Towne, Accounts ABSENT: Phil Klein, Supervisor Anthony Scirocco, Supervisor STAFF PRESENT: Lynn Bachner, Deputy Commissioner, Finance Patrick Design, Deputy Commissioner, DPW Matthew Dorsey, City Attorney Alicia Farone, Deputy Mayor Debbie Harper, Deputy Commissioner, Accounts CALL TO ORDER Mayor Michael Lenz moved and Commissioner Matthew McCabe seconded to adjourn to executive session at 5:15 p.m. to discuss the CSEA contract and land acquisition. Ayes all. Council members returned at 6:10 p.m. and reported that no action was taken. BUDGET WORKSHOP Commissioner Matthew McCabe said his department was very close to putting together the preliminary budget. The Finance Department had added $13,050 for tax bills and for additional land purchases; DPW had nothing new, DPS added $16,000 for hardware and equipment; Accounts had asked for an additional $25,000 for the grant writer and had reduced some expenditures, they may also ask for funding for the real property technician and there was nothing new from Recreation. He asked that departments review their budget and bring further adjustments to him. Public Comment Period - Budget Mayor Michael Lenz opened the public comment period on the budget. John Kraus 227 Grand Avenue, Saratoga Citizens for Affordable Taxes, said that even with a $4.68 proposed tax rate the budget process is not over. He said the City needs to estimate the 2005 expenditures, revenues and surplus. He then hypothesized on 2004 tax rates and what they could have been and what the surplus could have been and then further hypotehesized on what the future surplus and tax rate might be using those same numbers. He again said the 2005 surplus needs to be identified. He asked where all of the savings had gone ($400,000 from the 2004 surplus, $794,000 from the County, $100,000 insurance savings, $456,000 additional sales tax money, $117,00 Safety Net Program and $40,000 health benefit cost savings). There needs to be a reconciliation of the 2005 estimates to the 2006 Comprehensive Budget. The citizens were overtaxed in 2005 at $5.09 and now the Council is trying to claim victory at $4.68. Mark Lawton said the Mayor’s Office has been charged with, through the charter, maximizing the open space bonding funds. Maximizing income and matching capabilities should be the first priority. There is a new Department of State program for open space and economic development with funding capacity at $5 million. Applications for that funding are due by December 1. The City needs to be more aggressive in finding grant funds. There being no one else wishing to speak on the budget, Mayor Michael Lenz closed the public comment period. Page 1 of 10 Mayor Michael Lenz said he had no changes for the Mayor’s Office portion of the budget. Bill McTygue said the outdoor recreation program has continued to grow over the years, however, staff has not increased. He said they have routinely requested to add additional field maintenance staff, however, the request has not been filled. This year with the addition of the interactive play fountains, staff is stretched thin. There are five full time and one part time crew members and he was here tonight to seek funding for one additional crew member. They currently maintain soccer fields at several locations, baseball diamonds, foot ball fields and other playing fields. There is also general maintenance of marking, mowing, etc. that needs to be done. With the addition of the play fountains, one of the crew members has been dedicated to maintaining the four fountains. The message this evening is that they need an additional crew member or they may have to reduce field maintenance. Commissioner Thomas McTygue said that the playing fields need maintenance seven days a week and it has become a burden on the department. Commissioner Stephen Towne asked what was the estimated cost for the additional person. Bill McTygue said he believed it had already been requested in the Recreation Department budget. Bill McTygue said that the play fountains need daily attention. The fountains are open seven days a week from Memorial Day to Labor day. Commissioner Thomas McTygue also pointed out that with vacation and sick time, there often is not a full staff. Commissioner Stephen Towne asked if this could be a seasonal position. Bill McTygue said that this individual would be used during the winter months for snow removal and at the ice rinks. He said they were not advocating for a part time position. He said he would develop an estimate of the cost for this position. Commissioner Thomas Curley said he had no changes to the budget at this time. Commissioner Stephen Towne said his department is developing estimates of savings for 2005 and it was necessary to have those numbers from all departments. He said that there also needs to be an analysis of the surplus, contingency, encumbrances and an analysis of the sales tax. That information would put the Council in a better position to develop a budget. He was also still reviewing the funding for the real property technician position and he would talk to Commissioner Matthew McCabe about that position. Commissioner Matthew McCabe said there are many items that are still “moving targets” and at this time it was still too difficult to estimate the savings in some of those areas. He said that sales tax is down slightly, mortgage tax and state aid are stable. They are still waiting for further information on the OTB revenue. He said he would take the time he needed to develop good numbers in those areas. The next public hearing is scheduled for November 10 and would be continued to November15 and as many other meetings as are necessary. Public Comment Period - Budget Mayor Michael Lenz opened the second public comment period on the budget. John Kraus said the Council overtaxed the residents this past year and they are now trying to claim victory with the $4.68 rate. There was a 21 percent increase in the 2005 tax levy. The taxpayers gave the City $13.1 million to provide the required services and now they want to know where it went, how it was spent and where is the excess. The budget process needs to be more open and informative. If the Council cannot handle this responsibility then they should turn it over to those who will. There being no one else wishing to speak, Mayor Michael Lenz closed the public comment period. PUBLIC HEARING Alternative Veteran’s Exemption Tony Popolizio, Assistant Assessor, said in July 2005 the governor signed legislation which amended the state law and allows an increase to the income limits for veterans. The City is now proposing local law #5 of 2005 to increase the City’s income limits for veterans to the new levels. The program does not require any effort on the part of veterans already enrolled. It will go into effect on the 2006 assessment roll, therefore, the impact would be to the 2007 tax roll. Commissioner Stephen Towne said that Local Law #5 of 2005, entitled “Taxation - Alternative Veterans Exemption” was distributed with the agenda. The local law provides for the maximum exemptions allowable by the state from the City’s real property taxation. The rates will go from $27,000 to $36,000; $18,000 to $24,000 and $90,000 to $120,000. Page 2 of 10 City of Saratoga Springs City Council Meeting Minutes Tuesday, November 1, 2005 Mayor Michael Lenz opened the public hearing. Jim Coyne, 10 Knight Way, said that the veterans support this local law. He also said that they are working with the City on fundraising efforts for the War Memorial. He thanked Phil Klein and Anthony Scirocco for their support at the County. He urged the Council to support this resolution. Dave Bronner, 5 Royal Henley Court, said he is a combat veteran and he urged the Council to adopt the resolution. Phil Diamond, 29 Waterview Drive, urged the Council to adopt the resolution. Mayor Michael Lenz closed the public hearing. RECONVENE MEETING Mayor Michael Lenz reconvened the meeting at 7:05 p.m. Public Comment Period Barbara Trypaluk, 211 Circular Street, urged the Council to support the public access negotiator. The City needs to fund this at $150,000. Dave Bronner, 5 Royal Henley Court, said the school board recently refused to fund the public access negotiator at $75,000. He said that funding for this project should be done in context of the entire budgeting process. On the water matter he said that The Saratogian recently stated that they were concerned with the waffling on the long term versus supplemental water source. He said at the last Council meeting it was stated that the City is now looking for a 100 year solution. He said this needs to be clarified. Bill Ennis, 9 Brookwood Drive, said that with the recent indictment of Commissioner Stephen Towne by the Ethics Board the Council should insist that he resign or the Council should dismiss him or eliminate the position. Cheryl Keyrouse, Wampum Drive, said there was concern expressed by a resident that the County did not apply for funding for the child care subsidy program. That program allowed for a family of four making less than $53,000 could receive assistance from that subsidy. She was concerned as to why the County did not accept this funding. Mary Beth Delarm, 96 Quevic Drive, submitted a petition signed by 683 people expressing their concern with the subdivision known as Beaver Pond Village. They were not in support of this subdivision. She said it will impact the wetlands, natural species, buffers, flooding, noise, ponds, traffic, water system, sewer system, schools will see an increase in student population, archaeological nature of the area will change, it will require more public safety services, will damage the eco system, it will destroy the character of the area, etc. She suggested that the Council consider this land under the open space bond act. The City does not need any further sprawl. The Council needs to be a leader on this matter and prevent the destruction of this natural area. Kyle York, 59 Railroad Place, said there are motorcycles all summer throughout the City, but then they disappear after the summer months. He said there needs to be some thought given to the noise from motorcycles. He said the noise level is high when they are around. Jim Coyne, 10 Knight Way, said the American Legion Post is located within the West Avenue SAD. The taxes from that SAD is a burden on the Legion. He said that it amounts to $40,000 over the life of the SAD and it was unreasonable for the City to think that they should pay this tax. Bill McTygue said they are talking about a supplemental water source. Saratoga Lake is a long term water supply source. The DOH has recommended that the City continue to proceed to use Loughberry Lake as long as we can and then go with Saratoga Lake. Page 3 of 10 City of Saratoga Springs City Council Meeting Minutes Tuesday, November 1, 2005 Phil Diamond, 29 Waterview Drive, said that public access television is needed in this City. It will serve everyone. He urged the Council to fund this project. He also said the City should move quickly in obtaining the permits from the state for Saratoga Lake. Commissioner Stephen Towne said that in response to Bill Ennis’ comment, the City’s Ethics Board forwarded the matter to the Attorney General’s office. He said the comment was a political comment made to mislead the public. Commissioner Thomas McTygue said he has not waffled on the water issue. He said that he has outlasted three publishers at the Saratogian since the water issue began. The publisher nor the editor has attended any Council meetings. Everyone knows his position and he has not waffled. Mayor Michael Lenz closed the public comment period. DEPARTMENT OF PUBLIC SAFETY American Legion/Special Assessment District Commissioner Thomas Curley said that last week he was contacted by the American Legion concerning the special assessment district matter. He said it is his intention to bring forth a motion to seek relief for that organization. They need this relief from this tax. Commissioner Thomas Curley moved and Mayor Michael Lenz seconded that the American Legion is exempt from the West Avenue Special Assessment District tax. Tony Izzo said that this ordinance was created by a local law, therefore, if the Council wishes to change the formula, an amendment to the local law is necessary. There needs to be a public hearing before an amendment can be made. There also needs to be some clarification and verification on the numbers. A public hearing was set for November 15 at 6:35 p.m. Jim Coyne clarified that the dollar amounts were $2,600 a year for a total of $40,000 ACCOUNTS DEPARTMENT Local Law #5 - 2005 - Taxation Alternative Veteran’s Exemption (05-225) Commissioner Stephen Towne said this local law will enhance the existing exemption for veterans. It will impact the 2006 assessment roll and the 2007 tax roll. Those who are currently on file with exemptions will automatically receive the enhanced level. Commissioner Stephen Towne moved and Commissioner Thomas McTygue seconded the following resolution: LOCAL LAW NO. 5 OF 2005 A LOCAL LAW TO AMEND ARTICLE X OF THE CODE OF THE CITY OF SARATOGA SPRINGS, NEW YORK, ENTITLED ATAXATION B ALTERNATIVE VETERANS EXEMPTION.@ BE IT ENACTED by the City Council of the City of Saratoga Springs, New York as follows: SECTION 1. Article X of Chapter 212 of the Code of the City of Saratoga Springs is hereby amended to read as follows: AARTICLE X Alternative Veterans Exemption Page 4 of 10 City of Saratoga Springs City Council Meeting Minutes Tuesday, November 1, 2005 212-72 Maximum exemptions allowable As authorized by Section 458-a, Subdivision 2, Paragraph (d)(ii) of the Real Property Tax Law, the maximum exemptions allowable from this city’s real property taxation pursuant to Paragraphs (a), (b) and 8 of Subdivision 2, of Section 458-a shall be [$27,000, $18,000 and $90,000] $36,000, $24,000 and $120,000 respectively. This article shall take effect immediately. It shall be filed in the office of the Secretary of the State of New York. SECTION 2. This Local Law shall take effect immediately upon filing in the office of the Secretary of State of the State of New York in accordance with Municipal Home Rule Law Section 27. Therefore, I move to adopt Local Law #5 of 2005, entitled “Taxation - Alternative Veterans Exemption” as presented. Ayes all. SUPERVISORS Open Space Plan Phil Klein said that John Behan, Behan Associates, was here this evening to make a presentation to the City on the County’s open space initiative. John Behan said the County has begun to recognize the opportunities to address open space issues. He said there needs to be some “green” infrastructure with connected trails, open spaces, natural resources, all to preserve the sense of open space. He said this is an economic development initiative. If there is a particular trail that the City would like to promote or if the City has a site in mind that they believe could fit into this plan, they should contact the county. He said their next meeting will be in Schuylerville. He then displayed photos through a power point presentation on how the county has been developed over the years. He noted that the county is not highly developed. He said that by addressing this issue now our children will benefit from this foresight. He said there needs to be some work on identify key intermunicipal resources, prioritizing resources, implementing strategies and developing a design guidebook. This is a plan for the future that will create parks and nature preserves, recreation trails, will enhance the protection for farm land and will assist in water quality. He said there will be a series of public meetings and in the spring a draft document will be available. MAYOR=S OFFICE Shelters of Saratoga Peter Whitten, Shelters of Saratoga, said he was here this evening concerning the dedication of 128 Grand Avenue. This home provides for low income senior housing. He said this was done through the initiatives of Gene Corsale. He thanked the Community Development Office and DPW for their contributions to the project. Bellevue Hospital Mobile Mammography Event Mayor Michael Lenz said that Bellevue Hospital Mobile Mammography will be located in the parking lot behind City Hall on Friday, November 11 from 10:00 to 2:00 p.m. He urged women to sign up for this service. Bake Sale Mayor Michael Lenz announced that there would be a bake sale at City Hall on November 8 to benefit Give a Child a Christmas. Award of Bid - Decorative Street Lights Upon the recommendation of the Department of Public Works, Commissioner Stephen Towne moved and Commissioner Thomas McTygue seconded to award the bid for decorative street lights to Thorpe Electric of Rensselaer as follows: Item #1A $1196.85; Item #1B $1196.85; Item #1C $176.75; Item #2A $1247.35; Item #2B $166.65; Item #3A $2979.50; Item #3B $1326.13; Item #4A $2003.84 and Item #4B $126.25. This bid has been reviewed by the Purchasing Department and meets purchasing guidelines. Ayes all. Award of Bid - Water Treatment Plant Upon the recommendation of the Department of Public Works, Commissioner Stephen Towne moved and Commissioner Thomas McTygue seconded to award the bid for the water treatment plant as follows: Contract #1A: General Construction - Blue Heron Construction LLC in the amount of $1,056,499. He further moved to waive the informality of specification section 00100, Information for Bidders paragraph 00100.07 of the specification which states, “Do not remove the bid forms from this binder”. Paragraph 0100.06 of the same specification section allows the Owner to waive any informalities in the bid. Contract #1B - Mechanical Construction: to Lenz Hardware, Inc., in the amount of $9,900. Contract #1C - Plumbing Construction: to R.F. Gordon, Mechanical, Inc., in the amount of $74,450. Contract #1D - Electrical Construction: to Stilsing Electric in the amount of $83,720. This bid has been reviewed by the Purchasing Department and meets purchasing guidelines. He further moved to authorize the Mayor to sign all necessary contract documents contingent upon the review of the City Attorney and the Risk & Safety Manager. Ayes all. Authorization for Mayor to sign contract with General Codes Software Commissioner Stephen Towne said that in recent years, the requests for City Council meeting minutes searches have increased significantly. Often it may take more than an hour to complete a search on one topic. To meet the requests in a more timely fashion, my department has researched the technological advances in text searchable software. To that end, our current vendor, General Codes, whom we use for code book codification, has a software program whereby minutes are scanned and then become text searchable on the specific word or words identified. Recently, Bruce Cadman, General Codes representative, provided a demonstration of the software for Accounts Department staff. After that demonstration, a quote was obtained to scan approximately 9,500 written pages of City Council minutes and more than five years of electronic images. This will allow for City Council minutes dating back to 1979 to be text searchable. There could also be the possibility to expand this program to include other departments such as Planning & Zoning, thereby decreasing their search time. Therefore, Commissioner Stephen Towne moved and Mayor Michael Lenz seconded to authorize the Mayor to sign the contract with General Codes in the amount of $2,525 for the optical character recognition software. The funding will come from the General Codes line item. The motion is contingent upon the City Attorney and the Risk & Safety Manager reviewing the contract. Ayes all. Page 6 of 10 City of Saratoga Springs City Council Meeting Minutes Tuesday, November 1, 2005 Local Law #5 2005 - Taxation - Alternative Veteran’s Exemption Previously discussed. Geyser Road Multi-Use Path (05-226) John Murphy and Molly Gagne, representing the Southwest Neighborhood Association, made a presentation to the Council on the proposed Geyser Road Multi-Use Path and asked for the Council’s support. Molly Gagne said that since the SWNA began they have made some small, positive impacts with road clean up, additional stop signs and an active community policing program. She said Geyser Road is one of the most dangerous roads in the area for cyclists. She said that last year they were denied a grant application from Parks and Trails, however, Parks and Trails have contacted them this year encouraging them to apply this year. They then did a power point presentation on this subject. They showed proposed options for the trails noting that they have not yet determined which was the best. They are looking for some guidance from Parks & Trails and CDTA on which might be the best option. They believe that to connect to the Railroad Run Trail and the State Park are the best options. They then showed examples of nearby trails funded through this program. She said that it was important to tie to existing trails. Molly Gagne said at this time they are not seeking any funds from the Council but are looking for support. Commissioner Stephen Towne moved and Mayor Michael Lenz seconded the following resolution: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA SPRINGS, NEW YORK WHEREAS, in every community today there is a growing need for places to walk and exercise, and WHEREAS, the Southwest Neighborhood Association (SWNA) has proposed a multi-use path that would connect with the existing Railroad Run path and thereby greatly increase the opportunity for walking for the Saratoga Springs community; and WHEREAS, the Council has been informed of SWNA’s proposal and has viewed a presentation outlining the possibilities and options as well as the need for financial assistance, NOW THEREFORE BE IT RESOLVED as follows: 1. This Council finds that an extension of existing walking and fitness trails in the City would benefit the public health and the overall public interest. 2. The proposal to extend the current available trails is viable and worthy. 3. This Council supports the efforts of SWNA to submit applications for assistance to the New York State Office of Parks and Trails, and to take further steps to establish a multi-use path through Geyser Road. Ayes all. Saratoga County Sewer Rates Commissioner Stephen Towne moved and Mayor Michael Lenz seconded to add the Saratoga County Sewer Rate announcement to the agenda. Ayes all. Commissioner Stephen Towne said that yesterday, he received a letter from the Office of the Saratoga County Attorney requesting that he inform the Council of a public hearing on the Saratoga County Sewer Rates for 2006. That public hearing will be held on Wednesday, November 9 at 9:00 a.m. at the Board of Supervisors Chambers in Ballston Spa. FINANCE OFFICE Payroll Page 7 of 10 City of Saratoga Springs City Council Meeting Minutes Tuesday, November 1, 2005 Commissioner Matthew McCabe moved and Commissioner Thomas Curley seconded to approve the following payrolls: October 21, 2005 - $342,534.13 and October 28, 2005 - $344,515.19. Budget Amendments Commissioner Matthew McCabe moved and Commissioner Thomas Curley seconded to approve the budget amendments as presented. (Attachment C). Ayes all. Wellchoice Agreement Commissioner Matthew McCabe said an agreement had been received from Wellchoice. Wellchoice will provide administrative services for the Medicare Retiree Drug Subsidy program for Empire Blue Cross. This administrative service fee is $1,000. Commissioner Matthew McCabe moved and Commissioner Thomas McTygue seconded to authorize the Mayor to sign the contract with Wellchoice in connection with the Medicare Retiree Drug Subsidy program. The funds are within the Finance budget. Ayes all. E-Government Credit Card Payment fee structure (05-227) Commissioner Matthew McCabe said that the City has received a grant which will allow the City to accept payment over the internet for parking tickets. There is an expense for that service though. Commissioner Matthew McCabe proposed that the City charge a fee of $5 to use the on line payment system. Commissioner Matthew McCabe moved and Commissioner Thomas McTygue seconded to approve the fee of $5 per transaction for 2005 and 2006 for the online payment services. Commissioner Stephen Towne asked if the Finance Department had looked at other municipalities and their service fees. Commissioner Matthew McCabe said they established the fee based on the volume of tickets. He does not want this service to cost the City anything. He said he was comfortable with this fee. Ayes all. Victorian Streetwalk Shuttle Page 8 of 10 City of Saratoga Springs City Council Meeting Minutes Tuesday, November 1, 2005 Commissioner Matthew McCabe said that he had been in contact with CDTA and the DBA and there is agreement that the CDTA will provide bus service during the Victorian Streetwalk at no cost to the City. He said they are also looking at using the Weibel Avenue ice rink parking lots. He has not yet received confirmation from NYRA that their parking lot is available. He noted that the train station parking lot will be used, but said the holiday train comes in that same evening. He said that DA Collins will provide signs for the Northway which will direct traffic to the appropriate lots. Budget Workshop Schedule Commissioner Matthew McCabe said a budget workshop will be held on November 10 at 9:00 a.m. There will be a public hearing on November 10 at 9:00 a.m. as well. The public hearing will be continued to each successive Council meeting. Exact Software Agreement Commissioner Matthew McCabe moved and Mayor Michael Lenz seconded to authorize the Mayor to sign the contract with Exact Software. He said this is a typical software agreement from technical support. Because the cost of the contract was unavailable, Commissioner Matthew McCabe withdrew this item from discussion. DEPARTMENT OF PUBLIC WORKS Annual Report Commissioner Thomas McTygue distributed the 2004 annual report from DPW. Purchase of Land Commissioner Thomas McTygue said there is a particular piece of land owned by Kenmar Development that should not be developed. He said he would like to look at the possibility of the City purchasing the parcel through the open space funds. Change Order #6 - Woodlawn Parking Deck Commissioner Thomas McTygue moved and Commissioner Thomas Curley seconded to approve change order #6 for the Woodlawn Avenue parking deck in the amount of $9,347. Ayes all. DEPARTMENT OF PUBLIC SAFETY Alternate Parking on Belmont Drive, Preakness Way, Winners Circle, Derby Drive and Aqueduct Drive Commissioner Thomas Curley requested a public hearing be set for the next Council meet at 6:30 p.m. on the alternate side parking on Belmont Drive, Preakness Way, Winners Circle, Derby Drive and Aqueduct Drive. Kyle York, 59 Railroad Place, said it was good to see democracy work at that Council table. Jim Cornick, Police Department, said that while using the shuttle for the Victorian Streetwalk was a good idea, there should be some thought given to utilizing shuttle services during next years Fish Creek Regatta. He said they are estimating 1,000 teams and it could draw upwards of 10,000 people. There being no one else wishing to speak, Mayor Michael Lenz closed the second public comment period.
