PRESENT: Thomas Curley, Commissioner, Public Safety Kenneth Klotz, Mayor Michael Lenz, Commissioner, Finance Thomas McTygue, Commissioner, Public Works Bernard Mirling, Commissioner, Accounts ALSO PRESENT: Phillip Klein, Board of Supervisors Representative Anthony Scirocco, Board of Supervisors Representative STAFF PRESENT: Christine Gillmett-Brown, Deputy Commissioner, Finance Carol Kennedy, Deputy Commissioner, Accounts Bob King, Deputy Commissioner, Public Safety William McTygue, Deputy Commissioner, Public Works Jeffrey Wait, City Attorney PUBLIC HEARING Sarcom Rezoning Mayor Kenneth Klotz said this is a public hearing on the petition from Sarcom, Inc., to rezone their one acre property at 393 Church Street from Rural Residential-1 (single family homes on two acre lots) to a Highway General Business District. He said the Council had received favorable advisory opinions from both the City and the County Planning Boards. Jonathan Lapper, attorney representing the applicant, said this request was to simply extend the Highway General Business District by one more parcel. He said they propose to renovate this parcel for office use. He said they had appeared before the Zoning Board of Appeals, however, the ZBA felt this parcel should be rezoned rather than to grant a variance. He said the ZBA also sent a letter to the Council with their recommendation to rezone. Mayor Kenneth Klotz asked why the ZBA felt this parcel should be rezoned. Geoff Bornemann, City Planner, said the ZBA felt that the applicant could not meet the criteria test for a variance and, therefore, felt that rezoning was more appropriate. Mayor Kenneth Klotz opened the public hearing. There being no one wishing to speak, Mayor Kenneth Klotz closed the public hearing. CALL TO ORDER Mayor Kenneth Klotz called the meeting to order at 7:00 p.m. MAYOR'S OFFICE Approve CDBG Consolidated Plan Approve CDBG Consolidated Plan Mayor Kenneth Klotz moved and Commissioner Bernard Mirling seconded to approve the Community Development Block Grant program as presented. Brad Birge, Community Development Coordinator, said this is a five-year strategic plan which will be submitted to Housing and Urban Development once adopted by the City. He said this plan gives priorities and investment strategies of the City's needs for the next five years. Ayes all. Status of Property at Routes 50 and 9 Mayor Kenneth Klotz said it was his understanding that the property owner is liable for cleanup costs; therefore, if the City took possession of this parcel, the City would then be liable. He said this clean up is a major problem. He advised caution on the City's part before moving too quickly on this matter. Commissioner Thomas Curley said that some discussion with DEC is necessary before taking ownership of this parcel. He said he was concerned about the traffic flow in this area and did not want to lose this window of opportunity. He said perhaps the Council should start thinking about acquiring this parcel. Commissioner Thomas McTygue said we should continue to proceed with the right-of-wayin this area issue that was started several years ago. He asked that Jeff Wait, City Attorney, do some research on the previously discussed agreement with Pizza Hut. Mayor Kenneth Klotz agreed that Jeff Wait would work on the right-of-way issues and a plan should be developed to place the City in a better position should this parcel become available. Approve Settlement with Roemer, Wallens, & Mineaux Mayor Kenneth Klotz moved and Commissioner Bernard Mirling seconded to approve the settlement with Roemer, Wallens & Mineaux to resolve the billing issues for their retainer in the amount of $2,200. Mayor Kenneth Klotz reminded Council members that the individual contract with James Roemer was not renewed in January and because that contract was not renewed, the firm asked for a larger retainer. He said they continued to work on some cases and, therefore, need to be paid. Commissioner Thomas Curley asked if Roemer, Wallens & Mineaux had agreed with this figure. Mayor Kenneth Klotz said yes. Ayes all. Approve Ryan-Biggs Associates contract Mayor Kenneth Klotz moved and Commissioner Bernard Mirling seconded to approve the contract with Ryan-Biggs Associates in the amount of $7,800 for a structural evaluation of City Hall in connection with renovations in the Engineering Department. Paul Male said they are looking to renovate their office to allow for a second floor in the main area and some additional storage areas. He said, though, that the structural integrity of the police department floor needed to be evaluated before plans could be developed. Commissioner Michael Lenz asked if the money was within the budget. Paul Male said it was in the Engineering Department budget. Ayes all. Approve Revised Grant/Loan Guidelines (HUD) Mayor Kenneth Klotz moved and Commissioner Thomas Curley seconded to approve the revised grant/loan guidelines. Brad Birge said the City has a grant program to fund rehabilitation for income eligible residents. He said this revision was to update the income guidelines. Ayes all. Approve Contract Change - Camp Saradac Bus Drivers Mayor Kenneth Klotz moved and Commissioner Thomas McTygue seconded to approve the contract with the Camp Saradac Bus Drivers in the amount of $12.25/hour with an effective date of July 1, 2000. Ayes all. Announce EPA Clean-Up Grant Mayor Kenneth Klotz said the City had received a grant from EPA in the amount of $100,000 for the study of the Excelsior Avenue ice rink site and the Spring Run area. He said he hoped that Niagara Mohawk would work with the City on this matter. Commissioner Thomas McTygue said he had received a letter from Niagara Mohawk requesting that the City consider selling the old ice rink site to them. He asked that the Real Estate Committee look into that issue. Council members agreed. Budget Amendments Mayor Kenneth Klotz said that since the budget surplus had been announced, there have been many discussion on how to use that money. He said there has been some good community input as well as good suggestions from Council members. He said he was in the process of preparing a comprehensive plan which would be ready for the next meeting. He asked that if Council members had any input, to please contact him before that meeting. Commissioner Thomas Curley said he would like to get together with Mayor Kenneth Klotz before the end of the week. Confirmation of Approval by Memo - Spring Run Trail Grant Application Mayor Kenneth Klotz moved and Commissioner Bernard Mirling seconded to confirm the vote by memorandum to authorize him to submit the Spring Run Trail Grant to the Capital District Transit Committee in the amount of $716,188. He said that 50 percent of the cost ($358,094)would be paid by CDTC if the grant is awarded. Geoff Bornemann said that the City has applied for a grant to construct the trail system in the amount of $716,188. He said the city would be eligible for up to 50 percent ($358,094) of the total if the grant is awarded. He said the City should know in about two months whether we qualify. Mayor Kenneth Klotz asked what were the City's chances. Geoff Bornemann said this is the second time that the City will apply for this grant. He said that last time the two top projects were funded and the City's request was number three on the list. He said the City should be very competitive in this particular grant. Mayor Kenneth Klotz said he hoped that Niagara Mohawk would work with the City on this project to provide a substantial part of the required local match. Commissioner Thomas Curley asked what would happen if Niagara Mohawk decided not to participate and fund the City's share. Mayor Kenneth Klotz said there were many options, one of which was to withdraw the application. Ayes all. ACCOUNTS DEPARTMENT Approval of July 5 City Council Meeting Minutes Commissioner Bernard Mirling moved and Commissioner Thomas Curley seconded to approve the July 5 City Council meeting minutes as written. Ayes all. Mayor Kenneth Klotz pointed out at the last meeting Deputy Commissioner Christine Gillmett-Brown has stated that there was $50,000 in the contingency fund to cover the cost of the guide rails. He asked that it be noted in the records that there was enough money in the contingency fund to cover the entire cost of these guide rails. Waive of Bid -- City Center Portable Wall Commissioner Bernard Mirling moved and Commissioner Thomas Curley seconded to confirm the recent approval by memo for the emergency repairs for the City Center Portable Wall to B.R. Johnson for a total sum of $1,799.00. Ayes all. Award of Bid - Sale of Police Cars Upon the recommendation of the Department of Public Safety, Commissioner Bernard Mirling moved and Commissioner Thomas Curley seconded to award the bid for the sale of used vehicles to West Side Auto Supply for various prices. Ayes all. Award of Bid -- Walk-Off Mats & Dust Mop Service Upon the recommendation of the Department of Public Works, Commissioner Bernard Mirling moved and Commissioner Thomas McTygue seconded to award the bid for Walk Off Mats to Coyne Textile Services for various prices. Ayes all. Award of Bid - Tire Repair Service Upon the recommendation of the Department of Public Works, Commissioner Bernard Mirling moved and Commissioner Thomas McTygue seconded to award the bid for Tire Repair Service to Metroland Tire Company (only bidder). Ayes all. Vote - Sarcom Rezoning Commissioner Bernard Mirling moved and Commissioner Thomas McTygue seconded to issue a negative SEQR declaration and adopt the ordinance to rezone the Sarcom property from RR-1 to Highway General Business District. Commissioner Bernard Mirling said he was concerned that this was "spot zoning". He said that the Comprehensive Plan Committee recently reviewed this area and did not recommend rezoning. He said he was concerned about setting a precedent in that others could come in and simply ask for one more parcel to be included. Mayor Kenneth Klotz agreed. He said this is one decision by the Council and should not be construed as "open season" on such requests. Commissioner Thomas Curley cautioned about the use of terminology "spot zoning". He said this was not spot zoning but rather rezoning one parcel from one designation to another and extending the district by one lot. Ayes all. SARA Grant Discussion Nancy Wagner, Records Department, thanked Council members for the opportunity to share with them what has been happening in the Records Department. She said that since 1991, the Records Department has received $161,017 in non-matching grants. She said that items such as microfilming, needs assessments, etc., have been completed through that funding. She explained that Saratoga Springs is located in Region 4 and during the 2000-2001 cycle, 78 entities were eligible to apply for grants, however, only ten did so. She said a total of 76 grants were awarded throughout the state. She said for the second year, the City had the opportunity to apply for two grants and were awarded both for a total of $22,131. She thanked both Commissioner Bernard Mirling and Deputy Commissioner Carol Kennedy for their support of her efforts in obtaining these grants. FINANCE OFFICE FINANCE OFFICE Payroll Commissioner Michael Lenz moved and Commissioner Bernard Mirling seconded to approve the following payrolls: July 7, 2000 - $313,866,.08 and July 14, 2000 - $306,162.58. Ayes all. Budget Amendments Commissioner Michael Lenz moved and Commissioner Bernard Mirling seconded to approve the budget amendments as presented (Attachment A). Ayes all. Budget Transfers Commissioner Michael Lenz moved and Mayor Kenneth Klotz to approve the budget transfers as presented (Attachment B). Ayes all. June 30, 2000, Financial Report Commissioner Michael Lenz distributed the June 30 financial report. He said that at this time of the year, expenditures should be at about 50 percent and we are at about 45 percent. Mayor Kenneth Klotz said this information was useful, but asked about revenues. Commissioner Michael Lenz said that revenue projections would be done on a quarterly basis. He said that a presentation on revenues would be done at the next meeting. Fireworks Commissioner Michael Lenz reported that contributions had been received from Roohan Realty, PJ's Bar-b-q, Saratoga National Bank & Trust Company, Sneering Provost Redgrave Title Agency and the Special Assessment District for the fireworks display on July 4. He thanked those companies for their contribution to this event. Bond Resolution - Washington Street Bond Resolution - Washington Street Commissioner Michael Lenz moved and Commissioner Bernard Mirling seconded to approve the bond resolution for Washington Street drainage ($366,343) as presented (Attachment C). Commissioner Michael Lenz said this bond resolution would be finance through the 2001 capital budget. Retirement Standard Work Day Resolution (00-161) Commissioner Michael Lenz moved and Commissioner Kenneth Klotz seconded to approve the following resolution: BE IT RESOLVED, that the City of Saratoga Springs be and hereby establishes the following as a standard workday for elected and appointed officials for the purpose of determining days worked reportable to the New York State and local Employees' Retirement System: Elected Officials: Mayor Kenneth Klotz five day work week, 6.6 hour day Appointed Officials: Deputy Commissioner William McTygue, five day work week, 8 hour day Deputy Commissioner Carol Kennedy five day work week, 8 hour day City Attorney, Jeffrey Wait five day work week, 6 hour day; Commissioner Thomas McTygue clarified that this resolution did not lock his deputy into eight hours days. Deputy Commissioner Christine Gillmett-Brown said this resolution was for retirement purposes only and would not affect the regular workday. Ayes all. DEPARTMENT OF PUBLIC WORKS Waive of Bid - Stained Glass Panels for Hathorn Spring Commissioner Thomas McTygue moved and Mayor Kenneth Klotz seconded to waive the bid for four stained glass windows in the amount of $1,600 to Stephen Henderer. Ayes all. Amendment to May 16, 2000 City Council Meeting Minutes - Authorization for Kubricky Construction to do work on Excelsior Avenue - Change to DKC General Engineering Contractor Commissioner Thomas McTygue moved and Mayor Kenneth Klotz seconded to amend the May 16, 2000, City Council meeting minutes to change the name of the contractor performing work on Excelsior Avenue from Kubricky Construction to DKC General Engineering Contracting. Ayes all. Parking Lot Discussion Commissioner Thomas McTygue said it was his intention to request the Engineering Department to draft an RFP on parking lots. He said he would like to revamp the Woodlawn Avenue parking lot from Division Street to Church Street. He said this parking area needs to be more pedestrian friendly. He said he hoped through these renovations, that the businesses that border this lot would open up their rear entrances. He said he also hoped that a few more parking spaces could be added. Commissioner Thomas McTygue reported that Roohan Realty had agreed to pay $3,300 for clean up work in the Woodlawn Avenue lot. He said he had spoken to members of the Special Assessment District, Downtown Business Association and shop owners concerning this upgrade. Downtown Business Association and shop owners concerning this upgrade. Commissioner Thomas McTygue said he was not requesting any funding at this time and he hoped he would not need to ask the Council for funds. He said any construction work would be done in the fall and redesign work would be done in the spring. He again said that he hoped that funding would come from other sources. Commissioner Thomas McTygue said he would also like to have the opportunity to discuss with Public Safety, DBA, SAD and others for a parking deck at the Hub parking lot. He said preliminary discussions need to be held to gather ideas. He said it would be a good idea for the City to be ready when funding sources become available. He said he had spoken to Assemblyman D'Andrea's office and he would support this parking deck. Commissioner Thomas McTygue said he would report back to the Council at a later date on how this progresses. Supervisor Phil Klein said it was a good idea to get "shovel ready" in connection with another parking deck. He said he would also be willing to discuss this proposal with Senator Bruno's office. Council members agreed it was a good idea to move ahead with this concept. Commissioner Michael Lenz said that pedestrian traffic has increased along this west side of Broadway since the Roohan building was constructed. He suggested that perhaps Woodlawn Alley should become more like Long Alley, i.e., paving. He said he too would encourage the business owners on this side of Broadway to spruce up their rear entrances. He also suggested that perhaps thought should be given to a new structure on the Woodlawn Alley parking lot, but as a requirement to any construction on that lot it should be made clear that the same amount of parking spaces must be provided. He said the possibilities are endless in that area. Commissioner Thomas McTygue said the Spring Street parking lots seem to be doing well, however, he had heard some complaints that two hour parking was simply not enough time. He suggested that the Council increase that time to three hours. Waive of Bids - Gazebo Park Commissioner Thomas McTygue moved and Commissioner Thomas Curley seconded to waive the bid in the amount of $1,092.47 for landscaping to Saratoga Landscaping at the intersection of Railroad Avenue and Division Street and to waive the bid to make payment to Franklin Associates in the amount of $1,012.23 for misc. bills for the Gazebo Park. Ayes all. DEPARTMENT OF PUBLIC SAFETY Authorization for Mayor to sign Agreement with Dr. Brooks to Provide Training for the Fire Department and its Emergency Medical Services Commissioner Thomas Curley moved and Commissioner Thomas McTygue seconded to authorize the Mayor to sign the agreement with Dr. Brooks to provide training for the Fire Department and its Emergency Medical Services. Ayes all. Addition to the Fire Department Waive of Bid List Commissioner Thomas Curley moved and Mayor Kenneth Klotz seconded to waive the bid to Rosen Uniform for uniforms for the Fire Department. Commissioner Bernard Mirling said the waive of bid list was created for emergency repairs for vehicles. He said he did not believe this particular addition to the list met that criteria. Commissioner Thomas Curley said currently the fire department uses a company from Onondaga County which was very inconvenient for measuring, purchasing, etc. He said they have used Rosen in the past and found their services to be acceptable and because of their proximity to the City they would like to use that company. He said he wanted a quality vendor which was local. Commissioner Bernard Mirling said it was his responsibility to ensure that the bidding procedures were followed and he felt this was an item that should go out to bid. He said it could be written into the specs followed and he felt this was an item that should go out to bid. He said it could be written into the specs that the vendor must come to the City for measurements, etc. Commissioner Thomas Curley said he was not trying to circumvent the bidding process, but Rosen had been used before and they have been very competitive with their bids. Commissioner Bernard Mirling suggested that this vendor be waived individually rather than added to the waive of bid list. He said this list was begun for emergency repairs to vehicles. He said this item did not fit that criteria. Commissioner Thomas Curley asked for written documentation on what the criteria was for this waive of bid list. Commissioner Bernard Mirling said there is no justification for adding this item to the waive of bid list. Commissioner Thomas Curley said they need a local vender with a good quality product. Commissioner Thomas McTygue asked if the fire fighters drive to Albany for fittings, do they go on City time, do we pay mileage and how many uniforms would likely be purchased. Commissioner Thomas Curley said they go on their own time and the City does not pay mileage and there would be approximately six uniforms purchased this year. Mayor Kenneth Klotz said he would support this motion, however, he suggested that more detailed conversations on this issue be held. Commissioner Thomas McTygue suggested that issues such as these be discussed with the Purchasing Department before being brought up at the Council table. Commissioner Thomas Curley said he had been working with the Purchasing Department and will continue to do so. Ayes all. Jefferson/Vanderbilt Terrace Community Police Summer Programs Officer Sicko said he had been in the community police program for one year now. He said this year they will begin many new programs for the youth in these areas. He said a youth basketball league sponsored by the Housing Authority will be instituted and will run from August 1-31. He said the coaches will be from the Terrace and they will play on Tuesday and Thursday evenings from 6:30 p.m. to 8:00 p.m. He said there will be two leagues for ages 6-10 and 11-14. He said this will be a positive program for the youth in this area and he hoped for a good turnout. Officer Sicko said a neighborhood watch program will also begin shortly. He said at this time there are four interested individuals and a training seminar will be held soon. Officer Sicko said there will be a bike registration program held this coming Saturday. He said at this time of the year, many bikes are lost/stolen. Office Sicko said there are also residents in this area interested in a "movie" night. He said there will be movie nights on Friday and Saturday evenings (Friday night for the youth and Saturday night for the senior citizens). He said this event will be sponsored by the Housing Authorize also. Officer Sicko said in September they hoped to begin a family softball league. Mayor Kenneth Klotz said these are good positive programs for the residents of this area. and he was glad to see the City being proactive. Commissioner Thomas Curley said these are good programs and these accomplishments are due in great part to the commitment of Officer Sicko. He said the City needs to be proactive and he thanked the Housing Authority for making some of these events possible. He said he appreciated the efforts of the involved parties in this partnership. Exhibit of Saratoga Springs Historical Fires and Fire Department Memorabilia - Museum in the Casino Commissioner Thomas Curley informed Council members that there is a fire exhibit display at the Casino which was quite impressive. He encouraged members of the Council and community to stop by and take a look. Enforcement Inspection Locations Enforcement Inspection Locations Commissioner Thomas Curley said he had been looking at the parcels on both Route 29 east and west. He said he had identified 36 parcels on the east side but of that 36 only 3 or 4 were appropriate for a vehicle inspection location. He said on the west side he had identified between 12 to 14 parcels, however, only 3 were appropriate. He said he had been discussing with property owners the possibility of the City acquiring one or more parcels. He said the community has called for this enforcement and because the community is calling for it, it will require a financial commitment by the City. He said that perhaps the Council should consider this under the capital budget. Mayor Kenneth Klotz said he was glad to hear that Commissioner Thomas Curley had been looking into this issue. He said he also hoped that it might be possible that the City could use a portion of the half a million-dollar grant from Senator Bruno's office to cover this expense. Commissioner Thomas Curley said he had been told that was not an option, however, he was willing to go back again and confirm those discussions. Commissioner Michael Lenz said he was glad to see that Commissioner Thomas Curley was being proactive in this area and it was good for him to get a plan together. He said it would be well advised for the City to identify a location and have a proposal ready when funds become available. Mayor Kenneth Klotz said it was his understanding that some of the half million dollars could be used for purchase of land. He said it was a simple reprogramming of funds. Commissioner Bernard Mirling said he hoped that the realtor that Commissioner Thomas Curley was using was not expecting a commission for this sale. Commissioner Thomas Curley said there are no agreements between himself and the realtor at this time. Request for Funding of Vehicles/Equipment for Truck Enforcement Commissioner Thomas Curley moved and Commissioner Michael Lenz seconded to approve funding to purchase to new vehicles fully equipped in the amount of $70,278 and the purchase of scales in the amount of $20,000 for a grand total of $90,278.82. He said this purchase will allow on a continuing basis four officers to operate under this truck enforcement program. Commissioner Thomas Curley said he had distributed a memo previously on this detailing these needs. Commissioner Michael Lenz said this request is not budgeted nor appropriated. He said perhaps some of the items could be considered under the capital budget, however, he thought the bulk would likely fall under the general budget. He said the Council has already agreed to fund some projects from the 2001 capital budget and the remainder of the West Avenue funds. He said he would like the opportunity to look at the budget before committing any more expenditures. He asked if the $25,000 had been received from Bob Israel for the purchase of the parcel of land. Mayor Kenneth Klotz said he would direct City Attorney Jeffrey Wait to look into that issue. Commissioner Michael Lenz said he was uncomfortable approving this motion without knowing from where the funds would come. Commissioner Thomas Curley said this is the direction he had been charged with. He said the Council recently approved funding two new officer positions and this equipment was needed for those officers. He said he needs a commitment from the Council on this purchase. He said this was not a large purchase in comparison with other purchases that the City makes. Commissioner Thomas McTygue asked if there were enough vehicles available already owned by the City. He said it appears that there are many police vehicles parked along side of City Hall at any given point during the day. Commissioner Thomas Curley said there are ten patrol cars and two traffic cars. He explained that the scales need to be carried to the enforcement site and that requires two vehicles. He pointed out that much of his fleet of cars has more than 100,000 miles on them. Mayor Kenneth Klotz asked for an inventory and use of police vehicles. He suggested that the Council wait until the next meeting before taking action on this motion. Commissioner Thomas Curley objected to that request. He said when Commissioner Thomas McTygue requests a new vehicle, he had not been asked for an inventory. He asked why he needed to justify this request. Mayor Kenneth Klotz said he simply wanted an inventory. Commissioner Thomas McTygue said it was his guess that Public Safety has more than 35 vehicles and Commissioner Thomas McTygue said it was his guess that Public Safety has more than 35 vehicles and $90,000 was a lot of money to commit to this evening. He said he understood the cost of the scale was necessary, but was concerned about purchasing more cars. He too said he would like to see an inventory. Commissioner Thomas Curley said perhaps he could consider leasing vehicles for the investigators. Mayor Kenneth Klotz said he wanted to support this motion, however, would like to see an inventory/use /mileage of the vehicles. Commissioner Thomas Curley said the public has spoken on this issue and he was simply trying to respond to the community's needs. He said there is a window of opportunity here to order these cars and he did not want to miss that opportunity. Mayor Kenneth Klotz said the Council could approve this request by memo if there was some urgency. Commissioner Thomas Curley agreed to provide Council members with a list of vehicles by the end of the week. Commissioner Michael Lenz said there seems to be some unanimity on the Council's part but we need to figure out a way to fund this need.
