October 18, 2021 CITY OF SARATOGA SPRINGS City Council Pre-Agenda Meeting City Council Room 474 Broadway Saratoga Springs, NY 12866 10:00 AM PRESENT: Meg Kelly, Mayor Michele Madigan, Commissioner of Finance John Franck, Commissioner of Accounts Anthony Scirocco, Commissioner of DPW Robin Dalton, Commissioner of DPS STAFF PRESENT: Lisa Shields, Deputy Mayor Deidre Ladd, Deputy Commissioner, Finance Maire Masterson, Deputy Commissioner, Accounts Eileen Finneran, Deputy Commissioner, DPS Vince DeLeonardis, City Attorney EXCUSED: Joe O’Neill, Deputy Commissioner, DPW Matthew Veitch, Supervisor Tara Gaston, Supervisor CALL TO ORDER Mayor Kelly called the meeting to order at 10:00 a.m. PUBLIC HEARINGS 1. 2022 Proposed Budget – Commissioner Madigan advised this is the first public hearing as required by City Charter. 2. New Chapter 37 of the City Code – Civilian Review Board – Commissioner Dalton stated the correct name is Community Police Board. 3. Substantial Amendment to 2021 CDBG Annual Action Plan – No comments. 4. Unified Development Ordinance (Final) – No comments. 5. Weibel Avenue PUD Amendment – Vince DeLeonardis, advised there are two amendments as part of this. The first amendment is to extend the expiration date of the PUD and the second one is to add new uses. The City and County both found in favor of the extension of the expiration but both also found issue with the new uses. Vince will try to contact the applicant to determine if they want to move forward with both amendments or not so that they know how to address SEQRA. PRESENTATION 1. SiFi Networks Broadband – Groundbreaking City Council Pre-Agenda Meeting 10/18/2021 Commissioner Madigan advised the pilot for this project is scheduled for Buff Road. Commissioner Scirocco advised the residential pilot will take place on Buff Road and the commercial pilot will happen on Fenlon to Circular on South Broadway. CONSENT AGENDA 1. Approval of 10/5/2021 City Council Meeting Minutes 2. Approval of 10/4/2021 Pre-Agenda Meeting Minutes 3. Approve Resolution for the Use of Insurance Reserve #10 4. Approve Budget Amendments – Insurance Reserve #10 5. Approve Budget Transfers - Regular 6. Budget Amendments – Regular (Increases) 7. Approve Payroll 10/1/21 $406,171.03 8. Approve Payroll 10/15/21 $413,298.27 9. Approve Mid-Warrant – 2021 21MWOCT1 $109,950.82 10. Approve Warrant – 2021 21OCT2 $1,520,753.93 No comments. MAYOR’S DEPARTMENT Announcement: The Next Pre-Agenda and City Council Meetings Will be Held on Monday, 11/1/21 No comments. Update: Implementation of Task Force No comments. Discussion: Cannabis Legislation No comments. Discussion and Vote: Authorization for the Mayor to Execute Visitors Center Agreement – Addendum Five No comments. Announcement: Resolution in Memory of William Benton No comments. ACCOUNTS DEPARTMENT Discussion and Vote: Approval of Resolution Recommending the Saratoga Springs School District to Rename the East Side Recreation Major Field in Honor of William J. McNeary, III Commissioner Franck advised that prior to Mr. McNeary’s death, he made a donation for the installation of the lights on the field at East Side Recreation. This resolution is to recommend to the school district, who owns this land, to rename the field in his honor. Discussion and Vote: Approve Resolution to Extend Temporary Outdoor Seating Areas to November 30, 2021 Page 2 of 4 City Council Pre-Agenda Meeting 10/18/2021 Commissioner Franck advised the restaurants have requested this extension. Discussion: How to Proceed with Zoning Amendments for Weibel Avenue Plaza PUD Commissioner Franck advised this is the item Vince spoke of under the public comment section of the agenda. This item will be pulled from the agenda to allow Vince time to get in contact with the applicant. Set Public Hearing: Zoning Amendment for the Marion Avenue – Maple Dell Planned Unit Development No comments. FINANCE DEPARTMENT Discussion: Honoring For Mayor Scott Johnson, and Commemorating Former Finance Commissioners Remigia Foy and Matt McCabe Commissioner Madigan advised she would like to name the Recreation Center in honor of Scott Johnson and do something to commemorate the two former finance commissioners, Remigia Foy and Matt McCabe. If the Council is ready, she would change this item to a discussion and vote. Discussion and Vote: Resolution to Establish an Assignment to Fund Recommendations and Initiatives Adopted by City Council in Response to the Police Reform Task Force Commission Madigan advised this is support for the recommendations by the Task Force. She is looking to put $250,000 in the assignment for funding. Discussion and Vote: Resolution to Establish a Non-Profit Grant Program Assignment Commissioner Madigan advised this is to set aside cash for a grant program for the organizations that provide a public benefit to the City but have not yet been considered for annual funding. This would be based upon an application process modeled after the CDBG process. This funding will be based on available fund balance. Some years there may not be funds available. Discussion and Vote: Resolution to Replenish an Assignment for Sick Leave Commissioner Madigan advised this was depleted in 2020 due to COVID. She is looking to replenish this assignment from fund balance. Discussion and Vote: Budget Transfers – Contingency Commissioner Madigan advised this is for the Visitor Center management agreement and to update the City website. Discussion and Vote: Budget Amendments – Payroll No comments. Discussion and Vote: Budget Transfers – Payroll No comments. Announcement: 2022 Budget Workshop #2: Public Works, Public Safety, and the Mayor’s Department Commissioner Madigan advised the next scheduled budget workshop is Wednesday, October 20, 2021 at 1 p.m. This workshop will focus on DPW, DPS and the Mayor’s Department. PUBLIC WORKS DEPARTMENT Discussion and Vote: Approval to Pay Invoice #529602 to Pallette Stone Corp. in the Amount of $11,776.00 No comments. Commissioner Scirocco advised he is adding an item for discussion and vote: authorization for mayor to sign contract with MityLite for the purchase of chiavari chairs. PUBLIC SAFETY DEPARTMENT Discussion and Vote: Adopt a New Chapter 37 of the City Code Commissioner Dalton stated Kim Galvin is coming in to do an update on implementation. Discussion and Vote: Authorization for Mayor to Sign Contract with Biometrics4All Commissioner Dalton advised this contract is for the digital fingerprinting in the Police Department. SUPERVISORS Mayor Kelly read the supervisors’ agendas into the record as follows: Matt Veitch – Saratoga County 2022 Budget Update. EXECUTIVE SESSION Mayor Kelly moved and Commissioner Madigan seconded to move into executive session to discuss the proposed acquisition of real property when publicity would substantially affect the value thereof at 10:17 a.m. Ayes - All The City Council returned from executive session at 10:38 a.m. Mayor Kelly announced no decisions were made in executive session to report to the public.
