STUDY SESSION Present: 4 - Mayor Chris Rogers, Vice Mayor Natalie Rogers, Council Member Victoria Fleming, and Council Member John Sawyer Absent: 3 - Council Member Eddie Alvarez, Council Member Tom Schwedhelm, and Council Member Jack Tibbetts 3.1 WATER DEMAND OFFSET POLICY AND FEES It is recommended by Santa Rosa Water that the City Council hold a Study Session to receive information, ask questions, discuss, and provide comment regarding the proposed Water Demand Offset Policy and Water Demand Offset Fee Study, which have been developed to implement the requirement in the City’s Water Shortage Contingency Plan that during water shortage emergencies that require water allocations (water rationing) new construction must offset water demand. Council Member Alvarez joined the meeting at 1:39 p.m. PUBLIC COMMENTS Duane De Witt, Housing Advocacy Group, spoke on the group not being informed this item was before Council, concerns by residents when new development is happening during a water shortage when residents are asked to conserve. Calum Weeks, Generation Housing, spoke thanking staff and the consultants for listening to their concerns, asked Council to hold off on implementing the fees, asked why it is not subject to AB 602, and to use subsidies to help build additional housing. This item was received and filed. 3.2 ONE-TIME MONIES The City has $7 million remaining of PG&E settlement funds that remain unobligated. In addition, the City must develop a spending plan for $34,367,436 of the American Rescue Plan Act (ARPA) funding, which will be allocated to the City in two equal tranches of $17,183,718. The first tranche was received in May 2021, and the second tranche is expected in May 2022. At a Study Session on July 13, 2021, the City Council provided staff with a list of projects that may be funded through either ARPA funds, or PG&E settlement funds. In addition, City staff identified projects which may also be considered for funding. In total, approximately $171.5 million of projects were identified. A working group of eight City employees met to review the projects, and determine their respective rankings based on sustainability, economic, City of Santa Rosa Regular Meeting Minutes Page 4 of 19 City Council Regular Meeting Minutes - Final October 26, 2021 and equity considerations/factors. Council Member Tibbetts joined the meeting at 3:00 p.m. PUBLIC COMMENTS Michelle spoke in support for the Roseland Boys & Girls Club. Ananda Sweet, Santa Rosa Metro Chamber of Commerce, spoke in support of several issues on the priority list presented and thanked Council for their work. David Bowman spoke in support of the youth in Roseland. Phil Kerr, CEO of City Ventures, spoke regarding housing build in Santa Rosa and their commitment to infill development to conserve open spaces, asked Council to use for additional planning and contract resources. Keith Christopherson spoke on the housing crisis, commended staff for their work and asked Council to fund Planning staff. Duane De Witt, Roseland Action, spoke on the importance of looking at how to improve the area, storm water improvement, and using ARPA funds for broadband. PUBLIC HEARINGS 15.1 PUBLIC HEARING - INTRODUCTION OF AN ORDINANCE OF THE COUNCIL OF THE CITY OF SANTA ROSA AMENDING TITLE 9 OF THE SANTA ROSA CITY CODE BY AMENDING CHAPTER 9-12 REFUSE AND SANITATION AND CHAPTER 9-14 CONSTRUCTION AND DEMOLITION DEBRIS BY ADDING PROVISIONS AND REQUIREMENTS OF SENATE BILL 1383 SHORT-LIVED CLIMATE POLLUTANTS: ORGANIC WASTE REDUCTIONS BACKGROUND: California is now experiencing the effects of a climate crisis: hotter summers with record breaking temperatures, even more devastating fire seasons, more extreme droughts, and rising sea levels that erode our coastlines. Scientists tell us that greenhouse gasses related to human activities, like landfilling food and yard waste, causes climate change. To respond to this climate crisis, California is implementing statewide organic waste recycling and surplus food recovery. In September 2016, Governor Edmund Brown Jr. set methane emissions reduction targets for California (SB 1383 Lara, Chapter 395, Statutes of 2016) in a statewide effort to reduce emissions of short-lived climate pollutants. The statewide targets enact policies designed to reduce organic waste disposal 75% and rescue currently disposed edible food by at least 20% by 2025. The City of Santa Rosa must adopt an enforceable ordinance or similar mechanism requiring compliance with the various SB 1383 regulation requirements no later than January 1, 2022. RECOMMENDATION: It is recommended by the Transportation and Public Works Department that the Council introduce an ordinance to amend Title 9 of the Santa Rosa City Code by amending Chapter 9-12 Refuse and Sanitation and Chapter 9-14 Construction and Demolition Debris by adding provisions and requirements of Senate Bill 1383 City of Santa Rosa Regular Meeting Minutes Page 6 of 19 City Council Regular Meeting Minutes - Final October 26, 2021 Short-Lived Climate Pollutants: Organic Waste Reductions. REPORT ITEMS 14.1 REPORT - TRUST AGREEMENT AND AUTHORIZING FILING OF VALIDATION ACTION FOR PENSION OBLIGATION BOND ISSUANCE City of Santa Rosa Regular Meeting Minutes Page 18 of 19 City Council Regular Meeting Minutes - Final October 26, 2021 BACKGROUND: Staff is proposing that the City of Santa Rosa initiate the process to issue Pension Obligation Bond (“POBs”) in order to take advantage of current favorable borrowing rates and to refund a portion or all of its outstanding CalPERS Unfunded Accrued Liability (“UAL”). While staff has consistently presented the intent of doing a financing that is less than the UAL, for validation purposes only, the practice is to validate the entire amount. As such the information in this report assumes a full funding scenario. RECOMMENDATION: It is recommended by the Finance Department that the Council, by resolution: 1) authorize the issuance of one or more series of City of Santa Rosa Pension Obligation Bonds; 2) approve and authorize execution and delivery of an Indenture of Trust (“Indenture”) relating thereto; 3) authorize a validation action related to the Pension Obligation Bonds; and 4) direct staff to return to the City Council for approval of documents related to the initial series of the Pension Obligation Bonds.
