Variance
PUBLIC HEARING & REGULAR MEETING
1. Area Variance submitted by Karim Botros at 582 Sekon Road, Tupper
Lake, NY 12986 Variance will consist of demolition of 3 non-conforming
structures with a replacement of 1 Residential Structure.
2. Area Variance submitted by Todd & Emily Hoffnagle at 6187 NY-30 Lake
Clear NY 12945 Variance will be for a garage that will connect to a non-
conforming structure.

Joe called the meeting to order at 6:05pm
Area Variance submitted by Todd and Emily Hoffnagle at 6187 NY-30 Lake Clear NY 12983.
Designated in our tax records as 433.2-1-1 for a garage that will connect to a non-conforming
structure.
Todd Hoffnagle presented the board with a letter that he had made explaining to the neighbors
what their project was going to consist of and had those who was for the project sign it. He
explains that it will be a 36 X 24 garage that meets the Town setbacks but will be adding it to a
non-conforming structure. None of the neighbors were against the project that was being
presented from the Hoffnagle’s.
Chris reads the letter aloud so Joe who is on zoom can see the letter also.
Mark explains that he had gone out to the property and didn’t see any issue

Area Variance Submitted by Karim Botros at 582 Sekon Road Tupper Lake NY 12986. Designated
in our tax record as 483.2-3-39 for demolition of 3 non-conforming structures with a replacement of
one (1) residential structure
Dan Spada who is representing Botros says that the 3 structure that are on the property are “eye sores.”
One of the structures close to the property line was damaged by a fire that happened on the neighboring

property. He explains that the new structure will be more to the center of the property. “This will also give
the neighbors a better view of the lake which the don’t have that now.”
The only concern from the neighbors were from the Kraus and that was the right way being maintained
Guy Middleton the Lake Manager of Upper Saranac Lake Foundation mentioned that they had received
last week that the septic failed that was connected to all 3 of the buildings .
Joe had some concerns about the septic that with the failed septic will it determine the process of the
project.
Guy mentioned that they are working on getting it fix “Sekon as a community septic so it has to get fixed.”
Todd explains that if the project was accepted that he will have a condition on the permit stating that the
Certificate of Occupancy will not be issued until the Wastewater Treatment System is repaired or hooked
up to a new approved system.
Mark makes the motion to accept the project with the condition of no Certificate of Occupancy is granted
until the Wastewater treatment system is repairs or new approved system is hooked up.
