Council Member Fleming joined the meeting at 12:39 p.m. Ken Martin, labor negotiator for Unit 2 - Firefighters, spoke on Item 3.5 and in support of good-faith bargaining. Eli Held, firefighter, spoke on Item 3.5 and requested fair compensation for firefighters. John Holt, Local 1401, spoke on Item 3.5, and asked for fair contract. Thomas Gallagher, Fire Captain, spoke on Item 3.5 and the loss of top-tier firefighters leaving for high paying jobs at other agencies. Konstantin Zherebnenkov spoke on Item 3.5 and requested fair compensation and adjustments for the fire department firefighters. Kayla Neel-Grant, Single Role Paramedic, spoke on Item 3.5 and City of Santa Rosa Regular Meeting Minutes Page 2 of 17 City Council Regular Meeting Minutes - Final July 23, 2024 requested fair compensation and negotiations in order to fill vacant positions. Matt Tognizzi spoke on Item 3.5 and asked that the compensation be increased to align with comparable cities. Gary Lopez, Santa Rosa Fire Captain, spoke on Item 3.5 and recruiting concerns for City of Santa Rosa due to low wages. Jon Aarsheim spoke on Item 3.5 and the sacrifice firefighters make to serve this community. Steve DelPorto, Local 1401, spoke on Item 3.5, past negotiations, current negotiations, and desire to get the firefighters what they deserve. Unidentified father of fire fighter spoke on the conditions that firefighters serve in, specifically exposure to high temperatures and that personal toll should also be recognized. Mayor N. It is recommended by the Transportation and Public Works Department that the Council hold a Study Session on the Sonoma County Integrated Transit Service Plan recently completed by the Sonoma County Transportation Authority (SCTA) in coordination with Santa Rosa CityBus, Sonoma County Transit and Petaluma Transit. This item is provided for Council’s information and no action will be taken except for possible direction to staff. REPORT, IF ANY, ON STUDY AND CLOSED SESSIONS Teresa Stricker, City Attorney, combined reports for Item 6 and Item 9.1. The report noted that the June litigation summary was attached in the agenda packet, reported that there were no settlements over $50,000 in June and that the caseload remains consistent at approximately 30 matters; and reported there was no reportable City of Santa Rosa Regular Meeting Minutes Page 5 of 17 City Council Regular Meeting Minutes - Final July 23, 2024 action taken in Closed Session on Items 3.1 through 3.5. PUBLIC COMMENT Adina Flores spoke on pending litigation. Thomas Ells spoke on various real estate items and transparency on closed session items. 7. PROCLAMATIONS/PRESENTATIONS - NONE. 8. STAFF BRIEFINGS - NONE. 9. CITY MANAGER’S/CITY ATTORNEY’S REPORTS Maraskeshia Smith, City Manager, reported on recent concerns related to Cultural Heritage Board, upcoming Ice Cream and Tacos with a Cop events, and the upcoming National Night Out event. PUBLIC COMMENT Adina Flores spoke on the Cultural Heritage Board resignations and suggested Council re-evaluate the fee study. Duane De Witt spoke on the Cultural Heritage Board as it relates to Roseland, the recent resignations, and suggested abolishing the board. 9.1 REPORT OF SETTLEMENTS AND ACTIVE LITIGATION The City Attorney will report on settlements over $50,000 through June 2024 as well as provide a summary of pending litigation against the City. Jerry Reid, General Manager of Smother's European Mobile Cars spoke in opposition to the future agenda item on the business license tax, it being too high, and proposed suggestions to modify the proposed measure. STATEMENTS OF ABSTENTION BY COUNCIL MEMBERS City Attorney Stricker announced Council Member Alvarez recusal from Item 16.1 due to financial interest in a cannabis business. 11. MAYOR'S/COUNCIL MEMBERS’ REPORTS Council Member MacDonald requested a future agenda item to reconsider the recently adopted fee increases related to historic landmark alteration permits, fees for historic districts, and those additional fees identified by Director Osburn so long as the reconsideration does not negatively impact those currently within the permit process. Mayor N. Rogers concurred. Council Member Fleming reported on a recent Metropolitan Transit Commission (MTC) meeting where the MTC approved putting the Bay Area Housing Finance bond on the ballot and other community events attended. Mayor N. Rogers provided a brief report on Sonoma County Mayor's and Councilmembers Director's meeting, and other community events attended including a Park-A-Month event, and announced appointment of Miles Horton to the Community Advisory Board. This item was continued to the August 6, 2024 regular Council meeting. 15.2 RESOLUTION - TRANSIENT OCCUPANCY TAX BALLOT MEASURE (THIS ITEM HAS BEEN CONTINUED TO THE AUGUST 6, 2024, REGULAR MEETING.) RECOMMENDATION: It is recommended by the Finance Department that the City Council (1) introduce an ordinance to amend chapter 3-28 of the Santa Rosa City Code to increase the Transient Occupancy Tax (TOT) by two percent (2%), and (2) approve a resolution ordering the submission of a ballot measure to seek voter approval of this ordinance at the November 5, 2024, General Municipal Election and directing related actions. This item was continued to the August 6, 2024 regular Council meeting. 16. PUBLIC HEARINGS 16.1 PUBLIC HEARING - ORDINANCE OF THE COUNCIL OF THE CITY OF SANTA ROSA ADDING CHAPTER 6-20 OF THE SANTA ROSA CITY CODE TITLED “REGULATION OF RETAIL TOBACCO SALES,” AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN AGREEMENT WITH THE COUNTY FOR COMPLIANCE City of Santa Rosa Regular Meeting Minutes Page 14 of 17 City Council Regular Meeting Minutes - Final July 23, 2024 MONITORING AND ENFORCEMENT BACKGROUND: The City Council will consider an ordinance that proposes adding Chapter 6-20 to the Santa Rosa City Code titled “Regulation of Retail Tobacco Sales” requiring all tobacco retailers to obtain a license and comply with enhanced regulations associated with tobacco sales, in particular, those targeting sales to youth. The ordinance incorporates direction from Council provided during their June 4, 2024, meeting revising sections associated with license transfer language and the level of fines and penalties. The revised ordinance does not alter the proposed language to establish a buffer between retail locations and schools and parks, a ban on electronic tobacco smoking devices and flavored tobacco sales, and establishment of minimum package sizes and pricing. If adopted, the ordinance will impose a license fee on retailers selling tobacco products within the City limits. Staff will return to Council with a resolution to impose any such fees. RECOMMENDATION: It is recommended by the City Manager’s Office that the Council: 1) hold a public hearing to discuss regulation of retail tobacco sales; 2) introduce an ordinance adding Chapter 6-20 to the Santa Rosa City Code titled “Regulation of Retail Tobacco Sales”; and 3) by motion, authorize the City Manager to negotiate and execute an agreement with the County of Sonoma for license administration and compliance monitoring. Estela Venegas, Aliados Health, spoke in support of the tobacco retail license. Efren Reyes Hernandez spoke in support of the tobacco retail license and the ban of flavored tobacco products. Alexandra Mendoza Ayala spoke in support of the tobacco retail license and the ban on flavored tobacco products. Blythe Young, American Heart Association, spoke in support of the tobacco retail license but requested an earlier start date to the ordinance, evaluation of the 2 year license structure, and that fines be civil and administrative in nature. The City Council grants or overrules such protests. The City Council, by resolution, may confirm the itemized report of the costs of abatement. The City Council authorizes the Santa Rosa Fire Department, County Auditor and Tax Collector to enact a special assessment as a lien upon respective parcels subject to the Weed and Rubbish Abatement Program. RECOMMENDATION: It is recommended by the Santa Rosa Fire Department that the Council, by resolution, confirm the itemized report of the Fire Department of the cost of weed and rubbish abatement as provided for in Sections 9-08.020, 9-08.080, and 9-08.090 of the Santa Rosa City Code.
