PRESENT : Valerie Keehn, Mayor Commissioner John Franck, Accounts Commissioner Ron Kim, DPS Commissioner Matthew McCabe, Finance Commissioner Thomas McTygue, DPW SUPERVISORS : Cheryl Keyrouze Joanne Yepsen STAFF PRESENT : Lynn Bachner, Deputy Commissioner, Finance Michele Boxley, Deputy Commissioner, Accounts Michael Englert, City Attorney Eileen Finneran, Deputy Mayor Bill McTygue, Director, DPW EXECUTIVE SESSION Council members convened to an executive session at 6:15 p.m. to discuss the Rip Van Dam litigation. Council members returned at 6:30 p.m. and reported that no action was taken. FIREFIGHTER ’S AWARDS Awards were presented to firefighters. CALL TO ORDER Mayor Valerie Keehn called the meeting to order at 7:00 p.m. PUBLIC COMMENTS Mayor Valerie Keehn opened the first public comment period. She asked that initial comments be directed to items on this agenda or previous agendas. After that, comments of general nature would be heard. Connie Sullivan thanked the Council for supporting the Mommies Bill and asked that they call the Assembly and Senate to show their support. They have been working on this for nine years. Kyle York, 59 Railroad Place, said the report on Capital News 9 was a good report and he hoped that the City would get behind the race track matter. He said the City’s needs to offer advice on the race track matter and not just be a bystander. David Bronner, 5 Royal Henley Court, said he hoped that the water front project would move along. He asked why there is no mention of the Interlaken Water System in the annual water report. Those wells are up and running. He suggested that there be some thought given to determining what the City’s share of the sales tax formula might have been if the City had stayed with the County. He believed it would have been more than what we are getting now. Leaving the County formula was a huge fiscal mistake. He also hoped the July 4th celebration in Congress Park would go on. Wilma Koss, 160 Kaydeross Park Road, said in the annual water quality report the statement that the existing water sources cannot meet long term or emergency needs is unsubstantiated. The new Interlaken well system is also another independent source for the City. Reports show that the City’s usage has not increased in the past seven years. Based on current population growth, the City would not need a new system for 27 years. Commissioner Thomas McTygue said he is seeking a permit for a long term water source. It is the right way to go. There are now concerns from surrounding municipalities on the Hudson River dredging and how that will impact their water. There are pcbs in the Hudson River. He is protecting the citizens of this community by applying for a permit. There are no expenditures of funds at this point. He will continue to manage the water source. If there is a major drought as there was in the 60s and 70s it would be a problem. There being no one else wishing to speak, Mayor Valerie Keehn closed the second public comment period. PRESENTATION Saratoga Arts Fest Supervisor Joanne Yepsen introduced Marie Glotzbach, chair of the Saratoga Arts Fest program. Marie Glotzbach said the arts fest would be held June 15-17. This is will be a cultural and artistic asset for the community. There are 58 artists, 28 venues and more than 60 volunteers ready to participate that weekend. Their temporary office is located at 454 Broadway. Tickets and information can be obtained from that location. They also have a web site at www.saratogaartsfest.org. She thanked the Council and the volunteers for all of their support. This will be a positive event for the community. Preservation of the Saratoga Race Track Supervisor Joanne Yepsen introduced Carrie Woerner, Director Saratoga Springs Preservation Foundation. Carrie Woerner said the race track is one of the City’s biggest assets. It is a national treasure. There has been much discussion lately on local participation on the design and planning of the race track with the possibility of a new franchise. There are four firms that have submitted proposals and she was not here to advocate for one or the other, but rather to advocate that the City have some say over any design or expansion at the race track. A coalition has been formed and that group is working hard on preserving the race track and for the City to be an active participant in the design, development, expansion, etc. of project at the track. She further explained that if it is determined that the state owns the parcel, the City may not be an active participant. She said now is the moment for the City to contact the Governor’s Office on allowing the City some oversight through its land use boards. There is a web site at www.historicsaratogaracecourse.org and she encouraged everyone to visit that site. At this time she was proposing that the north side of Union Avenue – the Oklahoma Track and other buildings – be included in the historic district. The City needs to push the Governor for some local control. The parcel also needs to be placed in the historic district. She asked that the Council start that process. Mayor Valerie Keehn said she was a member of the ad hoc committee that put together the rfp and made the recommendation to the governor. She said the committee talked about this project and the relationship between the local community and whether the local community should have some oversight. The ad hoc committee did not feel that it was within their purview to make a recommendation on that matter. Parks Commissioner Bernadette Castro noted that the buildings were on the national historic register. Mayor Valerie Keehn commended Carrie Woerner for bringing this matter forward. She has since talked to Parks Commissioner Carol Ash and a meeting will be held in the very near future to discuss maintenance, upgrading, and local oversight. She said there is communication between her office and the state which leaves the door open for discussions. MAYOR’S DEPARTMENT City Center Project – Resolution (07-91) Mark Baker said the resolution this evening was the next step in the process of completing the application process with the state dormitory authority. He said the City Center Authority had received a $6 million grant from the Economic Development Corporation. This resolution gives the City oversight and municipal control on how this project comes together. Once the application process is complete, it will go to the budget office, the senate committee, to the governor, back to the senate finance committee and then the dormitory authority who will then draft the disbursement agreement. That is the paper trail for accessing the funds. He said both the Planning Board and the Design Review Commission will be active participants in this process. Mayor Valerie Keehn moved and Commissioner Ron Kim seconded to adopt the following resolution: WHEREAS, the City of Saratoga Springs is the owner and landlord of the Saratoga Springs City Center; and WHEREAS, the City of Saratoga Springs has leased and the City Center Authority has accepted and agreed to lease the City Center for a period ending in July 2032; and WHEREAS, the City has resolved that the up-grade and expansion of the City Center is of the greatest interest and benefit to all the citizens of the City; and WHEREAS, the City has recognized that the timely , efficient review and implementation of the City Center Project is of the utmost importance to the fiscal viability of the City Center operation and the economic viability of our community; and WHEREAS, the City Center Authority has secured a pledge of $6 million from the State of New York, through a grant from NYS Regional Economic Development, administered by the NYS Dormitory Authority; and WHEREAS, in the administration of the grant for the expansion of the City Center, the funding and distributing agencies need to be assured that the project will be adequately reviewed by the local municipality; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Saratoga Springs, as an involved agency, will take the municipal control and community oversight for the timely and efficient review of the City Center Expansion and Renovation Project; and BE IT FURTHER RESOLVED, that the City Council retains authority with respect to determining the applicability of the City land use regulations and requirements to the Project; and BE IT FURTHER RESOVLED, that the City of Saratoga Springs defers to the NYS Dormitory Authority as lead agency pursuant to the State Environmental Quality Review Act. Economic Development Loan (07-92) Mayor Valerie Keehn moved and Commissioner Ron Kim seconded to approve the loan from the City’s economic development revolving loan fund to Scallions Restaurant in the amount of $50,000 at 5 percent fixed interest rate for a 10 year term and 12 months interest only payments. Brad Birge said this business will provide an estimated 22 full time positions for persons of low and moderate income. It was also noted that the Saratoga Economic Development Corporation approved this loan. 3 of 10 City of Saratoga Springs City Council Meeting Minutes Tuesday, June 5, 2007 Commissioner Ron Kim said this brings the fund down to $89,000. Brad Birge said that is correct, however, this is a revolving loan fund. It was noted that these are federal funds. Ayes all. Housing Trust Fund Grant (07-93) Mayor Valerie Keehn said the Saratoga County Economic Opportunity Council applied for a $150,000 grant from the Workforce Housing Trust Fund. This fund was established in 2004 to provide a source of local funding to assist in the development of housing affordable to the City’s workforce. They will use the funds for two affordable units at 1 Waterbury Street. Brad Birge said the fund was initially established in 2004 and then funded again in 2005. The fund currently has $225,000 in federal Community Development Block Grant funds. If this grant to EOC was funded that would leave $75,000. The income requirements for these units are households earning less than 80 percent of the area median income and the rents are not to exceed federal fair market rates. Commissioner John Franck said that while he supported this proposal, it was his understanding from reading the material that no grants would be approved from this fund until the fund reached $500,000 and the fund would not drop below 50 percent of that amount. Brad Birge said those were meant as guidelines. He said it was hoped that there would be additional funding for this program. He further noted that the federal government is interested in the City getting this money back into circulation by accomplishing the original goals of the trust fund. Mayor Valerie Keehn noted that there was no mechanism for this to be self-perpetuating. Brad Birge said the City could choose to fund it with additional money. Mayor Valerie Keehn said while this is only two affordable units, it is two more than is currently available. She thanked EOC for taking the lead in this matter. Commissioner Thomas McTygue said EOC had a project several years ago that didn’t go well because of bad contractors. The City had to go in and help them out. He asked Dennis Brunnelle what assurances the City had that would not happen again. Dennis Brunnelle said there is a plan in place and they have learned from their mistakes. He said Northern Dean had been into look at the property and they have a good assessment of the work that needs to be done. They also have a list of reliable contractors. Commissioner Thomas McTygue asked about the time table. Dennis Brunnelle said they were going to honor the leases, so the occupancy would not change until after December 2008. Mayor Valerie Keehn moved and Commissioner Ron Kim seconded to approve the grant of $150,000 to the Saratoga County Economic Opportunity Council to purchase/rehabilitate the two unit building at 1 Waterbury Street . The units will remain as affordable housing for a minimum of 30 years. Ayes all. Design Review Commission Alternates Mayor Valerie Keehn requested that a public hearing be set for the next Council meeting at 6:40 p.m. on the alternate members for land use boards. She said the Design Review Commission wants to try this, while the remaining two boards are not interested at this time. Proclamation – Anthony Rogers (07-94) Mayor Valerie Keehn said that Anthony Rogers is one of the oldest living veterans in this area and this was an opportunity for the City to officially recognize him. Mayor Valerie Keehn read the following proclamation PROCLAMATION CITY OF SARATOGA SPRINGS Whereas, for more than two centuries the men and women of our United States military have been the greatest force for the preservation of human rights and freedom in the history of the world, and Whereas, in 1941 a group of young American soldiers from northern New York State, was organized into the United States Army’s Fourth Armored Division, under the command of Major General John S. Wood. It was assigned to General George S. Patton’s Third Army. In the months that followed, the Fourth would go on to literally write history with lightening, 4 of 10 City of Saratoga Springs City Council Meeting Minutes Tuesday, June 5, 2007 sweeping Nazi forces all across France in an incredible series of swift and decisive victories. To the German troops who faced them, the men of the Fourth were nothing less than superhuman. To the people in the many French towns suffering under Nazi oppression, they were loved and respected as heroes, and Whereas, Anthony Rogers, a longtime resident of Saratoga Springs, is now in his 97th year. Mr. Rogers served honorably as a mechanical engineer in the Fourth Armored Division. As with all veterans of the Second World War, Mr. Roger’s contributions to freedom cannot be overstated. He was an impressive member of an impressive group of skilled soldiers who kept heavy armored machinery in good repair and moving forward. A recipient of numerous military honors and decorations, most importantly, the Purple Heart, Mr. Rogers was once personally congratulated by General Patton for his courage and dedication under fire, and Whereas, our World War II Veterans are national treasures. Some have passed from our lives. Many others, like Mr. Rogers, remain quietly among us. They are our grandparents, our great-grandparents, our neighbors, our friends. Friends. A surprising number of them speak little or not at all about their wartime experiences, regarding them as too personal or too horrifying to relate. They remain nonetheless among the most heroic and self-sacrificing individuals who ever lived, and our frequent tributes to them pale beside their imperishable contributions to our nation and our world, Now, Therefore, I, Valerie Keehn, Mayor of the City of Saratoga Springs, am pleased to join with my fellow Saratogians in honoring the life and work of Mr. Anthony Rogers and to wish him good health and happiness. ACCOUNTS DEPARTMENT Fireworks/Special Events/Parade Permit Application Commissioner John Franck said on April 24th, in response to concerns with the City’s handling of fireworks applications a multidisciplinary committee met to review current procedures. He informed the Council that the revised fireworks application is now online and available for public use. In addition, the once separate Special Events Permit Application and Parade Application Permit have now been combined for ease of use. Major changes to this process include the following;  The applicant now applies for the permit co-signed by the fireworks provider both supplying insurance certificates  Community notification was added up to 1000 feet of the event  Applications are sequentially reviewed as a community safeguard  Parade and Special Events were combined so Public Safety could better assess community impact  Both applications are more customer friendly and easier to fill out He thanked the community, police and fire departments, public works, and risk and safety for their assistance with this new process. He will continue to listen to the concerns of the community and tweak the process if necessary. Special Livery Ordinance – Set Public Hearing Commissioner John Franck requested that a public hearing be set for June 19th at 6:50 p.m. to review the Special Livery Ordinance. A copy of the revised ordinance is available for review in the City Clerks office. Changes to this ordinance include;  Extending access for pedicabs up Caroline and Phila Street one way to Circular Street  Allowing pedicabs to cross Broadway at Congress street to improve access to the West Side  No longer requiring a Class E license for pedicab drivers (this is a requirement for motorized livery only) 5 of 10 City of Saratoga Springs City Council Meeting Minutes Tuesday, June 5, 2007 Award for Records Management Commissioner John Franck announced that the New York Association of Local Government Records Officers have awarded Nancy Wagner the Robert W. Arnold Distinguished Service Award for her assistance to other communities and colleagues in records management with advice on resources, preparing grants and other records management procedures. The award will be presented at NYALGRO's annual school on June 11. Explore NY400 Resolution (07-95) Commissioner John Franck moved and Commissioner Ron Kim seconded to add Explore NY400 resolution to the agenda for discussion and vote. Ayes all. Cheryl Keyrouze said this program will develop and coordinate the 400th anniversary of the voyages of Henry Hudson and Samuel deChamplain and the voyage of Robert Fulton’s steamship up the Hudson River. There will be a series of celebrations with a wide range of local activities all throughout 2009. Mary Ann Fitzgerald, City Historian, is aware and very excited about being involved in this program. She encouraged everyone to visit the website: www.exploreny400.com. Commissioner John Franck moved and Commissioner Ron Kim seconded the following resolution: Explore NY 400 Community Resolutions WHEREAS, the New York State Hudson-Fulton-Champlain Quadricentennial Commission was established under Chapter 590 of the Law of 2002, to plan, develop and coordinate the 400th anniversary, in 2009, of the voyages of exploration made by Henry Hudson and Samuel deChamplain as well as the 200th anniversary of Robert Fulton ’s steamship voyage up the Hudson River; and WHEREAS, these historic voyages of exploration in 1609 would change the world forever and lead to the European settlement of the New World and the innovation of steam travel and commerce in 1807, establishing the Hudson River and Lake Champlain as the corridor of trade, communication, politics and ideas, and that further, this vital north-south corridor of water created other water links such as the Champlain and Erie Canals, which provided opportunities inland and encourage the westward movement through the these water route s; and WHEREAS, the State and the Federal governments recognize the voyages of exploration and invention to be of historical importance and significance to New York State and the nation and recognize the tradition to observe these contributions made by Hudson, Fulton, and deChamplain, by commemorating these events in 2009, WHEREAS, as an Explore NY 400 Community, the community may use the Explore NY 400 logo, link to the Explore NY 400 website and may be eligible for either state or federal grant money to assist in Quadricentennial planning, events, and legacy projects and BE IT FURTHER RESOLVE D, that the City of Saratoga Springs supports the mission of the Hudson-Fulton-Champlain Quadricentennial Commission and requests designation as an Explore NY 400 Community and will be an active partner by establish an Explore NY 400 Committee, and will cooperate to its fullest with the Commission in making the 400th anniversary a successful historic New York State event. Ayes all. FINANCE DEPARTMENT Budget Amendments Commissioner Matthew McCabe moved and Commissioner Ron Kim seconded to approve the budget amendment s as presented. He said the budget remains in balance and the amendments have met the guidelines (Attachment A). Ayes all. Budget Presentation Commissioner Matthew McCabe said a budget presentation will be held on June 20 at 7:00 p.m. at the library. Woodlawn Parking Lot RFP 6 of 10 City of Saratoga Springs City Council Meeting Minutes Tuesday, June 5, 2007 Commissioner Matthew McCabe said the rfp for the Woodlawn Avenue parking lot was received today. There were two responses, although one of the responses was not a true response but rather it was a letter expressing an interest in submitting a proposal. He said he would leave it up to the Council on how to proceed. He was not encouraged by what he received. He said this proposal is for a lease back option. It is a $43 million project with a parking garage and DPS facility. He applauded their creativity but a lease back option would cost the City about $1.5 million yearly from the general fund budget. The proposal deserves scrutiny. He has many other ideas on parking. He said that with only one response, the Council could have a presentation of the proposal. Mayor Valerie Keehn asked if there were any plans to request the second vendor to submit a proposal. Commissioner Matthew McCabe said no. There was a deadline that was well advertised. Commissioner John Franck said the second response should not be considered in this discussion. Commissioner Ron Kim thanked Commissioner Matthew McCabe for being flexible with the rfp. He said the Woodlawn Avenue site is a good location to accommodate the DPS station. He said he did not want to see this rfp delayed. The $1.5 million lease could easily double or triple if the City delays this process. Construction costs have gone up significantly in the past few years. He also noted that the City gets many calls on parking and with the Putnam Street parking upper deck being closed, the situation has worsened. There have been discussions on permitted parking for downtown employees and the possibility of having one or more of the floors for employee parking. The team that has been put together for this proposal is a good team. He has been working with BBL and Labella on the feasibility study for DPS. The local part of the team, Bonacio Construction, Frost Architecture and The LA Group are also good, well established businesses from this community. Commissioner John Franck said he was concerned with the City’s integrity. The City has sent out several rfps on parking lots and then just let them sit. Recently there have been three parking lot rfps and nothing has come of them. He said the Council needs to make a decision. He did not want to hear the same arguments as before that there is only one proposal. The estimate on the parking spaces could be as high as $17,500 per space which would make it a $10 million project. The High Rock Avenue parking lot had an rfp that included 800 spaces. The sooner that the City holds a workshop the better for everyone. Mayor Valerie Keehn said the City needs to look at parking as a whole. The Council needs to look at the High Rock Avenue lot, Lillian’s, Woodlawn Avenue and the City Center expansion when talking about parking. Commissioner Ron Kim said that was fine, but he did not want this process delayed because of the broader scope of all of the other parking lots. Commissioner Matthew McCabe said this is a creative plan, but his initial goal was not met and it dictates that funds be used from the general fund. This is a budgetary issue. Commissioner Matthew McCabe said he wanted to be clear the workshop would include all issues. Commissioner Ron Kim said that the feasibility study on the DPS proposal would be available within the next few weeks. Council members agreed they did not want to hold the process up though. It was agreed that a workshop would be held on Tuesday, June 12 at 5:00 p.m. Sonny Bonacio said he was glad to see this move forward. He reminded Council members that he had responded to all of the rfps on parking and he was interested in having discussions with the Council again on the lot behind City Hall. He said this particular proposal is no pie in the sky formula. He said the funding for this proposal will not stick around forever. The funding works now but it may not in a few months. He said there are other revenue sources that the City needs to explore. Commissioner Ron Kim suggested that the not-for-profit organization also attend the meeting. Peter Cornell, Vice President, BBL, said they could be here. July 4th Celebration 7 of 10 City of Saratoga Springs City Council Meeting Minutes Tuesday, June 5, 2007 Commissioner Matthew McCabe said there is a group of volunteers who are trying to address all of the issues for the July 4th celebration. They are looking at setting up, damage control, safety, etc. DPS has no problem with this event. He suggested that a few of the nearby streets be closed. Donations are coming in. The volunteers are ready to move this celebration forward. There will be more port-a-johns, the vendors will be limited, the dog ordinance will be enforced and the ancillary activities will be limited. Commissioner Matthew McCabe moved and Commissioner Ron Kim seconded to approve moving forward with the July 4th celebration with DPW managing the permit process and DPS coordinating the safety issues. Ayes all. Commissioner Thomas McTygue said he was somewhat concerned with closing the street. He said it may cause more confusion after the fireworks display is over with everyone trying to leave. He said it’s difficult to remove barricades in the dark. The DPW crews will rope off the area the day before. Volunteers cannot rope the area off. He asked for a full report of overtime expenditures from DPS when this is over. DEPARTMENT OF PUBLIC WORKS Streets Not Paved Commissioner Thomas McTygue said the City is underfunded when it comes to paving and the cost of blacktop has gone up considerably. They are currently dealing with small portions of some roads, i.e., Ballston Avenue, West Fenlon Street and Union Avenue. He said there are some streets in the City that are in bad shape, i.e., Nelson Avenue, Jefferson Street, Crescent Street, however, they will not be paved at this time due to pending projects. He said the drainage system for Nelson Avenue is planned with the next year or so. Myrtle Street is another street in bad shape, however, they are waiting on that one as well due to the pending Saratoga Hospital project. Waterfront Monies Commissioner Thomas McTygue moved and Commissioner Ron Kim seconded that the Council set up accounts to enable the Department of Public Works to perform work at the waterfront site and purchase a few picnic tables and get the area open for residents to enjoy. The money is in a capital account, however, it was only earmarked for asbestos removal that has been done. The project totals $14,612 -- labor at $8,000, social security at $612, other supplies at $5000 and professional services at $1000. He said these funds would be used to do some landscaping type work and to get some picnic tables out there. Gerry Magoohalan said this is a good plan. He said the committee would like to see some use of this parcel by the July 4 holiday. It was unfortunate that there could not be any boating or water use, however, this was a good first step. He is working with the City Engineer on an rfp for further development of this area. Commissioner Matthew McCabe said there was $200,000 included in the capital budget and those funds would be used for this expense. Ayes all. Senior Citizen’s Generator Commissioner Thomas McTygue said the generator at the senior citizen’s center is up and running. Should there be an emergency they will be able to house people and cook meals. Trash Barrels – Mills Engineering Commissioner Thomas McTygue moved and Commissioner Ron Kim seconded to approve the purchase of barrels for Broadway from Mills Engineering. The purchase is for 8 barrels at $515 each plus shipping. The Special Assessment District will pay for 5 and the City will pay for 3. Ayes all. Southeast Drainage 8 of 10 City of Saratoga Springs City Council Meeting Minutes Tuesday, June 5, 2007 Commissioner Thomas McTygue said the engineering firm had been hired to do the design for the southeast drainage system going from East Avenue, through NYRA to Lincoln Avenue. He said that they would like to get this work done this year, while NYRA is still around. Putnam Street Parking Deck Commissioner Thomas McTygue said the Putnam Street parking deck resurfacing project is moving along quite well. This is a very good resurfacing program that should last more than 15 years. They estimate that the work will be done no later than the end of June and possibly sooner. Paving of Union Avenue Commissioner Thomas McTygue said the paving of Union Avenue from Regent Street to Circular Street had been completed. Compost Commissioner Thomas McTygue announced that DPW had sold more than $80,000 in compost which was $20,000 more than anticipated. They will be delivering compost until the end of June. DEPARTMENT PUBLIC SAFETY $5,000 Donation from Housing Authority for Critical Incident Management Equipment (07-96) Commissioner Ron Kim moved and Commissioner John Franck seconded to accept the $5,000 donation from the Housing Authority for the Critical Incident Management Equipment. Parking Restrictions on South Franklin Street Commissioner Ron Kim requested that a public hearing be set for the next Council meeting at 6:30 p.m. on parking restrictions on South Franklin Street. SUPERVISORS Joanne Yepsen Saratoga Arts Fest Final Plans – previously discussed. Preservation of the Saratoga Race Track – previously discussed. Economic Development Proposed Resolutions: This project is moving along well. The material was submitted to the Army Corp of Engineers. There is a log jam in the Lake Lonely area that gets worse each year. They are in the permitting stage for mitigation measures at this time. As part of the permitting process, the County is required to spend $250,000 towards the County Water project. The cost of removing the log jam is estimated at $53,000 and it is estimated that it will take two weeks to complete the job. It will be done during the dry season. This will have a tremendous impact on the residents in this area. Mayor Valerie Keehn thanked Supervisor Joanne Yepsen for staying with this project. NYS Affordable Housing Trust Fund: There is a great need for an affordable housing trust fund at the state level and she continues to work on this matter. Saratoga County Affordable Housing Trust Fund: A small committee has been formed to discuss the idea of a Saratoga County affordable trust fund. There is some support from Supervisor Phil Barrett. Citizens Transportation Committee of Saratoga County: This committee continues to work diligently on transportation throughout the City and County. They have worked closely with CDTA on the new bus service that will begin on July 2. PUBLIC COMMENT Mayor Valerie Keehn opened the second public comment period. Commissioner Thomas McTygue said it was a pleasure to have the supervisors report on their activities and to see how active they are.
