CALL TO ORDER Mayor Kim called the meeting to order at 7:00 p.m. Dr. Joe Buchac shared some of his music with the audience. PUBLIC COMMENT Mayor Kim advised there are new rules to public comment. People have 4 minutes to use or lose it. He asked all to be kind; we are a community. He also asked the speakers to be factual. The Council members may respond if they choose. He will also hold a public comment period at the end of the City Council meeting. The public must register to present their questions. Mayor Kim opened the public comment period at 7:05 p.m. Page 4 of 18 City Council Meeting 3/7/2023 Rose Tate of Saratoga Springs stated the news has been showing footage of train wrecks and accidents causing air pollution. The air pollution jeopardizes the health of the people in that area. There can be two to three hours of stop and go traffic on Lincoln Avenue when the track lets out. Lincoln Avenue is a confined area with metal containers that are trapping the pollution. Diogonese of Stolen Land stated the most important business that needs to be taken care of this evening is the fascist member of the Council. Chandler Hickenbottom faces bogus charges for her troubles. She thanked Commissioner Sanghvi, Commissioner Moran, Commissioner Golub, and Mayor Kim for speaking up against Commissioner Montagnino’s against Chandler Hickenbottom. It was identified at the hearing this morning that Commissioner Montagnino asked for an order of protection against Chandler Hickenbottom. Diogonese asked where the free speech hurts Commissioner Montagnino. Commissioner Montagnino stated the order of protection he requested was a ‘no illegal conduct order’ not an order of protection. Tracey Krosky of Halfmoon stated statements fall on deaf ears here. Knowing Commissioner Montagnino is using his personal position to punish a black woman for speaking out and smirking when people speak tells everything needed to be known about him. It has been said Commissioner Montagnino wants one of the t-shirts because he thinks it’s funny. It is Commissioner Montagnino’s intent is to terrorize the public based upon his past. Sherri Grinter stated the port-a-potties is a great idea and should be located in front of the cameras. One should be handicap accessible. Steve Mickle of Saratoga Springs stated he watches the Council meetings at home. The perception from the audience is most Council members are not paying attention. Norah Brennan of Saratoga Springs stated she was working out of country and was asked what one thing makes this county great. Her response was the freedom to speak. Part of being an elected official in this country is having to listen to what the public has to say and when someone disrupts the Council in a way they or audience doesn’t like, it is a mild form of disagreement. Commissioner Montagnino has decided to make this about him. If you can’t do the job you were elected to do you need to step aside; you are distracting from allowing the City Council to move forward. Heather Reynolds of Saratoga Springs stated Commissioner Montagnino took a situation that could have been resolved through empathy and conversation but took the path of inflammation. Having been a member of the Board of Education, conversation regarding police officers at schools wasn’t pleasant and was uncomfortable; but she owed it to people to listen and try to understand it from their perspective. She suggested Commissioner Montagnino do more listening, less talking and threatening. Julie Lewis of Saratoga Springs stated she is a supporter of Saratoga Black Lives Matter, the black community, and those who feel their voice is not heard. She is struck by the discrepancies that she sees happening. She told Commissioner Montagnino he has not listened and has not communicated. If the Council wants peace in the City you must do the things people are talking about. Matt Oill of Schenectady stated Commissioner Montagnino used the Black Lives Matter movement to get elected. If the Council had taken substantial steps towards racial justice by this point, they wouldn’t be in this position. He gave all of them a chance but proved his skepticism correct. Winston Grady Willis of Clifton Park and former member of the Police Reform Task Force stated he stands in solidarity with Chandler Hickenbottom. He applauded those on the Council that spoke out against the summons brought forward by Commissioner Montagnino. When folks like Chandler disrupt, they are reminding the rest of who are privileged and in position of power that they have to do more. Lexis Figuereo of Saratoga Springs stated one thing that hasn’t been said tonight is Commissioner Montagnino met with Chandler and himself before he was elected about the changes he was going to make Page 5 of 18 City Council Meeting 3/7/2023 and the police reform he was going to make. Commissioner Montagnino spoke against Robin Dalton suppressing their speech and then does the same thing. Wake up and focus on the real issues. Saratoga Black Lives Matters was waiting for the Council to do what they said they were going to do. Let’s focus on the real issues. The taxpayers are paying for Commissioner Montagnino’s mess-ups. This is being added to the Attorney General’s investigation. Saratoga Black Lives Matters is suing the City. Commissioner Montagnino met with Saratoga Black Lives Matters countless times before he was elected and hasn’t met with them since. Commissioner Montagnino stated he filed the charge because the City Council meeting was ended, not delayed or interrupted. You can’t have a democracy where people are shutting down a meeting. Lexis Figuereo stated it is all about freedom of speech. Every person should have freedom of speech and due process. People should be able to speak and bring up their grievances at any time without being charged criminally for it. Mayor Kim stated there will be a community forum on this at the March 21 meeting and asked Commissioner Montagnino to reserve this for that date. Daesha Harris of Saratoga Springs stated people don’t get to speak at every Council meeting. While the Police Reform Task Force was working to move things forward, the police were out there shooting protestors. She was told by Commissioner Montagnino she needs to check the points in the 50-point plan as if there is some scam. She asked what Commissioner Montagnino is talking about. He specifically said number one is not on there. Mayor Kim closed the public comment period at 7:44 p.m. PUBLIC HEARING 2023 Water and Sewer Rates Resolution Mayor Kim opened the public hearing at 7:44 p.m. No one spoke. Mayor Kim closed the public hearing at 7:44 p.m. PRESENTATION 2023 Community Development Block Grant Annual Action Plan Recommendations Pamela Polacsek presented along with Julie Lewis. Ms. Polacsek stated the primary objective of the CDBG program is to develop a viable urban community through housing, economic development, elimination of slums and blight, expansion of community services, and neighborhood revitalization. This year was the easiest in decision-making. There was just over $356,000 in requests with approximately $313,888 to give away. There was only one applicant for the public service portion. The suggested awards are as follows:  Mother Susan Andersen Women & Shelter Program - $32,075  AIM Services - $25,313  Rebuilding Together Saratoga - $100,000  Franklin Community Center - $20,000  Mother Susan Andersen for Shelter Roof Repair - $9,500  RISE - $40,000 Page 6 of 18 City Council Meeting 3/7/2023  Pitney Meadows Community Farm – Roof Restoration - $37,000  CDBG Program Administrator - $50,000 Mayor’s Infrastructure Update Joanne Yepsen, chair of the Infrastructure Committee, stated they convened last year to look at the priorities and needs of the City. The Committee identified and ranked the projects. Once that was completed, funding had to be secured for these projects. Joanne introduced Darren from Delta. Darren stated two reports were distributed to the Council (attached). The due diligence report drafted details, cost estimates, and time lines. Grant requests were not successful this year. They looked at the previous priorities (12 projects) and planning initiatives to identify current priorities, described the project, and opportunities. Shovel ready projects were looked at as well as projects that improve quality of life, and priorities related to affordable housing and homelessness. The next steps to move forward included the submission of a letter of intent to apply with the grant application, which was due the end of January 2023. Yesterday they filed two community funded project requests and have identified a lot of funding resources. As potential funding sources are identified, they will keep the City informed. Mayor Kim stated the City has received funding for homelessness through Congressman Tonko. SUPERVISORS Matt Veitch National Association of Counties Conference Report Supervisor Veitch reported this conference took place February 10 -14. He services on the Community Economic & Workforce Committee where a resolution was passed to maintain federal funding levels for things like CDBG funding. Supervisor Veitch chairs the International Economic Development Task Force where they discussed the North American trade and the US/Mexico/Canada Agreement. The heard from three high-level administration officials. The next NACO conference is in July in Austin, Texas. New York State Association of Counties Conference Supervisor Veitch reported this occurred in Albany on February 27 & 28. He is the vice-chair of the Public Safety Committee where the resolutions addressed better funding for mental health services in jails; improve probation; alternatives to incarceration, to protect the public and reduce the reliance on jails and detentions. He attended seminars on ethics in government, first amendment audits, and state budget overview. Tara Gaston Public Health Supervisor Gaston reported Saratoga County has the highest rate of flu in the state. The COVID positivity rate remains low. Overdose prevention kit distribution is in the final plans. National Association of Counties Conference Supervisor Gaston reported she too is on the Economic & Workforce Committee. She also attended the IT Committee where they discussed cyber security. Page 7 of 18 City Council Meeting 3/7/2023 New York State Association of Counties Conference Supervisor Gaston reported she is a member of the Climate Action Committee and discussed extended producer responsibility. The producer is responsible to pay the municipality to make sure things are not put into landfills or waterways that are not safe. In the Mental & Public Health Committee, they talked about the opioid crisis and increasing funding. Mayor Kim asked for clarification of the County not accepting CDBG funding. Supervisor Gaston stated the City of Saratoga Springs has been titled an entitlement city for federal funding. The County is not able to be titled and ‘Entitlement County’ meaning the City has to give up the entitlement city status and the County has to accept entitlement county status. Concern at the County is municipalities that did receive funding would no longer be able to receive funding. Approve Budget Amendments Commissioner Montagnino stated when this Council first took office, at their first meeting they approved minutes from December 7, 2021; less than a month behind from meeting to approval of minutes. Tonight’s agenda has approval from the October 18, 2022 City Council meeting minutes. A second person was approved to prepare the minutes of City Council meetings. He asked if there is a reason why the minutes are five months behind. Commissioner Moran stated there were more than two meetings in November and December as there were budget meetings, City Council meetings and special City Council meetings. Mayor Kim stated the issue with this is he doesn’t remember in detail what happened in October at the various budget workshops and it is a long time. He doesn’t have the staff to compare the minutes with the videos. Mayor Kim stated he is going to abstain from approving these minutes because he has not had time to review them. He suggested pulling those items out and voting separately. Records of the video is always going to be the best thing. Commissioner Montagnino stated he doesn’t raise this as an academic exercise. A meeting was held two months ago, where it was discussed at length, the mayor signing a contract for Hueber Bruer to be in compliance with the SAFER Grant. That contract has not yet been signed because there are others in the City who claim the Council never voted to approve that item. Chief Dyer was here that night and confirmed it was passed. Here it is months later and there still aren’t minutes for that meeting, the question remains open, and they still don’t have the contract. Mayor Kim asked if the contract was given to his office. Page 8 of 18 City Council Meeting 3/7/2023 Commissioner Montagnino stated he believes it was. He knows there was question about the insurance carried by the subcontractor but the insurance certificate has been provided. Commissioner Moran stated the contract was passed pending provision of insurance. He stated the minutes have been posted on the website consistently. Tony Izzo, city attorney, stated his recollection is Chief Dyer was here and stated the insurance was in the process of being resolved. Mayor Kim asked how they get the contract signed. Commissioner Montagnino stated he believed the director of risk and safety has the insurance certificate and that was the only thing in the way of getting it signed. Mayor Kim advised they will contact the director of risk and safety and get back to Commissioner Montagnino. They may need the minutes. Commissioner Sanghvi suggested pulling the minutes and voting on them the next time. Mayor Kim asked if there was a consensus of pulling the minutes and voting on them the next time. Commissioner Moran stated the minutes are posted on the web to be reviewed by everyone; it is not expected for them to be read between posting on the agenda and the City Council meeting. Mayor Kim stated he has gone back to look at past minutes and rely upon their accuracy. He doesn’t have the time to watch the video. Commissioner Moran stated the process is to translate the video. The Accounts Department has spent a lot of time this year improving the accuracy of the minutes. He is proud of the work the secretary to the City Council, Lisa Ribis, has done and Barb Brindisi, assistant city clerk, who has also picked up the skill. He is certain since he took office that the quality of the minutes have improved. Commissioner Montagnino moved and Commissioner Sanghvi seconded to table the first six items of this Consent Agenda. The funds were designated for the upgrade of existing water and sewer lines at Allen Drive and are asking for the money to be repurposed. Discussion: City Council Agenda and Internal Operations Commissioner Moran stated it is good to get the input of the community. His staff recommended they be consulted on any changes the Council feels need to happen; the Council must agree to go forward with changes; communicate changes properly with employees; and start date of a change is built to happen in the future and not the next meeting. Commissioner Moran reminded the Council they need to set employees up for success and make sure they have the time to make the proper changes that may impact the employee schedules. Commissioner Sanghvi stated she agrees with Commissioner Moran. After the Council hears from the public regarding times of meetings, it is important to talk with the employees and see what works best to come up with a solution for everyone. Mayor Kim stated that makes sense. The final agenda has to be published before noon on Monday so the pre-agenda meeting has to happen on Friday to get that done. Let’s talk about it. Commissioner Moran stated this change will impact the warrant and bill payment. Commissioner Moran announced that the next short term rental workshop is April 25, 2023 at 6 p.m. at the City Center. FINANCE DEPARTMENT Announcement: Update on City Finances Commissioner Sanghvi announced Saratoga Springs lead the state with sales tax collection with at total of $16.95 million, up 14.6% from 2021. Collected $743,149 of occupancy tax, an increase of 27% from 2021. Mortgage tax collection for 2023 is much lower than expected. Announcement: Participatory Budgeting Commissioner Sanghvi announced the first cycle of participatory budgeting is in the implementation stage. Projects will continue to roll out over the course of the year. On March 1, 2023, the Finance Department began to accept proposals for cycle two of the participatory program and will continue to accept proposals through May 1, 2023. The 28% increase in sewer charges is due to an increase in charges from the Saratoga County Sewer District. This created a budget shortfall in the 2023 sewer budget. Commissioner Golub moved and Commissioner Sanghvi seconded to adopt the 2023 water and sewer rate resolutions. Commissioner Sanghvi asked if a reason was provided as to why there is such an increase in the County sewer rates. Supervisor Veitch explained the calculation is proposed to the Board of Supervisors for vote by the Sewer District. The City of Saratoga Springs is the only municipality in the County where sewers is based upon flow and not by the number of actual users. The County takes a measurement of flow from the northern part of the City and a measurement from the exit on the southern part of the City. Mayor Kim stated Mayor Klotz investigated getting the City out of the tax, which was a good decision. Maybe the City should investigate this again to see if opting out of this calculation is worth it. Ayes – All (Commissioner Moran, Commissioner Sanghvi, Commissioner Golub, Commissioner Montagnino, Mayor Kim) Nays – 0 PUBLIC SAFETY DEPARTMENT Discussion and Vote: Whether to Install Two Portable Toilets at the Woodlawn Garage Commissioner Montagnino stated when Code Blue ends there will be no shelter for the homeless. The Woodlawn Garage has become the place where the homeless congregate. The cost of installing handicap/wheelchair accessible toilets has been investigated. The question is how to pay for this and what revenue line the money will come from. This would be a step to provide some dignity to the homeless. If served 3 times a week would cost the City a little under $1,000 per month. Mayor Kim stated the cart is before the horse in this situation. There could be bidding issues and the Council needs to get public input on this. This was tried previously by Commissioner Scirocco and was not seen in a positive manner by the business community. The City should we working hard to get the permanent location. Commissioner Montagnino stated in October he was with the mayor when they announced a location. People yelled at the mayor and the mayor caved. Mayor Kim stated he didn’t cave; Shelters of Saratoga abandoned the plan. He went into a meeting with the school parents, who were a hostile audience and stated William Street is still on the table. Commissioner Golub stated he agrees providing for the City’s homeless is high on the list. He would like to understand what went wrong when this was tried before. Commissioner Golub is open to having a conversation about this. Commissioner Sanghvi stated she understands this was done previously by Commissioner Scirocco. She would also like to understand where it failed; who is going to pay for this; cost of maintenance; and how is this going to be paid for. Maybe the Homeless Task Force can look into this. Maybe the bathrooms in Congress Park can be left open after hours. Commissioner Montagnino stated the Council agrees this is a problem and agrees when Code Blue closes for the season there is nowhere for the homeless to go to relieve themselves. Page 16 of 18 City Council Meeting 3/7/2023 Commissioner Sanghvi stated the City Council should look at all options/solutions and not have a ‘knee jerk’ reaction to a situation. Commissioner Moran asked if the Council could move on as four of the Council members feel this is a bad idea. Mayor Kim stated the problem is this is a proposal; it isn’t real at this point. Code Blue is open now so there is time to bring this back with details. Commissioner Montagnino moved to change this agenda item to a public hearing regarding the installation of portable toilets. Discussion and Vote: Authorization to Reimburse Employee #2716 in the Amount of $119.52 (23-131) Commissioner Montagnino advised this is for the purchase light fixtures for the equestrian barn. There are enough people on the task force to get the job done. PUBLIC COMMENT Mayor Kim re-opened the public comments period at 10:12 p.m. Rose Tate of Saratoga Springs stated she was aghast to learn of the need for a bathroom in the garage. She can’t believe there isn’t a bathroom for people to use. Having a bathroom is a good idea. Kristen Dart of Saratoga Springs stated the City has a commissioner who is raising a delay in meeting minutes because someone outside the Council raised a question; however, the video provided the answer. The same member of the Council accused public of filibustering when the public is asking for accountability. This shows the power at Council table is being used for pettiness, not for good or progress. The minutes were on the agenda and cold have been addressed at the pre-agenda meeting. Ms. Dart applauded the mayor’s attempt to move forward with the Police Reform Task Force work. Only pieces of what was passed Page 17 of 18 City Council Meeting 3/7/2023 matches what was originally submitted to the City Council. There has been no spending of money indicating any of the points have been implemented. Commissioner Montagnino stated the creation of the Civilian Review Board (CRB) is one of the 50 points and the one that was most controversial when the points were adopted. It took nine more months to get the CRB staffed. For the first time, this City’s Police Department has passed the mock assessment for accreditation and are awaiting the official review by Division of Criminal Justice Service. People do need a full report of where the 50 points stand. All but a handful of the points have been fully implemented. Sam Brewer of Saratoga Springs states he comes to the meetings to make sure taxpayers funds are being spent appropriately.
