FILE NUMBER REZ23-001 RECOMMENDATION: This ordinance, introduced as part of a broader package of amendments at the June 6, 2023, Regular Meeting by a 6-1-0 vote (Fleming no), amends the text of Section 20-48.040 of Title 20 of the Santa Rosa City Code, Chapter 20-48, Short-Term Rentals, to provide a 30-day grace period, following the adoption of the ordinance, to submit applications to renew expired Short-Term Rental Permits issued during the first year of the Short-Term Rental Ordinance. On June 6, 2023, after a duly noticed public hearing, Council introduced a series of amendments to the text of Chapter 20-48, Short-Term Rentals. Council directed that (a) staff return as quickly as possible with an amendment to provide the 30-day grace period set forth in this proposed ordinance, and (b) staff return at a later date with a comprehensive ordinance setting forth the remaining amendments introduced on June 6th. REPORT ITEMS 14.1 REPORT - INDEPENDENT POLICE AUDITOR ANNUAL REPORT BACKGROUND: On November 30, 2021, the City entered into contract with the OIR Group to become an independent auditor of the Santa Rosa Police Department. The OIR group reports directly to the City Manager and reviews internal investigations, conducts audits of policies, practices and records, and conducts community outreach. RECOMMENDATION: It is recommended by the Police Department that the Council receive a presentation by the OIR Group LLC (OIR) of the annual report of Santa Rosa Police Department (SRPD) oversight. This is for information and no action will be taken. PUBLIC HEARINGS Present: 7 - Mayor Natalie Rogers, Vice Mayor Dianna MacDonald, Council Member Eddie Alvarez, Council Member Victoria Fleming, Council Member Jeff Okrepkie, Council Member Chris Rogers, and Council Member Mark Stapp 15.1 PUBLIC HEARING - AMENDMENT TO CHAPTER 6-66 OF THE SANTA ROSA CITY CODE, RENT CONTROL - MOBILEHOMES, TO SET CUMULATIVE LIMIT ON RENT INCREASES FOR COMBINED CALENDAR YEARS 2023 AND 2024 BACKGROUND: In December 2022, the Council adopted an Amendment to the Mobilehome Rent Control Ordinance (Chapter 6-66) that reduced the maximum annual allowable rent increase for a mobilehome space from 100% of the Consumer Price Index (CPI) up to a 6% increase, to 70% of CPI up to a 4% increase. The Amendment took effect on January 6, 2023. Some mobilehome parks, however, had rent increases effective January 1, 2023, at 100% of CPI, which was 5.7%. Mobilehome parks with rent increases on and after January 6, 2023, applied the new reduced rate of 70% of CPI or 3.99%. Staff has been evaluating options to provide a remedy for the residents of mobilehome parks that had increases at 100% of CPI in early January 2023, and has determined that a further adjustment to the Ordinance is appropriate to provide consistency and equity in application of the Ordinance going forward. RECOMMENDATION: It is recommended by the Housing and Community Services Department that the Council introduce an City of Santa Rosa Regular Meeting Minutes Page 12 of 20 City Council Regular Meeting Minutes - Final June 20, 2023 ordinance amending Chapter 6-66 of the Santa Rosa City Code, Rent Control - Mobilehomes, to limit the cumulative rental increase for any mobilehome space in the combined calendar years 2023 and 2024 to the lesser of: (A) Four percent (4%) rent increase for 2023, plus the allowed increase in rent for 2024 under Chapter 6-66 (equal to 70% of the increase in annual CPI as of August 2023, not to exceed 4%), or (B) Eight percent (8%) of the rent charged for the space in 2022. Vice Mayor MacDonald opened the public hearing at 6:43 p.m. PUBLIC COMMENT: Tom La Penna spoke in support of Item 15.1 and requested an overlay zoning for senior housing at 55+ parks in the City and removal of in-place transfer. Gary Brady spoke on Item 15.1 and requested the money be frozen in the rent control mediation fund. Roger McConnell spoke in opposition to the 10% in-place transfer fee and requested the reinstallation of mobile home park commission. Jo Ann Jones, Vice President of the Santa Rosa Manufactured Home Homeowners Association, expressed appreciation of the ordinance revision, and requested the correction of the rent disparity City of Santa Rosa Regular Meeting Minutes Page 13 of 20 City Council Regular Meeting Minutes - Final June 20, 2023 before the CPI comes out for next year. Barbara Goodman requested that the Council do what is right and what is fair for the remaining parks. Barbara Sue Wilson requested that the remaining 5 parks be included in the rental increase limitations. Bonnie Petty spoke in opposition to the transfer tax, and provided a handout to Council. Diane Monroe expressed appreciation for the amendment to the ordinance and expressed concern about the Carriage Court ownership changing to an all-ages park. Margaret Dematteo, Legal Aid Sonoma County, spoke regarding retaliatory conduct by park owners regarding changes from last year, and the power imbalance between park ownership and renters. Deborah Collins spoke on historical mobile home prices, rental rates, in opposition to the 10% in-place transfer fee, and that parks are taking advantage of the owners. Carol R spoke in opposition to the 10% in-place transfer free. Saulo Londono, Western Manufactured Housing Communities Association, WMA, spoke in opposition to Item 15.1.
