PLAN BACKGROUND: The Disaster Mitigation Act of 2000 requires that State and local governments develop and adopt a LHMP to be eligible to receive federal grants pertaining to disaster preparedness. From November 2015 to February 2016, City staff from multiple departments worked with the City’s consultant to create an updated plan. The team met four times during the period from November 2015 through January 2016. On February 23, 2016, the public review draft of the LHMP was released for a 30-day public review period. On April 7, 2016, the Draft Local Hazard Mitigation Plan was submitted to California Department of Emergency Services (Cal OES). Council adopted the plan on January 10, 2017. In December 2017, an application to develop a CWPP intended to be an annex to the LHMP, specific to the Wildfire section of the currently adopted plan was developed. The application was reviewed by State and Federal officials and funding was awarded in June 2018. In December 2018, the RFP process was opened to solicit applicants to provide proposals for the development of the CWPP. The plan serves as a 5-year road map to work to mitigate the risk of wildfires through the course of nine objectives and forty-two actionable items. RECOMMENDATION: It is recommended by the Fire Department that the Council, by motion, accept the first annual report for the Community Wildfire Protection Plan, a Wildfire Annex to the Local Hazard Mitigation Plan in compliance with the Healthy Forests Restoration Act. Those teleconference meetings have been held in accordance with the Governor’s Executive Orders N-29-20 and N-08-21, which waive certain provisions of the Ralph M. Brown Act (Brown Act) in the interests of public health. The two executive orders, however, sunset as of September 30, 2021. Assembly Bill 361 (AB 361) was signed into law by Governor Newsom on September 16, 2021. AB 361 allows for teleconference meetings under relaxed Brown Act standards during a state of emergency, provided that certain factual findings are made and certain alternative procedures are set in place to protect public participation. RECOMMENDATION: It is recommended by the City Attorney that the Council: 1) by motion, find good cause, under the Early Agenda Policy and the Open Government Ordinance, to consider this item, notwithstanding that the item did not appear on the preliminary agenda; and 2) by resolution, authorize the continued implementation of teleconferenced public meetings for all the City’s Boards, Commissions and Committees pursuant to Assembly Bill 361. Duane De Witt spoke on the overhead projector for public comment at Council meetings, on providing a safe way to support sideshows, and concern on the approval by the Planning Commission of a cannabis dispensary in the Roseland area. 18.
