Assistant Chief Cornick said an advisory board had been formed to review how to spend the local law enforcement block grant funds and their recommendations are as follows: training, equipment, CAPTAIN youth program expansion, alcohol abuse & substance council programs, Rape Crisis programs, programs in the school district and an automated fingerprinting system. He said the total funds available are $76,278 with $8,475 match from the Council which was approved in early 1999. He said they have two years to spend these funds. He said the City’s match would likely be required in 2001. Mayor Kenneth Klotz asked if the $8,475 had been included in the 2000 budget. Assistant Chief Cornick said no but it should be included in the 2001 budget. Mayor Kenneth Klotz asked if public hearings on these funds had been held. Assistant Chief Cornick said no, but they had a lot of input from these organizations. There being no one wishing to speak, Mayor Kenneth Klotz closed the public hearing. Assistant Chief Cornick said he would like to request that the Mayor be authorized to sign a grant Page 1 of 15 City of Saratoga Springs City Council Meeting Minutes Tuesday, September 19, 2000 application for the 2000 local law enforcement block grant. He said this grant amounts to $56,352 with a match from the City of $6,251. Local Law #4 Moratorium Extension Jeff Wait, City Attorney, said an extension of Local Law #3 on the moratorium for Loughberry Lake was needed in order to have more time to review and analyze new zoning regulations. He said they were asking for another 120 days. He said they recently received the report from Barton & Loguidice and hoped to draft the regulations and present them to the Council within the next 120 days. He said both the City and the County Planning Boards have reviewed this project. Mayor Kenneth Klotz opened the public hearing. There being no one wishing to speak, Mayor Kenneth Klotz closed the public hearing. MAYOR=S OFFICE Ed Valentine B Tribute & Condolences (00-191) Mayor Kenneth Klotz held a brief moment of silence in memory of Ed Valentine, former Commissioner of Accounts, who died on Sunday, September 17. He then read the following memoriam: Edward E. Valentine, former Commissioner of Accounts for the City of Saratoga Springs, died last Sunday, September 17, 2000. During his many years of service, Commissioner Valentine achieved many things on behalf of the community, but perhaps the best example of his style as a public official was found in his responsiveness to the individual citizens who came to him to voice their opinions and concerns. He spent countless hours of his time listening, discussing and pursuing solutions to their problems. He was a champion of the ordinary citizen. His particular interests ranged from youth recreation to veterans affairs to low-income housing. His 18-year tenure was one of the longest ever for a council member. On behalf of the people of Saratoga Springs, this Council respectfully honors the work of Commissioner Valentine and extends sympathy to his family. Crop Walk B Proclamation (00-192) Mayor Kenneth Klotz announced that the 21st annual crop walk would be held on October 15 at 1:00 p.m. He said this event is sponsored by Bread for the World and organized locally by Bob Dake. West Avenue Special Assessment District Page 2 of 15 City of Saratoga Springs City Council Meeting Minutes Tuesday, September 19, 2000 Mayor Kenneth Klotz announced the appointments of Mark Lawrence, Marc Paguin, Jack Minogue, Phil Klein, Richard Sweeney and Dr. Hale Card to the West Avenue Special Assessment District Board. Commissioner Thomas McTygue asked about the percentage the SAD will pay. Mayor Kenneth Klotz said Tony Izzo was working on that issue and the final figures will be available for the budget process. Economic Consultant B Report Mayor Kenneth Klotz said he had been working with the firm of Ernst & Young on the possibility of securing their services to review the sales tax issue. He said when he had more information he would report back to the Council. City Center Feasibility Study (00-193) Mark Baker, City Center Authority Director, said they received ten responses to the RFP that was distributed. He said the list of ten was narrowed to three and those three were interviewed. He said the City Center Authority Board is now recommending to the Council that based on history, availability, quality of work and time frame the firm of Pinnacle Advisory Group be hired for the feasibility study at a cost not to exceed $55,000. He said that $30,000 had been set aside for this study from proceeds of the sale of the City Center. He said the remaining $25,000 will come from their capital account. Mayor Kenneth Klotz moved and Commissioner Bernard Mirling seconded that the firm of Pinnacle Advisory Group be contracted with to do the feasibility study for the City Center at a cost not to exceed $55,000. Ayes all. Capital District Transportation Committee (CDTC) Funding Mayor Kenneth Klotz said the Capital District Transportation Committee notified the City that communities in this region may submit an application for federal funding for transportation projects. He said applications are due November 15, 2000 and a 20 percent local match will be required. He said small projects under $100,000 would not be considered. Mayor Kenneth Klotz said the City has submitted applications in the past for this program and has received funding for South Broadway, West Avenue, new traffic signals and downtown pedestrian improvements. He said if any Council member had any suggested projects, he would be glad to have his staff assist with the preparation of an application. Page 3 of 15 City of Saratoga Springs City Council Meeting Minutes Tuesday, September 19, 2000 Commissioner Thomas Curley asked what is eligible for this funding. Geoff Bornemann said this is federal/state funding which is available to this region. He said the City applied for funding recently for the Washington Street infrastructure, but was not successful; however, the City could apply for again. Commissioner Thomas McTygue asked if the City could apply for funding for streets such as Weibel Avenue. Geoff Bornemann said yes, however, all projects compete with other projects within their region. Commissioner Thomas McTygue said Weibel Avenue would be a good project (lighting, rebuilding highway, sidewalks, etc.). Comprehensive Plan Review -- Report Mayor Kenneth Klotz reported that the Comprehensive Plan Review committee held a public hearing last week for the proposed amendments to the 1999 plan. He said there were a number of comments made at that meeting and because of those comments he would not propose a public hearing date be set at this time. He said that committee will continue to evaluate those comments and then forward their recommendations onto the Council. Commissioner Thomas McTygue asked that the comments presented to the Comprehensive Plan Committee be forwarded to Council members. Mayor Kenneth Klotz said those comments would be circulated. National Prostate Cancer Awareness Month -- Proclamation (00-194) Mayor Kenneth Klotz reported that September is National Prostate Awareness month. He said meetings for this organization are held the second Tuesday of each month from 7:00 p.m. to 9:00 p.m. at Saratoga Hospital. United Court System Contract (00-195) Mayor Kenneth Klotz moved and Commissioner Bernard Mirling seconded to approve the contract with the Unified Court System from April 1, 2000 to March 31, 2001, in an amount not to exceed $65,000. Commissioner Thomas Curley asked if this was for providing personnel to the court. Mayor Kenneth Klotz said yes. Ayes all. Joint Boards -- Quarterly Meeting Mayor Kenneth Klotz announced that the joint quarterly meeting of the Zoning Board of Appeals, Planning Board and Design Review Commission and the Comprehensive Review Committee will be held on Monday, September 25 at 7:00 p.m. Legal Services Bill B Eckhardt vs. City Page 4 of 15 City of Saratoga Springs City Council Meeting Minutes Tuesday, September 19, 2000 Jeff Wait said the majority of the legal expenses incurred in this case had been covered by insurance, however, there were still some small outstanding bills. Commissioner Thomas McTygue moved and Commissioner Thomas Curley seconded to approve payment in an amount not to exceed $1,000 for legal expenses related to the Eckhardt case. Ayes all. Executive Session B Certiorari Case Mayor Kenneth Klotz requested an executive session to discuss a certiorari case. Council members agreed. Safety on Saratoga Lake B Discussion Mayor Kenneth Klotz said we are all aware of the accident on Saratoga Lake involving a motor boat and rowing team. He said he talked to Sheriff Bowen about his investigation into the matter and Sheriff Bowen is awaiting a report from the state park police. He said Sheriff Bowen was reluctant to come to any conclusions until the report is issued. Mayor Kenneth Klotz said there is a widespread perception that Saratoga Lake is saturated with vehicles on the lake. He said Sheriff Bowen said that enforcement on lake is a joint effort between the state, conservation warden, county sheriff and park police. He said the City has no jurisdiction although it does have a direct interest. David Bronner, lives adjacent to Fish Creek, said he witnessed this accident. He said it is necessary for people to understand the need for safety on the lake, however, he said he wanted to make it clear that this accident had nothing to do with congestion on the lake. He said it had nothing to do with speed limits, the fact that the buoys had been removed or with sun glare. He said this accident was caused by an irresponsible and negligent action by a sheriff’s deputy. He said the deputy was accelerating, with his engine at full power. He said he heard the girls scream and then the motor boat simply ran over the row boat. He said he helped rescue all of the girls and all the girls were placed inside the sheriff’s boat. David Bronner said Saratoga Lake is a pretty safe because of the safeguards that are followed. Mayor Kenneth Klotz asked if David Bonner told his story to investigators. David Bronner said he had not been contacted and in fact he had called investigators to ask when he might be interviewed. He said we should be concerned about safety on the lake but as a result of this incident, individuals should not jump to any conclusions that there is a safety problem on the lake. Commissioner Thomas Curley asked Mayor Kenneth Klotz if there was anything the City could do in connection with safety on the lake. Mayor Kenneth Klotz said he thought the Council should express our concerns formally and in public about safety on the lake. He said the Council should be Page 5 of 15 City of Saratoga Springs City Council Meeting Minutes Tuesday, September 19, 2000 concerned and should also continue to inquire to see if there is any way the City can or should become involved in safety on the lake. Leadership Saratoga B Cindy Phillips Mayor Kenneth Klotz said Cindy Phillips had been selected to participate Leadership Saratoga Program. Community Development 1999 Consolidated Annual Performance and Evaluation Report Brad Birge, Community Development Coordinator said their program years ends on July 30 and this is a report for 1999. He said this report is available for review at the public library, in his office or on the City’s WEB site until September 28. Local Law #4 -- Loughberry Lake Moratorium (00-196) Mayor Kenneth Klotz moved and Commissioner Bernard Mirling seconded to approval Local Law #4 Loughberry Lake Moratorium as presented (Attachment A). Ayes all. Building Department -- Position Upgrade (00-197) Mayor Kenneth Klotz moved and Commissioner Bernard Mirling seconded to upgrade the Building Information Processing Specialist position from Grade 6 to Grade 8, Step 1 with an effective date of September 25. Ayes all. National League of Cities Undoing Racism Day Mayor Kenneth Klotz reported that tomorrow is National Undoing Racism Day and events will be held throughout the country on this project. He said he would draft a proclamation on this matter. Chamber WEB Site Job Listing Mayor Kenneth Klotz reported that the Chamber has added a page to the WEB site for job listing announcements for members of the Chamber. He said because the City is a member of the Chamber, any department may take advantage of this and list any job openings. Historic Preservation Grant (00-204) Mayor Kenneth Klotz said he had just learned that the New York State Office of Parks Recreation and Historic Preservation awarded the City a $15,000 grant to develop a Comprehensive Historic Preservation Plan. He said the objective is to identify a strategic work program for future historic Page 6 of 15 City of Saratoga Springs City Council Meeting Minutes Tuesday, September 19, 2000 preservation activities within the City. He said they will also focus on ways to strengthen the relationship between tourism and historic preservation. Mayor Kenneth Klotz said last November the City Council authorized the Design Review Commission to apply for the funding. He said the total project cost is $25,000 with $10,000 in local matches being provided by in-kind services from the Saratoga Springs Preservation Foundation, The Saratoga Associates, the Convention and Visitor’s Bureau, the Open Space Project and the City Planning Office. Mayor Kenneth Klotz moved and Commissioner Bernard Mirling seconded that the Mayor be authorized to sign all the contract documents associated with this grant. Ayes all. ACCOUNTS DEPARTMENT Approval of September 5, 2000, meeting minutes Commissioner Bernard Mirling moved and Mayor Kenneth Klotz seconded to approve the September 5 City Council meeting minutes. Ayes all. Award of Bid -- Fence Upon the recommendation of the Department of Public Works, Commissioner Bernard Mirling moved and Commissioner Thomas McTygue seconded to award the bid for fence at the Water Treatment Plan to AFSCO Fence Company for $3,346 (low bidder). Ayes all. Waive of Bid B City Center B Floor Upon the recommendation of the City Center Authority, Commissioner Bernard Mirling moved and Mayor Kenneth Klotz seconded to waive the bid for engineering services for Wedge Room floor assessment to Jarrett-Martin of Glens Falls for an estimated cost of $4,300 plus expenses. Ayes all. Waive of Bid B City Center B Portable Wall Maintenance & Repair Upon the recommendation of the City Center Authority, Commissioner Bernard Mirling moved and Commissioner Thomas McTygue seconded to waive the bid for ongoing maintenance and repair of the City Center’s portables wall system to B.R. Johnson, Inc. of East Syracuse per their quote. (sole source contractor). Ayes all. Page 7 of 15 City of Saratoga Springs City Council Meeting Minutes Tuesday, September 19, 2000 Approval for Mayor to sign contract with School District (00-198) Commissioner Bernard Mirling moved and Commissioner Thomas McTygue seconded to authorize the Mayor to sign the contract with the City School District to allow the district to use a voting machine for a mock election. Ayes all. Waive of Bid B Election Lift Gate Commissioner Bernard Mirling moved and Commissioner Thomas McTygue seconded to waive the bid for a lift gate to be installed on a DPW truck to be used for the transportation and delivery of the voting machines to T&T Sales in the amount of $2,476. Ayes all. DEPARTMENT OF PUBLIC WORKS Waive of Bid B Drink Hall Roof Commissioner Thomas McTygue moved and Mayor Kenneth Klotz seconded to waive the bid for repairs to the Drink Hall roof in the amount of $2,650 (previously approved by memo). Ayes all. Carousel -- Discussion Commissioner Thomas McTygue showed the Council preliminary plans for the carousel for Congress Park. Mayor Kenneth Klotz asked what was the specific location of the carousel. Commissioner Thomas McTygue said near the Spring Street entrance. Young, Summer, Ward Contract Legal Work (00-199) Commissioner Thomas McTygue moved and Mayor Kenneth Klotz seconded to authorize the Mayor to sign the contract with Young, Summer & Ward, upon the City Attorney’s review, for legal services in connection with the long range water source. He said the fees would be $150, $120 & $80 per hour. Jeffrey Wait said there are a number of items the firm will work on, i.e., EIS compliance, securing water supply permit, establish watershed rules and regulations, secure funding. Dean Summer & Jeff Baker, Young, Summer & Ward, said they have provided the City with documentation on their background and experience. He said this is a law firm that specializes in environmental law firm. Mayor Kenneth Klotz asked what might the time frame be for this project. Dean Summer said that would depend on the public’s responses. He said if it if goes smoothly about a year but if there is, it would depend on the steps taken by the Council. Page 8 of 15 City of Saratoga Springs City Council Meeting Minutes Tuesday, September 19, 2000 Council members agreed that a few minutes during the executive session would be devoted to discussing this topic with Dean Summer. Ayes all. 20 Walworth Street B Dennis Brunelle Commissioner Thomas McTygue said this is a project that the City has been working on with EOC for a while now. He said this project was awarded block grant money in September 1998 to renovate 20 Walworth Street. Dennis Brunelle said unfortunately there have been delays because of the contractors and they are now in a crisis situation. He said they have a family who will become homeless in the very near future, however, if the renovation work can be completed on this home, that family could move in. Dennis Brunelle said he had discussed this issue with Commissioner Thomas McTygue and they would like to get Council approval to allow DPW to do the renovation work on this building. He said it would not cost the City anything because EOC would reimburse the City for the work. He said the estimated amount is $20,000. Commissioner Thomas McTygue said it should not take more than four weeks to complete this job. Commissioner Thomas McTygue moved and Mayor Kenneth Klotz seconded to authorize the Department of Public Works to do the renovation work at 20 Walworth Street. It was further noted that the full amount of approximately $20,000 would be reimbursed to the City by EOC. Commissioner Bernard Mirling said although he had no problem with the motion, he would like to see a written contract. Dennis Brunelle said one would be drawn up. Ayes all. Woodlawn Avenue Parking Lot (00-200) Commissioner Thomas McTygue moved and Commissioner Bernard Mirling seconded to enter into an agreement in the amount of $13,500 with The Saratoga Associates for the design work for the Woodlawn Avenue parking lot and that the money come from the contingency fund. Commissioner Thomas McTygue said six RFPs were distributed and the City received two responses (The Saratoga Associates and The LA Group). He said there would be a charette with downtown businesses and interested parties. He said they felt that the parking lot could be increased by about 30 spaces, more lighting could be added and it could be made more pedestrian friendly. He said through this redesign, he hoped that business owners would be encouraged to open up the rear of their businesses. Page 9 of 15 City of Saratoga Springs City Council Meeting Minutes Tuesday, September 19, 2000 Commissioner Thomas McTygue reminded Council members that they are also looking at the Hub parking lot and those possibilities. (Commissioner Michael Lenz arrived). Commissioner Thomas McTygue said he would come to the Council for funding next year for the capital improvements to this parking lot. Commissioner Michael Lenz said he was not sure if there were enough funds in the contingency fund to cover this cost. He said this was a good idea though. Ayes all. FINANCE OFFICE Payroll Commissioner Michael Lenz moved and Commissioner Bernard Mirling seconded to approve the following payrolls: September 8 B$317,054.50 and September 15 -- $309,653.20. Ayes all. Budget Amendments Commissioner Michael Lenz moved and Commissioner Thomas McTygue seconded to approve the budget amendments as presented (Attachment B). Ayes all. Budget Transfers Commissioner Michael Lenz moved and Mayor Kenneth Klotz seconded to approve the budget transfers as presented (Attachment C). Ayes all. August 31, 2000, Financial Commissioner Michael Lenz distributed the August 31 financial report. He said expenditures should be at about 67 percent and we are at 62 percent. Budget B Discussion Commissioner Michael Lenz said the 2001 budget worksheets were distributed on September 8 and were due back to his office no later than October 1. He said on October 6, he would distribute revenue estimates and expenditure requests as made by the departments. He said at the October 17 meeting he would schedule budget work shops and set public hearings. He reminded Council members that the budget needs to be adopted by November 30. Surplus -- Discussion (00-201) Commissioner Michael Lenz said the City’s independent auditors and the state comptroller examiners recently questioned the existence of a resolution from the 1980s that restricts how Page 11 of 15 City of Saratoga Springs City Council Meeting Minutes Tuesday, September 19, 2000 the City Council can spend the $1,000,000 received after the sale of the City Center. He said his office has done some research and found that the City Council of 1983 created a capital reserve in a resolution entitled, (1) The Creation of a New Real Property Acquisition Capital Reserve Fund and (2) the Transfer of the Unexpended Balance of the City Center Reserve Fund to the Credit of the Real Property Acquisition Capital Reserve Fund dated July 6, 1983. He said that resolution states the funds must be used to “acquire real property in order to provide additional municipal facilities, including, but not limited to parks, playgrounds municipal office facilities, police and fire stations, public works facilities, convention and trade show facilities, parking structures and rights of way for street and road extensions.” Commissioner Michael Lenz said the state comptroller’s office and our independent auditors have requested that the $1,000,000 be classified as a reserved fund balance rather than an unappropriated fund balance due to the existence of the 1983 resolution. He said his recommendation as Finance Commissioner is not to reserve the $750,000 from Niagara Mohawk in light of the fact that the $1,000,000 from the City Center has to be reserved and to create a new Capital Reserve that the $1,000,000 can be transferred into. Therefore, any expenditure pertaining to the budget proposal approved by the City Council on August 8, 2000 should come from the unappropriated fund balance and not the $1,000,000. Commissioner Michael Lenz said he would like the assistance of the City Attorney to review the 1983 resolution as well as General Municipal Finance Law along with Deputy Finance Commissioner Christine Gillmett-Brown to determine what our options are and report back to the City Council on October 3. DEPARTMENT OF PUBLIC SAFETY Set Public Hearing B Amend Duties of Code Enforcement Officer Commissioner Thomas Curley requested that a public hearing be set for October 3, 6:55 p.m. for discussion on amendments to the code enforcement officer duties. Council members agreed. Set Public Hearing B Amend Unsafe Structure Ordinance Commissioner Thomas Curley requested that a public hearing be set for October 3, 6:45 p.m. for the Unsafe Structure ordinance. Child Car Seat Safety Check Commissioner Thomas Curley reported that a child car seat safety check will be held on October Page 12 of 15 City of Saratoga Springs City Council Meeting Minutes Tuesday, September 19, 2000 5 from 3:00 p.m. to 7:00 p.m. at Allstar Motors. Waive of Bid B Smith & Wesson B Pistol Parts Commissioner Thomas Curley moved and Commissioner Michael Lenz seconded to waive the bid to Smith & Wesson in the amount of $8,000 for replacement parts for pistols. He said there is no state contract for these items. He said the funds would come from the local law enforcement block grant. Ayes all. Police & Fire Activities Commissioner Thomas Curley said he would like to commend the police department on their recent drug arrest. He said much of the thanks was due to Lt. Moore. Commissioner Thomas Curley also commended the fire department for containing the fire on Broadway. He said the fire was contained within 20 minutes and the building was secure. Local Law Enforcement Block Grant B Authorization for Mayor to sign (00-202) Commissioner Thomas Curley moved and Mayor Kenneth Klotz seconded to authorize the Mayor to sign the Local Law Enforcement Block Grant for 2000. Ayes all. (Supervisor Phil Klein arrived 8:15 p.m.) Commissioner Thomas Curley reported that during recent road blocks tickets were written on uninsured vehicles, seat belt noncompliance, unlicensed motorists, minor drug arrests, various moving violations, uninspected vehicles, etc. He said these road blocks have been very successful. He said road blocks such as these are funded through these grants. Tax Relief -- Discussion Commissioner Thomas Curley suggested that, until a truck route/bypass solution is approved, the Council consider allowing tax relief for residential parcels along the truck routes. He said the City already gives tax relief to veterans. He said this would simply be another component to the overall plan. Commissioner Bernard Mirling said that was an idea to be considered, however, questioned exactly what residential parcels would qualify. He said perhaps when a truck route is designated this could be considered. Commissioner Thomas Curley said it is obvious that certain streets, Adelphi, Finley, Church, VanDam, etc. would be part of the designated area. Commissioner Michael Lenz agreed that Page 13 of 15 City of Saratoga Springs City Council Meeting Minutes Tuesday, September 19, 2000 the criteria needed to be established before the Council gives this serious consideration. He said this was a good starting point though. Commissioner Bernard Mirling suggested that perhaps the zoning be reviewed in these areas. Commissioner Thomas Curley said this would take some time to put together, however, he wanted the Council to start thinking about it. Other B Edward Valentine Commissioner Michael Lenz said he would be remiss if he did not say something about Ed Valentine. He said he had spent more than two hours in line at the funeral home to offer his condolences. He said he got to know Ed quite well over the last few years and found that he was a quality individual. He said there was a great line in the movie It’s a Wonderful Life that say that no man is a failure who has friends. He said Ed was a true success and the City is better because of him. He said he would truly miss Ed. Woodlawn Park Reservoir Commissioner Thomas McTygue showed pictures to Council members of the recent dive into the reservoir tanks in Woodlawn Park. He said these 5,000,000 million gallon tanks were constructed in 1935 and appear to still be in sound condition. He said the diver did a complete interior investigation and found only one minor crack which can be repaired. He said he was quite pleased that the tanks were in such good shape. He said they are now in the process of removing some of the trees and growth in this area and will secure the caps to the tanks. He said they are exploring the possibility of security lighting, fencing and perhaps video equipment.
